following bill2 which was read twice and
 referred to the ,committee on ,homeland
 ,security and ,governmental ,affairs   
,a ,,bill  ,to require the ,federal     
,government to provide critical health  
care resources in response to the       
,,covid-#ai pandemic4  #a4 ,short title 
,this ,act may be cited as the          
,emergency ,medical ,supplies           
,procurement ,act4  #b4 ,federal        
provision of critical health care       
resources  7a7 ,requirement ,to provide 
critical health care resources  7#a7 ,in
 general ,the ,president1 acting through
 the ,administrator of the ,federal     
,emergency ,management ,agency1 and in  
consultation with the ,secretary of     
,health and ,human ,services and the    
head of any other relevant ,federal     
agency1 shall fulfill1 to the greatest  
extent possible and with due urgency1   

according to need1 all requests from    
,states for critical health care        
resources that are required to support  
medical providers1 treat patients1 or   
promote the general well-being in       
response to1 or to recover from1 the    
outbreak of ,,covid-#ai4  7#b7 ,use of  
authorities ,to carry out paragraph     
7#a71 the ,president shall make use of  
any and all available authorities at the
 disposal of the ,federal ,government to
 procure1 manufacture1 and support the  
manufacturing of critical health care   
resources1 including emergency          
authorities such as the ,defense        
,production ,act of #aiej 7#ej ,u4,s4,c4
 #deaa et seq471 the ,national          
,emergencies ,act 7#ej ,u4,s4,c4 #afja  
et seq471 and the ,robert ,t4 ,stafford 
,disaster ,relief and ,emergency        
,assistance ,act 7#db ,u4,s4,c4 #eaba et
 seq474  7#c7 ,determination of         
emergency end date ,the ,secretary of   
,health and ,human ,services and the    
,administrator of the ,federal          

,emergency ,management ,agency shall    
jointly-- 7,a7 determine the date on    
which all requests from ,states for     
critical health care resources related  
to the outbreak of ,,covid-#ai are      
fulfilled or otherwise resolved1 which  
shall not be earlier than the day after 
the date on which no new cases of       
,,covid-#ai are reported in the ,united 
,states for a period of not less than   
#ad consecutive days2 and  7,b7 promptly
 submit to ,congress and the ,secretary 
of the ,treasury a certification        
indicating the date determined under    
subparagraph 7,a74  7b7 ,reports to     
,congress ,not later than #g days after 
the date of enactment of this ,act1 and 
every #g days thereafter until the      
,,covid-#ai emergency end date1 the     
,secretary of ,health and ,human        
,services and the ,administrator of the 
,federal ,emergency ,management ,agency 
shall jointly submit to ,congress a     
report on the implementation of and     
activities authorized by this section1  

including information on-- 7#a7 the use 
of funds2  7#b7 the number of requests  
received from ,states for critical      
health care resources1 including the    
contents of the requests and the dates  
on which the requests are received and  
fulfilled2  7#c7 if any ,state request  
received has not been fulfilled or has  
been partially fulfilled1 the reasons   
why the request was not fully fulfilled2
  7#d7 the distribution of critical     
health care resources by ,state1        
geographic area1 and need2  7#e7 the    
criteria or methodology used to guide   
the prioritization of ,state requests   
and the distribution of critical health 
care resources2 and  7#f7 the sources of
 the critical health care resources     
provided to ,states1 including the      
prices paid by the ,federal ,government 
for such critical health care resources 
and to which suppliers such amounts were
 paid4  7c7 ,funding2 limitations  7#a7 
,funding ,there is appropriated1 out of 
amounts in the ,treasury not otherwise  

appropriated1 for the fiscal year ending
 ,september #cj1 #bjbj1 to remain       
available until the ,,covid-#ai         
emergency end date1 #ge1jjj1jjj1jjj to  
the ,federal ,emergency ,management     
,agency to carry out this section4  7#b7
 ,limitation ,no funds made available   
under this section shall be provided    
to-- 7,a7 any person who is a ,federal  
elected official or serving in a ,senior
 ,executive ,service position2 or  7,b7 
any entity that is controlled in whole  
or in part by a ,federal elected        
official or serving in a ,senior        
,executive ,service position4  7#c7     
,emergency designation  7,a7 ,in general
 ,the amounts provided under this       
section are designated as an emergency  
requirement pursuant to section #d7;g7  
of the ,statutory ,pay-,as-,you-,go ,act
 of #bjaj 7#b ,u4,s4,c4 #icc7;g774  7,b7
 ,designation in ,senate ,in the        
,senate1 this section is designated as  
an emergency requirement pursuant to    
section #daab7;a7 of ,h4 ,con4 ,res4 #ga

 7#aaeth ,congress71 the concurrent     
resolution on the budget for fiscal year
 #bjah4  7d7 ,definitions ,in this      
section-- 7#a7 the term ,,covid-#ai     
emergency end date means the date on    
which all requests from ,states for     
critical health care resources related  
to the outbreak of ,,covid-#ai are      
fulfilled or otherwise resolved1 as     
certified by the ,administrator of the  
,federal ,emergency ,management ,agency 
and the ,secretary of ,health and ,human
 ,services under subsection 7a77#c72    
7#b7 the term critical health care      
resources includes-- 7,a7 personal      
protective equipment 7such as surgical  
masks1 ,n-#ie respirator masks1 surgical
 gowns1 and face visors72  7,b7         
ventilators2  7,c7 testing reagents and 
compounds2  7,d7 approved vaccines1     
therapeutics1 diagnostics1              
pharmaceuticals1 small molecule active  
pharmaceutical ingredients1 and other   
necessary drugs2  7,e7 ancillary medical
 supplies1 and other applicable supplies

 required for the administration of     
drugs1 vaccines and other biological    
products1 medical devices1 and          
diagnostic tests2 and  7,f7 other       
medical supplies or hospital            
infrastructure1 as necessary2  7#c7 the 
term ,senior ,executive ,service        
position has the meaning given that term
 in section #cacb7;a7 of title #e1      
,united ,states ,code2 and  7#d7 the    
term ,state means-- 7,a7 each of the    
several ,states of the ,united ,states2 
7,b7 the ,district of ,columbia2  7,c7  
the ,commonwealth of ,puerto ,rico2

7,f7 the ,commonwealth of the ,northern
