R. 9721 IN THE HOUSE OF REPRESENTATIVES September 20, 2024 Ms. De La Cruz introduced the following bill; which was referred to the Committee on Oversight and Accountability A BILL To amend the National Defense Authorization Act for Fiscal Year 2013 to add whistleblower protections to certain modified contracts, and for other purposes. 1. Short title This Act may be cited as the Ensuring Access to Whistleblower Protections Act. 2. Department of Housing and Urban Development contracts Section 828(b)(3) of the National Defense Authorization Act for Fiscal Year 2013 (Public Law 112–239; 126 Stat. 1841) is amended— (1) by striking At the time and inserting the following: (A) In general At the time ; and (2) by adding at the end the following new subparagraph: (B) Department of Housing and Urban Development contracts (i) In general At the time of any covered modification to a contract that the Secretary of Housing and Urban Development has awarded before the date that is 180 days after the date of the enactment of this Act, the Secretary of Housing and Urban Development shall make best efforts to include in the contract a contract clause providing for the applicability of the amendments made by this section to the contract. (ii) Covered modification defined In this subparagraph, the term covered modification means any modification, including a modification relating to— (I) a contract option year; (II) a contract extension; (III) a contract renewal; (IV) a review for approval of or execution of an annual contributions contract; (V) a substantial deviation; (VI) a significant amendment; or (VII) an annual cost or rent adjustment. .
