aircraft systems at or near the international borders of the ,united ,states1 and for other purposes4 #a4 ,short title ,this section may be cited as the ,border ,drone ,threat ,assessment ,act4 #b4 ,definitions ,in this ,act3 7#a7 ,administrator ,the term ,administrator means the ,administrator of the ,federal ,aviation ,administration4 7#b7 ,appropriate congressional committees ,the term appropriate congressional committees means-- 7,a7 the ,select ,committee on ,intelligence of the ,senate2 7,b7 the ,committee on ,homeland ,security and ,governmental ,affairs of the ,senate2 7,c7 the ,committee on ,commerce1 ,science1 and ,transportation of the ,senate2 7,d7 the ,committee on the ,judiciary of the ,senate2 7,e7 the ,committee on ,armed ,services of the ,senate2 7,f7 the ,committee on ,foreign ,relations of the ,senate2 7,g7 the ,permanent ,select ,committee on ,intelligence of the ,house of ,representatives2 7,h7 the ,committee on ,homeland ,security of the ,house of an international land border or coastal border of the ,united ,states4 7#d7 ,commander ,the term ,commander means the ,commander of the ,united ,states ,northern ,command 7,,usnorthcom74 7#e7 ,director ,the term ,director means the ,director of ,national ,intelligence4 7#f7 ,foreign malign influence ,the term foreign malign influence has the meaning given such term in section #aai;,b7f7 of the ,national ,security ,act of #aidg 7#ej ,u4,s4,c4 #cjei7;f774 7#g7 ,intelligence community ,the term intelligence community has the meaning given such term in section #c of the ,national ,security ,act of #aidg 7#ej ,u4,s4,c4 #cjjc74 7#h7 ,malign actor ,the term malign actor means any individual1 group1 or organization that is engaged in foreign malign influence1 illicit drug trafficking1 or other forms of transnational organized crime4 7#i7 ,transnational organized crime ,the term transnational organized crime has the meaning given such term in section #bhd7;i7 of title #aj1 ,united ,states ,code4 7#aj7 ,under secretary ,the term ,under ,secretary means the ,under ,secretary for ,intelligence and ,analysis of the ,department of ,homeland ,security4 7#aa7 ,under secretary of defense ,the term ,under ,secretary of ,defense means the ,under ,secretary of ,defense for ,intelligence and ,security4 7#ab7 ,unmanned aircraft2 unmanned aircraft system ,the terms unmanned aircraft and unmanned aircraft system have the meanings given such terms in section #ddhja of title #di1 ,united ,states ,code4 #c4 ,threat assessment 7a7 ,in general ,not later than #a year after the date of the enactment of this ,act1 the ,under ,secretary of ,defense1 in consultation with the ,commander1 the ,director1 the ,under ,secretary1 the ,administrator1 and the heads of the other elements of the intelligence community1 shall complete an assessment of the threat regarding unmanned aircraft systems at or near the international borders of the ,united ,states4 7b7 ,elements ,the threat assessment required under subsection 7a7 shall include-- 7#a7 a description of the malign actors operating unmanned aircraft systems at or near the international borders of the ,united ,states1 including malign actors who cross such borders2 7#b7 a description of how a threat is identified and assessed at or near the international borders of the ,united ,states1 including a description of the capabilities of the ,united ,states ,government to detect and identify unmanned aircraft systems operated by1 or on behalf of1 malign actors2 7#c7 a description of the data and information collected by operators of unmanned aircraft systems at or near the international borders of the ,united ,states1 including how such data is used by malign actors2 7#d7 a description of the tactics1 techniques1 and procedures used at or near the international borders of the ,united ,states by malign actors with regards to unmanned aircraft systems1 including how unmanned aircraft systems are acquired1 modified1 and utilized to conduct malicious activities1 including attacks1 surveillance1 conveyance of contraband1 and other forms of threats2 7#e7 a description of the guidance1 policies1 and procedures that address the privacy1 civil rights1 and civil liberties of persons who lawfully operate unmanned aircraft systems at or near the international borders of the ,united ,states2 7#f7 a description of the capabilities of the ,united ,states ,government to counter1 contain1 trace1 defeat1 or otherwise mitigate threats from unmanned aircraft systems operated by malign actors at or near the international borders of the ,united ,states2 7#g7 an assessment of whether the capabilities of the ,united ,states ,government are sufficient for achieving complete air domain awareness at or near the international borders of the ,united ,states2 and 7#h7 an assessment of the adequacy of current authorities of the ,united ,states ,government to counter the use of unmanned aircraft systems by malign actors at or near the international borders of the ,united ,states1 including an accounting of the delineated responsibilities of ,federal agencies to counter1 contain1 trace1 or defeat unmanned aircraft systems at or near the international borders of the ,united ,states4 #d4 ,report and briefing 7a7 ,in general ,not later than #ahj days after completing the threat assessment required under section #b1 the ,under ,secretary of ,defense1 in coordination with the ,commander1 the ,director1 the ,under ,secretary1 and the ,administrator1 shall submit a report to the appropriate congressional committees containing findings with respect to such assessment4 7b7 ,elements ,the report required under subsection 7a7 shall include-- 7#a7 a detailed description of the threats posed to the national security of the ,united ,states by unmanned aircraft systems operated by malign actors at or near the international borders of the ,united ,states2 7#b7 a summary of the current responsibilities1 authorities1 regulations1 policies1 and procedures of the ,united ,states ,government for achieving air domain awareness at and near the international borders of the ,united ,states and countering and defeating unmanned aircraft systems used by malign actors along such borders2 and 7#c7 an assessment of whether a change in authorities or additional authorities or resources are necessary to achieve complete air domain awareness at or near international borders of the ,united ,states and to counter and defeat unmanned aircraft systems used by malign actors along such borders4 7c7 ,form ,the report required under subsection 7a7 shall be submitted in unclassified form1 but may include a classified annex1 as appropriate4 7d7 ,briefing ,not later than #ij days after the submission of the report required under subsection 7a71 the ,under ,secretary of ,defense shall provide a briefing regarding the report to the appropriate congressional committees4
