 ,means  ,a ,,bill  ,to set aside funds 
for payments to ,indian tribes and      
tribal consortia under subpart #a of    
part ,b of title ,,iv of the ,social    
,security ,act4  #a4 ,short title ,this 
,act may be cited as the ,tribal ,child 
,welfare ,support ,act4  #b4 ,set-aside 
of funds for payments to ,indian tribes 
and tribal consortia for child welfare  
services  7a7 ,in general ,section #dbh 
of the ,social ,security ,act 7#db      
,u4,s4,c4 #fbh7 is amended--  7#a7 in   
subsection 7a7-- 7,a7 by striking may   
and inserting shall2 and  7,b7 by       
striking the last sentence2  7#b7 by    
striking subsection 7b7 and inserting   
the following3  7b7 ,direct payments to 
tribal organizations and tribal         
consortia ,the ,secretary shall pay any 

amount to which an ,indian tribe or     
tribal consortium is entitled under this
 section directly to the tribal         
organization of the ,indian tribe or in 
the case of a payment to a tribal       
consortium1 such tribal organizations   
of1 or entity established by1 the       
,indian tribes that are part of the     
consortium as the consortium shall      
designate4  2 and  7#c7 by adding at the
 end the following3  7d7 ,reservation of
 funds ,of the amount made available    
under section #dbe for a fiscal year1   
the ,secretary shall reserve #c percent 
for payments under subsection 7a7 of    
this section4  4  7b7 ,conforming       
amendment ,section #dbc7;a77#a7 of such 
,act 7#db ,u4,s4,c4 #fbc7;a77#a77 is    
amended by inserting 1 after applying   
section #dbh7;d71 before for each fiscal
 year4  7c7 ,limitation on applicability
 ,the amendments made by this section   
shall not apply with respect to a fiscal
 year unless the amount made available  
under section #dbe of the ,social       

,security ,act for the fiscal year meets
 or exceeds #ajc percent of the amount  
made available in fiscal year #bjbd to  
enable the ,secretary of ,health and    
,human ,services to reserve #c percent  
of the amount for payments to ,indian   
tribes and tribal organizations under   
subpart #a of part ,b of title ,,iv of  
such ,act without reducing the allotment
 of any ,state for the fiscal year under
 section #dbc of such ,act4 ,should the 
threshold for reserving #c percent for  
payments to ,indian tribes and tribal   
organizations not be met in a fiscal    
year1 then amounts paid under section   
#dbh7;a7 of such ,act shall be deemed to
 be a part of the allotment 7as         
determined under section #dbc of such   
,act7 for the ,state in which such      
,indian tribal organization is located4
