,crapo7 introduced the following bill2 which was read twice and referred to the ,committee on ,agriculture1 ,nutrition1 and ,forestry ,a ,,bill ,to amend the ,food and ,nutrition ,act of #bjjh to establish a dairy nutrition incentive program1 and for other purposes4 #a4 ,short title ,this ,act may be cited as the ,dairy ,nutrition ,incentive ,program ,act of #bjbe4 #b4 ,dairy nutrition incentive program 7a7 ,in general ,the ,food and ,nutrition ,act of #bjjh 7#g ,u4,s4,c4 #bjaa et seq47 is amended by adding at the end the following3 #ca4 ,dairy nutrition incentive program 7a7 ,definitions ,in this section3 7#a7 ,dairy product ,the term dairy product means a product for which cow's milk is listed as-- 7,a7 the first ingredient on the labeled ingredients list of the product2 or 7,b7 the second ingredient on the labeled ingredients list of the product1 if the first listed ingredient is water4 7#b7 ,eligible entity ,the term eligible entity means-- 7,a7 a ,state or local governmental entity2 and 7,b7 a nonprofit organization4 7#c7 ,fluid milk ,the term fluid milk means any variety of pasteurized cow's milk that-- 7,a7 is packaged in liquid form2 and 7,b7 contains vitamins ,a and ,d at levels consistent with the ,food and ,drug ,administration standards1 and applicable ,state and local standards1 for fluid milk4 7#d7 ,naturally nutrient-rich dairy ,the term naturally nutrient-rich dairy means-- 7,a7 fluid milk2 7,b7 yogurt and other cultured cow's milk dairy products2 and 7,c7 cheese 7including nonstandardized cheese7 made from cow's milk4 7#e7 ,program ,the term program means the dairy nutrition incentive program established under subsection 7b74 7b7 ,establishment ,not later than #ahj days after the date of enactment of this section1 the ,secretary shall establish a dairy nutrition incentive program under which the ,secretary shall develop and test methods to increase the purchase and consumption of naturally nutrient-rich dairy by members of households that receive benefits under the supplemental nutrition assistance program by providing an incentive for the purchase of naturally nutrient-rich dairy at the point of purchase to members of households purchasing food using those benefits4 7c7 ,grants or cooperative agreements 7#a7 ,in general ,to carry out the program1 the ,secretary shall enter into cooperative agreements with1 or provide grants to1 eligible entities1 on a competitive basis1 for projects that meet the purpose of the program described in subsection 7b74 7#b7 ,application ,an eligible entity seeking to enter into a cooperative agreement or receive a grant under the program shall submit to the ,secretary an application at such time1 in such manner1 and containing such information as the ,secretary may require4 7#c7 ,selection criteria ,the ,secretary shall develop and make public criteria for evaluating proposed projects in applications submitted under paragraph 7#b71 which shall incorporate a scientifically based strategy designed to improve diet quality and nutritional outcomes through the increased purchase of naturally nutrient-rich dairy4 7#d7 ,priority ,in entering into cooperative agreements and awarding grants under the program1 the ,secretary shall give priority to projects that-- 7,a7 maximize the percentage of funds used for direct incentives for participants in the supplemental nutrition assistance program2 7,b7 include a project design-- 7i7 that provides incentives when naturally nutrient-rich dairy is purchased using benefits under the supplemental nutrition assistance program2 and 7ii7 in which the incentives earned may be used only to purchase naturally nutrient-rich dairy2 7,c7 include project sites that serve members of households that participate in the supplemental nutrition assistance program2 and 7,d7 incorporate the use of point-of-sale systems that can electronically issue incentives earned under the program4 7#e7 ,additional financial assistance ,an eligible entity may request funds from the ,secretary1 pursuant to section #af1 to offset initial costs to enable electronic benefits transfer technology for electronic point-of-sale systems described in paragraph 7#d77;,d7 for project sites selected under the program4 7d7 ,evaluation 7#a7 ,in general ,the ,secretary shall provide for an independent evaluation of each project carried out under the program that measures1 to the maximum extent practicable1 the effect of incentives on purchases of naturally nutrient-rich dairy by members of households that receive benefits under the supplemental nutrition assistance program4 7#b7 ,methodology requirement ,the independent evaluation under paragraph 7#a7 shall use rigorous methodologies1 such as random assignment or other methods that are capable of producing scientifically valid information regarding activities that are effective4 7#c7 ,discontinuance 7,a7 ,in general ,except as provided in subparagraph 7,b71 subject to availability of funds1 nothing in this section shall limit the continuation of a project carried out under the program4 7,b7 ,noncompliance ,the ,secretary may discontinue a project or close a project site under the program if the project-- 7i7 does not comply with the requirements under this section2 7ii7 does not comply with the requirements of the grant awarded or cooperative agreement entered into under the program1 as applicable2 or 7iii7 if the ,secretary determines that the results of the independent evaluation of the project under paragraph 7#a7 are not satisfactory4 7#d7 ,public dissemination ,the ,secretary shall make publicly available the results of each independent evaluation carried out under paragraph 7#a74 7e7 ,report ,not later than ,december #ca of the first full calendar year following the date of establishment of the program1 and biennially thereafter1 the ,secretary shall submit to the ,committee on ,agriculture1 ,nutrition1 and ,forestry of the ,senate and the ,committee on ,agriculture of the ,house of ,representatives a report that includes a description of-- 7#a7 the status of each project carried out under the program2 and 7#b7 the results of each completed evaluation under paragraph 7#a7 during the period covered by the report4 7f7 ,funding 7#a7 ,mandatory funding ,there is appropriated to the ,secretary1 out of any funds in the ,treasury not otherwise appropriated1 #aj1jjj1jjj for each fiscal year to carry out this section4 7#b7 ,authorization of appropriations 7,a7 ,in general ,in addition to the funds made available under paragraph 7#a71 there is authorized to be appropriated to the ,secretary to carry out this section #aj1jjj1jjj for fiscal year #bjbe and each fiscal year thereafter4 7,b7 ,appropriations in advance ,with respect to any funds made available under subparagraph 7,a71 only funds appropriated in advance specifically to carry out this section shall be available to carry out this section4 7#c7 ,evaluation costs ,of the funds made available to carry out this section for a fiscal year1 the ,secretary shall use not more than #g percent to carry out subsection 7d74 7#d7 ,limitation on use ,funds made available to carry out this section shall not be used for any project that limits the use of benefits under the supplemental nutrition assistance program4 4 7b7 ,transition from healthy fluid milk incentives projects 7#a7 ,in general ,the ,secretary of ,agriculture 7referred to in this subsection as the ,secretary7 shall transition projects carried out under section #dbjh of the ,agriculture ,improvement ,act of #bjah 7#g ,u4,s4,c4 #bjbf;a7 to be carried out as part of the dairy nutrition incentive program established under section #ca of the ,food and ,nutrition ,act of #bjjh4 7#b7 ,no interruption ,in carrying out paragraph 7#a71 the ,secretary shall ensure that-- 7,a7 there is no interruption in projects being carried out under section #dbjh of the ,agriculture ,improvement ,act of #bjah 7#g ,u4,s4,c4 #bjbf;a7 during the transition described in that paragraph2 and 7,b7 any additional authorities or flexibilities under the dairy nutrition incentive program established under section #ca of the ,food and ,nutrition ,act of #bjjh shall be applied to the projects described in subparagraph 7,a74 7#c7 ,repeal ,effective #a year after the date on which the ,secretary certifies that the ,secretary has completed carrying out paragraph 7#a71 section #dbjh of the ,agriculture ,improvement ,act of #bjah 7#g ,u4,s4,c4 #bjbf;a7 is repealed4
