,our ,seas #b4j ,amendments ,act4 #b4 ,modifications to the ,marine ,debris ,foundation 7a7 ,status of ,foundation ,section #aaa7;a7 of the ,save ,our ,seas #b4j ,act 7#cc ,u4,s4,c4 #dbaa7;a77 is amended1 in the second sentence1 by striking organization and inserting corporation4 7b7 ,board of ,directors 7#a7 ,appointment1 vacancies1 and removal ,section #aab7;b7 of such ,act 7#cc ,u4,s4,c4 #dbab7;b77 is amended-- 7,a7 in paragraph 7#a71 in the matter preceding subparagraph 7,a7-- 7i7 by striking and considering and inserting considering2 7ii7 by inserting and with the approval of the ,secretary of ,commerce1 after by the ,board12 and 7iii7 by inserting and such other criteria as the ,under ,secretary may establish after subsection 7a72 7,b7 in paragraph 7#c77;,a71 by inserting amended-- 7,a7 in paragraph 7#a77;,a71 by striking officers and employees and inserting the initial officers and employees of the ,board2 and 7,b7 in paragraph 7#b77;,b77i71 by striking chief operating officer and inserting chief executive officer4 7#c7 ,chief executive officer ,section #aab of such ,act 7#cc ,u4,s4,c4 #dbab7 is amended by adding at the end the following3 7h7 ,chief executive officer 7#a7 ,appointment2 removal2 review ,the ,board shall appoint and may remove and review the performance of the chief executive officer of the ,board4 7#b7 ,powers ,the chief executive officer of the ,board may appoint1 remove1 and review the performance of any officer or employee of the ,foundation4 4 7c7 ,powers of ,foundation ,section #aac7;c77#a7 of such ,act 7#cc ,u4,s4,c4 #dbac7;c77#a77 is amended1 in the matter preceding subparagraph 7,a7-- 7#a7 by inserting nonprofit before corporation2 and 7#b7 by striking acting as a trustee and inserting formed4 7d7 ,principal office ,section #aac of such ,act 7#cc ,u4,s4,c4 #dbac7 is amended by adding at the end the following3 7g7 ,principal office ,the ,board may locate the principal office of the ,foundation outside the ,district of ,columbia and is encouraged to locate that office in a coastal ,state4 4 7e7 ,best practices ,section #aac of such ,act 7#cc ,u4,s4,c4 #dbac71 as amended by subsection 7d71 is further amended by adding at the end the following3 7h7 ,best practices 7#a7 ,tribal government ,in this paragraph1 the term ,tribal government means the recognized governing body of any ,indian or ,alaska ,native tribe1 band1 nation1 pueblo1 village1 community1 component band1 or component reservation individually identified 7including parenthetically7 in the list published most recently as of the date of enactment of the ,save ,our ,seas #b4j ,amendments ,act pursuant to section #ajd of the ,federally ,recognized ,indian ,tribe ,list ,act of #aiid 7#be ,u4,s4,c4 #eaca74 7#b7 ,best practices ,the ,foundation shall develop and implement best practices for conducting outreach to ,tribal governments and ,indian ,tribes4 7#c7 ,requirements ,the best practices developed under paragraph 7#b7 shall-- 7,a7 include a process to support technical assistance and capacity building to improve outcomes2 and 7,b7 promote an awareness of programs and grants available under this ,act4 4 7f7 ,use of funds ,section #aah of such ,act 7#cc ,u4,s4,c4 #dbah7 is amended-- 7#a7 in subsection 7a7-- 7,a7 in paragraph 7#b71 by striking and ,state and local government agencies and inserting 1 ,state and local government agencies1 ,united ,states and international nongovernmental organizations1 regional organizations1 and foreign government entities2 and 7,b7 in paragraph 7#c7-- 7i7 in the paragraph heading1 by striking ,prohibition and inserting ,limitation2 and 7ii7 by striking subparagraph 7,b7 and inserting the following3 7,b7 ,salaries ,the ,foundation may use ,federal funds described in subparagraph 7,a7 to pay for salaries only during the #bd-month period beginning on the date of the enactment of this ,act4 ,the ,secretary shall not require reimbursement from the ,foundation for any such ,federal funds used to pay for such salaries4 2 and 7#b7 in subsection 7b77#b71 by striking and ,state and local government agencies and inserting 1 ,state and local government agencies1 ,united ,states and international nongovernmental organizations1 regional organizations1 and foreign government entities4 #c4 ,modifications to the ,marine ,debris ,program of the ,national ,oceanic and ,atmospheric ,administration 7a7 ,grants1 cooperative agreements1 contracts1 and other agreements ,section #c7;d7 of the ,marine ,debris ,act 7#cc ,u4,s4,c4 #aieb7;d77 is amended-- 7#a7 in the subsection heading1 by striking and contracts and inserting contracts1 and other agreements2 7#b7 in paragraph 7#a71 by striking and contracts and inserting 1 contracts1 and other agreements2 7#c7 in paragraph 7#b7-- 7,a7 in subparagraph 7,b7-- 7i7 by striking part of the and inserting part of a2 and 7ii7 by inserting or 7,c7 after subparagraph 7,a72 and 7,b7 in subparagraph 7,c71 in the matter preceding clause 7i71 by inserting and except as provided in subparagraph 7,b7 after subparagraph 7,a72 and 7#d7 by adding at the end the following3 7#g7 ,in-kind contributions ,with respect to any project carried out pursuant to a contract or other agreement entered into under paragraph 7#a7 that is not a cooperative agreement or an agreement to provide financial assistance in the form of a grant1 the ,administrator may contribute on an in-kind basis the portion of the costs of the project that the ,administrator determines represents the amount of benefit the ,national ,oceanic and ,atmospheric ,administration derives from the project4 4 7b7 ,receipt and expenditure of funds2 use of resources ,section #c of the ,marine ,debris ,act 7#cc ,u4,s4,c4 #aieb7 is amended by adding at the end the following3 7e7 ,receipt and expenditure of funds ,in order to accomplish the purpose set forth in section #b1 the ,administrator1 acting through the ,program1 may1 only to the extent provided in advance in appropriations ,acts1 receive and expend funds made available by-- 7#a7 any department1 agency1 or instrumentality of the ,united ,states2 7#b7 any ,state1 local1 or tribal government 7or any political subdivision thereof72 7#c7 any foreign government or international organization2 7#d7 any public or private organization2 or 7#e7 any individual4 7f7 ,use of resources ,in order to accomplish the purpose set forth in section #b1 the ,administrator1 acting through the ,program1 may use1 with consent1 with reimbursement1 and subject to the availability of appropriations1 the land1 services1 equipment1 personnel1 and facilities of-- 7#a7 any department1 agency1 or instrumentality of the ,united ,states2 7#b7 any ,state1 local1 or tribal government 7or any political subdivision thereof72 7#c7 any foreign government or international organization2 7#d7 any public or private organization2 or 7#e7 any individual4 4 ,passed the ,senate ,december #bb1 #bjbb4,secretary
