committee concerned  ,a ,,bill  ,to     
require the head of each ,federal       
agency1 within #ajj calendar days1 to   
complete all pending ,freedom of        
,information ,act requests related to a 
drug or medical device to prevent1      
diagnose1 mitigate1 or treat            
,,covid-#ai1 gain-of-function or        
potential pandemic pathogen research1 or
 a policy1 rule1 or standard requiring  

,,covid-#ai vaccination of individuals1 
and for other purposes4  #a4 ,short     
title ,this ,act may be cited as the    
,answer ,,covid ,f,o,i,as ,now ,act4    
#b4 ,completion of ,,foia requests      
relating to drugs and medical devices to
 prevent1 diagnose1 mitigate1 or treat  
,,covid-#ai  7a7 ,in general  7#a7      
,completion of requests ,notwithstanding
 any other provision of law1 the head of
 each ,federal agency shall1 not later  
than #ajj calendar days after the date  
of enactment of this ,act1 complete all 
requests for records made under section 
#eeb7;a7 of title #e1 ,united ,states   
,code1 that are-- 7,a7 made to the      
,federal agency2  7,b7 pending as of the
 date of enactment of this ,act2 and    
7,c7 related to-- 7i7 a drug or medical 
device to prevent1 diagnose1 mitigate1  
or treat ,,covid-#ai2  7ii7             
gain-of-function research or potential  
pandemic pathogen research2 or  7iii7 a 
policy1 rule1 or standard requiring     
,,covid-#ai vaccination of individuals4 

7#b7 ,rule of construction ,nothing in  
this ,act shall be construed to require 
the disclosure of information that is   
exempt from disclosure under section    
#eeb7;b7 of title #e1 ,united ,states   
,code4  7b7 ,list of pending requests   
,the head of a ,federal agency shall    
publicly and electronically make        
available a list of all requests        
described in subsection 7a77#a74  7c7   
,reports  7#a7 ,initial report ,not     
later than #g business days after the   
date of enactment of this ,act1 the head
 of each ,federal agency shall provide  
the list required by subsection 7b7 to--
 7,a7 the ,committee on the ,judiciary1 
the ,committee on ,energy and ,commerce1
 and the ,committee on ,oversight and   
,reform of the ,house of                
,representatives2  7,b7 the ,committee  
on the ,judiciary1 the ,committee on    
,health1 ,education1 ,labor1 and        
,pensions1 and the ,committee on        
,homeland ,security and ,governmental   
,affairs of the ,senate2 and  7,c7 the  

,secretary of the ,treasury4  7#b7      
,subsequent report ,not later than #ajj 
calendar days after the date of         
enactment of this ,act1 the head of each
 ,federal agency shall provide a list of
 all requests described in subsection   
7a77#a7 that remain pending1 if any1    
to-- 7,a7 the committees referred to in 
paragraph 7#a72 and  7,b7 the ,secretary
 of the ,treasury4  7d7 ,definitions ,in
 this section3 7#a7 ,the term ,federal  
agency means an agency as that term is  
defined in section #eea of title #e1    
,united ,states ,code4  7#b7 ,the term  
gain-of-function research means any     
research that may be reasonably         
anticipated to confer an attribute to a 
pathogen such that the pathogen would   
have enhanced pathogenicity or          
transmissibility in mammals4  7#c7 ,the 
term potential pandemic pathogen means a
 pathogen that1 prior to any            
gain-of-function research-- 7,a7 is     
likely highly transmissible and likely  
capable of wide and uncontrollable      

spread in human populations2 and  7,b7  
is likely highly virulent and likely to 
cause significant morbidity or mortality
 in humans4  #c4 ,penalty for failure to
 dispose of pending ,,foia requests     
,beginning on the day that is #aja      
calendar days after the date of         
enactment of this ,act1 the ,secretary  
of the ,treasury shall transfer from the
 appropriations account of the office of
 the head of a ,federal agency 7as      
defined in section #b7;d77 to the       
,countermeasures ,injury ,compensation  
,program of the ,health ,resources and  
,services ,administration #a1jjj1jjj for
 each calendar day on which any request 
described in section #b7;a77#a7 remains 
pending with such ,federal agency4  #d4 
,compelling need for expedited          
processing ,with respect to affirming or
 denying a request for expedited        
processing of a record under section    
#eeb7;a77#f77;,e7 of title #e1 ,united  
,states ,code1 a person submitting such 
request to a ,federal agency 7as defined

 in section #b7;d77 shall be deemed to  
have demonstrated a compelling need for 
such record if such record is related   
to-- 7#a7 a drug or medical device to   
prevent1 diagnose1 mitigate1 or treat   
,,covid-#ai2  7#b7 gain-of-function     
research or potential pandemic pathogen 
research 7as such terms are defined in  
section #b7;e772 or  7#c7 a policy1     
rule1 or standard requiring ,,covid-#ai 
vaccination of individuals4
