area in the ,state of ,colorado1 and for other purposes4 #a4 ,short title ,this ,act may be cited as the ,gunnison ,outdoor ,resources ,protection ,act of #bjbe4 #b4 ,definitions ,in this ,act3 7#a7 ,collaboratively developed ,the term collaboratively developed1 with respect to a project1 means the project is developed and implemented through a collaborative process that-- 7,a7 includes multiple interested persons representing diverse interests2 and 7,b7 7i7 is transparent and nonexclusive2 or 7ii7 meets the requirements for a resource advisory committee under-- 7,i7 for projects carried out on ,national ,forest ,system land1 subsections 7c7 through 7f7 of section #bje of the ,secure ,rural ,schools and ,community ,self-,determination ,act of #bjjj 7#af ,u4,s4,c4 #gabe72 or 7,,ii7 for projects carried out on ,bureau of ,land ,management land1 subpart #aghd of part #agjj of title #dc1 ,code of ,federal ,regulations 7or successor regulations74 7#b7 ,county ,the term ,county means ,gunnison ,county1 ,colorado4 7#c7 ,covered area ,the term covered area means each of the ,special ,management ,areas1 ,wildlife ,conservation ,areas1 ,protection ,areas1 and ,recreation ,management ,areas and the ,scientific ,research and ,education ,area4 7#d7 ,decommission ,the term decommission1 with respect to a road1 means-- 7,a7 reestablishing native vegetation on the road2 7,b7 restoring any natural drainage1 watershed function1 or other ecological processes that were disrupted or adversely impacted by the road by removing or hydrologically disconnecting the road prism and reestablishing stable slope contours2 7,c7 effectively blocking the road to vehicular traffic1 where feasible2 and 7,d7 developing and implementing an effective monitoring and response plan for invasive species and vehicular traffic incursions4 7#e7 ,ecological integrity ,the term ecological integrity has the meaning given the term in section #bai4ai of title #cf1 ,code of ,federal ,regulations 7as in effect on the date of enactment of this ,act74 7#f7 ,off-highway vehicle ,the term off-highway vehicle-- 7,a7 with respect to ,national ,forest ,system land1 has the meaning given the term in section #bab4a of title #cf1 ,code of ,federal ,regulations 7or a successor regulation72 and 7,b7 with respect to land managed by the ,bureau of ,land ,management1 has the meaning given the term off-road vehicle in section #hcdj4j-e of title #dc1 ,code of ,federal ,regulations 7or a successor regulation74 7#g7 ,over-snow vehicle ,the term over-snow vehicle has the meaning given the term in section #bab4a of title #cf1 ,code of ,federal ,regulations 7or a successor regulation74 7#h7 ,protection ,area ,the term ,protection ,area means a protection area designated by section #e7;a74 7#i7 ,recreation ,management ,area ,the term ,recreation ,management ,area means a recreation management area designated by section #f7;a74 7#aj7 ,restore ,the term restore has the meaning given the term in section #bai4ai of title #cf1 ,code of ,federal ,regulations 7as in effect on the date of enactment of this ,act74 7#aa7 ,scientific ,research and ,education ,area ,the term ,scientific ,research and ,education ,area means the ,rocky ,mountain ,scientific ,research and ,education ,area designated by section #g7;a74 7#ab7 ,secretary ,the term ,secretary means-- 7,a7 the published by the ,department of ,agriculture in #bjae4 7#ag7 ,wildlife ,conservation ,area ,the term ,wildlife ,conservation ,area means a wildlife conservation area designated by section #d7;a74 7#ah7 ,winter travel management plan ,the term winter travel management plan means a decision designating roads1 trails1 or areas for over-snow vehicle use in accordance with-- 7,a7 in the case of ,forest ,service land within a covered area1 subpart ,c of part #bab of title #cf1 ,code of ,federal ,regulations 7or successor regulations72 and 7,b7 in the case of ,bureau of ,land ,management land present and future generations the natural1 scenic1 scientific1 cultural1 watershed1 recreation1 and wildlife resources of the ,special ,management ,areas4 7c7 ,management 7#a7 ,in general ,the ,secretary shall manage the ,special ,management ,areas in a manner that-- 7,a7 conserves1 protects1 and enhances the resources of the ,special ,management ,areas2 and 7,b7 is in accordance with-- 7i7 this ,act2 and 7ii7 other