read twice and referred to the ,committee on ,indian ,affairs ,a ,,bill ,to amend the ,lumbee ,act of #aief4 #a4 ,short title ,this ,act may be cited as the ,lumbee ,fairness ,act4 #b4 ,federal recognition ,the ,act of ,june #g1 #aief 7#gj ,stat4 #bed1 chapter #cge71 is amended-- 7#a7 by striking section #b2 7#b7 in the first sentence of the first section1 by striking ,that the ,indians and inserting the following3 #c4 ,designation of ,lumbee ,indians ,the ,indians 2 7#c7 in the preamble-- 7,a7 by inserting before the first undesignated clause the following3 #a4 ,findings ,congress finds that-- 2 7,b7 by designating the undesignated clauses as paragraphs 7#a7 through 7#d71 respectively1 and indenting appropriately2 7,c7 by striking ,whereas each place it appears2 7,d7 by striking and after the semicolon at the end of each of paragraphs 7#a7 and 7#b7 7as so designated72 and 7,e7 in paragraph 7#d7 7as so designated71 by striking 3 ,now1 therefore1 and inserting a period2 7#d7 by moving the enacting clause so as to appear before section #a 7as so designated72 7#e7 by striking the last sentence of section #c 7as designated by paragraph 7#b772 7#f7 by inserting before section #c 7as designated by paragraph 7#b77 the following3 #b4 ,definitions ,in this ,act3 7#a7 ,secretary ,the term ,secretary means the ,secretary of the ,interior4 7#b7 ,tribe ,the term ,tribe means the ,lumbee ,tribe of ,north ,carolina or the ,lumbee ,indians of ,north ,carolina4 2 and 7#g7 by adding at the end the following3 #d4 ,federal recognition 7a7 ,in general ,federal recognition is extended to the ,tribe 7as designated as petitioner number #fe by the ,office of ,federal ,acknowledgment74 7b7 ,applicability of laws ,all laws and regulations of the ,united ,states of general application to ,indians and ,indian tribes shall apply to the ,tribe and its members4 7c7 ,petition for acknowledgment ,notwithstanding section #c1 any group of ,indians in ,robeson and adjoining counties1 ,north ,carolina1 whose members are not enrolled in the ,tribe 7as determined under section #e7;d77 may petition under part #hc of title #be of the ,code of ,federal ,regulations for acknowledgment of tribal existence4 #e4 ,eligibility for ,federal services 7a7 ,in general ,the ,tribe and its members shall be eligible for all services and benefits provided by the ,federal ,government to federally recognized ,indian tribes4 7b7 ,service area ,for the purpose of the delivery of ,federal services and benefits described in subsection 7a71 those members of the ,tribe residing in ,robeson1 ,cumberland1 ,hoke1 and ,scotland counties in ,north ,carolina shall be deemed to be residing on or near an ,indian reservation4 7c7 ,determination of needs ,on verification by the ,secretary of a tribal roll under subsection 7d71 the ,secretary and the ,secretary of ,health and ,human ,services shall-- 7#a7 develop1 in consultation with the ,tribe1 a determination of needs to provide the services for which members of the ,tribe are eligible2 and 7#b7 after the tribal roll is verified1 each submit to ,congress a written statement of those needs4 7d7 ,tribal roll 7#a7 ,in general ,for purpose of the delivery of ,federal services and benefits described in subsection 7a71 the tribal roll in effect on the date of enactment of this section shall1 subject to verification by the ,secretary1 define the service population of the ,tribe4 7#b7 ,verification limitation and deadline ,the verification by the ,secretary under paragraph 7#a7 shall-- 7,a7 be limited to confirming documentary proof of compliance with the membership criteria set out in the constitution of the ,tribe adopted on ,november #af1 #bjja2 and 7,b7 be completed not later than #b years after the submission of a digitized roll with supporting documentary proof by the ,tribe to the ,secretary4 #f4 ,authorization to take land into trust 7a7 ,in general ,notwithstanding any other provision of law1 the ,secretary is hereby authorized to take land into trust for the benefit of the ,tribe4 7b7 ,treatment of certain land ,an application to take into trust land located within ,robeson ,county1 ,north ,carolina1 under this section shall be treated by the ,secretary as an on reservation trust acquisition under part #aea of title #be1 ,code of ,federal ,regulations 7or a successor regulation74 #g4 ,jurisdiction of ,state of ,north ,carolina 7a7 ,in general ,with respect to land located within the ,state of ,north ,carolina that is owned by1 or held in trust by the ,united ,states for the benefit of1 the ,tribe1 or any dependent ,indian community of the ,tribe1 the ,state of ,north ,carolina shall exercise jurisdiction over-- 7#a7 all criminal offenses that are committed2 and 7#b7 all civil actions that arise4 7b7 ,transfer of jurisdiction 7#a7 ,in general ,subject to paragraph 7#b71 the ,secretary may accept on behalf of the ,united ,states1 after consulting with the ,attorney ,general of the ,united ,states1 any transfer by the ,state of ,north ,carolina to the ,united ,states of any portion of the jurisdiction of the ,state of ,north ,carolina described in subsection 7a7 over ,indian country occupied by the ,tribe pursuant to an agreement between the ,tribe and the ,state of ,north ,carolina4 7#b7 ,restriction ,a transfer of jurisdiction described in paragraph 7#a7 may not take effect until #b years after the effective date of the agreement described in that paragraph4 7c7 ,effect ,nothing in this section affects the application of section #aji of the ,indian ,child ,welfare ,act of #aigh 7#be ,u4,s4,c4 #aiai74 #h4 ,authorization of appropriations ,there are authorized to be appropriated such sums as are necessary to carry out this ,act4 4
