other purposes4  #a4 ,short title ,this 
,act may be cited as the ,archie        
,cavanaugh ,migratory ,bird ,treaty     
,clarification ,act4  #b4 ,purpose  ,the
 purpose of this ,act is to clarify the 
treatment of authentic ,alaska ,native  
articles of handicraft offered for sale 
under the ,convention between the       
,united ,states and ,japan for the      
,protection of ,migratory ,birds and    
,birds in ,danger of ,extinction and    
,their ,environment1 signed at ,tokyo   
,march #d1 #aigd 7,,tias #giij74  #c4   
,clarification for authentic ,alaska    
,native articles of handicraft          
containing migratory bird parts  7a7 ,in
 general ,not later than #ahj days after
 the date of the enactment of this      
,act-- 7#a7 the ,secretary of ,state    

shall work with the ,secretary of the   
,interior to enter into appropriate     
bilateral procedures1 as necessary1 with
 the foreign country that is party to   
the treaty described in section #b to   
clarify the treatment of authentic      
,alaska ,native articles of handicraft  
to be offered for sale containing       
nonedible migratory bird parts from the 
species of migratory birds listed in the
 treaty2 and  7#b7 the ,secretary of the
 ,interior may modify any regulations   
implementing the ,migratory ,bird       
,treaty ,act 7#af ,u4,s4,c4 #gjc et     
seq471 as appropriate1 consistent with  
the treaty described in section #b1 in  
consultation with the foreign country   
that is party to the treaty1 the ,alaska
 ,migratory ,bird ,co-,management       
,council1 and the ,pacific ,flyway      
,council1 and in coordination with the  
,law ,enforcement ,office of the ,united
 ,states ,fish and ,wildlife ,service1  
to implement any necessary              
clarifications resulting from the       

procedures described in paragraph 7#a71 
including conditions for consignment and
 re-sale1 certification of authenticity1
 and provisions pertaining to species of
 conservation concern4  7b7             
,modification of regulations ,if the    
,secretary of the ,interior determines  
that any of the species used under this 
section show significant population     
declines or is determined to be a ,bird 
of ,conservation ,concern pursuant to   
section #ac of the ,fish and ,wildlife  
,conservation ,act of #aihj 7#af        
,u4,s4,c4 #biab71 the ,secretary may    
modify regulations to remove the species
 from application under this section4   
7c7 ,outreach ,the ,secretary of the    
,interior shall work in collaboration   
with the ,alaska ,migratory ,bird       
,co-,management ,council and other      
appropriate stakeholders to develop     
outreach and communication resources and
 means to communicate rules pertaining  
to the sale of authentic ,alaska ,native
 articles of handicraft including parts 

of migratory birds4  7d7 ,technical     
amendment ,section #b7;a7 of the        
,migratory ,bird ,treaty ,act 7#af      
,u4,s4,c4 #gjc7 is amended by inserting 
a comma after ,march #d1 #aigb4  7e7    
,definitions ,in this ,act3 7#a7 ,alaska
 ,native ,the term ,alaska ,native means
 a member of any ,indian ,tribe that is 
based in the ,state of ,alaska1 as      
verified through issuance of--  7,a7 a  
,tribal enrollment card2  7,b7 a        
,certificate of ,degree of ,indian      
,blood 7commonly known as a ,,cdib7 by  
the ,bureau of ,indian ,affairs2 or     
7,c7 a permit under the ,silver ,hand   
program of the ,alaska ,state ,council  
on the ,arts4  7#b7 ,authentic ,alaska  
,native article of handicraft ,the term 
authentic ,alaska ,native article of    
handicraft--  7,a7 means any item that  
is-- 7i7 composed1 wholly or in a       
significant respect1 of natural         
materials that were found1 foraged1 or  
gifted2 and  7ii7 produced1 decorated1  
or fashioned in significant part-- 7,i7 

by an ,alaska ,native2  7,,ii7 in the   
exercise of traditional ,alaska ,native 
handicrafts2 and  7,,iii7 without the   
use of any mass copying device2  7,b7   
includes-- 7i7 any weaving1 carving1    
stitching1 sewing1 lacing1 beading1     
drawing1 or painting that meets the     
criteria described in clause 7i72 and   
7ii7 any item1 including clothing1      
described in subclause 7,i7 that        
combines the techniques described in    
that subclause2 and  7,c7 does not      
include any item that contains a part of
 a migratory bird that was taken in a   
wasteful or illegal manner4  7#c7