applicable laws4 7#b7 ,uses 7,a7 ,in general ,the ,secretary shall only allow uses of the ,special ,management ,areas that the ,secretary determines would further the purpose described in subsection 7b74 7,b7 ,vehicle and bicycle use 7i7 ,in general ,the use of off-highway vehicles and bicycles in the ,special ,management ,areas shall be permitted only on roads1 trails1 and areas designated for use by those vehicles on the date of enactment of this ,act1 except-- 7,i7 as needed for administrative purposes2 7,,ii7 to respond to an emergency2 or 7,,iii7 as authorized under clauses 7ii7 and 7iii74 7ii7 ,winter travel management ,for any portion of a ,special ,management ,area for which the ,secretary has not adopted a winter travel management plan as of the date of enactment of this ,act1 the ,secretary-- 7,i7 shall1 not later than #c years after the date of enactment of this ,act1 adopt a winter travel management plan with respect to the applicable portion of the ,special ,management ,area2 and 7,,ii7 may1 during any period beginning on the date of enactment of this ,act and ending on the date of adoption of a winter travel management plan for the applicable portion under subclause 7,i71 permit the use of over-snow vehicles in the applicable portion of the ,special ,management ,area in accordance with the applicable land management plan or other applicable management direction4 7iii7 ,potential trails ,the ,secretary may permit-- 7,i7 the use of bicycles on the potential trails described in paragraph 7#c7 if the trails are designated by the ,secretary for the use2 and 7,,ii7 the use of off-highway vehicles on the potential trails described in subparagraphs 7,a71 7,c71 and 7,f7 of paragraph 7#c7 if the trails are designated by the ,secretary for the use4 7#c7 ,limitation ,nothing in this section affects the potential development1 in accordance with applicable law1 of-- 7,a7 a proposed trail of less than #ej inches in width1 commonly known as the ,big ,grassy ,trail1 within the ,american ,flag ,special ,management ,area designated by subsection 7a77#a72 7,b7 the proposed trails1 commonly known as the ,crested ,butte to ,paonia ,trail and the ,crested ,butte to ,carbondale ,trail1 within the ,beckwiths ,special ,management ,area designated by subsection 7a77#b72 7,c7 the proposed trails1 commonly known as the ,antelope ,ridge ,trail and ,connector1 the ,east ,west ,antelope ,trail1 the ,west ,antelope ,trail1 and the ,mill ,creek ,connector1 within the ,mc,intosh ,mountain ,special ,management ,area designated by subsection 7a77#d72 7,d7 the proposed trail1 commonly known as the ,gunnison to ,crested ,butte ,trail1 and the trails generally depicted in figure #g of the document entitled ,candidate ,conservation ,agreement3 ,for the ,gunnison sage-grouse1 ,centrocercus minimus--,gunnison ,basin ,population and dated #bjab within the ,signal ,peak ,special ,management ,area designated by subsection 7a77#g72 7,e7 the proposed trails1 commonly known as the ,gunnison to ,crested ,butte ,trail and the ,baxter ,gulch to ,splain's ,gulch ,trail1 in the ,whetstone ,headwaters ,special ,management ,area designated by subsection 7a77#i72 or 7,f7 the proposed trail1 commonly known as the ,splain's ,gulch to ,carbon ,creek ,trail1 in the ,whetstone ,headwaters ,special ,management ,area designated by subsection 7a77#i74 #d4 ,designation of wildlife conservation areas 7a7 ,designation 7#a7 ,cabin ,creek ,wildlife ,conservation ,area ,subject to valid existing rights1 certain and restore for the benefit and enjoyment of present and future generations the wildlife and wildlife habitat of the ,wildlife ,conservation ,areas2 and 7#b7 to conserve1 protect1 and enhance for the benefit and enjoyment of present and future generations the natural1 scenic1 scientific1 cultural1 watershed1 and recreation resources of the ,wildlife ,conservation ,areas4 7c7 ,management 7#a7 ,in general ,the ,secretary shall manage the ,wildlife ,conservation ,areas in a manner that-- 7,a7 furthers the purposes of the ,wildlife ,conservation ,areas2 and 7,b7 is in accordance with-- 7i7 this ,act2 and 7ii7 other applicable laws4 7#b7 ,uses 7,a7 ,in general ,the ,secretary shall only allow uses of the ,wildlife ,conservation ,areas that the ,secretary determines would further the purposes described in subsection 7b74 7,b7 ,vehicle and