or preparing to participate in activities to counter the ,islamic ,state of ,iraq and ,syria1 and their affiliated or associated groups3 ,provided further1 ,that amounts made available under this heading shall be available to provide assistance only for activities in a country designated by the ,secretary of ,defense1 in coordination with the ,secretary of ,state1 as having a security mission to counter the ,islamic ,state of ,iraq and ,syria1 and following written notification to the congressional defense committees of such designation3 ,provided further1 ,that the ,secretary of ,defense shall ensure that prior to providing assistance to elements of any forces or individuals1 such elements or individuals are appropriately vetted1 including at a minimum1 assessing such elements for associations with terrorist groups or groups associated with the ,government of ,iran2 and receiving commitments from such elements to promote respect for human rights and the rule of law3 ,provided further1 ,that the ,secretary of ,defense shall1 not fewer than #ae days prior to obligating from this appropriation account1 notify the congressional defense committees in writing of the details of any such obligation3 ,provided further1 ,that the ,secretary of ,defense may accept and retain contributions1 including assistance in-kind1 from foreign governments1 including the ,government of ,iraq and other entities1 to carry out assistance authorized under this heading3 ,provided further1 ,that contributions of funds for the purposes provided herein from any foreign government or other entity may be credited to this ,fund1 to remain available until expended1 and used for such purposes3 ,provided further1 ,that the ,secretary of ,defense shall prioritize such contributions when providing any assistance for construction for facility fortification3 ,provided further1 ,that the ,secretary of ,defense may waive a provision of law relating to the acquisition of items and support services participate in activities to counter the ,islamic ,state of ,iraq and ,syria and returned by such forces or groups to the ,united ,states1 and such equipment may be treated as stocks of the ,department of ,defense upon written notification to the congressional defense committees3 ,provided further1 ,that equipment procured using funds provided under this heading1 or under the heading1 ,iraq ,train and ,equip ,fund in prior ,acts1 and not yet transferred to security forces1 irregular forces1 or groups participating1 or preparing to participate in activities to counter the ,islamic ,state of ,iraq and ,syria may be treated as stocks of the ,department of ,defense when determined by the ,secretary to no longer be required for transfer to such forces or groups and upon written among military personnel appropriations shall not be taken into account for purposes of the limitation on the amount of funds that may be transferred under this section4 #hjjf4 7a7 ,with regard to the list of specific programs1 projects1 and activities 7and the dollar amounts and adjustments to budget activities corresponding to such programs1 projects1 and activities7 contained in the tables titled ,committee ,recommended ,adjustments in the report accompanying this ,act and the tables contained in the classified annex accompanying this ,act1 the obligation and expenditure of amounts appropriated or otherwise made available in this ,act for those programs1 projects1 and activities for which the amounts appropriated exceed the amounts requested are hereby required by law to be carried out in the manner provided by such tables to the same extent as if the tables were included in the text of this ,act4 7b7 ,amounts specified in the referenced tables described in subsection 7a7 shall not be treated as subdivisions of appropriations for purposes of section #hjje of this ,act3 ,provided1 ,that section #hjje of this ,act shall apply when transfers of the amounts described in subsection 7a7 occur between appropriation accounts1 subject to the limitation in subsection 7c73 ,provided further1 ,that the transfer amount limitation provided in section #hjje of this ,act shall not apply to transfers of amounts described in subsection 7a7 if such transfers are necessary for the proper execution of such funds4 7c7 ,during the current fiscal year1 amounts specified in the referenced tables in titles ,,iii and ,,iv of this ,act described in subsection 7a7 may not be transferred pursuant to section #hjje of this ,act other than for proper execution of such amounts1 as provided in subsection 7b74 #hjjg4 7a7 ,not later than #fj days after enactment of this ,act1 the ,department of ,defense shall submit a report to the congressional defense committees to establish the baseline for application of reprogramming and transfer authorities for fiscal year #bjbe3 ,provided1 ,that the report shall include-- 7#a7 a table for each appropriation with a separate column to display the ,president's budget request1 adjustments made by ,congress1 adjustments due to enacted rescissions1 if appropriate1 and the fiscal year enacted level2 7#b7 a delineation in the table for each appropriation both by budget activity and program1 project1 and activity as detailed in the ,budget ,appendix2 and 7#c7 an identification of items of special congressional interest4 7b7 ,notwithstanding section #hjje of this ,act1 none of the funds provided in this ,act shall be available for reprogramming or transfer until the report identified in subsection 7a7 is submitted to the congressional defense committees1 unless the ,secretary of ,defense certifies in writing to the congressional defense committees that such reprogramming or transfer is necessary as an emergency requirement3 ,provided1 ,that this subsection shall not apply to transfers from the following appropriations accounts3 7#a7 ,environmental ,restoration1 ,army2 7#b7 ,environmental ,restoration1 ,navy2 7#c7 ,environmental ,restoration1 ,air ,force2 7#d7 ,environmental ,restoration1 ,defense-,wide2 7#e7 ,environmental ,restoration1 ,formerly ,used ,defense ,sites2 and 7#f7 ,drug ,interdiction and ,counter-,drug ,activities1 ,defense4 7,,transfer ,,of ,,funds7 #hjjh4 ,during the current fiscal year1 cash balances in working capital funds of the ,department of ,defense established pursuant to section #bbjh of title #aj1 ,united ,states ,code1 may be maintained in only such amounts as are necessary at any time for cash disbursements to be made from such funds3 ,provided1 ,that transfers may be made between such funds3 ,provided further1 ,that transfers may be made between working capital funds and the ,foreign ,currency ,fluctuations1 ,defense appropriation and the ,operation and ,maintenance appropriation accounts in such amounts as may be determined by the ,secretary of ,defense1 with the approval of the ,director of the ,office of ,management and ,budget1 except that such transfers may not be made unless the ,secretary of ,defense has notified the ,congress of the proposed transfer3 ,provided further1 ,that except in amounts equal to the amounts appropriated to working capital funds in this ,act1 no obligations may be made against a working capital fund to procure or increase the value of war reserve material inventory1 unless the ,secretary of ,defense has notified the ,congress prior to any such obligation4 #hjji4 ,funds appropriated by this ,act may not be used to initiate a special access program without prior notification #cj calendar days in advance to the congressional defense committees4 #hjaj4 ,none of the funds provided in this ,act shall be available to initiate3 7#a7 a multiyear contract that employs economic order quantity procurement in excess of #bj1jjj1jjj in any one year of the contract or that includes an unfunded contingent liability in excess of #bj1jjj1jjj2 or 7#b7 a contract for advance procurement leading to a multiyear contract that employs economic order quantity procurement in excess of #bj1jjj1jjj in any one year1 unless the congressional defense committees have been notified at least #cj days in advance of the proposed contract award3 ,provided1 ,that no part of any appropriation contained in this ,act shall be available to initiate a multiyear contract for which the economic order quantity advance procurement is not funded at least to the limits of the ,government's liability3 ,provided further1 ,that no part of any appropriation contained in this ,act shall be available to initiate multiyear procurement contracts for any systems or component thereof if the value of the multiyear contract would exceed #ejj1jjj1jjj unless specifically provided in this ,act3 ,provided further1 ,that no multiyear procurement contract can be terminated without #cj-;day prior notification to the congressional defense committees3 ,provided further1 ,that the execution of multiyear authority shall require the use of a present value analysis to determine lowest cost compared to an annual procurement3 ,provided further1 ,that none of the funds provided in this ,act may be used for a multiyear contract executed after the date of the enactment of this ,act unless in the case of any such contract-- 7#a7 the ,secretary of ,defense has submitted to ,congress a budget request for full funding of units to be procured through the contract and1 in the case of a contract for procurement of aircraft1 that includes1 for any aircraft unit to be procured through the contract for which procurement funds are requested in that budget request for production beyond advance procurement activities in the fiscal year covered by the budget1 full funding of procurement of such unit in that fiscal year2 7#b7 cancellation provisions in the contract do not include consideration of recurring manufacturing costs of the contractor associated with the production of unfunded units to be delivered under the contract2 7#c7 the contract provides that payments to the contractor under the contract shall not be made in advance of incurred costs on funded units2 and 7#d7 the contract does not provide for a price adjustment based on a failure to award a follow-on contract4 ,funds appropriated in title ,,iii of this ,act may be used for multiyear procurement contracts of not more than #cej ,t#djh engines and #cg ,,ch-#ec,k heavy lift helicopters4 #hjaa4 ,within the funds appropriated for the operation and maintenance of the ,armed ,forces1 funds are hereby appropriated pursuant to section #dja of title #aj1 ,united ,states ,code1 for humanitarian and civic assistance costs under chapter #bj of title #aj1 ,united ,states ,code3 ,provided1 ,that such funds may also be obligated for humanitarian and civic assistance costs incidental to authorized operations and pursuant to authority granted in section #dja of title #aj1 ,united ,states ,code1 and these obligations shall be reported as required by section #dja7;d7 of title #aj1 ,united ,states ,code3 ,provided further1 ,that funds available for operation and maintenance shall be available for providing humanitarian and similar assistance by using ,civic ,action ,teams in the ,trust ,territories of the ,pacific ,islands and freely associated states of ,micronesia1 pursuant to the ,compact of ,free ,association as authorized by ,public ,law #ii-bci3 ,provided further1 ,that upon a determination by the ,secretary of ,defense that such action is beneficial for graduate medical education programs conducted at ,defense ,health ,agency medical facilities located in ,hawaii1 the ,secretary of ,defense may authorize the provision of medical services at such facilities and transportation to such facilities1 on a nonreimbursable basis1 for civilian patients from ,american ,samoa1 the ,commonwealth of the ,northern ,mariana ,islands1 the ,marshall ,islands1 the ,federated ,states of ,micronesia1 ,palau1 and ,guam4 #hjab4 ,none of the funds appropriated by this or any prior ,department of ,defense ,appropriations ,act may be used to obligate and expend funds made available in accordance with subsection 7c7 of section #cacf of title #aj1 ,united ,states ,code1 except for the purposes described in paragraphs 7d77#a7 through 7d77#d74 #hjac4 ,none of the funds made available by this ,act shall