,federal funding for institutions of    
higher education that carry out         
diversity1 equity1 and inclusion        
initiatives1 and for other purposes4    
#a4 ,short title ,this ,act may be cited
 as the ,eliminate ,,dei in ,colleges   
,act4  #b4 ,prohibition on ,federal     
funding for institutions of higher      
education that carry out diversity1     
equity1 and inclusion initiatives ,part 
,b of title ,i of the ,higher ,education
 ,act of #aife 7#bj ,u4,s4,c4 #ajaa et  
seq47 is amended by adding at the end   
the following3  #abd4 ,prohibition on   
diversity1 equity1 and inclusion        
initiatives  7a7 ,restriction on        
eligibility ,notwithstanding any other  

provision of law1 no institution of     
higher education shall be eligible to   
receive funds or any other form of      
financial assistance under any ,federal 
program1 including participation in any 
federally funded or guaranteed student  
loan program1 unless the institution    
certifies to the ,secretary that the    
institution-- 7#a7 does not and will not
 carry out any program1 project1        
initiative1 or other activity the       
primary purpose of which is to advocate1
 promote1 or otherwise support          
diversity1 equity1 and inclusion2 and   
7#b7 does not and will not maintain any 
office or other entity within the       
institution to advocate1 promote1 or    
otherwise support diversity1 equity1 and
 inclusion4  7b7 ,information           
availability ,each institution of higher
 education that provides the            
certification required by subsection 7a7
 shall1 upon request1 make available to 
the ,secretary any information needed by
 the ,secretary to verify the truth and 

accuracy of the certification4  7c7     
,regulations ,the ,secretary shall      
publish regulations to implement and    
enforce the provisions of this section4 
7d7 ,appeals ,upon determination by the 
,secretary to terminate financial       
assistance to any institution of higher 
education under this section1 the       
institution may file an appeal with an  
administrative law judge before the     
expiration of the #cj-;day period       
beginning on the date such institution  
is notified of the decision to terminate
 financial assistance under this        
section4 ,such judge shall hold a       
hearing with respect to such termination
 of assistance before the expiration of 
the #de-;day period beginning on the    
date that such appeal is filed4 ,such   
judge may extend such #de-;day period   
upon a motion by the institution        
concerned4 ,the decision of the judge   
with respect to such termination shall  
be considered to be a final agency      
action4  7e7 ,definition ,in this       

section1 the term diversity1 equity1 and
 inclusion means the concept according  
to which individuals are-- 7#a7         
classified on basis of race1 color1 sex1
 national origin1 gender identity1 or   
sexual orientation2 and  7#b7 afforded  
differential or preferential treatment  
basis of such classification4  4
