,states ,code1 to modify the authority  
of the ,secretary of each military      
department to replace damaged or        
destroyed facilities to include         
replacement of certain facilities in    
failing condition1 and for other        
purposes4  #a4 ,short title ,this ,act  
may be cited as the ,military           
,facilities ,upgrades ,act4  #b4        
,modification of authority to replace   
damaged or destroyed facilities to      
include certain facilities in failing   
condition  7a7 ,in general ,section     
#bhed of title #aj1 ,united ,states     
,code1 is amended-- 7#a7 by striking    
subsection 7a7 and inserting the        
following new subsection 7a73  7a7 7#a7 

,subject to subsection 7b71 the         
,secretary concerned may replace a      
facility under the jurisdiction of the  
,secretary concerned1 including a family
 housing facility-- 7,a7 that has been  
damaged or destroyed2 or  7,b7 that is a
 facility described in paragraph 7#b7 in
 failing condition1 if-- 7i7 replacement
 is more cost-effective than repair2    
7ii7 the replacement facility supports  
an existing mission of the ,department  
of ,defense2 and  7iii7 the replacement 
facility does not exceed the total      
square footage of the replaced facility4
  7#b7 ,a facility described in this    
paragraph is any of the following       
facilities of the ,department of        
,defense or an armed force3 7,a7 ,any   
barracks1 housing1 or dormitory         
facility4  7,b7 ,a child development    
center4  7,c7 ,any other quality of life
 facility1 including a fitness center1  
recreation facility1 dining facility1 or
 commissary facility4  2  7#b7 in       
subsection 7b71 by striking repair1     

restoration1 or2  7#c7 in subsection    
7c7-- 7,a7 in paragraph 7#a71 in the    
matter preceding subparagraph 7,a71 by  
striking subsection 7a7 and inserting   
subsection 7a77#a77;,a72 and  7,b7 in   
paragraph 7#b7-- 7i7 by striking this   
subsection and inserting paragraph 7#a72
 and  7ii7 by striking described in     
paragraph 7#a7 and inserting described  
in paragraph 7#a77;,b72  7#d7 by        
redesignating paragraph 7#c7 as         
paragraph 7#d72  7#e7 by inserting after
 paragraph 7#b7 the following new       
paragraph 7#c73  7#c7 ,in using the     
authority described in subsection       
7a77#a77;,b7 to carry out a military    
construction project to replace a       
facility1 including a family housing    
facility1 that is in failing condition1 
the ,secretary concerned may use        
appropriations available for operation  
and maintenance4  2 and  7#f7 in        
paragraph 7#d71 as redesignated by      
paragraph 7#d7 of this subsection1 by   
inserting per armed force before in any 

fiscal year4  7b7 ,conforming and       
clerical amendments  7#a7 ,heading      
amendment ,the heading for section #bhed
 of such title is amended to read as    
follows3  #bhed4 ,replacement of        
damaged1 destroyed1 or failing          
facilities  4  7#b7 ,clerical amendment 
,the table of sections at the beginning 
of subchapter ,,iii of chapter #afi of  
such title is amended by striking the   
item relating to section #bhed and      
inserting the following new item3
