R. 8094 IN THE HOUSE OF REPRESENTATIVES April 19, 2024Mr. Kean of New Jersey introduced the following bill; which was referred to the Committee on Energy and Commerce A BILL To amend title XIX of the Social Security Act to modify certain asset recovery rules. 1. Modification of certain asset recovery rules Section 1917(b)(1)(A) of the Social Security Act (42 U.S.C. 1396p(b)(1)(A)) is amended by inserting unless, at the option of the State, after the death of the individual the home of such individual is transferred to another individual who is eligible for medical assistance under this title or has an income below 138 percent of the Federal poverty level after paid on behalf of the individual.