bicycle use 7i7 ,in general ,the use of off-highway vehicles and bicycles in the ,wildlife ,conservation ,areas shall be permitted only on roads1 trails1 and areas designated for the uses on the date of enactment of this ,act4 7ii7 ,exceptions ,notwithstanding clause 7i7-- 7,i7 off-highway vehicles and bicycles may be permitted-- 7aa7 as needed for administrative purposes2 or 7bb7 to respond to an emergency2 7,,ii7 for any portion of a ,wildlife ,conservation ,area for which the ,secretary has not adopted a winter travel management plan as of the date of enactment of this ,act1 the ,secretary-- 7aa7 shall1 not later than #c years after the date of enactment of this ,act1 adopt a winter travel management plan for the applicable portion of the ,wildlife ,conservation ,area2 and 7bb7 may1 during the period beginning on the date of enactment of this ,act and ending on the date of adoption of a winter travel management plan for the applicable portion under item 7aa71 permit the use of over-snow vehicles in the applicable portion of the ,wildlife ,conservation ,area in accordance with the applicable land management plan or other applicable management direction2 7,,iii7 except as authorized under subclause 7,i71 the use of off-highway vehicles and bicycles shall be prohibited in the ,matchless ,wildlife ,conservation ,area designated by subsection 7a77#d72 and 7,,iv7 the ,secretary may permit the use of bicycles on the potential trails described in paragraph 7#c7 if the trails are designated by the ,secretary for the use4 7#c7 ,limitation ,nothing in this section affects the potential development1 in accordance with applicable law1 of-- 7,a7 the proposed trail1 commonly known as the ,gunnison to ,crested ,butte ,trail1 in the ,flat ,top ,wildlife ,conservation ,area designated by subsection 7a77#b72 7,b7 the proposed trail1 commonly known as the ,crested ,butte to ,carbondale ,trail1 in the ,munsey ,creek ,wildlife ,conservation ,area designated by subsection 7a77#e72 or 7,c7 the proposed trails1 commonly known as the ,tenderfoot ,mountain to ,bambi's ,trail and the ,big ,loop ,trail1 in the ,sawtooth ,wildlife ,conservation ,area designated by subsection 7a77#h74 #e4 ,designation of protection areas 7a7 ,designation 7#a7 ,castle ,protection ,area ,subject to valid existing rights1 certain ,federal ,protection ,areas in a manner that-- 7,a7 furthers the purposes of the ,protection ,areas described in subsection 7b72 and 7,b7 is in accordance with-- 7i7 this ,act2 and 7ii7 other applicable laws4 7#b7 ,uses 7,a7 ,in general ,the ,secretary shall only allow uses of the ,protection ,areas that the ,secretary determines would further the purposes described in subsection 7b74 7,b7 ,vehicle use 7i7 ,in general ,except as provided in clause 7ii71 as needed for administrative purposes1 or to respond to an emergency1 the use of off-highway vehicles in the ,protection ,areas is prohibited4 7ii7 on the date of enactment of this ,act4 7,c7 ,bicycles ,the ,secretary may permit the use of bicycles in the ,protection ,areas only-- 7i7 on roads and trails designated for the use on the date of enactment of this ,act2 7ii7 as needed for administrative purposes2 7iii7 to respond to an emergency2 or 7iv7 if designated by the ,secretary for the use on the potential trails described in paragraph provide for1 and improve the management of1 recreation resources in the ,recreation ,management ,areas for the benefit and enjoyment of present and future generation2 and 7#b7 to conserve1 protect1 and enhance for the benefit and enjoyment of present and future generations the natural1 scenic1 scientific1 cultural1 watershed1 and wildlife resources of the ,recreation ,management ,areas4 7c7 ,management 7#a7 ,in general ,the ,secretary shall manage the ,recreation ,management ,areas in a manner that-- 7,a7 furthers the purposes of the ,recreation ,management ,areas described in subsection 7b72 and 7,b7 is in accordance with-- 7i7 this ,act2 and 7ii7 other applicable laws4 7#b7 ,uses 7,a7 ,in general ,the ,secretary shall only allow uses of the ,recreation ,management ,areas that the ,secretary determines would further the purposes described in subsection 7b74 7,b7 ,vehicle and bicycle use 7i7 ,double top 7,i7 ,in general ,except as provided in subclause 7,,ii71 the use of off-highway vehicles and bicycles in the ,double ,top ,recreation ,management ,area designated by subsection 7a77#a7 shall be permitted only on roads and trails designated for the use on the date of enactment of this ,act4 7,,ii7 ,exceptions 7aa7 ,over-snow vehicles ,except as provided in item 7bb71 the use of over-snow vehicles shall not be permitted in the ,double ,top ,recreation ,management ,area designated by subsection 7a77#a74 7bb7 ,administrative use ,nothing in this section limits the use of off-highway vehicles in the ,double ,top ,recreation ,management ,area designated by subsection 7a77#a7 as necessary for administrative purposes or to respond to an emergency 7including as appropriate for administrative support and emergency response during the ,grand ,traverse skiing event1 as permitted by the ,grand ,mesa1 ,uncompahgre1 and ,gunnison ,national ,forests74 7ii7 ,horse ranch park 7,i7 ,vehicle use 7aa7 ,in general ,except as provided in item 7bb71 the use of off-highway vehicles in the ,horse ,ranch ,park ,recreation ,management ,area designated by subsection 7a77#b7 is prohibited4 7bb7 ,exceptions ,the ,secretary may permit the use of over-snow vehicles in the ,horse ,ranch ,park ,recreation ,management ,area designated by subsection 7a77#b7-- 7,,aa7 only on roads1 trails1 and areas designated for the use on the date of enactment of this ,act2 or 7,,bb7 as needed for administrative purposes or to respond to an emergency4 7,,ii7 ,bicycles ,the ,secretary may permit the use of bicycles in the ,horse ,ranch ,park ,recreation ,management ,area designated by subsection 7a77#b7 only-- 7aa7 on roads1 trails1 and areas designated for the use on the date of enactment of this ,act2 7bb7 as needed for administrative purposes2 7cc7 to respond to an emergency2 or 7dd7 if designated by the ,secretary for the use on the potential trails described in subclause 7,,iii74 7,,iii7 ,limitation ,nothing in this section affects the potential development1 in accordance with applicable law1 of the proposed trail commonly known as the ,crested ,butte to ,paonia ,trail1 the proposed trail commonly known as the ,crested ,butte to ,carbondale ,trail1 or the proposed trail commonly known as the ,dark ,canyon ,loop ,trail1 in the ,horse ,ranch ,park ,recreation ,management ,area designated by subsection 7a77#b74 #g4 ,designation of the ,rocky ,mountain ,scientific ,research and ,education ,area 7a7 ,designation ,subject to valid existing rights1 certain ,federal land managed by the ,forest ,service comprising approximately #ab1bej acres1 as generally depicted as ,rocky ,mountain ,scientific ,research and ,education ,area on the map entitled ,sheet #c3 ,kebler and ,schofield ,pass and dated ,august #bg1 #bjbd1 is designated as the ,rocky ,mountain ,scientific ,research and ,education ,area4 7b7 ,purposes ,the purposes of the ,scientific ,research and ,education ,area are-- 7#a7 to encourage and preserve conditions necessary for ecological1 evolutionary1 geological1 biogeochemical1 climatological1 biological1 meteorological1 and other natural science research and education2 7#b7 to provide opportunities for the use of continually emerging techniques and methodologies in the conduct of the research and education described in paragraph 7#a72 and 7#c7 to conserve1 protect1 and enhance for the benefit and enjoyment of present and future generations the natural1 scenic1 scientific1 cultural1 watershed1 recreation1 and wildlife resources of the ,scientific ,research and ,education ,area4 7c7 ,management 7#a7 ,in general ,the ,secretary shall manage the ,scientific ,research and ,education ,area in a manner that-- 7,a7 furthers the purposes of the ,scientific ,research and ,education ,area described in subsection 7b72 and 7,b7 is in accordance with-- 7i7 this ,act2 and 7ii7 other applicable laws4 7#b7 ,uses 7,a7 ,in general ,the ,secretary shall only allow uses of the ,scientific ,research and ,education ,area that the ,secretary determines would further the purposes described in subsection 7b74 7,b7 ,vehicle use ,except as needed for administrative purposes or to respond to an emergency1 the use of off-highway vehicles in the ,scientific ,research and ,education ,area shall be permitted only on roads designated for the use on the date of enactment of this ,act4 7,c7 ,bicycles ,the use of bicycles in the ,scientific ,research and ,education ,area shall be