,energy and ,commerce ,a ,,bill ,to provide transparency in short-term rental listings1 and for other purposes4 #a4 ,short title ,this ,act may be cited as the ,safety ,enforcement for ,children and ,users through ,rental ,evaluation and ,disclosure ,act of #bjbf or the ,,secured ,act of #bjbf4 #b4 ,requirements regarding registered child sex offenders and short-term rentals 7a7 ,requirements 7#a7 ,covered platforms ,a provider of a covered platform-- 7,a7 prior to publishing a listing by a property owner for a short-term rental on the covered platform1 shall implement reasonable procedures to request that the property owner disclose whether the property owner is a registered child sex offender2 and 7,b7 if a property owner discloses under subparagraph 7,a7 that the property owner is a registered child sex offender1 shall include a clear and conspicuous public disclosure with respect to any such listing by the property owner published on the covered platform to a prospective guest prior to the point of sale that shall include a link to a public sex offender registry where such disclosure may be independently verified4 7#b7 ,property owners ,a property owner who is a registered child sex offender-- 7,a7 shall respond to a request made by a provider of a covered platform under paragraph 7#a77;,a72 and 7,b7 may not provide materially false information with respect to any such request4 7b7 ,enforcement 7#a7 ,enforcement by ,commission 7,a7 ,unfair or deceptive acts or practices ,a violation of subsection 7a7 shall be treated as a violation of a regulation under section #ah7;a77#a77;,b7 of the ,federal ,trade ,commission ,act 7#ae ,u4,s4,c4 #eg;a7a77#a77;,b77 regarding unfair or deceptive acts or practices4 7,b7 ,powers of ,commission ,the ,commission shall enforce subsection 7a7 in the same manner1 by the same means1 and with the same jurisdiction1 powers1 and duties as though all applicable terms and provisions of the ,federal ,trade ,commission ,act 7#ae ,u4,s4,c4 #da et seq47 were incorporated into and made a part of this ,act1 and any person who violates such subsection shall be subject to the penalties and entitled to the privileges and immunities provided in the ,federal ,trade ,commission ,act4 7#b7 ,actions by ,states 7,a7 ,in general ,in any case in which the attorney general of a ,state1 or an official or agency of a ,state1 has reason to believe that an interest of the residents of such ,state has been or is threatened or adversely affected by an act or practice in violation of subsection 7a71 the ,state1 as parens patriae1 may bring a civil action on behalf of the residents of the ,state in an appropriate district court of the ,united ,states to-- 7i7 enjoin such act or practice2 7ii7 enforce compliance with such subsection2 7iii7 obtain damages1 restitution1 or other compensation on behalf of residents of the ,state2 or 7iv7 obtain such other legal and equitable relief as the court may consider to be appropriate4 7,b7 ,notice ,before filing an action under this paragraph1 the attorney general1 official1 or agency of the ,state involved shall provide to the ,commission a written notice of such action and a copy of the complaint for such action4 ,if the attorney general1 official1 or agency determines that it is not feasible to provide the notice described in this subparagraph before the filing of the action1 the attorney general1 official1 or agency shall provide written notice of the action and a copy of the complaint to the ,commission immediately upon the filing of the action4 7,c7 ,authority of ,commission 7i7 ,in general ,on receiving notice under subparagraph 7,b7 of an action under this paragraph1 the ,commission shall have the right-- 7,i7 to intervene in the action2 7,,ii7 upon so intervening1 to be heard on all matters arising therein2 and 7,,iii7 to file petitions for appeal4 7ii7 ,limitation on ,state action while ,federal action is pending ,if the ,commission or the ,attorney ,general of the ,united ,states has instituted a civil action for violation of subsection 7a7 7referred to in this clause as the ,federal action71 no ,state attorney general1 official1 or agency may bring an action under this paragraph during the pendency of the ,federal action against any defendant named in the complaint in the ,federal action for any violation of such subsection alleged in such complaint4 7c7 ,definitions ,in this section3 7#a7 ,commission ,the term ,commission means the ,federal ,trade ,commission4 7#b7 ,covered platform ,the term covered platform means a digital platform1 website1 application1 or other similar service that facilitates short-term rentals4 7#c7 ,property owner ,the term property owner means an individual who holds legal title to1 or has the right to offer for rent1 a short-term rental listed on a covered platform1 whether listed directly or through an agent of the individual4 7#d7 ,public sex offender registry ,the term public sex offender registry means a government-maintained1 publicly accessible database of registered sex offenders1 including the ,national ,sex ,offender ,public website and any other similar registry maintained by a ,state4 7#e7 ,registered child sex offender ,the term registered child sex offender means an individual who is required by law to register as a sex offender on a public sex offender registry if such registration is based on1 in whole or in part1 a conviction for a sexual offense that the individual committed against another individual who was under the age of #ah years old at the time of such offense4 7#f7 ,short-term rental ,the term short-term rental means any dwelling unit1 residence1 or other real property that a guest or lessee may occupy in exchange for monetary compensation for a period of fewer than #i consecutive months for each such guest or lessee4 7d7 ,effective date ,this section shall take effect on the date that is #a year after the date of the enactment of this ,act4
