add communications equipment and services produced or provided by ,shenzhen ,da-,jiang ,innovations ,sciences and ,technologies ,company ,limited and ,autel ,robotics to the list that the ,federal ,communications ,commission is required to maintain under that ,act1 and for other purposes4 #a4 ,short title ,this ,act may be cited as the ,countering ,,ccp ,drones and ,supporting ,drones for ,law ,enforcement ,act4 #b4 ,countering ,,ccp drones 7a7 ,determination of whether unmanned aircraft systems manufacturers are ,chinese military companies ,pursuant to the annual review required under section #abfj;,h7a7 of the ,william ,m4 7,mac7 ,thornberry ,national ,defense ,authorization ,act for ,fiscal ,year #bjba 7,public ,law #aaf-bhc2 #aj ,u4,s4,c4 #aac note71 the ,secretary of ,defense shall determine if any entity that manufactures or assembles unmanned aircraft systems 7as defined in section #ddhja of title #di1 ,united ,states ,code71 or any subsidiary1 parent1 affiliate1 or successor of such an entity1 should be identified under such section #abfj;,h7a7 as a ,chinese military company operating directly or indirectly in the ,united ,states4 7b7 ,addition of certain equipment and services of ,,dji ,technologies and ,autel ,robotics to covered communications equipment and services list 7#a7 ,in general ,section #b of the ,secure and ,trusted ,communications ,networks ,act of #bjai 7#dg ,u4,s4,c4 #afja7 is amended-- 7,a7 in subsection 7c71 by adding at the end the following3 7#e7 ,the communications equipment or service being-- 7,a7 communications or video surveillance equipment produced or provided by-- 7i7 ,shenzhen ,da-,jiang ,innovations ,sciences and ,technologies ,company ,limited 7commonly known as ,,dji ,technologies72 7ii7 ,autel ,robotics2 or 7iii7 with respect to an entity described in clause 7i7 or 7ii7 7referred to in this clause as a named entity7-- 7,i7 any subsidiary1 affiliate1 or partner of the named entity2 7,,ii7 any entity in a joint venture with the named entity2 or 7,,iii7 any entity to which the named entity has issued a license to produce or provide that telecommunications or video surveillance equipment2 or 7,b7 telecommunications or video surveillance services1 including software1 provided by an entity described in subparagraph 7,a7 or using equipment described in that subparagraph4 7#f7 7,a7 ,the communications equipment or service being any communications equipment or service produced or provided by an entity-- 7i7 that is a subsidiary1 affiliate1 or partner of an entity that produces or provides any communications equipment or service described in any of paragraphs 7#a7 through 7#e7 7referred to in this subparagraph as a covered entity72 7ii7 that is in a joint venture with a covered entity2 or 7iii7 to which a covered entity has issued a license to produce or provide that communications equipment or service4 7,b7 ,an executive branch interagency body described in paragraph 7#a7 may submit to the ,commission a petition to have an entity recognized as an entity to which subparagraph 7,a7 applies4 2 and 7,b7 by adding at the end the following3 7e7 ,inapplicability to authorized intelligence activities 7#a7 ,definitions ,in this subsection1 the terms intelligence and intelligence community have the meanings given those terms in section #c of the ,national ,security ,act of #aidg 7#ej ,u4,s4,c4 #cjjc74 7#b7 ,inapplicability ,notwithstanding any other provision of this section1 an action by the ,commission under subsection 7b77#a7 based on a determination made under paragraph 7#e7 or 7#f7 of subsection 7c7 shall not apply with respect to any-- 7,a7 activity subject to the reporting requirements under title ,v of the ,national ,security ,act of #aidg 7#ej ,u4,s4,c4 #cjia et seq472 7,b7 activity of an element of the intelligence community relating to intelligence2 or 7,c7 activity of1 or procurement by1 an element of the intelligence community in support of an activity relating to intelligence4 4 7#b7 ,conforming amendments ,section #b of the ,secure and ,trusted ,communications ,networks ,act of #bjai 7#dg ,u4,s4,c4 #afja7 is amended by striking paragraphs 7#a7 through 7#d7 each place that term appears and inserting paragraphs 7#a7 through 7#f74 7#c7 ,effective date ,this subsection1 and the amendments made by this subsection1 shall take effect on the date that is #ahj days after the date of enactment of this ,act4 7c7 ,first responder secure drone program 7#a7 ,definitions ,in this subsection3 7,a7 ,eligible entity 7i7 ,in general ,the term eligible entity means an agency of an entity described in clause 7ii7 that has as a primary responsibility the maintenance of public safety4 7ii7 ,entity described ,an entity described in this clause is any of the following3 7,i7 ,each of the #ej ,states1 the ,district of ,columbia1 the ,commonwealth of ,puerto ,rico1 the ,united ,states ,virgin ,islands1 ,guam1 ,american ,samoa1 and the ,commonwealth of the ,northern ,mariana ,islands4 7,,ii7 ,a political subdivision1 including a unit of local government1 of an entity described in subclause 7,i74 7,,iii7 ,a ,tribal ,government4 7,b7 ,eligible small unmanned aircraft system ,the term eligible small unmanned aircraft system means a small unmanned aircraft system1 as defined in part #ajg of title #ad1 ,code of ,federal ,regulations 7or any successor regulation71 that-- 7i7 was not designed1 manufactured1 or assembled1 in whole or in part1 by a foreign entity of concern2 or 7ii7 does not include software or #a or more critical components from a foreign entity of concern4 7,c7 ,foreign entity of concern ,the term foreign entity of concern has the meaning given the term in section #iija of the ,william ,m4 7,mac7 ,thornberry ,national ,defense ,authorization ,act for ,fiscal ,year #bjba 7#ae ,u4,s4,c4 #dfea74 7,d7 ,secretary ,the term ,secretary means the ,secretary of ,transportation4 7,e7 ,unmanned aircraft system ,the term unmanned aircraft system has the meaning given such term in section #ddhja of title #di1 ,united ,states ,code4 7#b7 ,authority ,not later than #ahj days after the date of enactment of this ,act1 the ,secretary shall establish a program1 in coordination with the ,attorney ,general1 to be known as the ,first ,responder ,secure ,drone ,program1 to provide grants to eligible entities to facilitate the use of eligible small unmanned aircraft systems4 7#c7 ,use of grant amounts ,an eligible entity may use a grant provided under this subsection to-- 7,a7 purchase or lease eligible small unmanned aircraft systems2 7,b7 purchase or lease software1 training1 and other services reasonably associated with the purchase or lease of eligible small unmanned aircraft systems2 and 7,c7 dispose of unmanned aircraft systems owned by the eligible entity4 7#d7 ,restrictions on grant uses ,in administering grants under this program1 the ,secretary1 in coordination with the ,attorney ,general1 shall ensure funds are used in a manner that safeguards civil liberties and mitigates cybersecurity risks concerning the operation and use of the eligible small unmanned aircraft system4 7#e7 ,application ,to be eligible to receive a grant under this subsection1 an eligible entity shall submit to the ,secretary an application at such time1 in such form1 and containing such information as the ,secretary may require1 including an assurance that the eligible entity or any contractor of the eligible entity1 will comply with relevant ,federal regulations4 7#f7 ,federal share 7,a7 ,in general ,except as provided in subparagraph 7,b71 the ,federal share of the allowable costs of a project carried out using a grant provided under this subsection shall not exceed #ej percent of the total allowable project costs4 7,b7 ,waiver ,the ,secretary may increase the ,federal share under subparagraph 7,a7 to up to #ge percent if an eligible entity-- 7i7 submits a written application to the ,secretary requesting an increase in the ,federal share2 and 7ii7 demonstrates that the additional assistance is necessary to facilitate the acceptance and full use of a grant under this subsection1 due to circumstances such as alleviating economic hardship1 meeting additional workforce needs1 or any other uses that the ,secretary determines to be appropriate4 7#g7 ,funding ,there is authorized to be appropriated to the ,secretary1 #ae1jjj1jjj for fiscal year #bjbe to carry out this subsection1 to remain available until expended4 7#h7 ,sunset of program ,the program established under this subsection shall end on the date that is the earlier of-- 7,a7 the date on which all appropriations authorized under paragraph 7#g7 are expended2 and 7,b7 the date that is #b years after the date of enactment of this ,act4
