,institute of ,manufacturing established under section #c4 7#d7 ,institution of higher education ,the term institution of higher education has the meaning given the term in section #ajb of the ,higher ,education ,act of #aife 7#bj ,u4,s4,c4 #ajjb74 7#e7 ,secondary school ,the term secondary school has the meaning given the term in section #haja of the ,elementary and ,secondary ,education ,act of #aife 7#bj ,u4,s4,c4 #ghja74 7#f7 ,secretary ,the term ,secretary means the ,secretary of ,commerce4 #c4 ,establishment of ,national ,institute of ,manufacturing 7a7 ,establishment ,there is established in the ,department of ,commerce an institute to be known as the ,national ,institute of ,manufacturing4 7b7 ,mission ,the primary missions of the ,institute are to-- 7#a7 ensure global leadership in advanced manufacturing technologies critical to the long-term economic and national security of the ,united ,states2 7#b7 restore and strengthen the ,united ,states industrial commons1 which includes the essential skills1 equipment1 and suppliers that provide the foundation for the innovativeness and competitiveness of all ,united ,states manufacturers2 7#c7 strengthen the technical1 financial1 and educational conditions and assets necessary to ensure that the ,united ,states is the best location for the creation and production of advanced technologies emerging from national research and development investments2 7#d7 capitalize on the scientific and technological advances produced by researchers and innovators in the ,united ,states by developing capable and responsive institutions focused on advancing the technology and manufacturing readiness levels of those advances2 7#e7 support the discovery1 invention1 scale-up1 and transition of new products and manufacturing technologies to full-scale production in the ,united ,states2 7#f7 address the evolving needs of manufacturers to find a diverse set of workers with the necessary skills1 training1 and expertise2 7#g7 improve and expand manufacturing engineering and technology offerings within institutions of higher education and secondary schools to be more closely aligned with the needs of the ,united ,states manufacturing sector and the goal of strengthening the long-term competitiveness of ,united ,states manufacturing2 and 7#h7 work collaboratively with the private sector to leverage the knowledge1 resources1 and programs of the private sector to foster manufacturing in the ,united ,states and anticipate and prepare for emergencies and global1 national1 and regional supply chain disruptions4 7c7 ,functions ,in carrying out the purposes of this ,act1 the ,institute shall-- 7#a7 convene key industry1 academic1 and other stakeholders to identify short-1 medium-1 and long-term needs and priorities of the manufacturing sector in the ,united ,states1 including emergency readiness2 7#b7 monitor the status of technological developments1 critical production capacity1 skill availability1 investment patterns1 emerging defense needs1 and other key indicators of manufacturing competitiveness1 such as key indicators from manufacturing dealers1 to guide investment decisions2 7#c7 initiate and support discovery1 invention1 and translational research in engineering and manufacturing by making contracts or other arrangements1 including grants1 awards1 cooperative agreements1 loans1 and other forms of assistance1 to conduct that research and to assess the impact of that research on the economic well-being1 climate1 and national security of the ,united ,states2 7#d7 administer programs that incentivize and facilitate collaboration among private and public sector stakeholders in ,united ,states manufacturing2 7#e7 award scholarships and graduate fellowships in the engineering and manufacturing disciplines2 7#f7 award industrial1 academic1 and governmental fellowships to faculty and retired manufacturing experts to support the manufacturing interests of the ,united ,states2 7#g7 advise ,united ,states manufacturers on international trade and investment policies in international markets and advise the ,federal ,government on how to expand business opportunities for ,united ,states manufacturers in international markets2 7#h7 develop and assess key indicators of manufacturing competitiveness1 including the geographic diversity of manufacturing in the ,united ,states1 and provide interpretation and analysis of collected data on the manufacturing sector in