,definitions ,in this ,act3  7#a7       
,artisanal and small-scale mining ,the  
term artisanal and small-scale mining   
means a form of mining common in the    
developing world that-- 7,a7 typically  

employs rudimentary and low-cost        
extractive technologies and manual      
labor-intensive techniques2  7,b7 is    
frequently subject to limited           
regulation2 and  7,c7 often features    
inhumane1 harsh1 and dangerous working  
conditions4  7#b7 ,critical mineral ,the
 term critical mineral has the meaning  
given that term in section #gjjb7;a7 of 
the ,energy ,act of #bjbj 7#cj ,u4,s4,c4
 #afjf7;a774  7#c7 ,environmental harm  
to a protected area ,the term           
environmental harm to a protected area  
means damage to the environment of a    
protected area1 such as--  7,a7         
contamination of water resources1       
streams1 rivers1 lakes1 or other bodies 
of water1 including wells1 aquifers1 or 
soil2  7,b7 soil degradation or erosion2
 or  7,c7 degredation of aquatic or     
terrestrial ecosystems or biodiversity  
loss4  7#d7 ,forced labor ,the term     
forced labor has the meaning given that 
term in section #cjg of the ,tariff ,act
 of #aicj 7#ai ,u4,s4,c4 #acjg74  7#e7  

,large-scale mining ,the term           
large-scale mining means                
capital-intensive1 usually highly       
mechanized1 typically industrial-scale  
mining carried out by large commercial  
entities4  7#f7 ,,prc entity ,the term  
,,prc entity means--  7,a7 an entity    
under the ownership1 control1 or        
influence of-- 7i7 the ,government of   
the ,people's ,republic of ,china2  7ii7
 the ,chinese ,communist ,party2 or     
7iii7 a military1 intelligence1 or      
paramilitary entity of the ,communist   
,party of ,china or the ,people's       
,republic of ,china2  7,b7 an entity    
that is organized under the laws of1 or 
otherwise subject to the jurisdiction   
of1 the ,people's ,republic of ,china   
7including ,hong ,kong and ,macau72     
7,c7 an entity majority-owned1          
majority-controlled1 or                 
majority-financed by an entity described
 in subparagraph 7,a7 or 7,b72 or  7,d7 
a parent1 subsidiary1 affiliate1 or     
contractor of an entity described in    

subparagraph 7,a71 7,b71 or 7,c71       
including a joint venture in which an   
entity described in subparagraph 7,a71  
7,b71 or 7,c7 holds a controlling       
interest4  7#g7 ,protected area ,the    
term protected area means any area that 
has received protected status in the    
country in which the area is located1   
such as a national park1 game refuge1   
ecosystem reserve1 or other nature      
preserve4  7#h7 ,relevant congressional 
committees ,the term relevant           
congressional committees means the      
,committee on ,foreign ,relations of the
 ,senate and the ,committee on ,foreign 
,affairs of the ,house of               
,representatives4  7b7 ,in general ,not 
less frequently than once each year     
during the #e-year period beginning on  
the date of the enactment of this ,act1 
the ,secretary of ,state shall submit to
 the relevant congressional committees1 
and make publicly available1 including  
on the internet1 a list of--  7#a7 each 
,,prc entity that the ,secretary        

reasonably assesses is carrying out     
mining1 including large-scale mining or 
artisanal and small-scale mining1 of    
critical minerals1 gold1 or iron in the 
,democratic ,republic of the ,congo1    
,nigeria1 ,guinea1 ,zambia1 ,south      
,africa1 or ,zimbabwe or other ,african 
countries-- 7,a7 using forced labor2 or 
7,b7 in a manner that causes            
environmental harm to a protected area  
in the country concerned2 and  7#b7 each
 mine1 mining zone1 or concession at    
which such mining is carried out4  7c7  
,development of list ,in developing each
 list required by subsection 7b71 the   
,secretary of ,state shall-- 7#a7 use   
open-source information1 including from 
press sources and academic1 non-profit1 
and other non-state research            
organizations or individual researchers1
 and information received1 collected1 or
 otherwise obtained by ,united ,states  
embassies2 and  7#b7 consult with the   
,secretary of ,labor1 through the       
,bureau of ,international ,labor        

,affairs of the ,department of ,labor1  
the ,secretary of ,commerce1 ,secretary 
of the ,treasury1 the ,director of      
,national ,intelligence1 and other heads
 of ,federal departments and agencies1  
and the foreign country counterparts of 
such individuals in the listed countries
 in subsection 7b77#a71 as applicable4  
7d7 ,form ,each list required by        
subsection 7b7 shall be made publicly   
available and submitted to the relevant 
congressional committees in unclassified
 form1 but the version submitted to the 
relevant congressional committees may   
include a classified annex1 if          
warranted4
