 ,united ,states ,code1 is amended--    
7#a7 in subsection 7a7-- 7,a7 by        
striking 7a77#a7 ,no restricted and all 
that follows through the end of         
paragraph 7#a7 and inserting the        
following3  7a7 ,offense  7#a7 ,in      
general ,it shall be unlawful for a     
restricted person to-- 7,a7 ship1       
transport1 or possess in or affecting   
interstate or foreign commerce any      
biological agent or toxin described in  
paragraph 7#b72 or  7,b7 receive any    
biological agent or toxin described in  
paragraph 7#b7 that has been shipped or 
transported in interstate or foreign    

commerce4  7#b7 ,agents and toxins      
covered ,a biological agent or toxin    
described in this paragraph is a        
biological agent or toxin that-- 7,a7 is
 listed as a non-overlap or overlap     
select biological agent or toxin under  
part #gc of title #db1 ,code of ,federal
 ,regulations1 pursuant to section      
#cea;,a of the ,public ,health ,service 
,act 7#db ,u4,s4,c4 #bfb;a72 and  7,b7  
is not excluded or exempted under part  
#gc of title #db1 ,code of ,federal     
,regulations4  2 and  7,b7 by striking  
7#b7 ,whoever and inserting 7#c7        
,penalty4--,whoever and adjusting the   
margin accordingly2 and  7#b7 in        
subsection 7d71 in the matter preceding 
paragraph 7#a71 by inserting