the ,united ,states2 7#i7 provide small and medium manufacturers1 including new startups1 with financial support1 including loans1 counseling1 training1 technical assistance1 and advocacy2 and 7#aj7 identify opportunities to achieve commercial-scale production of emerging technologies by leveraging government procurement contracts4 7d7 ,director 7#a7 ,in general ,there shall be a ,director of the ,institute1 who shall-- 7,a7 be appointed by the ,president1 by and with the consent of the ,senate2 7,b7 oversee all ,institute activities2 7,c7 serve as an ex-officio member of the ,council2 7,d7 make recommendations regarding1 and manage1 the budget of the ,institute2 and 7,e7 advise and consult with the ,secretary on all policy issues relating to manufacturing4 7#b7 ,exercise of authority of the ,national ,institute of ,manufacturing 7,a7 ,in general ,except as otherwise provided1 the ,director shall exercise all of the authority granted to the ,institute under this ,act1 including any powers and functions that may be delegated to the ,director by the ,secretary4 7,b7 ,final actions ,all actions taken by the ,director under this ,act1 or under the terms of a delegation described in subparagraph 7,a71 shall be final and binding upon the ,institute4 7#c7 ,duties as ,director ,the ,director shall-- 7,a7 coordinate all activities within the ,department of ,commerce relating to manufacturing and advise and consult with the ,secretary on all policy issues relating to manufacturing2 7,b7 advise and consult with the ,secretary on the national security supply chain2 7,c7 monitor the status of technological developments1 critical production capacity1 skill availability1 investment patterns1 emerging defense needs1 and other key indicators of manufacturing competitiveness to coordinate with the ,chief ,financial ,officer and ,assistant ,secretary for ,administration of the ,department of ,commerce in developing the annual budgets for manufacturing-related programs of the ,department of ,commerce2 7,d7 oversee and convene the ,council2 and 7,e7 solicit input from the public and private sectors and academia regarding emerging trends in manufacturing and the responsiveness of ,federal programming4 7#d7 ,term ,the ,director shall serve for a term of #f years1 unless removed earlier by the ,president4 7e7 ,directorates ,unless otherwise provided by the ,director1 there shall be within the ,institute the following ,directorates3 7#a7 ,a ,directorate for ,technology ,development1 which shall-- 7,a7 make competitive awards to support discovery1 invention1 and translational research in the fields of engineering and manufacturing2 7,b7 conduct prize competitions in accordance with section #bd of the ,stevenson-,wydler ,technology ,innovation ,act of #aihj 7#ae ,u4,s4,c4 #cgai7 to stimulate innovation that has the potential to advance manufacturing technology2 7,c7 administer a pilot program establishing translational research centers associated with institutions of higher education1 which will guide and fund research needed to translate laboratory results to testable beta prototypes and facilitate connections with domestic manufacturers to scale domestic production2 and 7,d7 administer other programs and activities that promote technology development4 7#b7 ,a ,directorate for the ,industrial ,commons1 which shall-- 7,a7 administer the ,investing in ,manufacturing ,communities ,partnership2 7,b7 administer the ,manufacturing ,,usa ,program established under section #cd of the ,national ,institute of ,standards and ,technology ,act 7#ae ,u4,s4,c4 #bghs72 and 7,c7 administer other programs and activities that promote robust manufacturing innovation ecosystems and support manufacturing supply chains in the ,united ,states during emergencies4 7#c7 ,a ,directorate for ,education and ,workforce ,development1 which shall-- 7,a7 make competitive awards for scholarships and graduate fellowships2 7,b7 make competitive awards for industrial1 academic1 and governmental fellowships to faculty and retired manufacturing experts2 7,c7 make competitive awards for research1 development1 and evaluation of innovative training programs2 and 7,d7 administer programs and activities that promote the short-term and long-term workforce and education needs of the manufacturing sector4 7#d7 ,a ,directorate for ,small and ,medium ,manufacturers1 which shall-- 7,a7 administer programs for loans1 investment capital1 and