permitted only-- 7i7 on roads and trails designated for the use by the ,secretary on the date of enactment of this ,act2 or 7ii7 on trails designated for the use by the ,secretary after the date of enactment of this ,act if the ,secretary determines that the use is consistent with the purposes described in paragraphs 7#a7 and ,withdrawal ,subject to valid existing rights1 the ,federal land excluded from the boundary of the ,west ,elk ,wilderness under paragraph 7#a7 is withdrawn from-- 7,a7 entry1 appropriation1 or disposal under the public land laws2 7,b7 location1 entry1 and patent under the mining laws2 and 7,c7 operation of the mineral leasing1 mineral materials1 and geothermal leasing laws4 7e7 ,release ,congress finds that1 for the purposes of subsection 7c7 of section #fjc of the ,federal ,land ,policy and ,management ,act of #aigf 7#dc ,u4,s4,c4 #aghb71 the land within the ,powderhorn ,wilderness ,study ,area not designated as wilderness by this section 7or an amendment made by this section7-- 7#a7 has been adequately studied for wilderness designation2 and 7#b7 is no longer subject to that subsection4 #i4 ,north ,fork ,valley ,watershed 7a7 ,withdrawal 7#a7 ,in general ,subject to valid existing rights1 the ,federal land in ,delta ,county1 ,colorado1 as generally depicted as ,oil and ,gas ,withdrawal on the map entitled ,sheet #f3 ,north ,fork ,valley and dated ,august #bg1 #bjbd1 is withdrawn from operation of the mineral leasing laws with respect to oil and gas4 7#b7 ,effect ,nothing in paragraph 7#a7 prevents the ,secretary of the ,interior from authorizing the use or destruction of methane gas that would leak or be vented into the atmosphere from-- 7,a7 an active or inactive coal mine subject to a ,federal coal lease2 or 7,b7 an abandoned underground coal mine or the site of a former coal mine-- 7i7 that is not subject to a ,federal coal lease2 and 7ii7 with respect to which the ,federal interest in land includes mineral rights to the methane gas4 7b7 ,no surface occupancy restriction ,subject to valid existing rights1 the ,federal land in ,delta ,county1 ,colorado1 as generally depicted as ,oil and ,gas ,no ,surface ,occupancy on the map entitled ,sheet #a3 ,electric ,mountain and dated ,august #bg1 #bjbd1 shall be subject to a no surface occupancy restriction with respect to oil and gas exploration1 development1 production1 and distribution4 7c7 ,gunnison ,river motorized boats and boat ramp use 7#a7 ,in general ,notwithstanding the limitation on transfer in the ,gunnison ,gorge ,national ,conservation ,area ,approved ,resource ,management ,plan dated ,november #bjjd1 the ,secretary of the ,interior1 in accordance with the ,wilderness ,act 7#af ,u4,s4,c4 #aaca et seq47 and subject to paragraph 7#b7 and such terms and conditions as the ,secretary of the ,interior may require1 may transfer the special recreation use permit for the use of motorized boats within the ,gunnison ,gorge ,wilderness ,area1 if the use was established before the date of designation of the ,gunnison ,gorge ,wilderness ,area4 7#b7 ,boat ramp ,the ,secretary of the ,interior may only transfer the special recreation use permit described in paragraph 7#a7 under that paragraph if the ,secretary of the ,interior determines that-- 7,a7 the right of the public to the permanent and reasonable use of the boat ramp for the ,gunnison ,river at the ,gunnison ,forks ,day ,use ,area in ,delta ,county1 ,colorado1 has been acquired by a ,federal agency or a ,state or local government2 and 7,b7 any fees to be charged by the ,federal agency or the ,state or local government for public use of the boat ramp described in subparagraph 7,a7 would be reasonable4 #aj4 ,land to be held in trust for the ,ute ,mountain ,ute ,tribe 7a7 ,trust 7#a7 ,in general ,not later than #a year after the date of enactment of this ,act and subject to valid existing rights1 on request by the ,ute ,mountain ,ute ,tribe 7referred to in this section as the ,tribe71 the ,secretary of the ,interior shall take into trust for the benefit of the ,tribe the approximately #ai1jhj acres of land in the ,county1 owned in fee by the ,tribe1 as generally depicted on the map entitled ,ute ,mountain ,ute ,tribe2 ,pinecrest ,ranch--,fee to ,trust ,legislation and dated ,september #bj1 #bjbd4 7#b7 ,administration ,the land taken into trust by paragraph 7#a7 