,affairs  ,a ,,bill  ,to prohibit       
contracting with persons that have      
business operations with the ,maduro    
regime1 and for other purposes4  #a4    
,short title ,this ,act may be cited as 
the ,banning ,operations and ,leases    
with the ,illegitimate ,venezuelan      
,authoritarian ,regime ,act or the      
,,bolivar ,act4  #b4 ,prohibition on    
contracting with persons that have      
business operations with the ,maduro    
regime  7a7 ,prohibition ,except as     
provided in subsections 7b71 7c71 and   
7d71 the head of an executive agency may
 not enter into a contract for the      
procurement of goods or services with   

any person that the head of an executive
 agency determines1 with the concurrence
 of the ,secretary of ,state1 knowingly 
engages in significant business         
operations with an authority of the     
,government of ,venezuela that is not   
recognized as the legitimate ,government
 of ,venezuela by the ,united ,states4  
7b7 ,exceptions  7#a7 ,in general ,the  
prohibition under subsection 7a7 does   
not apply to a contract that the        
,secretary of ,state determines-- 7,a7  
is necessary-- 7i7 for purposes of      
providing humanitarian assistance to the
 people of ,venezuela2  7ii7 for        
purposes of providing disaster relief   
and other urgent life-saving measures2  
or  7iii7 to carry out noncombatant     
evacuations2 or  7,b7 is in the national
 security interests of the ,united      
,states4  7#b7 ,support for ,united     
,states ,government activities ,the     
prohibition in subsection 7a7 shall not 
apply to contracts that support ,united 
,states ,government activities in       

,venezuela1 including those necessary   
for the maintenance of ,united ,states  
,government facilities in ,venezuela1 or
 to contracts with international        
organizations4  7#c7 ,notification      
requirement ,the ,secretary of ,state   
shall notify the appropriate            
congressional committees of any contract
 entered into on the basis of an        
exception provided for under paragraph  
7#a74  7c7 ,office of foreign assets    
control licenses ,the prohibition in    
subsection 7a7 does not apply to a      
person that has a valid license to      
operate in ,venezuela issued by the     
,office of ,foreign ,assets ,control4   
7d7 ,american diplomatic mission in     
,venezuela ,the prohibition in          
subsection 7a7 does not apply to        
contracts related to the operation and  
maintenance of the ,united ,states      
,government's consular offices and      
diplomatic posts in ,venezuela4  7e7    
,waiver ,the ,secretary of ,state may   
waive the requirements of subsection 7a7

 if the ,secretary of ,state determines 
that to do so is in the national        
interest of the ,united ,states4  7f7   
,definitions ,in this section3 7#a7     
,appropriate congressional committees   
,the term appropriate congressional     
committees means the ,committee on      
,homeland ,security and ,governmental   
,affairs and the ,committee on ,foreign 
,relations of the ,senate and the       
,committee on ,homeland ,security and   
the ,committee on ,foreign ,affairs of  
the ,house of ,representatives4  7#b7   
,business operations ,the term business 
operations means engaging in commerce in
 any form1 including acquiring1         
developing1 maintaining1 owning1        
selling1 possessing1 leasing1 or        
operating equipment1 facilities1        
personnel1 products1 services1 personal 
property1 real property1 or any other   
apparatus of business or commerce4  7#c7
 ,executive agency ,the term executive  
agency has the meaning given the term in
 section #acc of title #da1 ,united     

,states ,code4  7#d7 ,government of     
,venezuela  7,a7 ,the term ,government  
of ,venezuela includes the government of
 any political subdivision of           
,venezuela1 and any agency or           
instrumentality of the ,government of   
,venezuela4  7,b7 ,for purposes of      
subparagraph 7,a71 the term agency or   
instrumentality of the ,government of   
,venezuela means an agency or           
instrumentality of a foreign state as   
defined in section #afjc7;b7 of title   
#bh1 ,united ,states ,code1 with each   
reference in such section to a foreign  
state deemed to be a reference to       
,venezuela4  7#e7 ,person ,the term     
person means-- 7,a7 a natural person1   
corporation1 company1 business          
association1 partnership1 society1      
trust1 or any other nongovernmental     
entity1 organization1 or group2  7,b7   
any governmental entity or              
instrumentality of a government2 and    
7,c7 any successor1 subunit1 parent     
entity1 or subsidiary of1 or any entity 

under common ownership or control with1 
any entity described in subparagraph    
7,a7 or 7,b74  7g7 ,term of             
applicability ,this section shall apply 
with respect to any contract entered    
into during the three-year period       
beginning on the date of the enactment  
of this ,act4
