,to allow women greater access to safe  
and effective contraception4  #a4 ,short
 title ,this ,act may be cited as the   
,allowing ,greater ,access to ,safe and 
,effective ,contraception ,act4  #b4    
,applications for non-prescription      
contraceptive drugs  7a7 ,priority      
review of application ,the ,secretary of
 ,health and ,human ,services 7referred 
to in this section as the ,secretary7   
shall give priority review to any       
supplemental application submitted under
 section #eje7;b7 of the ,federal ,food1
 ,drug1 and ,cosmetic ,act 7#ba         
,u4,s4,c4 #cee7;b77 for a contraceptive 
drug1 provided that--  7#a7 the         
supplemental application is with respect
 to a drug intended for routine use2 and

  7#b7 if the supplemental application  
is approved1 with respect to individuals
 aged #ah and older1 such drug would not
 be subject to section #ejc7;b77#a7 of  
the ,federal ,food1 ,drug1 and ,cosmetic
 ,act 7#ba ,u4,s4,c4 #cec7;b77#a774  7b7
 ,fee waiver ,the ,secretary shall waive
 the fee under section #gcf7;a77#a7 of  
the ,federal ,food1 ,drug1 and ,cosmetic
 ,act 7#ba ,u4,s4,c4 #cgi;h7a77#a77 with
 respect to a supplemental application  
that receives priority review under     
subsection 7a74  7c7 ,over-the-,counter 
availability ,notwithstanding any other 
provision of law1 with respect to       
individuals under age #ah1 a            
contraceptive drug that is eligible for 
priority review under subsection 7a7    
shall be subject to section #ejc7;b77#a7
 of the ,federal ,food1 ,drug1 and      
,cosmetic ,act 7#ba ,u4,s4,c4           
#cec7;b77#a771 including after approval 
of the supplemental application as      
described in subsection 7a77#b74  #c4   
,empowering women to make their own     

health decisions  7a7 ,repeal of tax on 
over-the-,counter medications  7#a7     
,h,s,as ,subparagraph 7,a7 of section   
#bbc7;d77#b7 of the ,internal ,revenue  
,code of #aihf is amended by striking   
,such term and all that follows through 
the period4  7#b7 ,archer ,m,s,as       
,subparagraph 7,a7 of section           
#bbj7;d77#b7 of the ,internal ,revenue  
,code of #aihf is amended by striking   
,such term and all that follows through 
the period4  7#c7 ,health flexible      
spending arrangements and health        
reimbursement arrangements ,section #ajf
 of the ,internal ,revenue ,code of     
#aihf is amended by striking subsection 
7f7 and by redesignating subsection 7g7 
as subsection 7f74  7#d7 ,effective     
dates  7,a7 ,distributions from savings 
accounts ,the amendments made by        
paragraphs 7#a7 and 7#b7 shall apply to 
amounts paid with respect to taxable    
years beginning after ,december #ca1    
#bjai4  7,b7 ,reimbursements ,the       
amendment made by paragraph 7#c7 shall  

apply to expenses incurred with respect 
to taxable years beginning after        
,december #ca1 #bjai4  7b7 ,repeal of   
limitations on contributions to flexible
 spending accounts  7#a7 ,in general    
,section #abe of the ,internal ,revenue 
,code of #aihf is amended by striking   
subsection 7i74  7#b7 ,effective date   
,the amendment made by this subsection  
shall apply to taxable years beginning
