,education1 ,labor1 and ,pensions  ,a   
,,bill  ,to promote and protect from    
discrimination living organ donors4  #a4
 ,short title ,this ,act may be cited as
 the ,living ,donor ,protection ,act of 
#bjai 4  #b4 ,prohibition on denial of  
coverage or increase in premiums of life
 or disability insurance for living     
organ donors  7a7 ,prohibition          
,notwithstanding any other provision of 
law1 it shall be unlawful to-- 7#a7     
decline or limit coverage of a person   
under any life insurance policy1        
disability insurance policy1 or         
long-term care insurance policy1 due to 
the status of such person as a living   
organ donor2  7#b7 preclude a person    
from donating all or part of an organ as

 a condition of receiving a life        
insurance policy1 disability insurance  
policy1 or long-term care insurance     
policy2  7#c7 consider the status of a  
person as a living organ donor in       
determining the premium rate for        
coverage of such person under a life    
insurance policy1 disability insurance  
policy1 or long-term care insurance     
policy2 or  7#d7 otherwise discriminate 
in the offering1 issuance1 cancellation1
 amount of such coverage1 price1 or any 
other condition of a life insurance     
policy1 disability insurance policy1 or 
long-term care insurance policy for a   
person1 based solely and without any    
additional actuarial risks upon the     
status of such person as a living organ 
donor4  7b7 ,enforcement ,a ,state      
insurance regulator may take such       
actions to enforce subsection 7a7 as are
 specifically authorized under the laws 
of such ,state4  7c7 ,definitions ,in   
this section3 7#a7 ,disability insurance
 policy ,the term disability insurance  

policy means a contract under which an  
entity promises to pay a person a sum of
 money in the event that an illness or  
injury resulting in a disability        
prevents such person from working4  7#b7
 ,life insurance policy ,the term life  
insurance policy means a contract under 
which an entity promises to pay a       
designated beneficiary a sum of money   
upon the death of the insured4  7#c7    
,living organ donor ,the term living    
organ donor means an individual who has 
donated all or part of an organ and is  
not deceased4  7#d7 ,long-term care     
insurance policy ,the term long-term    
care insurance policy means a contract  
for which the only insurance protection 
provided under the contract is coverage 
of qualified long-term care services 7as
 defined in section #ggjb;,b7c7 of the  
,internal ,revenue ,code of #aihf74  #c4
 ,clarification of organ donation       
surgery as qualifying as a serious      
health condition under ,,fmla  7a7      
,private sector employees ,section      

#aja7aa7 of the ,family and ,medical    
,leave ,act of #aiic 7#bi ,u4,s4,c4     
#bfaa7aa77 is amended by inserting      
7including recovery from surgery related
 to organ donation7 after physical or   
mental condition4  7b7 ,federal civil   
service employees  7#a7 ,definition     
,section #fcha7e7 of title #e1 ,united  
,states ,code1 is amended by inserting  
7including recovery from surgery related
 to organ donation7 after physical or   
mental condition4  7#b7 ,relationship to
 organ donor leave ,section #fchb7;d7 of
 title #e1 ,united ,states ,code is     
amended by adding at the end the        
following3 ,an employee who takes any   
part of the #ab-week period of leave    
under subsection 7a77#a7 to serve as an 
organ donor 7including recovery from    
surgery related to organ donation7 shall
 substitute1 for as much of that part as
 possible1 any leave available to the   
employee under section #fcbg44  #d4     
,updating of educational materials on   
the benefits of live organ donation  7a7

 ,educational materials  7#a7 ,review   
and updating ,not later than #f months  
after the date of enactment of this     
,act1 the ,secretary of ,health and     
,human ,services 7in this section       
referred to as the ,secretary7 shall    
review and update materials related to  
live organ donation in order to educate 
the public on--  7,a7 the benefits of   
live organ donation2 and  7,b7 the      
impact of live organ donation on the    
access of a living organ donor to       
insurance4  7#b7 ,information on        
statutory changes ,such updating shall  
include information on the changes made 
by sections #b and #c of this ,act4  7b7
 ,methods of updating ,in carrying out  
subsection 7a71 the ,secretary shall    
update1 as appropriate--  7#a7 ,public  
,service ,announcements previously      
provided by the ,secretary2  7#b7       
publicly accessible websites 7such as   
organdonor4gov1 or a successor website7 
that are maintained by the ,secretary   
and that contain information and        

resources regarding live organ donation2
 and  7#c7 other media determined       
appropriate by the ,secretary4
