subsequently determined by the ,speaker1
 in each case for consideration of such 
provisions as fall within the           
jurisdiction of the committee concerned 
,a ,,bill  ,to establish in the         
,department of ,homeland ,security a    
working group relating to countering    
terrorist1 cybersecurity1 border and    
port security1 and transportation       
security threats posed to the ,united   
,states by the ,chinese ,communist      
,party1 and for other purposes4  #a4    

,short title ,this ,act may be cited as 
the ,strategic ,homeland ,intelligence  
and ,enforcement ,legislation to ,defend
 ,against the ,,ccp ,act or the ,,shield
 ,against ,,ccp ,act4  #b4 ,working     
,group to counter certain threats posed 
to the ,united ,states by the ,chinese  
,communist ,party  7a7 ,establishment   
7#a7 ,in general ,not later than #ahj   
days after the date of the enactment of 
this ,act1 the ,secretary of ,homeland  
,security shall establish in the        
,department of ,homeland ,security a    
working group 7in this section referred 
to as the ,working ,group71 which shall 
carry out the duties specified in       
subsection 7b7 relating to countering   
terrorist1 cybersecurity1 border and    
port security1 and transportation       
security threats posed to the ,united   
,states by the ,chinese ,communist      
,party4  7#b7 ,director  7,a7           
,appointment ,the head of the ,working  
,group shall be a ,director 7in this    
section referred to as the ,director71  

who shall be appointed by the ,secretary
 of ,homeland ,security4  7,b7          
,reporting ,the ,director shall report  
to the ,secretary of ,homeland ,security
 regarding all administrative1          
operational1 and security matters of the
 ,working ,group4  7#c7 ,staffing ,the  
,secretary of ,homeland ,security shall 
ensure the ,working ,group is provided  
with the following3 7,a7 ,a sufficient  
number of employees to perform required 
duties4  7,b7 ,not fewer than one       
employee dedicated to ensuring          
compliance with privacy laws and        
regulations4  7#d7 ,detailees ,the      
,working ,group may accept and employ   
detailees with expertise in countering  
terrorist1 cybersecurity1 border and    
port security1 and transportation       
security threats posed by the ,chinese  
,communist ,party to the ,united        
,states1 or in related fields1 from any 
element of the intelligence community or
 any other ,federal agency the ,director
 determines appropriate1 with or without

 reimbursement1 consistent with         
applicable laws and regulations         
regarding such employees4  7b7 ,duties  
,the ,working ,group shall carry out the
 following3 7#a7 ,examine1 assess1 and  
report upon efforts by the ,department  
of ,homeland ,security to counter       
terrorist1 cybersecurity1 border and    
port security1 and transportation       
security threats posed to the ,united   
,states by the ,chinese ,communist      
,party1 including efforts to counter the
 ,chinese ,communist ,party's-- 7,a7    
nontraditional tactics and exploitation 
of the ,united ,states immigration      
system through-- 7i7 identity theft2    
7ii7 the immigrant and nonimmigrant visa
 processes2  7iii7 unlawful border      
crossings2  7iv7 human smuggling2 and   
7v7 human trafficking2  7,b7 predatory  
economic and trade practices1 including 
the trafficking of counterfeit and      
pirated goods1 the use of forced labor1 
labor exploitation for financial gain1  
customs fraud1 and theft of intellectual

 property and technology2  7,c7 direct  
or indirect support for transnational   
criminal organizations trafficking in   
fentanyl1 illicit drug precursors1 or   
other controlled substances through--   
7i7 the ,united ,states border2  7ii7   
international mail shipments2 or  7iii7 
express consignment operations2 and     
7,d7 support for illicit financial      
activity by ,chinese ,money ,laundering 
,organizations1 including any           
repatriation to ,china or any other     
country of the proceeds derived from the
 activities described in subparagraphs  
7,a7 through 7,c74  7#b7 ,account for   
the resources of the ,department that   
are dedicated to programs aimed at      
countering terrorist1 cybersecurity1    
border and port security1 and           
transportation security threats posed to
 the ,united ,states by the ,chinese    
,communist ,party1 and any supporting   
information as to the efficacy of each  
such program4  7#c7 ,build upon existing
 or ongoing evaluations and avoid       

unnecessary duplication by reviewing the
 findings1 conclusions1 and             
recommendations of other appropriate    
working groups1 committees1 commissions1
 or entities established by the         
,department related to efforts to       
counter terrorist1 cybersecurity1 border
 and port security1 and transportation  
security threats posed to the ,united   
,states by the ,chinese ,communist      
,party4  7#d7 ,identify gaps in         
policies1 processes1 and activities of  
the ,department to respond to terrorist1
 cybersecurity1 border and port         
security1 and transportation security   
threats posed to the ,united ,states by 
the ,chinese ,communist ,party4  7#e7   
,facilitate cooperation and coordination
 among offices and components of the    
,department on a holistic response to   
countering terrorist1 cybersecurity1    
border and port security1 and           
transportation security threats posed to
 the ,united ,states by the ,chinese    
,communist ,party4  7c7 ,additional duty