shall-- 7,a7 be part of the reservation of the ,tribe2 and 7,b7 be administered in accordance with the laws and regulations generally applicable to property held in trust by the ,united ,states for the benefit of an ,indian ,tribe4 7#c7 ,restriction on use for gaming activities ,the land taken into trust by paragraph 7#a7 shall not be eligible for1 or considered to have been taken into trust for1 any gaming activity under any ,federal law1 including the ,indian ,gaming ,regulatory ,act 7#be ,u4,s4,c4 #bgja et seq47 and regulations promulgated by the ,secretary of the ,interior or the ,national ,indian ,gaming ,commission under that ,act4 7b7 ,survey ,not later than #a year after the date of enactment of this ,act1 if any land is taken into trust under subsection 7a71 the ,secretary of the ,interior shall complete a survey to establish the boundaries of the land taken into trust under that subsection4 7c7 ,effect ,nothing in this section shall affect the rights1 title1 interests1 or jurisdiction of the ,county in ,county ,road #be or its right-of-way4 #aa4 ,general provisions 7a7 ,maps and legal descriptions 7#a7 ,in general ,as soon as practicable after the date of enactment of this ,act1 the ,secretary shall file a map and a legal description of the covered areas and wilderness areas with-- 7,a7 the ,committee on ,energy and ,natural ,resources of the ,senate2 and 7,b7 the ,committee on ,natural ,resources of the ,house of ,representatives4 7#b7 ,force of law ,each map and legal description filed under paragraph 7#a7 shall have the same force and effect as if included in this ,act1 except that the ,secretary may correct any typographical errors in the maps and legal descriptions4 7#c7 ,public availability ,each map and legal description filed under paragraph 7#a7 shall be on file and available for public inspection in the appropriate offices of the ,bureau of ,land ,management or the ,forest ,service1 as applicable4 7b7 ,acquisition of land 7#a7 ,in general ,the ,secretary may acquire any land or interest in land within a covered area or wilderness area only through exchange1 donation1 or purchase from a willing seller4 7#b7 ,management ,any land or interest in land acquired under paragraph 7#a7 shall be incorporated in1 and administered as a part of1 the covered area or wilderness area in which the land or interest in land is located4 7c7 ,withdrawal ,subject to valid existing rights1 the covered areas and wilderness areas are withdrawn from-- 7#a7 all forms of entry1 appropriation1 and disposal under the public land laws2 7#b7 location1 entry1 and patent under the mining laws2 and 7#c7 operation of the mineral leasing1 mining materials1 and geothermal leasing laws4 7d7 ,fish and wildlife ,nothing in this ,act affects the jurisdiction or responsibility of the ,state with respect to fish and wildlife in the ,state4 7e7 ,grazing ,the laws 7including regulations7 and policies followed by the ,secretary in issuing and administering grazing permits or leases on land under the jurisdiction of the ,secretary shall continue to apply within a covered area4 7f7 ,wildfire1 insect1 and disease management ,in accordance with this ,act1 the ,secretary may-- 7#a7 carry out any measures that the ,secretary determines to be necessary to manage wildland fire1 and treat hazardous fuels1 insects1 and diseases1 in the covered areas2 and 7#b7 coordinate the measures with the appropriate ,state or local agency1 as the ,secretary determines to be necessary4 7g7 ,vegetation management 7#a7 ,in general ,no project shall be carried out in a covered area for the purpose of harvesting commercial timber4 7#b7 ,ecological restoration ,any vegetation management project carried out in a covered area outside of the wildland-urban interface that includes the harvest or sale of merchantable materials shall-- 7,a7 be collaboratively developed2 7,b7 limit the sale of merchantable materials to small diameter trees or biomass2 and 7,c7 in accordance with the best available science-- 7i7 restore ecological integrity2 7ii7 maximize the retention of old growth and large trees1 as appropriate for the forest type2 and 7iii7 focus on prescribed fire as the primary means to achieve modified wildland fire behavior1 as measured by the projected reduction of uncharacteristically severe wildfire effects for the forest type4 7h7 ,roads