be used in any way1 directly or indirectly1 to influence congressional action on any legislation or appropriation matters pending before the ,congress4 #hjad4 ,none of the funds available in this ,act to the ,department of ,defense1 other than appropriations made for necessary or routine refurbishments1 upgrades1 or maintenance activities1 shall be used to reduce or to prepare to reduce the number of deployed and non-deployed strategic delivery vehicles and launchers below the levels set forth in the report submitted to ,congress in accordance with section #ajdb of the ,national ,defense ,authorization ,act for ,fiscal ,year #bjab4 7,,transfer ,,of ,,funds7 #hjae4 7a7 ,funds appropriated in title ,,iii of this ,act for the ,department of ,defense ,pilot ,mentor-,protg ,program may be transferred to any other appropriation contained in this ,act solely for the purpose of implementing a ,mentor-,protg ,program developmental assistance agreement pursuant to section #dijb of title #aj1 ,united ,states ,code1 under the authority of this provision or any other transfer authority contained in this ,act4 7b7 ,the ,secretary of ,defense shall include with the budget justification documents in support of the budget for fiscal year #bjbf 7as submitted to ,congress pursuant to section #aaje of title #ca1 ,united ,states ,code7 a description of each transfer under this section that occurred during the last fiscal year before the fiscal year in which such budget is submitted4 #hjaf4 ,none of the funds in this ,act may be available for the purchase by the ,department of ,defense 7and its departments and agencies7 of welded shipboard anchor and mooring chain unless the anchor and mooring chain are manufactured in the ,united ,states from components which are substantially manufactured in the ,united ,states3 ,provided1 ,that for the purpose of this section1 the term manufactured shall include cutting1 heat treating1 quality control1 testing of chain and welding 7including the forging and shot blasting process73 ,provided further1 ,that for the purpose of this section substantially all of the components of anchor and mooring chain shall be considered to be produced or manufactured in the ,united ,states if the aggregate cost of the components produced or manufactured in the ,united ,states exceeds the aggregate cost of the components produced or manufactured outside the ,united ,states3 ,provided further1 ,that when adequate domestic supplies are not available to meet ,department of ,defense requirements on a timely basis1 the ,secretary of the ,service responsible for the procurement may waive this restriction on a case-by-case basis by certifying in writing to the ,committees on ,appropriations of the ,house of ,representatives and the ,senate that such an acquisition must be made in order to acquire capability for national security purposes4 #hjag4 ,none of the funds appropriated by this ,act shall be used for the support of any nonappropriated funds activity of the ,department of ,defense that procures malt beverages and wine with nonappropriated funds for resale 7including such alcoholic beverages sold by the drink7 on a military installation located in the ,united ,states unless such malt beverages and wine are procured within that ,state1 or in the case of the ,district of ,columbia1 within the ,district of ,columbia1 in which the military installation is located3 ,provided1 ,that1 in a case in which the military installation is located in more than one ,state1 purchases may be made in any ,state in which the installation is located3 ,provided further1 ,that such local procurement requirements for malt beverages and wine shall apply to all alcoholic beverages only for military installations in ,states which are not contiguous with another ,state3 ,provided further1 ,that alcoholic beverages other than wine and malt beverages1 in contiguous ,states and the ,district of ,columbia shall be procured from the most competitive source1 price and other factors considered4 #hjah4 ,none of the funds available to the ,department of ,defense may be used to demilitarize or dispose of ,m-#a ,carbines1 ,m-#a ,garand rifles1 ,m-#ad rifles1 4#bb caliber rifles1 4#cj caliber rifles1 or ,m-#aiaa pistols1 or to demilitarize or destroy small arms ammunition or ammunition components that are not otherwise prohibited from commercial sale under ,federal law1 unless the small arms ammunition or ammunition components are certified by the ,secretary of the ,army or designee as unserviceable or unsafe for further use4 #hjai4 ,no more than #ejj1jjj of the funds appropriated or made available in this ,act shall be used during a single fiscal year for any single relocation of an organization1 unit1 activity or function of the ,department of ,defense into or within the ,national ,capital ,region3 ,provided1 ,that the ,secretary of ,defense may waive this restriction on a case-by-case basis by certifying in writing to the congressional defense committees that such a relocation is required in the best interest of the ,government4 #hjbj4 ,of the funds made available in this ,act under the heading ,procurement1 ,defense-,wide1 #bd1iej1jjj shall be available only for incentive payments authorized by section #ejd of the ,indian ,financing ,act of #aigd 7#be ,u4,s4,c4 #aedd73 ,provided1 ,that a prime contractor or a subcontractor at any tier that makes a subcontract award to any subcontractor or supplier as defined in section #aedd of title #be1 ,united ,states ,code1 or a small business owned and controlled by an individual or individuals defined under section #dbba7i7 of title #be1 ,united ,states ,code1 shall be considered a contractor for the purposes of being allowed additional compensation under section #ejd of the ,indian ,financing ,act of #aigd 7#be ,u4,s4,c4 #aedd7 whenever the prime contract or subcontract amount is over #ejj1jjj and involves the expenditure of funds appropriated by an ,act making appropriations for the ,department of ,defense with respect to any fiscal year3 ,provided further1 ,that notwithstanding section #aijf of title #da1 ,united ,states ,code1 this section shall be applicable to any ,department of ,defense acquisition of supplies or services1 including any contract and any subcontract at any tier for acquisition of commercial items produced or manufactured1 in whole or in part1 by any subcontractor or supplier defined in section #aedd of title #be1 ,united ,states ,code1 or a small business owned and controlled by an individual or individuals defined under section #dbba7i7 of title #be1 ,united ,states ,code4 #hjba4 7a7 ,notwithstanding any other provision of law1 the ,secretary of the ,air ,force may convey at no cost to the ,air ,force1 without consideration1 to ,indian tribes located in the ,states of ,nevada1 ,idaho1 ,north ,dakota1 ,south ,dakota1 ,montana1 ,oregon1 ,minnesota1 and ,washington relocatable military housing units located at ,grand ,forks ,air ,force ,base1 ,malmstrom ,air ,force ,base1 ,mountain ,home ,air ,force ,base1 ,ellsworth ,air ,force ,base1 and ,minot ,air ,force ,base that are excess to the needs of the ,air ,force4 7b7 ,the ,secretary of the ,air ,force shall convey1 at no cost to the ,air ,force1 military housing units under subsection 7a7 in accordance with the request for such units that are submitted to the ,secretary by the ,operation ,walking ,shield ,program on behalf of ,indian tribes located in the ,states of ,nevada1 ,idaho1 ,north ,dakota1 ,south ,dakota1 ,montana1 ,oregon1 ,minnesota1 and ,washington4 ,any such conveyance shall be subject to the condition that the housing units shall be removed within a reasonable period of time1 as determined by the ,secretary4 7c7 ,the ,operation ,walking ,shield ,program shall resolve any conflicts among requests of ,indian tribes for housing units under subsection 7a7 before submitting requests to the ,secretary of the ,air ,force under subsection 7b74 7d7 ,in this section1 the term ,indian tribe means any recognized ,indian tribe included on the current list published by the ,secretary of the be used for any national or international political or psychological activities4 #hjbd4 ,of the amounts appropriated for ,working ,capital ,fund1 ,army1 #abj1jjj1jjj shall be available to maintain competitive rates at the arsenals4 #hjbe4 7a7 ,of the funds made available in this ,act1 not less than #gc1ejj1jjj shall be available for the ,civil ,air ,patrol ,corporation1 of which-- 7#a7 #ef1ejj1jjj shall be available from ,operation and ,maintenance1 ,air ,force to support ,civil ,air ,patrol ,corporation operation and maintenance1 readiness1 counter-drug activities1 and drug demand reduction activities involving youth programs2 7#b7 #ae1jjj1jjj shall be available from ,aircraft ,procurement1 ,air ,force2 and 7#c7 #b1jjj1jjj shall be available from ,other ,procurement1 ,air ,force for vehicle procurement4 7b7 ,the ,secretary of the ,air ,force should waive reimbursement for any funds used by the ,civil ,air ,patrol for counter-drug activities in support of ,federal1 ,state1 and local government agencies4 #hjbf4 7a7 ,none of the funds appropriated in this ,act are available to establish a new ,department of ,defense 7department7 federally funded research and development center 7,,ffrdc71 either as a new entity1 or as a separate entity administrated by an organization managing another ,,ffrdc1 or as a nonprofit membership corporation consisting of a consortium of other ,f,f,r,d,cs and other nonprofit entities4 7b7 ,except when acting in a technical advisory capacity1 no member of a ,board of ,directors1 ,trustees1 ,overseers1 ,advisory ,group1 ,special ,issues ,panel1 ,visiting ,committee1 or any similar entity of a defense ,,ffrdc1 or any entity that contracts with the ,federal government to manage or operate one or more ,f,f,r,d,cs1 or any paid consultant to a defense ,,ffrdc shall receive funds appropriated by this ,act as compensation for services as a member of such entity3 ,provided1 ,that a member of any such entity shall be allowed travel expenses and per diem as authorized under the ,federal ,joint ,travel ,regulations1 when engaged in the performance of membership duties3 ,provided further1 ,that except when acting in a technical advisory capacity1 no paid consultant shall receive funds appropriated by this ,act as compensation by more than one ,,ffrdc in a calendar year4 7c7 ,notwithstanding any other provision of law1 none of the funds available to the department from any source during the current fiscal year may be used by a defense ,,ffrdc1 through a fee or other payment mechanism1 for construction of new buildings not located on a military installation1 for payment of cost sharing for projects funded by ,government grants1 for absorption of contract overruns1 or for certain charitable contributions1 not to include employee participation in community service and_/or development4 7d7 ,notwithstanding any other provision of law1 of the funds available to the department during fiscal year #bjbe1 not more than #b1hhf1cjj1jjj may be funded for professional technical staff-related costs of the defense ,f,f,r,d,cs3 ,provided1 ,that within such funds1 not more than #dfa1cjj1jjj shall be available for the defense studies and analysis ,f,f,r,d,cs3 ,provided further1 ,that this subsection shall not apply to staff years funded in the ,national ,intelligence ,program and the ,military ,intelligence ,program3 ,provided further1 ,that the ,secretary of ,defense shall1 with the submission of the department's fiscal year #bjbf budget request1 submit a report presenting the specific amounts of staff years of technical effort to be allocated for each defense ,,ffrdc by program during that fiscal year and the associated budget estimates1 by appropriation account and program4 #hjbg4 ,for the purposes of this ,act1 the term congressional defense committees means the ,armed ,services ,committee of the ,house of ,representatives1 the ,armed ,services ,committee of the ,senate1 the ,subcommittee on ,defense of the ,committee on ,appropriations of the ,house of ,representatives1 and the ,subcommittee on ,defense of the ,committee on ,appropriations of the ,senate4 #hjbh4 ,for the purposes of this ,act1 the term congressional intelligence committees means the ,permanent ,select ,committee on ,intelligence of the ,house of ,representatives1 the ,select ,committee on ,intelligence of the ,senate1 the ,subcommittee on ,defense of the ,committee on ,appropriations of the ,house of ,representatives1 and the ,subcommittee on ,defense of the ,committee on ,appropriations of the ,senate4 #hjbi4 ,during the current fiscal year1 the ,department of ,defense may acquire the modification1 depot maintenance and repair of aircraft1 vehicles and vessels as well as the production of components and other ,defense-related articles1 through competition between ,department of ,defense depot maintenance activities and private firms3 ,provided1 ,that the ,senior ,acquisition ,executive of the military department or ,defense ,agency concerned1 with power of delegation1 shall certify that successful bids include comparable estimates of all direct and indirect costs for both public and private bids3 ,provided further1 ,that ,office of ,management and ,budget ,circular ,a-#gf shall not apply to competitions conducted under this section4 #hjcj4 7a7 ,none of the funds appropriated in this ,act may be expended by an entity of the ,department of ,defense unless the entity1 in expending the funds1 complies with the ,buy ,american ,act4 ,for purposes of this subsection1 the term ,buy ,american ,act means chapter #hc of title #da1 ,united ,states ,code4 7b7 ,if the ,secretary of ,defense determines that a person has been convicted of intentionally affixing a label bearing a ,made in ,america inscription to any product sold in or shipped to the ,united ,states that is not made in ,america1 the ,secretary shall determine1 in accordance with section #dfeh of title #aj1 ,united ,states ,code1 whether the person should be debarred from contracting with the ,department of ,defense4 7c7 ,in the case of any equipment or products purchased with appropriations provided under this ,act1 it is the sense of the ,congress that any entity of the ,department of ,defense1 in expending the appropriation1 purchase only ,american-made equipment and products1 provided that ,american-made equipment and products are cost-competitive1 quality competitive1 and available in a timely fashion4 #hjca4 ,none of the funds appropriated or made available in this ,act shall be used to procure carbon1 alloy1 or armor steel plate for use in any ,government-owned facility or property under the control of the ,department of ,defense which were not melted and rolled in the ,united ,states or ,canada3 ,provided1 ,that these procurement restrictions shall apply to any and all ,federal ,supply ,class #ieae1 ,american ,society of ,testing and ,materials 7,,astm7 or ,american ,iron and ,steel ,institute 7,,aisi7 specifications of carbon1 alloy or armor steel plate3 ,provided further1 ,that the ,secretary of the military department responsible for the procurement may waive this restriction on a case-by-case basis by certifying in writing to the ,committees on ,appropriations of the ,house of ,representatives and the ,senate that adequate domestic supplies are not available to meet ,department of ,defense requirements on a timely basis and that such an acquisition must be made in order to acquire capability for national security purposes3 ,provided further1 ,that these restrictions shall not apply to contracts which are in being as of the date of the enactment of this ,act4 #hjcb4 7a7 7#a7 ,if the ,secretary of ,defense1 after consultation with the ,united ,states ,trade ,representative1 determines that a foreign country which is party to an agreement described in paragraph 7#b7 has violated the terms of the agreement by discriminating against certain types of products produced in the ,united ,states that are covered by the agreement1 the ,secretary of ,defense shall rescind the ,secretary's blanket waiver of the ,buy ,american ,act with respect to such types of products produced in that foreign country4 7#b7 ,an agreement referred to in paragraph 7#a7 is any reciprocal defense procurement memorandum of understanding1 between the ,united ,states and a foreign country pursuant to which the ,secretary of ,defense has prospectively waived the ,buy ,american ,act for certain products in that country4 7b7 ,the ,secretary of ,defense shall submit to the ,congress a report on the amount of ,department of ,defense purchases from foreign entities in fiscal year #bjbe4 ,such report shall separately indicate the dollar value of items for which the ,buy ,american ,act was waived pursuant to any agreement described in subsection 7a77#b71 the ,trade ,agreements ,act of #aigi 7#ai ,u4,s4,c4 #beja et seq471 or any international agreement to which the ,united ,states is a party4 7c7 ,for purposes of this section1 the term ,buy ,american ,act means chapter #hc of title #da1 ,united ,states ,code4 #hjcc4 ,none of the funds appropriated by this ,act may be used for the procurement of ball and roller bearings other than those produced by a domestic source and of domestic origin3 ,provided1 ,that the ,secretary of the military department responsible for such procurement may waive this restriction on a case-by-case basis by certifying in writing to the ,committees on ,appropriations of the ,house of ,representatives and the ,senate1 that adequate domestic supplies are not available to meet ,department of ,defense requirements on a timely basis and that such an acquisition must be made in order to acquire capability for national security purposes3 ,provided further1 ,that this restriction shall not apply to the purchase of commercial products1 as defined by section #ajc of title #da1 ,united ,states ,code1 except that the restriction shall apply to ball or roller bearings purchased as end items4 #hjcd4 ,in addition to any other funds made available for such purposes1 there is appropriated #fjj1jjj1jjj1 for an additional amount for the ,national ,defense ,stockpile ,transaction ,fund1 to remain available until ,september #cj1 #bjbg1 for activities pursuant to the ,strategic and ,critical ,materials ,stock ,piling ,act 7#ej ,u4,s4,c4 #ih et seq473 ,provided1 ,that none of the funds provided under this section may be obligated or expended until #cj days after the ,secretary of ,defense provides the ,committees on ,appropriations of the ,house of ,representatives and the ,senate a detailed execution plan for such funds3 ,provided further1 ,that of the amounts made available under this heading1 #ejj1jjj1jjj is designated by the ,congress as being for an emergency requirement pursuant to section #bea7;b77#b77;,a77i7 of the ,balanced ,budget and ,emergency ,deficit ,control ,act of #aihe4 #hjce4 ,none of the funds in this ,act may be used to purchase any supercomputer which is not manufactured in the ,united ,states1 unless the ,secretary of ,defense certifies to the congressional defense committees that such an acquisition must be made in order to acquire capability for national security purposes that is not available from ,united ,states manufacturers4 #hjcf4 7a7 ,the ,secretary of ,defense may1 on a case-by-case basis1 waive with respect to a foreign country each limitation on the procurement of defense items from foreign sources provided in law if the ,secretary determines that the application of the limitation with respect to that country would invalidate cooperative programs entered into between the ,department of ,defense and the foreign country1 or would invalidate reciprocal trade agreements for the procurement of defense items entered into under section #dhea of title #aj1 ,united ,states ,code1 and the country does not discriminate against the same or similar defense items produced in the ,united ,states for that country4 7b7 ,subsection 7a7 applies with respect to-- 7#a7 contracts and subcontracts entered into on or after the date of the enactment of this ,act2 and 7#b7 options for the procurement of items that are exercised after such date under contracts that are entered into before such date if the option prices are adjusted for any reason other than the application of a waiver granted under subsection 7a74 7c7 ,subsection 7a7 does not apply to a limitation regarding construction of public vessels1 ball and roller bearings1 food1 and clothing or textile materials as defined by section ,,xi 7chapters #ej-fe7 of the ,harmonized ,tariff ,schedule of the ,united ,states and products classified under headings #djaj1 #dbjb1 #dbjc1 #fdja through #fdjf1 #feje1 #gjai1 #gbah through #gbbi1 #gcjd4da through #gcjd4di1 #gcjf4dj1 #gejb through #gejh1 #haje1 #hajh1 #haji1 #hbaa1 #hbae1 and #idjd4 #hjcg4 ,none of the funds made available in this ,act1 or any subsequent ,act making appropriations for the ,department of ,defense1 may be used for the purchase or manufacture of a flag of the ,united ,states unless such flags are treated as covered items under section #dhfb7;b7 of title #aj1 ,united ,states ,code4 #hjch4 ,during the current fiscal year1 amounts contained in the ,department of ,defense ,overseas ,military ,facility ,investment ,recovery ,account shall be available until expended for the payments specified by section #bfhg;a7b77#b7 of title #aj1 ,united ,states ,code4 #hjci4 ,during the current fiscal year1 appropriations which are available to the ,department of ,defense for operation and maintenance may be used to purchase items having an investment item unit cost of not more than #cej1jjj3 ,provided1 ,that upon determination by the ,secretary of ,defense that such action is necessary to meet the operational requirements of a ,commander of a ,combatant ,command engaged in a named contingency operation overseas1 such funds may be used to purchase items having an investment item unit cost of not more than #ejj1jjj4 #hjdj4 ,up to #h1acb1jjj of the funds appropriated under the heading ,operation and ,maintenance1 ,navy may be made available for the ,asia ,pacific ,regional ,initiative ,program for the purpose of enabling the ,united ,states ,indo-,pacific ,command to execute ,theater ,security ,cooperation activities such as humanitarian assistance1 and payment of incremental and personnel costs of training and exercising with foreign security forces3 ,provided1 ,that funds made available for this purpose may be used1 notwithstanding any other funding authorities for humanitarian assistance1 security assistance or combined exercise expenses3 ,provided further1 ,that funds may not be obligated to provide assistance to any foreign country that is otherwise prohibited from receiving such type of assistance under any other provision of law4 #hjda4 ,the ,secretary of ,defense shall issue regulations to prohibit the sale of any tobacco or tobacco-related products in military resale outlets in the ,united ,states1 its territories and possessions at a price below the most competitive price in the local community3 ,provided1 ,that such regulations shall direct that the prices of tobacco or tobacco-related products in overseas military retail outlets shall be within the range of prices established for military retail system stores located in the ,united ,states4 #hjdb4 7a7 ,during the current fiscal year1 none of the appropriations or funds available to the ,department of ,defense ,working ,capital ,funds shall be used for the purchase of an investment item for the purpose of acquiring a new inventory item for sale or anticipated sale during the current fiscal year or a subsequent fiscal year to customers of the ,department of ,defense ,working ,capital ,funds if such an item would not have been chargeable to the ,department of ,defense ,business ,operations ,fund during fiscal year #aiid and if the purchase of such an investment item would be chargeable during the current fiscal year to appropriations made to the ,department of ,defense for procurement4 7b7 ,the fiscal year #bjbf budget request for the ,department of ,defense as well as all justification material and other documentation supporting the fiscal year #bjbf ,department of ,defense budget shall be prepared and submitted to the ,congress on the basis that any equipment which was classified as an end item and funded in a