imposition of sanctions with respect to 
foreign persons that have engaged in    
significant theft of trade secrets of   
,united ,states persons1 and for other  
purposes4  #a4 ,short title ,this ,act  
may be cited as the ,protecting         
,american ,intellectual ,property ,act  
of #bjbj4  #b4 ,imposition of sanctions 
with respect to theft of trade secrets  
of ,united ,states persons  7a7 ,report 
required  7#a7 ,in general ,not later   
than #ahj days after the date of the    
enactment of this ,act1 and not less    
frequently than every #ahj days         
thereafter1 the ,president shall submit 
to the appropriate congressional        
committees a report-- 7,a7 identifying1 
for the #ahj-;day period preceding      
submission of the report-- 7i7 any      
foreign person that has knowingly       
engaged in1 or benefitted from1         
significant theft of trade secrets of   
,united ,states persons1 if the theft of

 such trade secrets is reasonably likely
 to result in1 or has materially        
contributed to1 a significant threat to 
the national security1 foreign policy1  
or economic health or financial         
stability of the ,united ,states2  7ii7 
any foreign person that has provided    
significant financial1 material1 or     
technological support for1 or goods or  
services in support of or to benefit    
significantly from1 such theft2  7iii7  
any entity owned or controlled by1 or   
that has acted or purported to act for  
or on behalf of1 directly or indirectly1
 any foreign person identified under    
clause 7i7 or 7ii72 and  7iv7 any       
foreign person that is a chief executive
 officer or member of the board of      
directors of any foreign entity         
identified under clause 7i7 or 7ii72 and
  7,b7 describing the nature1 objective1
 and outcome of the theft of trade      
secrets each foreign person described in
 subparagraph 7,a77i7 engaged in or     
benefitted from2 and  7,c7 assessing    

whether any chief executive officer or  
member of the board of directors        
described in clause 7iv7 of subparagraph
 7,a7 engaged in1 or benefitted from1   
activity described in clause 7i7 or 7ii7
 of that subparagraph4  7#b7 ,form of   
report ,each report required by         
paragraph 7#a7 shall be submitted in    
unclassified form but may include a     
classified annex4  7b7 ,authority to    
impose sanctions  7#a7 ,sanctions       
applicable to entities ,in the case of a
 foreign entity identified under        
subparagraph 7,a7 of subsection 7a77#a7 
in the most recent report submitted     
under that subsection1 the ,president   
shall impose one of the following3 7,a7 
,blocking of property ,the ,president   
may1 pursuant to the ,international     
,emergency ,economic ,powers ,act 7#ej  
,u4,s4,c4 #agja et seq471 block and     
prohibit all transactions in all        
property and interests in property of   
the entity if such property and         
interests in property are in the ,united

 ,states1 come within the ,united       
,states1 or are or come within the      
possession or control of a ,united      
,states person4  7,b7 ,inclusion on     
entity list ,the ,president may include 
the entity on the entity list maintained
 by the ,bureau of ,industry and        
,security of the ,department of         
,commerce and set forth in ,supplement  
,no4 #d to part #gdd of the ,export     
,administration ,regulations1 for       
activities contrary to the national     
security or foreign policy interests of 
the ,united ,states4  7#b7 ,sanctions   
applicable to individuals ,in the case  
of an individual identified under       
subparagraph 7,a7 of subsection 7a77#a7 
in the most recent report submitted     
under that subsection1 the following    
shall apply3 7,a7 ,blocking of property 
,the ,president shall1 pursuant to the  
,international ,emergency ,economic     
,powers ,act 7#ej ,u4,s4,c4 #agja et    
seq471 block and prohibit all           
transactions in all property and        

interests in property of the individual 
if such property and interests in       
property are in the ,united ,states1    
come within the ,united ,states1 or are 
or come within the possession or control
 of a ,united ,states person4  7,b7     
,visa ban2 exclusion ,the ,secretary of 
,state shall deny a visa to the         
individual and revoke1 in accordance    
with section #bba7;i7 of the            
,immigration and ,nationality ,act 7#h  
,u4,s4,c4 #abja7;i771 any visa or other 
documentation of the individual1 and the
 ,secretary of ,homeland ,security shall
 exclude the individual from the ,united
 ,states4  7c7 ,implementation2         
penalties  7#a7 ,implementation ,the    
,president may exercise all authorities 
provided under sections #bjc and #bje of
 the ,international ,emergency ,economic
 ,powers ,act 7#ej ,u4,s4,c4 #agjb and  
#agjd7 to carry out this section4  7#b7 
,penalties ,a person that violates1     
attempts to violate1 conspires to       
violate1 or causes a violation of       