surety bonds for small and medium manufacturing firms2 7,b7 administer the ,hollings ,manufacturing ,extension ,partnership ,program established under #be of the ,national ,institute of ,standards and ,technology ,act 7#ae ,u4,s4,c4 #bghk72 and 7,c7 administer other programs and activities that help small and medium manufacturers prosper4 7#e7 ,a ,directorate on ,trade1 which shall-- 7,a7 manage and oversee an ,office of ,manufacturer ,trade1 which shall-- 7i7 advise manufacturers in the ,united ,states on trade2 7ii7 advise the ,united ,states ,trade ,representative1 the ,undersecretary of ,commerce for ,international ,trade1 and other entities in the ,federal ,government on trade to benefit manufacturers in the ,united ,states2 7iii7 receive and solicit recommendations and feedback from manufacturers in the ,united ,states2 and 7iv7 appoint an employee of the ,office to serve as a liaison between-- 7,i7 the ,office2 and 7,,ii7 7aa7 the ,united ,states ,trade ,representative2 and 7bb7 the ,industry ,trade ,advisory ,committees on ,aerospace ,equipment1 ,automotive ,equipment and ,capital ,goods1 and ,steel2 and 7,b7 manage and oversee a ,united ,states ,manufacturer ,trade ,council1 which shall-- 7i7 receive and solicit recommendations and feedback from manufacturers in the ,united ,states2 and 7ii7 in addition to voting members1 be composed of ex-officio members of the ,industry ,trade ,advisory ,committees described in subparagraph 7,a77iv77,,ii77bb74 7f7 ,authorities ,in carrying out the duties of the ,director under this ,act1 the ,director may-- 7#a7 appoint or create such advisory committees as may be appropriate for purposes of consultation and advice to the ,institute in the performance of the functions of the ,institute2 7#b7 issue rules governing the manner of operations of the ,institute2 7#c7 make expenditures necessary for administering the provisions in this ,act2 7#d7 enter into contracts or other arrangements with organizations and individuals in the ,united ,states and foreign countries as the ,director determines necessary to carry out the functions of the ,institute2 7#e7 award scholarships and fellowships to citizens of the ,united ,states for the purpose of study or scientific work in manufacturing2 7#f7 acquire1 construct1 hold1 and dispose of real and personal property as the ,director determines necessary2 and 7#g7 accept unconditional gifts or donations of services1 money1 or property4 7g7 ,advisory committees ,the ,institute shall manage and oversee the following advisory committees3 7#a7 ,the ,council4 7#b7 ,the ,manufacturing ,extension ,partnership ,advisory ,board established under section #be7m7 of the ,national ,institute of ,standards and ,technology ,act 7#ae ,u4,s4,c4 #bghk7m774 7#c7 ,the ,materials ,processing ,equipment ,technical ,advisory ,committee4 7h7 ,patent rights 7#a7 ,in general ,each contract entered into by the ,director shall contain provisions governing the disposition of inventions produced under the contract4 7#b7 ,prohibition ,no officer or employee of the ,institute may acquire or transfer any rights under the patent laws of the ,united ,states for any invention achieved in performing the assigned activities of the officer or employee4 7i7 ,transfer of functions and technical and conforming amendments 7#a7 ,investing in ,manufacturing ,communities ,partnership 7,a7 ,transfer of functions ,all functions of the ,investing in ,manufacturing ,communities ,partnership of the ,department of ,commerce1 including the personnel1 assets1 and obligations of the ,investing in ,manufacturing ,communities ,partnership of the ,department of ,commerce1 as in existence on the day before the date of enactment of this ,act1 shall be transferred to the ,institute4 7,b7 ,deeming of name ,any reference in any law1 regulation1 document1 paper1 or other record of the ,united ,states to the ,investing in having authority over the entity1 or functions relating to the entity1 as of the day before the date of enactment of this ,act shall provide to the ,director such assistance1 including the use of personnel and assets1 as the ,director may request in preparing for the transfer and integration of the entity into the ,institute or a component of the ,institute4 7,b7 ,services and personnel ,during the #a-year period beginning on the date of enactment of this ,act1 upon the request of the ,secretary1 the head of any executive agency may1 on a