procurement appropriation contained in this ,act shall be budgeted for in a proposed fiscal year #bjbf procurement appropriation and not in the supply management business area or any other area or category of the ,department of ,defense ,working ,capital ,funds4 #hjdc4 ,none of the funds appropriated by this ,act for programs of the ,central ,intelligence ,agency shall remain available for obligation beyond the current fiscal year1 except for funds appropriated for the ,reserve for ,contingencies1 which shall remain available until ,september #cj1 #bjbf3 ,provided1 ,that funds appropriated1 transferred1 or otherwise credited to the ,central ,intelligence ,agency ,central ,services ,working ,capital ,fund during this or any prior or subsequent fiscal year shall remain available until expended3 ,provided further1 ,that any funds appropriated or transferred to the ,central ,intelligence ,agency for advanced research and development acquisition1 for agent operations1 and for covert action programs authorized by the ,president under section #ejc of the ,national ,security ,act of #aidg 7#ej ,u4,s4,c4 #cjic7 shall remain available until ,september #cj1 #bjbf3 ,provided further1 ,that any funds appropriated or transferred to the ,central ,intelligence ,agency for the construction1 improvement1 or alteration of facilities1 including leased facilities1 to be used primarily by personnel of the intelligence community1 shall remain available until ,september #cj1 #bjbg4 #hjdd4 7a7 ,none of the funds appropriated by this ,act shall be available to convert to contractor performance an activity or function of the ,department of ,defense that1 on or after the date of the enactment of this ,act1 is performed by ,department of ,defense civilian employees unless-- 7#a7 the conversion is based on the result of a public-private competition that includes a most efficient and cost effective organization plan developed by such activity or function2 7#b7 the ,competitive ,sourcing ,official determines that1 over all performance periods stated in the solicitation of offers for performance of the activity or function1 the cost of performance of the activity or function by a contractor would be less costly to the ,department of ,defense by an amount that equals or exceeds the lesser of-- 7,a7 #aj percent of the most efficient organization's personnel-related costs for performance of that activity or function by ,federal employees2 or 7,b7 #aj1jjj1jjj2 and 7#c7 the contractor does not receive an advantage for a proposal that would reduce costs for the ,department of ,defense by-- 7,a7 not making an employer-sponsored health insurance plan available to the workers who are to be employed in the performance of that activity or function under the contract2 or 7,b7 offering to such workers an employer-sponsored health benefits plan that requires the employer to contribute less towards the premium or subscription share than the amount that is paid by the ,department of ,defense for health benefits for civilian employees under chapter #hi of title #e1 ,united ,states ,code4 7b7 7#a7 ,the ,department of ,defense1 without regard to subsection 7a7 of this section or subsection 7a71 7b71 or 7c7 of section #bdfa of title #aj1 ,united ,states ,code1 and notwithstanding any administrative regulation1 requirement1 or policy to the contrary shall have full authority to enter into a contract for the performance of any commercial or industrial type function of the ,department of ,defense that-- 7,a7 is included on the procurement list established pursuant to section #b of the ,javits-,wagner-,o',day ,act 7section #hejc of title #da1 ,united ,states ,code72 7,b7 is planned to be converted to performance by a qualified nonprofit agency for the blind or by a qualified nonprofit agency for other severely handicapped individuals in accordance with that ,act2 or 7,c7 is planned to be converted to performance by a qualified firm under at least #ea percent ownership by an ,indian tribe1 as defined in section #d7;e7 of the ,indian ,self-,determination and ,education ,assistance ,act 7#be ,u4,s4,c4 #dej;b7e771 or a ,native ,hawaiian ,organization1 as defined in section #h7;a77#ae7 of the ,small ,business ,act 7#ae ,u4,s4,c4 #fcg7;a77#ae774 7#b7 ,this section shall not apply to depot contracts or contracts for depot maintenance as provided in sections #bdfi and #bdgd of title #aj1 ,united ,states ,code4 7c7 ,the conversion of any activity or function of the ,department of ,defense under the authority provided by this section shall be credited toward any competitive or outsourcing goal1 target1 or measurement that may be established by statute1 regulation1 or policy and is deemed to be awarded under the authority of1 and in compliance with1 subsection 7h7 of section #bcjd of title #aj1 ,united ,states ,code1 for the competition or outsourcing of commercial activities4 7,,rescissions7 #hjde4 ,of the funds appropriated in ,department of ,defense ,appropriations ,acts1 the following funds are hereby rescinded from the following accounts and programs in the specified amounts3 ,provided1 ,that no amounts may be rescinded from amounts that were designated by the ,congress as an emergency requirement pursuant to a concurrent resolution on the budget or the ,balanced ,budget and ,emergency ,deficit ,control ,act of #aihe3 ,afghanistan ,security ,forces ,fund1 #bjbb_/bjbe1 #hj1jjj1jjj2 ,aircraft ,procurement1 ,army1 #bjbc_/bjbe1 #be1jjj1jjj2 ,aircraft ,procurement1 ,navy1 #bjbc_/bjbe1 #c1gjj1jjj2 ,other ,procurement1 ,navy1 #bjbc_/bjbe1 #ej1jjj1jjj2 ,aircraft ,procurement1 ,air ,force1 #bjbc_/bjbe1 #aae1bjd1jjj2 ,procurement of ,ammunition1 ,air ,force1 #bjbc_/bjbe1 #bc1jjj1jjj2 ,aircraft authorized positions for military technicians 7dual status7 of the ,army ,national ,guard1 ,air ,national ,guard1 ,army ,reserve and ,air ,force ,reserve for the purpose of applying any administratively imposed civilian personnel ceiling1 freeze1 or reduction on military technicians 7dual status71 unless such reductions are a direct result of a reduction in military force structure4 #hjdg4 ,none of the funds appropriated or otherwise made available in this ,act may be obligated or expended for assistance to the ,democratic ,people's ,republic of ,korea unless specifically appropriated for that purpose3 ,provided1 ,that this restriction shall not apply to any activities incidental to the ,defense ,,pow_/,,mia ,accounting ,agency mission to recover and identify the remains of ,united ,states ,armed ,forces personnel from the ,democratic ,people's ,republic of ,korea4 #hjdh4 7a7 ,none of the funds available to the ,department of ,defense for any fiscal year for drug interdiction or counter-drug activities may be transferred to any other department or agency of the ,united ,states except as specifically provided in an appropriations law4 7b7 ,none of the funds available to the ,central ,intelligence ,agency for any fiscal year for drug interdiction or counter-drug activities may be transferred to any other department or agency of the ,united ,states except as specifically provided in an appropriations law4 #hjdi4 ,in addition to the amounts appropriated or otherwise made available elsewhere in this ,act1 #bd1jjj1jjj is hereby appropriated to the ,department of ,defense3 ,provided1 ,that upon the determination of the ,secretary of ,defense that it shall serve the national interest1 the ,secretary shall make grants in the amounts specified as follows3 #bd1jjj1jjj to the ,united ,service ,organizations4 #hjej4 ,notwithstanding any other provision in this ,act1 the ,small ,business ,innovation ,research program and the ,small ,business ,technology ,transfer program set-asides shall be taken proportionally from all programs1 projects1 or activities to the extent they contribute to the extramural budget4 ,the ,secretary of each military department1 the ,director of each ,defense ,agency1 and the head of each other relevant component of the ,department of ,defense shall submit to the congressional defense committees1 concurrent with submission of the budget justification documents to ,congress pursuant to section #aaje of title #ca1 ,united ,states ,code1 a report with a detailed accounting of the ,small ,business ,innovation ,research program and the ,small ,business ,technology ,transfer program set-asides taken from programs1 projects1 or activities within such department1 agency1 or component during the most recently completed fiscal year4 #hjea4 ,none of the funds available to the ,department of ,defense under this ,act shall be obligated or expended to pay a contractor under a contract with the ,department of ,defense for costs of any amount paid by the contractor to an employee when-- 7#a7 such costs are for a bonus or otherwise in excess of the normal salary paid by the contractor to the employee2 and 7#b7 such bonus is part of restructuring costs associated with a business combination4 7,,including ,,transfer ,,of ,,funds7 #hjeb4 ,during the current fiscal year1 no more than #cj1jjj1jjj of appropriations made in this ,act under the heading ,operation and ,maintenance1 ,defense-,wide may be transferred to appropriations available for the pay of military personnel1 to be merged with1 and to be available for the same time period as the appropriations to which transferred1 to be used in support of such personnel in connection with support and services for eligible organizations and activities outside the ,department of ,defense pursuant to section #bjab of title #aj1 ,united ,states ,code4 #hjec4 7a7 ,notwithstanding any other provision of law1 the ,chief of the ,national ,guard ,bureau may permit the use of equipment of the ,national ,guard ,distance ,learning ,project by any person or entity on a space-available1 reimbursable basis4 ,the ,chief of the ,national ,guard ,bureau shall establish the amount of reimbursement for such use on a case-by-case basis4 7b7 ,amounts collected under subsection 7a7 shall be credited to funds available for the ,national ,guard ,distance ,learning ,project and be available to defray the costs associated with the use of equipment of the project under that subsection4 ,such funds shall be available for such purposes without fiscal year limitation4 #hjed4 7a7 ,none of the funds appropriated or otherwise made available by this or prior ,acts may be obligated or expended to retire1 prepare to retire1 or place in storage or on backup aircraft inventory status any ,c-#dj aircraft4 7b7 ,the limitation under subsection 7a7 shall not apply to an individual ,c-#dj aircraft that the ,secretary of the ,air ,force determines1 on a case-by-case basis1 to be no longer mission capable due to a ,class ,a mishap4 7c7 ,if the ,secretary determines under subsection 7b7 that an aircraft is no longer mission capable1 the ,secretary shall submit to the congressional defense committees a certification in writing that the status of such aircraft is due to a ,class ,a mishap and not due to lack of maintenance1 repairs1 or other reasons4 #hjee4 7a7 ,none of the funds appropriated in title ,,iv of this ,act may be used to procure end-items for delivery to military forces for operational training1 operational use1 or inventory requirements3 ,provided1 ,that this restriction does not apply to end-items used in development1 prototyping in accordance with an approved test strategy1 and test activities preceding and leading to acceptance for operational use4 7b7 ,if the number of end-items budgeted with funds appropriated in title ,,iv of this ,act exceeds the number required in an approved test strategy1 the ,under ,secretary of ,defense 7,research and ,engineering7 and the ,under ,secretary of ,defense 7,acquisition and ,sustainment71 in coordination with the responsible ,service ,acquisition ,executive1 shall certify in writing to the congressional defense committees that there is a bonafide need for the additional end-items at the time of submittal to ,congress of the budget of the ,president for fiscal year #bjbf pursuant to section #aaje of title #ca1 ,united ,states ,code3 ,provided1 ,that this restriction does not apply to programs funded within the ,national ,intelligence ,program4 7c7 ,the ,secretary of ,defense shall1 at the time of the submittal to ,congress of the budget of the ,president for fiscal year #bjbf pursuant to section #aaje of title #ca1 ,united ,states ,code1 submit to the congressional defense committees a report detailing the use of funds requested in research1 development1 test and evaluation accounts for end-items used in development1 prototyping and test activities preceding and leading to acceptance for operational use3 ,provided1 ,that the report shall set forth1 for each end item covered by the preceding proviso1 a detailed list of the statutory authorities under which amounts in the accounts described in that proviso were used for such item3 ,provided further1 ,that the ,secretary of ,defense shall1 at the time of the submittal to ,congress of the budget of the ,president for fiscal year #bjbf pursuant to section #aaje of title #ca1 ,united ,states ,code1 submit to the congressional defense committees a certification that funds requested for fiscal year #bjbf in research1 development1 test and evaluation accounts are in compliance with this section3 ,provided further1 ,that the ,secretary of ,defense may waive this restriction on a case-by-case basis by certifying in writing to the ,subcommittees on ,defense of the ,committees on ,appropriations of the ,house of ,representatives and the ,senate that it is in the national security interest to do so4 #hjef4 ,none of the funds appropriated or otherwise made available by this or other ,department of ,defense ,appropriations ,acts may be obligated or expended for the purpose of performing repairs or maintenance to military family housing units of the ,department of ,defense1 including areas in such military family housing units that may be used for the purpose of conducting official ,department of ,defense business4 #hjeg4 ,notwithstanding any other provision of law1 funds appropriated in this ,act under the heading ,research1 ,development1 ,test and ,evaluation1 ,defense-,wide for any new start ,defense ,innovation ,acceleration 7,,pe #jfjchch;,d#h,z7 or ,rapid ,prototyping ,program 7,,pe #jfjdcca;,d#h,z7 demonstration project with a value of more than #e1jjj1jjj may only be obligated #ae days after a report1 including a description of the project1 the planned acquisition and transition strategy and its estimated annual and total cost1 has been provided in writing to the congressional defense committees3 ,provided1 ,that the ,secretary of ,defense may waive this restriction on a case-by-case basis by certifying to the congressional defense committees that it is in the national interest to do so4 #hjeh4 ,the ,secretary of ,defense shall continue to provide a classified quarterly report to the ,committees on ,appropriations of the ,house of ,representatives and the ,senate1 ,subcommittees on ,defense on certain matters as directed in the classified annex accompanying this ,act4 #hjei4 ,notwithstanding section #abcaj7;b7 of title #aj1 ,united ,states ,code1 a servicemember who is a member of the ,national ,guard serving on full-time ,national ,guard duty under section #ejb7;f7 of title #cb1 ,united ,states ,code1 may perform duties in support of the ground-based elements of the ,national ,ballistic ,missile ,defense ,system4 #hjfj4 ,none of the funds provided in this ,act may be used to transfer to any nongovernmental entity ammunition held by the ,department of ,defense that has a center-fire cartridge and a ,united ,states military nomenclature designation of armor penetrator1 armor piercing 7,,ap71 armor piercing incendiary 7,,api71 armor-piercing incendiary tracer 7,,api-,t71 general purpose 7,,gp71 special purpose 7,,sp7 except #imm1 or enhanced performance round 7,,epr71 except to an entity performing demilitarization services for the ,department of ,defense under a contract that requires the entity to demonstrate to the satisfaction of the ,department of ,defense that the above listed projectiles are either3 7#a7 rendered incapable of reuse by the demilitarization process2 or 7#b7 used to manufacture ammunition pursuant to a contract with the ,department of ,defense or the manufacture of ammunition for export pursuant to a ,license for ,permanent ,export of ,unclassified ,military ,articles issued by the ,department of ,state4 #hjfa4 ,notwithstanding any other provision of law1 the ,chief of the ,national ,guard ,bureau1 or their designee1 may waive payment of all or part of the consideration that otherwise would be required under section #bffg of title #aj1 ,united ,states ,code1 in the case of a lease of personal property for a period not in excess of #a year to any organization specified in section #ejh7;d7 of title #cb1 ,united ,states ,code1 or any other youth1 social1 or fraternal nonprofit organization as may be approved by the ,chief of the ,national ,guard ,bureau1 or their designee1 on a case-by-case basis4 7,,including ,,transfer ,,of ,,funds7 #hjfb4 ,of the amounts appropriated in this ,act under the heading ,operation and ,maintenance1 ,army1 #aid1deb1eih shall remain available until expended3 ,provided1 ,that1 notwithstanding any other provision of law1 the ,secretary of ,defense is authorized to transfer such funds to other activities of the ,federal ,government3 ,provided further1 ,that the ,secretary of ,defense is authorized to enter into and carry out contracts for the acquisition of real property1 construction1 personal services1 and operations related to projects carrying out the purposes of this section3 ,provided further1 ,that contracts entered into under the authority of this section may provide for such indemnification as the ,secretary determines to be necessary3 ,provided further1 ,that projects authorized by this section shall comply with applicable ,federal1 ,state1 and local law to the maximum extent consistent with the national security1 as determined by the ,secretary of ,defense4 #hjfc4 7a7 ,none of the funds appropriated in this or any other ,act may be used to take any action to modify-- 7#a7 the appropriations account structure for the ,national ,intelligence ,program budget1 including through the creation of a new appropriation or new appropriation account2 7#b7 how the ,national ,intelligence ,program budget request is presented in the unclassified ,p-#a1 ,r-#a1 and ,o-#a documents supporting the ,department of ,defense budget request2 7#c7 the process by which the ,national ,intelligence ,program appropriations are apportioned to the executing agencies2 or 7#d7 the process by which the ,national ,intelligence ,program appropriations are allotted1 obligated and disbursed4 7b7 ,nothing in subsection 7a7 shall be construed to prohibit the merger of programs or changes to the ,national ,intelligence ,program budget at or below the ,expenditure ,center level1 provided such change is otherwise in accordance with paragraphs 7#a7-7c7 of subsection 7a74 7c7 ,the ,director of ,national ,intelligence and the ,secretary of ,defense may jointly1 only for the purposes of achieving auditable financial statements and improving fiscal reporting1 study and develop detailed proposals for alternative financial management processes4 ,such study shall include a comprehensive counterintelligence risk assessment to ensure that none of the alternative processes will adversely affect counterintelligence4 7d7 ,upon development of the detailed proposals defined under subsection 7c71 the ,director of ,national ,intelligence and the ,secretary of ,defense shall-- 7#a7 provide the proposed alternatives to all affected agencies2 7#b7 receive certification from all affected agencies attesting that the proposed alternatives will help achieve auditability1 improve fiscal reporting1 and will not adversely affect counterintelligence2 and 7#c7 not later than #cj days after receiving all necessary certifications under paragraph 7#b71 present the proposed alternatives and certifications to the congressional defense and intelligence committees4 7,,including ,,transfer ,,of ,,funds7 #hjfd4 ,in addition to amounts made available elsewhere in this ,act1 #djj1jjj1jjj is hereby appropriated to the ,department of ,defense and made available for transfer to operation and maintenance accounts1 procurement accounts1 and research1 development1 test and evaluation accounts only for those efforts by the ,commander1 ,united ,states ,africa ,command or ,commander1 ,united ,states ,southern ,command to expand cooperation1 share operational information1 advance interoperability1 or improve the capabilities of our allies and partners in their areas of operation3 ,provided1 ,that none of the funds provided under this section may be obligated or expended until #cj days after the ,secretary of ,defense provides to the congressional defense committees an execution plan3 ,provided further1 ,that not less than #ae days prior to any transfer of funds1 the ,secretary of ,defense shall notify the congressional defense committees of the details of any such transfer3 ,provided further1 ,that upon transfer1 the funds shall be merged with and available for the same purposes1 and for the same time period1 as the appropriation to which transferred3 ,provided further1 ,that the transfer authority provided under this section is in addition to any other transfer authority provided elsewhere in this ,act4 7,,including ,,transfer ,,of ,,funds7 #hjfe4 ,during ,u4,s4,c4 #aaje74 #hjfg4 ,none of the funds available to the ,department of ,defense may be obligated to modify command and control relationships to give ,fleet ,forces ,command operational and administrative control of ,united ,states ,navy forces assigned to the ,pacific fleet3 ,provided1 ,that the command and control relationships which existed on ,october #a1 #bjjd1 shall remain in force until a written modification has been proposed to the ,committees on ,appropriations of the ,house of ,representatives and the ,senate3 ,provided further1 ,that the proposed modification may be implemented #cj days after the notification unless an objection is received from either the ,house or ,senate ,appropriations ,committees3 ,provided further1 ,that any proposed modification shall not preclude the ability of the commander of ,united ,states ,indo-,pacific ,command to meet operational requirements4 #hjfh4 ,any notice that is required to be submitted to the ,committees on of the funds provided in this ,act shall be available for obligation or expenditure through a reprogramming of funds that creates or initiates a new program1 project1 or activity unless such program1 project1 or activity must be undertaken immediately in the interest of national security and only after written prior notification to the congressional defense committees4 #hjgc4 ,none of the funds in this ,act may be used for research1 development1 test1 evaluation1 procurement or deployment of nuclear armed interceptors of a missile defense system4 7,,including ,,transfer ,,of ,,funds7 #hjgd4 ,the ,secretary of ,defense may transfer funds from any available ,department of the ,navy appropriation to any available ,navy ship construction appropriation for the purpose of liquidating necessary enacted rescissions1 if appropriate1 and the fiscal year enacted level2 7#b7 a delineation in the table for each appropriation by ,expenditure ,center and project2 and 7#c7 an identification of items of special congressional interest4 7b7 ,none of the funds provided for the ,national ,intelligence ,program in this ,act shall be available for reprogramming or transfer until the report identified in subsection 7a7 is submitted to the congressional intelligence committees1 unless the ,director of ,national ,intelligence certifies in writing to the congressional intelligence committees that such reprogramming or transfer is necessary as an emergency requirement4 #hjhj4 ,any transfer of amounts appropriated to the ,department of ,defense ,acquisition ,workforce ,development ,account in or for fiscal year #bjbe to a military department or ,defense ,agency pursuant to section #agje7;e77#a7 of title #aj1 ,united ,states ,code1 shall be covered by and subject to section #hjje of this ,act4 #hjha4 7a7 ,none of the funds provided for the ,national ,intelligence ,program