,,bill  ,to amend the ,immigration and  
,nationality ,act to require the        
,secretary of ,homeland ,security to    
return identification documents to      
individuals upon their release from     
custody1 and for other purposes4  #a4   
,short title  ,this ,act may be cited as
 the ,protecting ,all ,personal ,effects
 and ,records from ,seizure ,act of     
#bjbf or the ,,papers ,act of #bjbf4    
#b4 ,return of documents after release  
from ,department of ,homeland ,security 
custody  7a7 ,in general ,chapter #d of 
title ,,ii of the ,immigration and      
,nationality ,act is amended by         
inserting after section #bcf;,a the     
following3  #bcf;,b4 ,return of         
documents after release from custody    
7a7 ,in general ,except as provided in  

subsection 7b71 upon releasing any      
individual from custody under this ,act1
 the ,secretary of ,homeland ,security  
shall return to such individual each    
covered document taken from the         
individual while in the custody of the  
,department of ,homeland ,security4  7b7
 ,exception ,the ,secretary may retain a
 covered document only if-- 7#a7 the    
document is determined to be fraudulent2
  7#b7 the document is contraband or    
evidence in a pending criminal          
proceeding2 or  7#c7 the individual is  
no longer legally entitled to possess   
the document under ,federal law4  7c7   
,certified copies ,if a covered document
 is retained pursuant to subsection 7b71
 the ,secretary shall provide the       
individual with a written explanation of
 the applicable exception and a         
certified copy of the document1 unless  
prohibited by law4  7d7 ,covered        
document ,for purposes of this section1 
the term covered document includes an   
original passport1 permanent resident   

card1 employment authorization document1
 birth certificate1 driver's license1   
social security card1 and any other     
similar government-issued document4  7e7
 ,no operational exception ,operational 
convenience or an anticipated future    
immigration enforcement action does not 
constitute grounds to retain a document 
after releasing an individual from      
custody under this ,act4  4  7b7        
,clerical amendment ,the table of       
contents of the ,immigration and        
,nationality ,act is amended by         
inserting after the item related to     
section #bcf;,a the following3  #bcf;,b4
