twice and referred to the ,committee on ,energy and ,natural ,resources ,a ,,bill ,to survey the gradient boundary along the ,red ,river in the ,states of ,oklahoma and ,texas1 and for other purposes4 #a4 ,short title ,this ,act may be cited as the ,red ,river ,gradient ,boundary ,survey ,act4 #b4 ,definitions ,in this ,act3 7#a7 ,affected area 7,a7 ,in general ,the term affected area means land along the approximately #aaf-mile stretch of the ,red ,river1 from its confluence with the north fork of the ,red ,river on the ,west to the #ihth meridian on the east4 7,b7 ,exclusions ,the term affected area does not include the portion of the ,red ,river within the boundary depicted on the survey prepared by the ,bureau of ,land ,management entitled ,township #e ,south1 ,range #ad ,west1 of the ,indian ,meridian1 ,oklahoma1 ,dependent ,resurvey and ,survey and dated ,february #bh1 #bjjf4 7#b7 ,gradient boundary survey method ,the term gradient boundary survey method means the measurement technique used to locate the ,south ,bank boundary line in accordance with the methodology established in ,oklahoma v4 ,texas1 #bfa ,u4,s4 #cdj 7#aibc7 7recognizing that the boundary line along the ,red ,river is subject to change due to erosion and accretion74 7#c7 ,landowner ,the term landowner means any individual1 group1 association1 corporation1 federally recognized ,indian tribe or member of such an ,indian tribe1 or other private or governmental legal entity that owns an interest in land in the affected area4 7#d7 ,secretary ,the term ,secretary means the ,secretary of the ,interior1 acting through the ,director of the ,bureau of ,land ,management4 7#e7 ,south bank ,the term ,south ,bank means the water-washed and relatively permanent elevation or acclivity 7commonly known as a cut bank7 along the southerly or right side of the ,red ,river that-- 7,a7 separates the bed of that river from the adjacent upland1 whether valley or hill2 and 7,b7 usually serves1 as specified in the fifth paragraph of ,oklahoma v4 ,texas1 #bfa ,u4,s4 #cdj 7#aibc7-- 7i7 to confine the waters within the bed2 and 7ii7 to preserve the course of the river4 7#f7 ,south bank boundary line ,the term ,south ,bank boundary line means the boundary1 with respect to title and ownership1 between the ,states of ,oklahoma and ,texas identified through the gradient boundary survey method that does not impact or alter the permanent political boundary line between the ,states along the ,red ,river1 as outlined under article ,,ii1 section ,b of the ,red ,river ,boundary ,compact enacted by the ,states and consented to by ,congress pursuant to ,public ,law #ajf-bhh 7#aad ,stat4 #iai74 #c4 ,survey of south bank boundary line 7a7 ,survey required 7#a7 ,in general ,the ,secretary shall commission a survey to identify the ,south ,bank boundary line in the affected area4 7#b7 ,requirements ,the survey shall-- 7,a7 adhere to the gradient boundary survey method2 7,b7 span the length of the affected area2 7,c7 be conducted by #a or more independent third-party surveyors that are-- 7i7 licensed and qualified to conduct official gradient boundary surveys2 and 7ii7 selected by the ,secretary1 in consultation with-- 7,i7 the ,texas ,general ,land ,office2 7,,ii7 the ,oklahoma ,commissioners of the ,land ,office1 in consultation with the attorney general of the ,state of ,oklahoma2 and 7,,iii7 each affected federally recognized ,indian ,tribe2 and 7,d7 subject to the availability of appropriations1 be completed not later than #b years after the date of enactment of this ,act4 7b7 ,approval of the boundary survey 7#a7 ,in general ,not later than #fj days after the date on which the survey or a portion of the survey under subsection 7a77#a7 is completed1 the ,secretary shall submit the survey for approval to-- 7,a7 the ,texas ,general ,land ,office2 7,b7 the ,oklahoma ,commissioners of the ,land ,office1 in consultation with the attorney general of the ,state of ,oklahoma2 and 7,c7 each affected federally recognized ,indian ,tribe4 7#b7 ,timing of approval ,not later than #fj days after the date on which each of the ,texas ,general ,land ,office1 the ,oklahoma ,commissioners of the ,land ,office1 in consultation with the attorney general of the ,state of ,oklahoma1 and each affected federally recognized ,indian ,tribe notify the ,secretary of the approval of the boundary survey or a portion of the survey by the applicable office or federally recognized ,indian ,tribe1 the ,secretary shall determine whether to approve the survey or portion of the survey1 subject to paragraph 7#d74 7#c7 ,submission of portions of survey for approval ,as portions of the survey are completed1 the ,secretary may submit the completed portions of the survey for approval under paragraph 7#a74 7#d7 ,written approval ,the ,secretary shall only approve the survey1 or a portion of the survey1 that has the written approval of each of-- 7,a7 the ,texas ,general ,land ,office2 7,b7 the ,oklahoma ,commissioners of the ,land ,office1 in consultation with the attorney general of the ,state of ,oklahoma2 and 7,c7 each affected federally recognized ,indian ,tribe4 #d4 ,survey of individual parcels ,surveys of individual parcels in the affected area shall be conducted in accordance with the boundary survey approved under section #c7;b74 #e4 ,notice and availability of survey ,not later than #fj days after the date on which the boundary survey is approved under section #c7;b71 the ,secretary shall-- 7#a7 publish notice of the approval of the survey in-- 7,a7 the ,federal ,register2 and 7,b7 #a or more local newspapers2 and 7#b7 on request1 furnish to any landowner a copy of-- 7,a7 the survey2 and 7,b7 any field notes relating to-- 7i7 the individual parcel of the landowner2 or 7ii7 any individual parcel adjacent to the individual parcel of the landowner4 #f4 ,effect of ,act ,nothing in this ,act-- 7#a7 modifies any interest of the ,state of ,oklahoma or ,texas1 or the sovereignty1 property1 or trust rights of any federally recognized ,indian ,tribe1 relating to land located north of the ,south ,bank boundary line1 as established by the survey2 7#b7 modifies any land patented under the ,act of ,december #bb1 #aibh 7#de ,stat4 #ajfi1 chapter #dg2 #dc ,u4,s4,c4 #ajfh7 7commonly known as the ,color of ,title ,act71 before the date of enactment of this ,act2 7#c7 modifies or supersedes the ,red ,river ,boundary ,compact enacted by the ,states of ,oklahoma and ,texas and consented to by ,congress pursuant to ,public ,law #ajf-bhh 7#aad ,stat4 #iai72 7#d7 creates or reinstates any ,indian reservation or any portion of such a reservation2 7#e7 modifies any interest or any property or trust rights of any individual ,indian allottee2 or 7#f7 alters any valid right of the ,state of ,oklahoma or the ,kiowa1 ,comanche1 or ,apache ,indian tribes to the mineral interest trust fund established under the ,act of ,june #ab1 #aibf 7#dd ,stat4 #gdj1 chapter #egb74 #g4 ,authorization of appropriations ,there is authorized to be appropriated to the ,secretary to carry out this ,act #a1jjj1jjj4