in this or any prior appropriations ,act shall be available for obligation or expenditure through a reprogramming or transfer of funds in accordance with section #ajb;,a7d7 of the ,national ,security ,act of #aidg 7#ej ,u4,s4,c4 #cjbd7;d77 that-- 7#a7 creates a new start effort2 7#b7 terminates a program with intelligence committees are notified #cj days in advance of such reprogramming of funds2 this notification period may be reduced for urgent national security requirements4 7b7 ,none of the funds provided for the ,national ,intelligence ,program in this or any prior appropriations ,act shall be available for obligation or expenditure through a reprogramming or transfer of funds in accordance security requirements4 #hjhb4 7a7 ,any agency receiving funds made available in this ,act1 shall1 subject to subsections 7b7 and 7c71 post on the public website of that agency any report required to be submitted by the ,congress in this or any other ,act1 upon the determination by the head of the agency that it shall serve the national interest4 7b7 ,subsection 7a7 shall not apply to a report if-- 7#a7 the public posting of the report compromises national security2 or 7#b7 the report contains proprietary information4 7c7 ,the head of the agency posting such report shall do so only after such report has been made available to the requesting ,committee or ,committees of ,congress for no less than #de days4 #hjhc4 7a7 ,none of the funds appropriated or otherwise made available by this ,act may be expended for any ,federal contract for an amount in excess of #a1jjj1jjj1 unless the contractor agrees not to-- 7#a7 enter into any agreement with any of its employees or independent contractors that requires1 as a condition of employment1 that the employee or independent contractor agree to resolve through arbitration any claim under title ,,vii of the ,civil ,rights ,act of #aifd or any tort related to or arising out of sexual assault or harassment1 including assault and battery1 intentional infliction of emotional distress1 false imprisonment1 or negligent hiring1 supervision1 or retention2 or 7#b7 take any action to enforce any provision of an existing agreement with an employee or independent contractor that mandates that the employee or independent contractor resolve through arbitration any claim under title ,,vii of the ,civil ,rights ,act of #aifd or any tort related to or arising out of sexual assault or harassment1 including assault and battery1 intentional infliction of emotional distress1 false imprisonment1 or negligent hiring1 supervision1 or retention4 7b7 ,none of the funds appropriated or otherwise made available by this ,act may be expended for any ,federal contract unless the contractor certifies that it requires each covered subcontractor to agree not to enter into1 and not to take any action to enforce any provision of1 any agreement as described in paragraphs 7#a7 and 7#b7 of subsection 7a71 with respect to any employee or independent contractor performing work related to such subcontract4 ,for purposes of this subsection1 a covered subcontractor is an entity that has a subcontract in excess of #a1jjj1jjj on a contract subject to subsection 7a74 7c7 ,the prohibitions in this section do not apply with respect to a contractor's or subcontractor's agreements with employees or independent contractors that may not be enforced in a court of the ,united ,states4 7d7 ,the ,secretary of ,defense may waive the application of subsection 7a7 or 7b7 to a particular contractor or subcontractor for the purposes of a particular contract or subcontract if the ,secretary or the ,deputy ,secretary personally determines that the waiver is necessary to avoid harm to national security interests of the ,united ,states1 and that the term of the contract or subcontract is not longer than necessary to avoid such harm4 ,the determination shall set forth with specificity the grounds for the waiver and for the contract or subcontract term selected1 and shall state any alternatives considered in lieu of a waiver and the reasons each such alternative would not avoid harm to national security interests of the ,united ,states4 ,the ,secretary of ,defense shall transmit to ,congress1 and simultaneously make public1 any determination under this subsection not less than #ae business days before the contract or subcontract addressed in the determination may be awarded4 7,,including ,,transfer ,,of ,,funds7 #hjhd4 ,from within the funds appropriated for operation and maintenance for the ,defense ,health ,program in this ,act1 up to #afb1ejj1jjj1 shall be available for transfer to the ,joint ,department of ,defense--,department of ,veterans ,affairs ,medical ,facility ,demonstration ,fund in accordance with the provisions of section #agjd of the ,national ,defense ,authorization ,act for ,fiscal ,year #bjaj1 ,public ,law #aaa-hd3 ,provided1 ,that for purposes of section #agjd7;b71 the facility operations funded are operations of the integrated ,captain ,james ,a4 ,lovell ,federal ,health ,care ,center1 consisting of the ,north ,chicago ,veterans ,affairs ,medical ,center1 the ,navy ,ambulatory ,care ,center1 and supporting facilities designated as a combined ,federal medical facility as described by section #gjf of ,public ,law #aaj-dag3 ,provided further1 ,that additional funds may be transferred from funds appropriated for operation and maintenance for the ,defense ,health ,program to the ,joint ,department of ,defense--,department of ,veterans ,affairs ,medical ,facility ,demonstration ,fund upon written notification by the ,secretary of ,defense to the ,committees on ,appropriations of the ,house of ,representatives and the ,senate4 #hjhe4 ,none of the funds appropriated or otherwise made available by this ,act may be used by the ,department of ,defense or a component thereof in contravention of the provisions of section #acj;h of title #aj1 ,united ,states ,code4 #hjhf4 ,notwithstanding price or other limitations applicable to the purchase of passenger carrying vehicles1 appropriations available to the ,department of ,defense may be used for the purchase of3 7#a7 heavy and light armored vehicles for the physical security of personnel or for force protection purposes up to a limit of #dej1jjj per vehicle2 and 7#b7 passenger motor vehicles up to a limit of #ge1jjj per vehicle for use by military and civilian employees of the ,department of ,defense in the ,united ,states ,central ,command area of responsibility4 7,,including ,,transfer ,,of ,,funds7 #hjhg4 ,upon a determination by the ,director of ,national ,intelligence that such action is necessary and in the national interest1 the ,director may1 with the approval of the ,director of the ,office of ,management and ,budget1 transfer not to exceed #a1ejj1jjj1jjj of the funds made available in this ,act for the ,national ,intelligence ,program3 ,provided1 ,that such authority to transfer may not be used unless for higher priority items1 based on unforeseen intelligence requirements1 than those for which originally appropriated and in no case where the item for which funds are requested has been denied by the ,congress3 ,provided further1 ,that a request for multiple notwithstanding section #bbah of title #aj1 ,united ,states ,code1 none of these funds shall be transferred to the ,national ,defense ,sealift ,fund for execution4 #hjhi4 ,the ,secretary of ,defense shall post grant awards on a public website in a searchable format4 #hjij4 ,none of the funds made available by this ,act may be used by the ,national ,security ,agency to-- 7#a7 conduct an acquisition pursuant to section #gjb of the ,foreign ,intelligence ,surveillance ,act of #aigh for the purpose of targeting a ,united ,states person2 or 7#b7 acquire1 monitor1 or store the contents 7as such term is defined in section #beaj7h7 of title #ah1 ,united ,states ,code7 of any electronic communication of a ,united ,states person from a provider of electronic communication services to the public pursuant to section #eja of the ,foreign ,intelligence ,surveillance ,act of #aigh4 #hjia4 ,none of the funds made available in this or any other ,act may be used to pay the salary of any officer or employee of any agency funded by this ,act who approves or implements the transfer of administrative responsibilities or budgetary resources of any program1 project1 or activity financed by this ,act to the jurisdiction of another ,federal agency not financed by this ,act without the express authorization of ,congress3 ,provided1 ,that this limitation shall not apply to transfers of funds expressly provided for in ,department of ,defense ,appropriations ,acts1 or provisions of ,acts providing supplemental appropriations for the ,department of ,defense4 #hjib4 ,of the amounts concept design and development1 ship configuration development1 systems engineering1 naval architecture1 marine engineering1 operations research analysis1 industry studies1 preliminary design1 ,oceanographic ,surveillance ,ship may be used to award a new contract for such activities unless these contracts include specifications that all auxiliary equipment1 including pumps and propulsion shafts1 are manufactured in the ,united ,states4 #hjie4 ,no amounts credited or otherwise made available in this or any other ,act to the ,department of ,defense ,acquisition ,workforce ,development civilian personnel of the ,department of ,defense for gaming1 or for entertainment that includes topless or nude entertainers or participants1 as prohibited by ,department of ,defense ,,fmr1 ,volume #i1 ,chapter #c and ,department of ,defense ,instruction #ajae4aj 7enclosure #c1 #ad;a and #ad;b74 #hjig4 7a7 ,none of the funds made available in this ,act may be used to maintain or establish a computer network unless such network is designed to block access to pornography websites4 7b7 ,nothing in subsection 7a7 shall limit the use of funds necessary for any ,federal1 ,state1 tribal1 or local law enforcement agency or any other entity carrying out criminal investigations1 prosecution1 or adjudication activities1 or for any activity necessary for the national defense1 including intelligence activities4 #hjih4 ,none of the funds provided for1 or otherwise made available1 in this or any other ,act1 may be obligated or expended by the ,secretary of ,defense to provide motorized vehicles1 aviation platforms1 munitions other than small arms and munitions appropriate for customary ceremonial honors1 operational military units1 or operational military platforms if the ,secretary determines that providing such units1 platforms1 or equipment would undermine the readiness of such units1 platforms1 or equipment4 #hjii4 7a7 ,none of the funds made available by this or any other ,act may be used to enter into a contract1 memorandum of understanding1 or cooperative agreement with1 make a grant to1 or provide a loan or loan guarantee to any corporation that has any unpaid ,federal tax liability that has been assessed1 for which all judicial and administrative remedies have been exhausted or have lapsed1 and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting such tax liability1 provided that the applicable ,federal agency is aware of the unpaid ,federal tax liability4 7b7 ,subsection 7a7 shall not apply if the applicable ,federal agency has considered suspension or debarment of the corporation described in such subsection and has made a determination that such suspension or debarment is not ,act may be used in contravention of the following laws enacted or regulations promulgated to implement the ,united ,nations ,convention ,against ,torture and ,other ,cruel1 ,inhuman or ,degrading inform such committees if such funds have not been obligated and the reasons therefor3 ,provided further1 ,that the ,secretary of ,defense shall consult with such committees in advance of the provision of support provided to other forces or groups recognized by and under the authority of the ,government of ,ukraine3 ,provided further1 ,that the ,united ,states may accept equipment procured defense articles1 assistance under section #ccc of title #aj1 ,united ,states ,code1 or peacekeeping operations for the countries designated annually to