 relating to information sharing ,the   
,working ,group shall review1 in        
coordination with the ,office of        
,intelligence and ,analysis of the      
,department of ,homeland ,security1     
information relating to terrorist1      
cybersecurity1 border and port security1
 and transportation security threats    
posed to the ,united ,states by the     
,chinese ,communist ,party that is      
gathered by ,federal1 ,state1 local1    
,tribal1 and territorial partners1 and  
the ,national ,network of ,fusion       
,centers1 and incorporate such          
information1 as appropriate1 into the   
,working ,group's own information       
relating to such threats4 ,the ,working 
,group1 in coordination with the ,office
 of ,intelligence and ,analysis1 shall  
also ensure the dissemination to        
,federal1 ,state1 local1 ,tribal1 and   
territorial partners1 and the ,national 
,network of ,fusion ,centers1 of        
information related to such threats4    
7d7 ,annual assessments  7#a7 ,in       

general ,not later than #ahj days after 
the date of the enactment of this       
section and annually thereafter for five
 years1 the ,secretary of ,homeland     
,security1 in coordination with the     
,under ,secretary for ,intelligence and 
,analysis of the ,department of         
,homeland ,security1 the ,director of   
the ,federal ,bureau of ,investigation1 
and the ,director of ,national          
,intelligence1 shall submit to the      
appropriate congressional committees a  
report that assesses terrorist1         
cybersecurity1 border and port security1
 and transportation security threats    
posed to the ,united ,states by the     
,chinese ,communist ,party during the   
immediately preceding #ab months4  7#b7 
,contents ,each assessment under        
paragraph 7#a7 shall also include the   
following3 7,a7 ,a description of the   
activities and operations of the        
,working ,group undertaken pursuant to  
subsection 7b74  7,b7 ,any other matters
 the ,secretary of ,homeland ,security  

determines relevant4  7#c7 ,form ,each  
assessment under paragraph 7#a7 shall be
 submitted in unclassified form1 but may
 include a classified annex4 ,the       
,secretary of ,homeland ,security shall 
post on a publicly available website of 
the ,department of ,homeland ,security  
the unclassified portion of each        
assessment4  7#d7 ,briefing ,not later  
than #cj days after the submission of   
each assessment under paragraph 7#a71   
the ,secretary of ,homeland ,security   
shall provide to the appropriate        
congressional committees a briefing on  
such assessment and the progress and    
challenges of the ,working ,group4  7e7 
,comptroller ,general review ,not later 
than one year after the date of the     
enactment of this ,act1 the ,comptroller
 ,general of the ,united ,states shall  
submit to the appropriate congressional 
committees a report on the              
implementation of this section4  7f7    
,research and development ,not later    
than one year after the date of the     

enactment of this ,act1 the ,secretary  
of ,homeland ,security1 in coordination 
with the ,director and the ,under       
,secretary for ,science and ,technology 
of the ,department of ,homeland         
,security1 shall1 to the extent         
practicable1 carry out research and     
development1 including operational      
testing1 of technologies and techniques 
for enhancing the ,department's security
 and situational awareness relating to  
countering terrorist1 cybersecurity1    
border and port security1 and           
transportation security threats posed to
 the ,united ,states by the ,chinese    
,communist ,party4  7g7 ,implementation 
,all activities carried out pursuant to 
this section-- 7#a7 shall be carried out
 in accordance with applicable          
constitutional1 privacy1 civil rights1  
and civil liberties protections2 and    
7#b7 may not infringe upon the lawful   
exercise of free speech by ,united      
,states persons4  7h7 ,sunset ,the      
,working ,group shall terminate on the  

date that is seven years after the      
establishment of the ,working ,group    
under subsection 7a77#a74  7i7          
,definitions ,in this section3 7#a7     
,appropriate congressional committees   
,the term appropriate congressional     
committees means-- 7,a7 in the ,house of
 ,representatives-- 7i7 the ,committee

and ,governmental ,affairs2  7ii7 the   
,committee on ,banking1 ,housing1 and   
,urban ,affairs2  7iii7 the ,committee  
on ,finance2  7iv7 the ,committee on the
 ,judiciary2 and  7v7 the ,committee on

center ,the term fusion center has the  
meaning given such term in subsection

,the term intelligence community has the

,the term ,national ,network of ,fusion 
,centers means a decentralized          
arrangement of fusion centers intended  
to enhance individual ,state and urban  
area fusion centers' ability to leverage
 the capabilities and expertise of all  
such fusion centers for the purpose of  
enhancing analysis and homeland security
