,foreign ,investment in the ,united ,states of certain agricultural real estate transactions ,section #gba7;a77#d7 of the ,defense ,production ,act of #aiej 7#ej ,u4,s4,c4 #defe7;a77#d77 is amended-- 7#a7 in subparagraph 7,a7-- 7,a7 in clause 7i71 by striking 2 and and inserting a semicolon2 7,b7 in clause 7ii71 by striking the period at the end and inserting 2 and2 and 7,c7 by adding at the end the following3 7iii7 any transaction described in subparagraph 7,b77vi7 proposed or pending on or after the date of the enactment of this clause4 2 and 7#b7 in subparagraph 7,b71 by adding at the end the following3 7vi7 ,any acquisition or transfer of an interest1 other than a security1 in agricultural land held by a person that is a national of1 or is organized under the laws or otherwise subject country that poses a risk to the national security of the ,united ,states in the most recent annual report on worldwide threats issued by the ,director of ,national ,intelligence pursuant to section #ajh;,b of the ,national ,security ,act of #aidg 7#ej ,u4,s4,c4 #cjdc;b77commonly known as the ,annual ,threat ,assessment74 4 #c4 ,expansion of membership in ,committee on ,foreign ,investment in the ,united ,states ,section #gba7k77#b7 of the ,defense ,production ,act of #aiej 7#ej ,u4,s4,c4 #defe7k77#b77 is amended-- 7#a7 by redesignating subparagraphs 7,h71 7,i71 and 7,j71 as subparagraphs 7,i71 7,j71 and 7,k71 respectively2 and 7#b7 inserting after subparagraph 7,g71 the following new subparagraph3 7,h7 ,the ,secretary of ,agriculture4 4 #d4 ,prohibition on use of funds for certain agricultural real estate holdings ,no assistance1 including subsidies1 may be provided by any ,federal agency to a person for an agricultural real estate holding wholly or partly owned by a person that is a national of1 or is organized under the laws or otherwise subject to the jurisdiction of1 a country-- 7#a7 designated as a nonmarket economy country pursuant to section #gga7ah7 of the ,tariff ,act of #aicj 7#ai ,u4,s4,c4 #afgg7ah772 or 7#b7 identified as a country that poses as risk to the national security of the ,united ,states in the most recent annual report on worldwide threats issued by the ,director of ,national ,intelligence pursuant to section #ajh;,b of the ,national ,security ,act of #aidg 7#ej ,u4,s4,c4 #cjdc;b77commonly known as the ,annual ,threat ,assessment74 #e4 ,disclosure requirements for foreign agricultural real estate holdings 7a7 ,reporting requirements ,section #b7;a7 of the ,agricultural ,foreign ,investment ,disclosure ,act of #aigh 7#g ,u4,s4,c4 #ceja7;a77 is amended-- 7#a7 in the first sentence of the matter preceding paragraph 7#a7-- 7,a7 by inserting 1 or enters into a leasing agreement the period of which is longer than #e years with respect to agricultural land1 after agricultural land2 and 7,b7 by striking acquisition or transfer and inserting acquisition1 transfer1 or lease2 and 7#b7 in paragraph 7#d71 by striking acquired or transferred and inserting acquired1 transferred1 or leased4 7b7 ,revocation of minimum acreage requirement ,section #i7a7 of the ,agricultural ,foreign ,investment ,disclosure ,act of #aigh 7#g ,u4,s4,c4 #cejh7a77 is amended by inserting 1 subject to the condition that the ,secretary may not exclude land from this definition based on the acreage of the land before the semicolon at the end4 #f4 ,reports of holdings of agricultural land in the ,united ,states by foreign persons ,section #f of the ,agricultural ,foreign ,investment ,disclosure ,act of #aigh 7#g ,u4,s4,c4 #ceje7 is amended-- 7#a7 by striking the section designation and heading and all that follows through ,not later than and inserting the following3 #f4 ,reports 7a7 ,transmission of reports to ,states ,not later than 2 and 7#b7 by adding at the end the following3 7b7 ,annual report 7#a7 ,in general ,annually1 the ,secretary shall prepare and make publicly available a report describing holdings of agricultural land by foreign persons1 as determined by reports submitted under section #b1 including-- 7,a7 an analysis of the countries with the most extensive agricultural land holdings on a ,state-by-,state and county-by-county basis2 7,b7 data and an analysis of agricultural land holdings in each county in the ,united ,states by a foreign person from-- 7i7 the ,people's ,republic of ,china2 7ii7 the ,russian ,federation2 or 7iii7 any other country that the ,secretary determines to be appropriate2 and 7,c7 an analysis of the sectors and industries for which the agricultural land holdings are used4 7#b7 ,transmission to ,states ,the ,secretary shall transmit the report prepared under paragraph 7#a7 to each ,state department of agriculture or appropriate ,state agency described in subsection 7a7 in conjunction with the applicable reports transmitted under that subsection4 4
