and ,windfall ,elimination ,provisions

,short title ,this ,act may be cited as 
the ,social ,security ,fairness for     
,firefighters and ,police ,officers     
,act4  #b4 ,exception from ,government  
,pension ,offset provision for          
firefighters and police officers ,clause
 7i7 of section #bjb7k77#e77;,b7 of the 
,social ,security ,act 7#db ,u4,s4,c4   
#djb7k77#e77;,b77 is amended by striking
 monthly periodic benefits and all that 
follows through the period and inserting
 the following3  monthly periodic       
benefits-- 7,i7 based wholly on service 
as a member of a uniformed service 7as  
defined in section #baj7m771 or  7,,ii7 

with respect to which the period of     
service taken into account in           
determining the amount of the benefit   
includes at least #e years of service of
 the individual as a firefighter 7as    
defined in paragraph 7#d7 of section    
#abjd of the ,omnibus ,crime ,control   
and ,safe ,streets ,act of #aifh 7#cd   
,u4,s4,c4 #ajbhd77 or a law enforcement 
officer 7as defined in paragraph 7#f7 of
 such section74  4  #c4 ,exception from 
,windfall ,elimination ,provisions for  
firefighters and police officers        
,subsections 7a77#g77;,a7 and 7d77#c7 of
 section #bae of the ,social ,security  
,act 7#db ,u4,s4,c4 #dae7 are amended by
 striking section #bcc1 and 7,,iii7 each
 place it appears and inserting section 
#bcc1 7,,iii7 a payment based on service
 described in section                   
#bjb7k77#e77;,b77i77,,ii71 and 7,,iv74  
#d4 ,effective date ,the amendments made
 by this ,act shall apply with respect  
to monthly insurance benefits payable   
under title ,,ii of the ,social         

,security ,act for months after         
,december #bjai4 ,notwithstanding       
section #bae7;f7 of the ,social         
,security ,act1 the ,commissioner of    
,social ,security shall adjust primary  
insurance amounts to the extent         
necessary to take into account the      
amendments made by section #c4
