  ,to amend title ,,xix of the ,social  
,security ,act to provide a higher      
,federal matching rate for increased    
expenditures under ,medicaid for        
behavioral health services 7including   
those related to mental health and      
substance use71 and for other purposes4 
#a4 ,short title ,this ,act may be cited
 as the ,medicaid ,bump ,act4  #b4      
,higher ,federal match for increased    
expenditures under ,medicaid for        
behavioral health services  7a7 ,in     
general ,section #aijc of the ,social   
,security ,act 7#db ,u4,s4,c4 #acif;b7  
is amended-- 7#a7 in subsection         
7a77#e7-- 7,a7 by inserting 7,a7 before 
an amount equal to2  7,b7 by inserting  
and after the semicolon2 and  7,c7 by   

adding at the end the following3  7,b7  
subject to subsection 7b77#f71 an amount
 equal to #ij percent of the amount by  
which-- 7i7 the sum of the amounts      
expended during such quarter which are  
attributable to the offering1 arranging1
 and furnishing 7directly or on a       
contract basis7 under the ,state plan   
7or under a waiver of the plan7 of      
behavioral health services 7including   
those related to mental health and      
substance use72 exceeds  7ii7 the sum of
 the amounts expended during the        
corresponding quarter in the #d-quarter 
period ending on ,march #ca1 #bjai1     
which are attributable to the offering1 
arranging1 and furnishing 7directly or  
on a contract basis7 under the ,state   
plan 7or under a waiver of the plan7 of 
such services2 plus  2 and  7#b7 in     
subsection 7b71 by adding at the end the
 following new paragraph3  7#f7         
,accountability and maintenance of      
effort requirements for additional      
federal funding for increased           

expenditures for behavioral health      
services ,as a condition for receiving  
the funds the ,secretary is otherwise   
obligated to pay to a ,state under      
subsection 7a77#e77;,b71 a ,state shall 
meet the following requirements3 7,a7   
,supplement1 not supplant ,the ,state   
shall use the funds received under such 
subsection to supplement1 not supplant1 
the level of ,state funds expended for  
the offering1 arranging1 and furnishing 
7directly or on a contract basis7 under 
the ,state plan 7or under a waiver of   
the plan7 of behavioral health services 
7including those related to mental      
health and substance use7 through       
programs and activities in effect as of 
,april #a1 #bjba4  7,b7 ,use of funds   
for activities that improve delivery of 
behavioral health services ,the ,state  
shall use the funds received under such 
subsection for activities that increase 
the capacity1 efficiency1 and quality in
 the provision of behavioral health     
services 7including those related to    

mental health and substance use7        
delivered by providers1 including       
through increases in payment rates for  
providers of those services and the     
adoption of other measures that ensure a
 reduction in staff turnover4  4  7b7   
,sub-,regulatory guidance ,not later    
than #ahj days after the date of        
enactment of this ,act1 the ,secretary  
of ,health and ,human ,services shall   
issue sub-regulatory guidance to ,states
 specifying the services that are       
behavioral health services for purposes 
of subparagraph 7,b7 of section         
#aijc7;a77#e7 of the ,social ,security  
,act 7#db ,u4,s4,c4 #acif;b7a77#e771 as 
added by subsection 7a77#a74  7c7       
,effective date ,the amendments made by 
this section shall apply with respect to
 calendar quarters beginning on or after
 ,january #a of the year that begins #a 
year after the date of the enactment of 
this ,act4  #c4 ,report regarding       
behavioral health service ,not later    
than #a year after the date of enactment

 of this ,act1 and annually thereafter1 
the ,secretary of ,health and ,human    
,services shall submit to the ,committee
 on ,energy and ,commerce of the ,house 
of ,representatives and the ,committee  
on ,finance of the ,senate a report     
regarding behavioral health services    
7including those related to mental      
health and substance use7 provided under
 title ,,xix of the ,social ,security   
,act 7#db ,u4,s4,c4 #acif et seq47 in   
each ,state 7as such term is defined in 
section #aaja7;a7 of such ,act 7#db     
,u4,s4,c4 #acja7;a77 for purposes of    
such title71 specifying the payment     
rates for such services1 the rationale  
for deriving such payment rates1 and    
utilization of such services1 as such   
data are available4