and trails 7#a7 ,in general ,except as provided in paragraph 7#b71 no road shall be constructed in a covered area4 7#b7 ,exception ,nothing in paragraph 7#a7 prevents the ,secretary from-- 7,a7 constructing a temporary road in a ,protection ,area1 ,recreation ,management ,area1 or ,special ,management ,area as the ,secretary determines to be necessary as a minimum requirement for carrying out a vegetation management project in accordance with this ,act2 7,b7 responding to an emergency2 or 7,c7 authorizing the transportation of scientific research equipment within the ,scientific ,research and ,education ,area4 7#c7 ,decommissioning of temporary roads ,not later than #c years after the date on which an applicable vegetation management project is completed1 the ,secretary shall decommission any temporary road constructed under paragraph 7#b77;,a7 for the applicable vegetation management project4 7#d7 ,rerouting ,nothing in this ,act prevents the ,secretary from rerouting a trail within a covered area to protect public safety or natural resources from degradation1 as determined to be appropriate by the ,secretary4 7i7 ,water rights ,nothing in this ,act affects the use or allocation of any absolute or conditional water right that is-- 7#a7 decreed under the laws of the ,state2 and 7#b7 in existence on the date of enactment of this ,act4 7j7 ,no buffer zones 7#a7 ,in general ,nothing in this ,act establishes a protective perimeter or buffer zone around a covered area or wilderness area4 7#b7 ,outside activities ,the fact that a non-wilderness activity or use on land outside of a covered area or wilderness area can be seen or heard from an area within a covered area or wilderness area shall not preclude the conduct of the activity or use outside the boundary of the covered area or wilderness area4 7k7 ,seasonal closures ,as appropriate and in accordance with applicable law1 the ,secretary shall develop and implement seasonal closures for off-highway vehicles and bicycles to protect wildlife and wildlife habitat in-- 7#a7 the ,mc,intosh ,mountain ,special ,management ,area designated by section #c7;a77#d72 7#b7 the ,signal ,peak ,special ,management ,area designated by section #c7;a77#g72 7#c7 the ,cabin ,creek ,wildlife ,conservation ,area designated by section #d7;a77#a72 7#d7 the ,flat ,top ,wildlife ,conservation ,area designated by section #d7;a77#b72 7#e7 the ,lake ,gulch and ,cebolla ,creek ,wildlife ,conservation ,area designated by section #d7;a77#c72 and 7#f7 the ,pinnacles ,wildlife ,conservation ,area designated by section #d7;a77#f74 7l7 ,restoration activities 7#a7 ,in general ,as appropriate and in accordance with applicable law1 the ,secretary shall conduct wet meadow and riparian restoration projects to improve climate resiliency and wildlife habitat in-- 7,a7 the ,mc,intosh ,mountain ,special ,management ,area designated by section #c7;a77#d72 7,b7 the ,signal ,peak ,special ,management ,area designated by section #c7;a77#g72 7,c7 the ,flat ,top ,wildlife ,conservation ,area designated by section #d7;a77#b72 7,d7 the ,lake ,gulch and ,cebolla ,creek ,wildlife ,conservation ,area designated by section #d7;a77#c72 7,e7 the ,pinnacles ,wildlife ,conservation ,area designated by section #d7;a77#f72 and 7,f7 the ,sawtooth ,wildlife ,conservation ,area designated by section #d7;a77#h74 7#b7 ,collaboration ,in carrying out the projects described in paragraph 7#a71 the ,secretary shall seek to collaborate with-- 7,a7 the ,colorado ,division of ,parks and ,wildlife2 7,b7 the ,upper ,gunnison ,river ,water ,conservancy ,district2 7,c7 the ,county2 7,d7 in the case of a project located in the ,sawtooth ,wildlife ,conservation ,area designated by section #d7;a77#h71 ,saguache ,county1 ,colorado2 7,e7 the ,united ,states ,fish and ,wildlife ,service2 and 7,f7 other interested entities and individuals4 7m7 ,tribal rights and uses 7#a7 ,treaty rights ,nothing in this ,act affects the treaty rights of any ,indian ,tribe4 7#b7 ,traditional ,tribal uses ,subject to any terms and conditions that the ,secretary determines to be necessary and in accordance with applicable law1 the ,secretary shall allow for the continued use of a covered area or wilderness area by members of ,indian ,tribes-- 7,a7 for traditional ceremonies2 and 7,b7 as a source of traditional plants and other materials4