paragraph 7#a77;,a7 or 7#b77;,a7 of     
subsection 7b7 or any regulation1       
license1 or order issued to carry out   
that paragraph shall be subject to the  
penalties set forth in subsections 7b7  
and 7c7 of section #bjf of the          
,international ,emergency ,economic     
,powers ,act 7#ej ,u4,s4,c4 #agje7 to   
the same extent as a person that commits
 an unlawful act described in subsection
 7a7 of that section4  7d7 ,national    
interest waiver ,the ,president may     
waive the imposition of sanctions under 
subsection 7b7 with respect to a person 
if the ,president-- 7#a7 determines that
 such a waiver is in the national       
interests of the ,united ,states2 and   
7#b7 not more than #ae days after       
issuing the waiver1 submits to the      
appropriate congressional committees a  
notification of the waiver and the      
reasons for the waiver4  7e7            
,termination of sanctions ,sanctions    
imposed under subsection 7b7 with       
respect to a foreign person identified  

in a report submitted under subsection  
7a7 shall terminate if the ,president   
certifies to the appropriate            
congressional committees1 before the    
termination takes effect1 that the      
person is no longer engaged in the      
activity identified in the report4  7f7 
,exceptions  7#a7 ,intelligence         
activities ,this section shall not apply
 with respect to activities subject to  
the reporting requirements under title  
,v of the ,national ,security ,act of   
#aidg 7#ej ,u4,s4,c4 #cjia et seq47 or  
any authorized intelligence activities  
of the ,united ,states4  7#b7 ,law      
enforcement activities ,sanctions under 
this section shall not apply with       
respect to any authorized law           
enforcement activities of the ,united   
,states4  7#c7 ,exception to comply with
 international agreements ,subsection   
7b77#b77;,b7 shall not apply with       
respect to the admission of an          
individual to the ,united ,states if    
such admission is necessary to comply   

with the obligations of the ,united     
,states under the ,agreement regarding  
the ,headquarters of the ,united        
,nations1 signed at ,lake ,success ,june
 #bf1 #aidg1 and entered into force     
,november #ba1 #aidg1 between the       
,united ,nations and the ,united        
,states1 under the ,convention on       
,consular ,relations1 done at ,vienna   
,april #bd1 #aifc1 and entered into     
force ,march #ai1 #aifg1 or under other 
international agreements4  7g7          
,exception relating to importation of   
goods  7#a7 ,in general ,the authority  
or a requirement to impose sanctions    
under this section shall not include the
 authority or a requirement to impose   
sanctions on the importation of goods4  
7#b7 ,good defined ,in this paragraph1  
the term good means any article1 natural
 or manmade substance1 material1 supply1
 or manufactured product1 including     
inspection and test equipment1 and      
excluding technical data4  7h7

,the term appropriate congressional     
committees means-- 7,a7 the ,committee  
on ,banking1 ,housing1 and ,urban       
,affairs and the ,committee on ,foreign 
,relations of the ,senate2 and  7,b7 the
 ,committee on ,financial ,services and 
the ,committee on ,foreign ,affairs of  
the ,house of ,representatives4  7#b7   
,export administration regulations ,the 
term ,export ,administration            
,regulations means subchapter ,c of     
chapter ,,vii of title #ae1 ,code of    
,federal ,regulations4  7#c7 ,foreign   
entity ,the term foreign entity means an
 entity that is not a ,united ,states   
person4  7#d7 ,foreign person ,the term 
foreign person means a person that is   
not a ,united ,states person4  7#e7     
,trade secret ,the term trade secret has
 the meaning given that term in section 
#ahci of title #ah1 ,united ,states     
,code4  7#f7 ,person ,the term person   
means an individual or entity4  7#g7    
,united states person ,the term ,united 

,states person means-- 7,a7 a ,united   
,states citizen or an alien lawfully    
admitted for permanent residence to the 
,united ,states2  7,b7 an entity        
organized under the laws of the ,united 
,states or of any jurisdiction within   
the ,united ,states1 including a foreign
 branch of such an entity2 or  7,c7 any
