 development of a plan to increase oil  
and gas production under oil and gas    
leases of ,federal lands under the      
jurisdiction of the ,secretary of       
,agriculture1 the ,secretary of ,energy1
 the ,secretary of the ,interior1 and   
the ,secretary of ,defense in           
conjunction with a drawdown of petroleum
 reserves from the ,strategic ,petroleum
 ,reserve4  #a4 ,short title ,this ,act 
may be cited as the ,strategic          
,production ,response ,act4  #b4        
,compensatory production increase plan  
,section #afa of the ,energy ,policy and
 ,conservation ,act 7#db ,u4,s4,c4      
#fbda7 is amended by adding at the end  
the following new subsection3  7k7 ,plan
  7#a7 ,in general ,except in the case  
of a severe energy supply interruption  
described in subsection 7d71 the        
,secretary may not execute the first    
drawdown of petroleum products in the   
,reserve after the date of enactment of 

this subsection1 whether through sale1  
exchange1 or loan1 until the ,secretary 
has developed and submitted to ,congress
 a plan to increase the percentage of   
,federal lands 7including submerged     
lands of the ,outer ,continental ,shelf7
 under the jurisdiction of the          
,secretary of ,agriculture1 the         
,secretary of ,energy1 the ,secretary of
 the ,interior1 and the ,secretary of   
,defense leased for oil and gas         
production by the same percentage as the
 percentage of petroleum in the         
,strategic ,petroleum ,reserve that has 
been drawn down during the period       
beginning ,january #ba1 #bjba1 and      
ending on the date of enactment of this 
,act1 and that is to be drawn down in   
that first and subsequent drawdowns1    
subject to the limitation under         
paragraph 7#b74  7#b7 ,limitation  7,a7 
,in general ,the plan required by       
paragraph 7#a7 shall not provide for--  
7i7 a total increase in the percentage  
of ,federal lands described in paragraph

 7#a7 leased for oil and gas production 
in excess of #ae percent2 or  7ii7 the  
financial benefit or participation of   
any entity that has a contractual       
relationship with1 or is owned1         
controlled1 or under the influence of1 a
 foreign entity of concern4  7,b7       
,definition ,in this paragraph1 the term
 foreign entity of concern means-- 7i7  
the ,people's ,republic of ,china2  7ii7
 the ,democratic ,people's ,republic of 
,korea2  7iii7 the ,russian ,federation2
  7iv7 the ,islamic ,republic of ,iran2 
and  7v7 any other country the          
government of which is subject to       
sanctions imposed by the ,united        
,states4  7#c7 ,consultation ,the       
,secretary shall1 in consultation with  
the ,secretary of ,agriculture1 the     
,secretary of the ,interior1 and the    
,secretary of ,defense-- 7,a7 prepare   
the plan required by paragraph 7#a72 and
  7,b7 ensure such plan will not result 
in the sale of petroleum products drawn 
down from the ,reserve to ,iran1 ,china1

 ,north ,korea1 or ,russia4  7#d7       
,submission to ,congress ,the ,secretary
 shall submit the plan developed under  
paragraph 7#a7 to the ,committees on    
,armed ,services1 ,agriculture1 ,energy 
and ,commerce1 and ,natural ,resources  
of the ,house of ,representatives and   
the ,committees on ,energy and ,natural 
,resources1 ,environment and ,public    
,works1 ,armed ,services1 and           
,agriculture1 ,nutrition1 and ,forestry 
of the ,senate4  7#e7 ,thompson divide  
,as part of the plan developed under    
paragraph 7#a71 the ,secretary shall    
identify areas to lease within the      
approximately #bbd1gic4gc acres1        
including approximately #bjj1eah4bh     
acres of ,national ,forest ,system      
lands1 approximately #ae1dfd4ii acres of
 public lands1 and approximately        
#h1haj4df acres of reserved ,federal    
mineral interest within the ,thompson   
,divide area in ,colorado4  7#f7        
,requirements ,the plan required by     
paragraph 7#a7 shall include a list of  

parcels planned to be offered for lease1
 including1 for each such parcel--  7,a7
 the size of the parcel1 by acre2  7,b7 
the location of the parcel2 and  7,c7   
any permits and approvals necessary to  
access the parcel and produce oil and   
gas on the parcel4  4  #c4 ,no effect on
 certain withdrawals of ,federal lands  
,nothing in this ,act1 or any amendments
 made by this ,act1 shall affect the    
,presidential memorandum titled         
,memorandum on the ,withdrawal of       
,certain ,areas of the ,united ,states  
,outer ,continental ,shelf from ,leasing
 ,disposition and dated ,september #h1  
#bjbj4  #d4 ,no effect on existing      
leasing restrictions ,nothing in this   
,act1 or the amendments made by this    
,act1 shall affect any statutory or     
regulatory restrictions in effect on the
 date of enactment of this ,act         
7including any withdrawal of ,federal   
land7 that may prohibit oil and gas     
leasing within the area designated as   
the ,north ,atlantic ,planning ,area4   

#e4 ,no effect on existing leasing      
restrictions ,nothing in this ,act1 or  
the amendments made by this ,act1 shall 
affect any statutory or regulatory      
restrictions in effect on the date of   
enactment of this ,act 7including any   
withdrawal of ,federal land7 that may   
prohibit oil and gas leasing within the 
area designated as the ,south ,atlantic 
,planning ,area4  #f4 ,rule of          
construction with respect to abuse of   
emergency declarations ,nothing in this 
,act1 or the amendments made by this    
,act1 may be construed to authorize the 
,president to make a determination under
 section #afa7;d7 of the ,energy ,policy
 and ,conservation ,act 7#db ,u4,s4,c4  
#fbda7;d77 that an emergency situation  
exists in order for the ,secretary of   
,energy to draw down and sell petroleum 
products under such subsection for      
political1 non-emergency purposes4