reimbursable basis1 provide services or detail personnel to assist with the transfer of an entity to the ,institute or a component of the ,institute under subsection 7i74 7#b7 ,incidental transfers ,the ,director of the ,office of ,management and ,budget1 in consultation with the ,director1 shall make such additional incidental dispositions of personnel1 assets1 and liabilities held1 used1 arising from1 available1 or to be made available1 in connection with the functions transferred under subsection 7i71 as the ,director of the ,office of ,management and ,budget may determine necessary to accomplish the purposes of this ,act4 #d4 ,national ,manufacturing ,advisory ,council 7a7 ,establishment ,there is established in the ,department of ,commerce the ,national ,manufacturing ,advisory ,council4 7b7 ,mission ,the mission of the ,council shall be to-- 7#a7 ensure regular communication between the ,federal ,government and the manufacturing sector in the ,united ,states2 7#b7 advise the ,secretary on government policies and government programs that affect ,united ,states manufacturing and provide a forum for discussing and proposing solutions to industry-related problems2 and 7#c7 ensure that the ,united ,states remains the preeminent destination for investment in manufacturing throughout the world4 7c7 ,duties ,the duties of the ,council shall include-- 7#a7 meeting from time to time to provide independent advice and recommendations to the ,secretary regarding issues involving ,united ,states manufacturing2 7#b7 completing specific tasks requested by the ,director or the ,secretary2 7#c7 monitoring the status of technological developments1 critical production capacity1 skill availability1 investment patterns1 emerging defense needs1 and other key indicators of manufacturing competitiveness2 7#d7 soliciting input from the public and private sector and academia regarding emerging trends in manufacturing1 the responsiveness of ,federal programming1 and suggestions for areas of increased ,federal attention2 7#e7 monitoring global manufacturing trends and global threats to manufacturing sectors in the ,united ,states2 7#f7 providing input on providing ,federal assistance for manufacturers relating to-- 7,a7 international trade and investment matters2 7,b7 research and technology development opportunities2 7,c7 workforce development and training programs and opportunities2 7,d7 small and medium manufacturer needs2 and 7,e7 industrial commons and supply chains needs4 7d7 ,charter ,the ,council shall develop a charter to govern the structure and mission of the ,council4 7e7 ,membership 7#a7 ,in general ,the ,council shall-- 7,a7 consist of individuals with a balance of backgrounds1 experiences1 and viewpoints2 and 7,b7 include individuals that directly represent private industry1 academia1 and labor4 7#b7 ,public participation ,the nomination process for membership on the ,council shall include a public nomination process to the maximum extent practicable4 7f7 ,transfer of functions 7#a7 ,transfer of functions ,all functions of the ,manufacturing ,council of the ,international ,trade ,administration of the ,department of ,commerce1 including the personnel1 assets1 and obligations of the ,united ,states ,manufacturing ,council of the ,international ,trade ,administration of the ,department of ,commerce1 as in existence on the day before the date of enactment of this ,act1 shall be transferred to the ,institute4 7#b7 ,deeming of name ,any reference in law1 regulation1 document1 paper1 or other record of the ,united ,states to the ,manufacturing ,council of the ,international ,trade ,administration of the ,department of ,commerce shall be deemed a reference to the ,national ,manufacturing ,advisory ,council4 7#c7 ,unexpended balances ,unexpended balances of appropriations1 authorization1 allocations1 or other funds related to the ,manufacturing ,council of the ,international ,trade ,administration of the ,department of ,commerce shall be available for use by the ,director for which the appropriations1 authorizations1 allocations1 or other funds were originally made available4 7g7 ,permanent authority ,notwithstanding section #ad of the ,federal ,advisory ,committee ,act 7#e ,u4,s4,c4 ,app471 the ,council shall be a permanent authority4 #e4 ,authorization of appropriations ,there is authorized to be appropriated to the ,institute such sums as may be necessary to carry out this ,act4
