#aaith ,,congress #ast ,session ,s4 #cjba ,,an ,,act ,to amend title #ah1 ,united ,states ,code1 to enhance enforcement with respect to material depicting obscene child sexual abuse or constituting child pornography1 and for other purposes4 #a4 ,short title ,this ,act may be cited as the ,enhancing ,necessary ,federal ,offenses ,regarding ,child ,exploitation ,act or the ,,enforce ,act4 #b4 ,clarifying production with respect to material constituting or containing child pornography ,section #bbeb;,a of title #ah1 ,united ,states ,code1 is amended-- 7#a7 in subsection 7a71 by striking paragraph 7#g7 and inserting the following3 7#g7 knowingly produces child pornography1 as defined in section #bbef7h77;,c71 that-- 7,a7 the person knows1 or has reason to know1 will be mailed1 shipped1 or transported using any means or facility of interstate or foreign commerce or in or affecting interstate or foreign commerce2 7,b7 was produced using materials that have been mailed1 shipped1 or transported in or affecting interstate or foreign commerce2 or 7,c7 has been mailed1 shipped1 or transported using any means or facility of interstate or foreign commerce or in or affecting interstate or foreign commerce1 2 and 7#b7 in subsection 7b7-- 7,a7 in paragraph 7#a71 by striking or 7#f7 and inserting 7#f71 or 7#g72 and 7,b7 by striking paragraph 7#c74 #c4 ,enhancing enforcement with respect to obscene visual representations of child sexual abuse 7a7 ,removing the statute of limitations for obscene visual representations of child sexual abuse ,section #cbii of title #ah1 ,united ,states ,code1 is amended by inserting #adff;,a or before #aeia4 7b7 ,including crimes of obscene visual representations of child sexual abuse in sex offender registration ,section #aaa7e77;,a77iii7 of the ,adam ,walsh ,child ,protection and ,safety ,act of #bjjf 7#cd ,u4,s4,c4 #bjiaa7e77;,a77iii77 is amended by inserting #adff;,a or before #aeia4 7c7 ,prohibition on reproduction of obscene visual representations of child sexual abuse in discovery ,section #adff;,a of title #ah1 ,united ,states ,code1 is amended-- 7#a7 by redesignating subsection 7f7 as subsection 7g72 and 7#b7 by inserting after subsection 7e7 the following3 7f7 ,prohibition on reproduction of obscene visual depictions of child sexual abuse ,in any criminal proceeding brought under this section-- 7#a7 any visual depiction involved in a violation of this section shall remain in the care1 custody1 and control of either the ,government or the court in the same manner specified for child pornography in paragraphs 7#a7 and 7#b7 of section #ceji7m72 and 7#b7 any identifiable minor1 as that term is defined in section #bbef7i71 depicted in any visual depiction involved in a violation of this section may have access to such depiction in the same manner specified for a victim1 with respect to child pornography depicting the victim1 in section #ceji7m77#c74 4 7d7 ,presumption of detention for violations of section #adff;,a pending trial ,section #cadb of title #ah1 ,united ,states ,code1 is amended-- 7#a7 in subsection 7c77#a77;,b71 in the undesignated matter following clause 7xiv71 by striking that involves and all that follows through #bdbe of this title and inserting that involves an offense described in subsection 7e77#c77;,e72 and 7#b7 in subsection 7e77#c71 by striking subparagraph 7,e7 and inserting the following3 7,e7 an offense-- 7i7 involving a minor victim under section #abja1 #aeia1 #bbda7;a71 #bbda7;b71 #bbdb1 #bbdd7;a77#a71 #bbde1 #bdba1 or #bdbb7;a7 of this title2 or 7ii7 under section #adff;,a7a71 #bbda7;c71 #bbea;,a1 #bbeb7;a77#a71 #bbeb7;a77#b71 #bbeb7;a77#c71 #bbeb;,a7a77#a71 #bbeb;,a7a77#b71 #bbeb;,a7a77#c71 #bbeb;,a7a77#d71 #bbfj1 #bdbb7;b71 #bdbc1 or #bdbe of this title4 4 7e7 ,supervised release for violations of section #adff;,a after imprisonment ,section #cehc7k7 of title #ah1 ,united ,states ,code1 is amended1 in the first sentence1 by inserting #adff;,a1 before #aeia14 ,passed the ,senate ,december #af1 #bjbe4,secretary
