the impaneling of a new jury if a jury  
fails to recommend by unanimous vote a  
sentence for conviction of a crime      
punishable by death4  #a4 ,short title  
,this ,act may be cited as ,eric's ,law4
  #b4 ,requirement to impanel a new jury
 in certain cases  7a7 ,additional      
ground for impaneling jury ,section     
#ceic7;b77#b7 of title #ah1 ,united     
,states ,code1 is amended-- 7#a7 in     
subparagraph 7,c71 by striking or at the
 end2 and  7#b7 by adding at the end the
 following3  7,e7 a new special hearing 
is required pursuant to subsection 7g72 
or  4  7b7 ,impaneling of new jury when 
jury does not reach a unanimous         
recommendation ,section #ceic of title  

#ah1 ,united ,states ,code1 is amended  
by adding at the end the following3  7g7
 ,special rule when jury does not return
 a unanimous recommendation  7#a7 ,in   
general ,if a jury described in         
subsection 7b77#a7 or subparagraphs 7,a7
 through 7,d7 of subsection 7b77#b7 does
 not1 by unanimous vote1 make a         
recommendation whether the defendant    
should be sentenced to death1 to life   
imprisonment without possibility of     
release1 or some other lesser sentence  
pursuant to subsection 7e71 the court1  
upon motion of the attorney for the     
government1 shall order a new special   
hearing and impanel a new jury pursuant 
to subsection 7b74  7#b7 ,imposition of 
sentence ,if the jury impaneled pursuant
 to paragraph 7#a7 does not reach a     
unanimous recommendation as to sentence1
 the court shall impose a sentence other
 than death authorized by law4  4
