title ,this ,act may be cited as the ,moab ,,umtra ,project ,transition ,act of #bjbe4 #b4 ,moab ,,umtra project ,section #cdje7;i7 of the ,strom ,thurmond ,national ,defense ,authorization ,act for ,fiscal ,year #aiii 7#aj ,u4,s4,c4 #hgbj note2 ,public ,law #aje-bfa7 is amended-- 7#a7 by striking paragraph 7#e72 7#b7 by redesignating paragraph 7#f7 as paragraph 7#e72 and 7#c7 by adding at the end the following3 7#f7 ,transfer of ,moab site to ,grand ,county 7,a7 ,in general ,subject to subparagraphs 7,b71 7,c71 and 7,d71 on achieving a remedial action completion status sufficient for land conveyance1 as determined by the ,secretary of ,energy in consultation with relevant regulatory authorities1 and subject to any regulatory or use restrictions1 if determined necessary to protect human health and safety by the ,secretary of ,energy or the ,nuclear ,regulatory ,commission 7including restrictions pursuant to the ,uranium ,mill ,tailings ,radiation ,control ,act of #aigh 7#db ,u4,s4,c4 #gija et seq47 and part #aib of title #dj1 ,code of ,federal ,regulations 7or successor regulations771 the ,secretary of ,energy shall convey1 at no cost1 all available right1 title1 and interest of the ,united ,states in and to the ,moab site to ,grand ,county1 ,utah4 7,b7 ,retention of certain water rights ,in carrying out the conveyance under subparagraph 7,a71 in accordance with applicable law1 the ,secretary of ,energy shall ensure that the ,united ,states retains such water rights as the ,secretary of ,energy determines necessary to carry out the responsibilities of the ,secretary of ,energy under the ,uranium ,mill ,tailings ,radiation ,control ,act of #aigh 7#db ,u4,s4,c4 #gija et seq471 part #aib of title #dj1 ,code of ,federal ,regulations 7or successor regulations71 and other applicable requirements1 including1 if the remediation of groundwater is ongoing at the time of the conveyance1 such rights as are necessary to maintain access to wells and the associated surface footprint of those wells4 7,c7 ,prohibition ,the conveyance under subparagraph 7,a7 shall include a provision that prohibits ,grand ,county1 ,utah1 from reconveying to a private entity or nonprofit organization any portion of the land conveyed to ,grand ,county1 ,utah1 under that subparagraph4 7,d7 ,additional terms and conditions ,the ,secretary of ,energy may require such additional terms and conditions in connection with the conveyance under subparagraph 7,a7 as the ,secretary determines necessary to protect the interests of the ,united ,states4 4 #c4 ,transfer of ,green ,river ,pipeline and associated infrastructure 7a7 ,conveyance ,on achieving remedial action completion status as described in section #cdje7;i77#f77;,a7 of the ,strom ,thurmond ,national ,defense ,authorization ,act for ,fiscal ,year #aiii 7#aj ,u4,s4,c4 #hgbj note2 ,public ,law #aje-bfa7 7as amended by section #b7c771 the ,secretary of ,energy shall convey1 at no cost1 to the ,grand ,county ,water ,conservancy ,district all right1 title1 and interest of the ,united ,states in and to the following infrastructure associated with the ,moab ,uranium ,mill ,tailings ,remedial ,action project3 7#a7 ,the water pipeline extending from the ,green ,river extraction site to the ,moab ,uranium ,mill ,tailings ,remedial ,action ,crescent ,junction site4 7#b7 ,all associated pump stations and diesel-powered pumps and related easements or rights-of-way4 7#c7 ,the holding pond located at the ,moab ,uranium ,mill ,tailings ,remedial ,action ,crescent ,junction site4 7b7 ,water rights 7#a7 ,in general ,on achieving the remedial action completion status described in subsection 7a71 the ,secretary of ,energy shall transfer to the ,grand ,county ,water ,conservancy ,district the ,crescent ,junction water right associated with the ,moab ,uranium ,mill ,tailings ,remedial ,action4 7#b7 ,requirement ,notwithstanding paragraph 7#a71 the ,secretary of ,energy may retain such water rights at the site described in that paragraph as are strictly necessary to complete remaining groundwater remediation or other responsibilities under the ,uranium ,mill ,tailings ,radiation ,control ,act of #aigh 7#db ,u4,s4,c4 #gija et seq474 7c7 ,conditions of transfer ,the ,secretary of ,energy shall include as a condition of the conveyances under this section-- 7#a7 a requirement that the ,grand ,county ,water ,conservancy ,district use the infrastructure and rights conveyed pursuant to the conveyances to address the water deficit in communities serviced by the ,grand ,county ,water ,conservancy ,district2 and 7#b7 a prohibition on conveying the infrastructure and rights conveyed pursuant to the conveyances to a private entity or nonprofit organization4 ,september #ag1 #bjbf,reported with an amendment