be in violation of the standards of the ,child ,soldiers ,prevention ,act of #bjjh 7,public ,law #aaj-deg2 #bb ,u4,s4,c4 #bcgj;c-#a7 may be used to support any military training or operation that includes child soldiers1 as defined by the ,child ,soldiers ,prevention ,act of #bjjh1 unless such assistance is otherwise permitted under section #djd of the ,child ,soldiers ,prevention ,act of #bjjh4 #hajh4 ,none of the funds made available by this ,act may be made available for any member of the ,taliban4 #haji4 ,notwithstanding any other provision of law1 any transfer of funds1 appropriated or otherwise made available by this ,act1 for support to friendly foreign countries in connection with the conduct of operations in which the ,united ,states is not participating1 pursuant to section #cca7;d7 of title #aj1 ,united ,states ,code1 shall be made in accordance with section #hjje of this ,act4 #haaj4 7a7 ,none of the funds appropriated or otherwise made available by this or any other ,act may be used by the ,secretary of ,defense1 or any other official or officer of the ,department of ,defense1 to enter into a contract1 memorandum of understanding1 or cooperative agreement with1 or make a grant to1 or provide a loan or loan guarantee to ,rosoboronexport or any subsidiary of ,rosoboronexport4 7b7 ,the ,secretary of ,defense may waive the limitation in subsection 7a7 if the ,secretary1 in consultation with the ,secretary of ,state and the ,director of ,national ,intelligence1 determines that it is in the vital national security interest of the ,united ,states to do so1 and certifies in writing to the congressional defense committees that-- 7#a7 ,rosoboronexport has ceased the transfer of lethal military equipment to1 and the maintenance of existing lethal military equipment for1 the ,government of the ,syrian ,arab ,republic2 7#b7 the armed forces of the ,russian ,federation have withdrawn from ,ukraine2 and 7#c7 agents of the ,russian ,federation have ceased taking active measures to destabilize the control of the ,government of ,ukraine over eastern ,ukraine4 7c7 ,the ,inspector ,general of the ,department of ,defense shall conduct a review of any action involving ,rosoboronexport with respect to a waiver issued by the ,secretary of ,defense pursuant to subsection 7b71 and not later than #ij days after the date on which such a waiver is issued by the ,secretary of ,defense1 the ,inspector ,general shall submit to the congressional defense committees a report containing the results of the review conducted with respect to such waiver4 7,,including ,,transfer ,,of ,,funds7 #haaa4 ,in addition to amounts appropriated in title ,,ii or otherwise made available elsewhere in this ,act1 #b1jjj1jjj1jjj is hereby appropriated to the ,department of ,defense and made available for transfer to the operation and maintenance accounts of the ,army1 ,navy1 ,marine ,corps1 ,air ,force1 and ,space ,force 7including ,national ,guard and ,reserve7 for purposes of improving military readiness3 ,provided1 ,that the transfer authority provided under this section is in addition to any other transfer authority provided elsewhere in this ,act3 ,provided further1 ,that none of the funds provided under this section may be obligated or expended until #cj days after the ,secretary of ,defense provides the ,committees on ,appropriations of the ,house of ,representatives and the ,senate a detailed execution plan for such funds4 #haab4 ,of the amounts appropriated in this ,act under the heading ,operation and ,maintenance1 ,defense-,wide1 for the ,defense ,security ,cooperation ,agency1 #be1jjj1jjj1 to remain available until ,september #cj1 #bjbf1 shall be for payments to reimburse key cooperating nations for logistical1 military1 and other support1 including access1 provided to ,united ,states military and stability operations to counter the ,islamic ,state of ,iraq and ,syria3 ,provided1 ,that such reimbursement payments may be made in such amounts as the ,secretary of ,defense1 with the concurrence of the ,secretary of ,state1 and in consultation with the ,director of the ,office of ,management and ,budget1 may determine1 based on documentation determined by the ,secretary of ,defense to adequately account for the support provided1 and such determination is final and conclusive upon the accounting officers of the ,united ,states1 and #ae days following written notification to the appropriate congressional committees3 ,provided further1 ,that these funds may be used for the purpose of providing specialized training and procuring supplies and specialized equipment and providing such supplies and loaning such equipment on a non-reimbursable basis to coalition forces supporting ,united ,states military and stability operations to counter the ,islamic ,state of ,iraq and ,syria1 and #ae days following written notification to the appropriate congressional committees3 ,provided further1 ,that the ,secretary of ,defense shall provide quarterly reports to the ,committees on ,appropriations of the ,house of ,representatives and the ,senate on the use and status of funds made available in this section4 #haac4 7a7 ,within #de days of enactment of this ,act1 the ,secretary of ,defense shall allocate amounts made available from the ,creating ,helpful ,incentives to ,produce ,semiconductors 7,,chips7 for ,america ,defense ,fund for fiscal year #bjbe pursuant to the transfer authority in section #ajb7;b77#a7 of the ,,chips ,act of #bjbb 7division ,a of ,public ,law #aag-afg71 to the account specified1 in the amounts specified1 and for the projects and activities specified1 in the table titled ,department of ,defense ,allocation of ,funds3 ,,chips and ,science ,act ,fiscal ,year #bjbe in the report accompanying this ,act4 7b7 ,neither the ,president nor his designee may allocate any amounts that are made available for any fiscal year under section #ajb7;b77#b7 of the ,,chips ,act of #bjbb if there is in effect an ,act making or continuing appropriations for part of a fiscal year for the ,department of ,defense3 ,provided1 ,that in any fiscal year1 the matter preceding this proviso shall not apply to the allocation1 apportionment1 or allotment of amounts for continuing administration of programs allocated using funds transferred from the ,,chips for ,america ,defense ,fund1 which may be allocated pursuant to the transfer authority in section #ajb7;b77#a7 of the ,,chips ,act of #bjbb only in amounts that are no more than the allocation for such purposes in subsection 7a7 of this section4 7c7 ,the ,secretary of ,defense may reallocate funds allocated by subsection 7a7 of this section1 subject to the terms and conditions contained in the provisos in section #hjje of this ,act3 ,provided1 ,that amounts may be reallocated pursuant to this subsection only for those requirements necessary to carry out section #iijc7;b7 of the ,william ,m4 7,mac7 ,thornberry ,national ,defense ,authorization ,act for ,fiscal ,year #bjba 7,public ,law #aaf-bhc74 7d7 ,concurrent with the annual budget submission of the ,president for fiscal year #bjbf1 the ,secretary of ,defense shall submit to the ,committees on ,appropriations of the ,house of ,representatives and the ,senate proposed allocations by account and by program1 project1 or activity1 with detailed justifications1 for amounts made available under section #ajb7;b77#b7 of the ,,chips ,act of #bjbb for fiscal year #bjbf4 7e7 ,the ,department of ,defense shall provide the ,committees on ,appropriations of the ,house of ,representatives and ,senate quarterly reports on the status of balances of projects and activities funded by the ,,chips for ,america ,defense ,fund for amounts allocated pursuant to subsection 7a7 of this section1 including all uncommitted1 committed1 and unobligated funds4 #haad4 ,of the funds appropriated in this ,act under the heading ,operation and ,maintenance1 ,defense-,wide1 #dg1jjj1jjj shall be for continued implementation and expansion of the ,sexual ,assault ,special ,victims' ,counsel ,program3 ,provided1 ,that the funds are made available for transfer to the ,department of the ,army1 the ,department of the ,navy1 and the ,department of the ,air ,force3 ,provided further1 ,that funds transferred shall be merged with and available for the same purposes and for the same time period as the appropriations to which the funds are transferred3 ,provided further1 ,that this transfer authority is in addition to any other transfer authority provided in this ,act4 #haae4 ,none of the funds made available by this ,act may be used to support any activity conducted by1 or associated with1 the ,wuhan ,institute of ,virology4 #haaf4 ,none of the funds made available by this ,act may be used to fund any work to be performed by ,eco,health ,alliance1 ,inc4 in ,china on research supported by the government of ,china unless the ,secretary of ,defense determines that a waiver to such prohibition is in the national security interests of the ,united ,states and1 not later than #ad days after granting such a waiver1 submits to the congressional defense committees a detailed justification for the waiver1 including-- 7#a7 an identification of the ,department of ,defense entity obligating or expending the funds2 7#b7 an identification of the amount of such funds2 7#c7 an identification of the intended purpose of such funds2 7#d7 an identification of the recipient or prospective recipient of such funds 7including any third-party entity recipient1 as applicable72 7#e7 an explanation for how the waiver is in the national security interests of the ,united ,states2 and 7#f7 any other information the ,secretary determines appropriate4 #haag4 ,none of the funds appropriated or otherwise made available in this or any other ,act may be used to transfer1 release1 or assist in the transfer or release to or within the ,united ,states1 its territories1 or possessions ,khalid ,sheikh ,mohammed or any other detainee who-- 7#a7 is not a ,united ,states citizen or a member of the ,armed ,forces of the ,united ,states2 and 7#b7 is or was held on or after ,june #bd1 #bjji1 at ,united ,states ,naval ,station1 ,guantanamo ,bay1 ,cuba1 by the ,department of ,defense4 #haah4 ,none of the funds appropriated or otherwise made available in this ,act may be used to transfer any individual detained at ,united ,states ,naval ,station ,guantanamo ,bay1 ,cuba1 to the custody or control of the individual's country of origin1 any other foreign country1 or any other foreign entity except in accordance with section #ajcd of the ,national ,defense ,authorization ,act for ,fiscal ,year #bjaf 7,public ,law #aad-ib7 and section #ajce of the ,john ,s4 ,mc,cain ,national ,defense ,authorization ,act for ,fiscal ,year #bjai 7,public ,law #aae-bcb74 #haai4 7a7 ,none of the funds appropriated or otherwise made available in this or any other ,act may be used to construct1 acquire1 or modify any facility in the ,united ,states1 its territories1 or possessions to house any individual described in subsection 7c7 for the purposes of detention or imprisonment in the custody or under the effective control of the ,department of ,defense4 7b7 ,the prohibition in subsection 7a7 shall not apply to any modification of facilities at ,united ,states ,naval ,station1 ,guantanamo ,bay1 ,cuba4 7c7 ,an individual described in this subsection is any individual who1 as of ,june #bd1 #bjji1 is located at ,united ,states ,naval ,station1 ,guantanamo ,bay1 ,cuba1 and who-- 7#a7 is not a citizen of the ,united ,states or a member of the ,armed ,forces of the ,united ,states2 and 7#b7 is-- 7,a7 in the custody or under the effective control of the ,department of ,defense2 or 7,b7 otherwise under detention at ,united ,states ,naval ,station1 ,guantanamo ,bay1 ,cuba4 #habj4 ,none of the funds made available by this ,act may be used to carry out the closure or realignment of the ,united ,states ,naval ,station1 ,guantanamo ,bay1 ,cuba4 #haba4 ,in addition to amounts made available elsewhere in this ,act1 #hj1jjj1jjj is hereby appropriated only for payments pursuant to section #abd of the ,continuing ,appropriations ,act1 #bjbc 7division ,a of ,public ,law #aag-ahj71 to remain available until ,september #cj1 #bjbg3 ,provided1 ,that during their period of availability1 such amounts may be charged for any proper expense pursuant to section #aeec7;b77#a7 of title #ca1 ,united ,states ,code1 notwithstanding the limitation in section #aeec7;b77#b7 of such title4 #habb4 ,none of the funds appropriated or otherwise made available by this or any other ,act may be obligated to integrate an alternative engine on any ,f-#ce aircraft4 #habc4 ,there is appropriated to the ,department of ,defense ,credit ,program ,account established pursuant to section #ijc7;b77#e7 of the ,national ,defense ,authorization ,act for ,fiscal ,year #bjbd 7,public ,law #aah-ca71 #bd1fjj1jjj1 to remain available until ,september #cj1 #bjbg1 for the cost of loans and loan guarantees pursuant to section #ijc7;b7 of such ,act for a pilot program on capital assistance to support defense investment in the industrial base3 ,provided1 ,that such costs1 including the cost of modifying such loans1 shall be as defined in section #ejb of the ,congressional ,budget ,act of #aigd3 ,provided further1 ,that such amounts are available to subsidize gross obligations for the principal amount of direct loans1 and total loan principal1 any part of which is to be guaranteed1 not to exceed #dib1jjj1jjj3 ,provided further1 ,that the use of direct loans or loan guarantee authority under this section for direct loans or commitments to guarantee loans for any project shall be in accordance with the criteria that are developed and certified pursuant to the third and fourth provisos of section #hadj in division ,a of the ,further ,consolidated ,appropriations ,act1 #bjbd 7,public ,law #aah-dg73 ,provided further1 ,that none of the direct loans or loan guarantee authority made available under this section shall be available for any project unless the ,secretary of ,defense 7,secretary7 and the ,director of the ,office of ,management and ,budget1 or their respective designees1 have each individually certified in advance in writing to the ,subcommittees on ,defense of the ,committees on ,appropriations of the ,house of ,representatives and the ,senate that the direct loan or loan guarantee1 as applicable1 and the project comply with the criteria referenced in the previous proviso3 ,provided further1 ,that the report required by the fourth proviso of section #hadj in division ,a of ,public ,law #aah-dg shall include information on any statutory improvements to section #adi of title #aj1 ,united ,states ,code1 as added by section #ijc of the ,national ,defense ,authorization ,act for ,fiscal ,year #bjbd 7,public ,law #aah-ca71 and section #ijc7;b7 of such ,act1 that would further align such sections with the budgetary treatment and recommendations referred to in the third proviso under such section #hadj1 including statutory improvements necessary to ensure that no further reference to the criteria or the certifications will be required in appropriations ,acts in future fiscal years3 ,provided further1 ,that1 for the purposes of carrying out the ,congressional ,budget ,act of #aigd1 the ,director of the ,congressional ,budget ,office may request1 and the ,secretary shall promptly provide1 documentation and information relating to a project identified by the ,department of ,defense pursuant to a ,notice of ,funding ,availability for applications for credit assistance under section #ijc7;b7 of the ,national ,defense ,authorization ,act for ,fiscal ,year #bjbd 7,public ,law #aah-ca71 including with respect to a project that was initiated or completed before the date of enactment of this ,act4 #habd4 ,the ,secretary of ,defense may use up to #fej1jjj1jjj of the amounts appropriated or otherwise made available in this ,act to the ,department of ,defense for the rapid acquisition and deployment of supplies and associated support services pursuant to section #cfja of title #aj1 ,united ,states ,code1 but only for the purposes specified in clauses 7i71 7ii71 7iii71 and 7iv7 of subsection 7c77#c77;,b7 of such section and subject to the applicable limits specified in clauses 7i71 7ii71 and 7iii7 of such subsection and1 in the case of clause 7iv7 of such subsection1 subject to a limit of #ej1jjj1jjj1 or for the purposes specified in section #bbi of the ,national ,defense ,authorization ,act for ,fiscal ,year #bjbd 7,public ,law #aah-ca7 and subject to a limit of #ajj1jjj1jjj3 ,provided1 ,that the ,secretary of ,defense shall notify the congressional defense committees promptly of all uses of this authority4 #habe4 ,of the amounts appropriated in this ,act under the heading ,operation and ,maintenance1 ,defense-,wide1 for the ,defense ,security ,cooperation ,agency1 #ejj1jjj1jjj1 to remain available until ,september #cj1 #bjbf1 shall be for the ,indo-,pacific ,security ,assistance ,initiative3 ,provided1 ,that such funds shall be available to the ,secretary of ,defense1 with the concurrence of the ,secretary of ,state1 to provide assistance1 including new procurement of defense articles1 services1 and military education and training to ,taiwan3 ,provided further1 ,that equipment procured using funds made available in this section1 and not yet transferred to ,taiwan1 or returned by ,taiwan to the ,united ,states1 may be treated as stocks of the ,department of ,defense upon written notification to the congressional defense committees3 ,provided further1 ,that the ,secretary of ,defense shall1 not less than #ae days prior to obligating funds made available in this section1 notify the congressional defense committees in writing of the details of any such obligation3 ,provided further1 ,that the ,secretary of ,defense shall provide quarterly reports to the congressional defense committees on the use and status of funds made available in this section4 #habf4 ,of the amounts appropriated or otherwise made available by title ,,ii of this ,act under the heading ,operation and ,maintenance1 ,air ,force1 the ,secretary of ,defense may reimburse the ,federated ,states of ,micronesia in an amount not to exceed #cd1jjj1jjj for land acquisition costs for defense sites in ,yap4 #habg4 ,the amounts appropriated in title ,,ii of this ,act are hereby reduced by #fej1jjj1jjj to reflect excess cash balances in ,department of ,defense ,working ,capital ,funds1 as follows3 7#a7 ,from ,operation and ,maintenance1 ,army1 #djj1jjj1jjj2 and 7#b7 ,from ,operation and ,maintenance1 ,navy1 #bej1jjj1jjj4 #habh4 ,notwithstanding any other provision of this ,act1 to reflect savings due to favorable foreign exchange rates1 the total amount appropriated in this ,act is hereby reduced by #bh1bcf1jjj4 #habi4 ,the total amount appropriated or otherwise made available in title ,,ii of this ,act is hereby reduced by #ej1jjj1jjj1 to limit expenses for the travel and transportation of persons4 7,,including ,,transfer ,,of ,,funds7 #hacj4 ,for an additional amount for the ,department of ,defense1 #hjj1jjj1jjj1 to remain available until ,september #cj1 #bjbe1 for transfer to military personnel accounts1 operation and maintenance accounts1 procurement accounts1 research1 development1 test and evaluation accounts1 and the ,defense ,working ,capital ,funds1 in addition to amounts otherwise made available for such purpose1 only for ,u4,s4 operations1 force protection1 deterrence1 and the replacement of combat expenditures in the ,united ,states ,central ,command area of operations3 ,provided1 ,that none of the funds provided under this section may be obligated or expended until #cj days after the ,secretary of ,defense provides to the congressional defense committees an execution plan3 ,provided further1 ,that not less than #ae days prior to any transfer of funds1 the ,secretary of ,defense shall notify the congressional defense committees of the details of any such transfer3 ,provided further1 ,that upon transfer1 the funds shall be merged with and available for the same purposes1 and for the same time period1 as the appropriation to which transferred3 ,provided further1 ,that any transfer authority provided herein is in addition to any other transfer authority provided by law3 ,provided further1 ,that such amount is designated by the ,congress as being for an emergency requirement pursuant to section #bea7;b77#b77;,a77i7 of the ,balanced ,budget and ,emergency ,deficit ,control ,act of #aihe4 7,,including ,,transfer ,,of ,,funds7 #haca4 ,for an additional amount for the ,department of ,defense1 #bej1jjj1jjj1 to remain available until ,september #cj1 #bjbe1 for transfer to military personnel accounts1 operation and maintenance accounts1 procurement accounts1 research1 development1 test and evaluation accounts1 and the ,defense ,working ,capital ,funds1 in addition to amounts otherwise made available for such purpose1 only for global ,u4,s4 counter-terrorism activities and force protection requirements1 to include in the ,united ,states ,european ,command area of operations3 ,provided1 ,that none of the funds provided under this section may be obligated or expended until #cj days after the ,secretary of ,defense provides to the congressional defense committees an execution plan3 ,provided further1 ,that not less than #ae days prior to any transfer of funds1 the ,secretary of ,defense shall notify the congressional defense committees of the details of any such transfer3 ,provided further1 ,that upon transfer1 the funds shall be merged with and available for the same purposes1 and for the same time period1 as the appropriation to which transferred3 ,provided further1 ,that any transfer authority provided herein is in addition to any other transfer authority provided by law3 ,provided further1 ,that such amount is designated by the ,congress as being for an emergency requirement pursuant to section #bea7;b77#b77;,a77i7 of the ,balanced ,budget and ,emergency ,deficit ,control ,act of #aihe4 7,,including ,,transfer ,,of ,,funds7 #hacb4 ,for an additional amount for the ,department of ,defense1 #ejj1jjj1jjj1 to remain available until ,september #cj1 #bjbe1 for transfer to the operation and maintenance accounts and research1 development1 test and evaluation accounts of the ,army1 ,navy1 ,marine ,corps1 ,air ,force1 ,space ,force1 and ,office of the ,secretary of ,defense1 for purposes of improving tactical artificial intelligence at the ,combatant ,commands3 ,provided1 ,that none of the funds provided under this section may be obligated or expended until #cj days after the ,secretary of ,defense provides to the congressional defense committees an execution plan3 ,provided further1 ,that not less than #ae days prior to any transfer of funds1 the ,secretary of ,defense shall notify the congressional defense committees of the details of any such transfer3 ,provided further1 ,that upon transfer1 the funds shall be merged with and available for the same purposes1 and for the same time period1 as the appropriation to which transferred3 ,provided further1 ,that any transfer authority provided herein is in addition to any other transfer authority provided by law3 ,provided further1 ,that such amount is designated by the ,congress as being for an emergency requirement pursuant to section #bea7;b77#b77;,a77i7 of the ,balanced ,budget and ,emergency ,deficit ,control ,act of #aihe4 #hacc4 ,notwithstanding any other provision of this ,act1 to reflect higher than anticipated fuel costs1 the total amount appropriated in title ,,ii of this ,act is hereby increased by #a1agb1jeg1jjj3 ,provided1 ,that the amounts made available under this section are designated by the ,congress as being for an emergency requirement pursuant to section #bea7;b77#b77;,a77i7 of the ,balanced ,budget and ,emergency ,deficit ,control ,act of #aihe4 #hacd4 ,each amount designated in this ,act by the ,congress as an emergency requirement pursuant to section #bea7;b77#b77;,a77i7 of the ,balanced ,budget and ,emergency ,deficit ,control ,act of #aihe shall be available 7or repurposed1 rescinded1 or transferred1 if applicable7 only if the ,president subsequently so designates all such amounts and transmits such designations to the ,congress4 ,this ,act may be cited as the ,department of ,defense ,appropriations ,act1 #bjbe4 ,august #a1 #bjbd,read twice and placed on the calendar
