,security ,act to establish a ,coronavirus ,local ,community ,stabilization ,fund4 #a4 ,short title ,this ,act may be cited as the ,state ,municipal ,assistance for ,response and ,transition ,act or the ,,smart ,act4 #b4 ,coronavirus ,local ,community ,stabilization ,fund 7a7 ,in general ,title ,,vi of the ,social ,security ,act1 as added by section #ejja7;a7 of the ,coronavirus ,aid1 ,relief1 and ,economic ,security ,act 7,public ,law #aaf-acf71 is amended by adding at the end the following3 #fjb4 ,coronavirus ,local ,community ,stabilization ,fund 7a7 ,appropriation 7#a7 ,in general ,out of any money in the ,treasury of the ,united ,states not otherwise appropriated1 there are appropriated for making payments to ,states under this section1 #ejj1jjj1jjj1jjj for fiscal year #bjbj1 to remain available until expended4 7#b7 ,reservation of funds ,of the amount appropriated under paragraph 7#a71 the ,secretary shall reserve #af1jjj1jjj1jjj of such amount for making payments to ,tribal governments under subsection 7c77#g74 7b7 ,authority ,to make payments 7#a7 ,in general ,the ,secretary shall pay each ,state the following amounts3 7,a7 ,not later than #cj days after the date of enactment of this section1 the relative population proportion amount determined for the ,state under subsection 7c77#a74 7,b7 ,not later than #cj days after the date of enactment of this section1 the relative infected population proportion amount determined for the ,state under subsection 7c77#b74 7,c7 ,as soon as practicable after ,december #ca1 #bjbj1 the relative lost revenue proportion amount determined for the ,state under subsection 7c77#c74 7#b7 ,amounts reserved for payments to local governments ,a ,state shall reserve #a_/c of each amount received by the ,state under paragraph 7#a7 to make direct payments to units of local government in the ,state under subsection 7c77#f74 7c7 ,payment amounts 7#a7 ,relative population proportion amount ,subject to paragraph 7#e71 the relative population proportion amount for a ,state is the product of-- 7,a7 #afa1ccc1ccc1ccc2 and 7,b7 the amount equal to the quotient of-- 7i7 the population of the ,state2 and 7ii7 the total population of all ,states4 7#b7 ,relative infected population proportion amount ,subject to subparagraph 7#e71 the relative infected population proportion amount determined under this paragraph for a ,state is the product of-- 7,a7 #afa1ccc1ccc1ccc2 and 7,b7 the quotient of-- 7i7 the cumulative population of the ,state that has been infected with ,coronavirus ,disease #bjai 7,,covid-#ai7 as of ,june #a1 #bjbj 7including individuals who were infected and have recovered as of such date72 and 7ii7 the total cumulative population of all ,states that has been infected with ,coronavirus ,disease #bjai 7,,covid-#ai7 as of such date 7including individuals who were infected and have recovered as of such date74 7#c7 ,relative lost revenue proportion amount ,the relative lost revenue proportion amount determined under this paragraph for a ,state is the product of-- 7,a7 #afa1ccc1ccc1ccc2 and 7,b7 the quotient of-- 7i7 the lost revenue amount determined for the ,state under paragraph 7#d72 and 7ii7 the sum of the lost revenue amounts determined for all ,states under paragraph 7#d74 7#d7 ,lost revenue amount 7,a7 ,in general ,for purposes of paragraph 7#c71 with respect to a ,state1 the lost revenue amount is the amount equal to the amount by which-- 7i7 the amount of revenue from taxes or other sources for the ,state for calendar year #bjai2 exceeds 7ii7 subject to subparagraph 7,b71 the amount of revenue from taxes or other sources for the ,state for calendar year #bjbj 7as certified by the ,governor of the ,state74 7,b7 ,adjustments to lost revenue amount ,for purposes of subparagraph 7,a77ii71 the amount of revenue from taxes or other sources for a ,state and calendar year #bjbj shall be adjusted in the following manner3 7i7 ,such amount shall exclude any funds received by the ,state in calendar year #bjbj under this title4 7ii7 ,such amount shall be increased by the amount of any reduction to ,state revenue from taxes or other sources for calendar year #bjbj that results from the ,state-- 7,i7 enacting a tax cut1 rebate1 deduction1 or credit2 or 7,,ii7 reducing1 delaying1 or eliminating any fee or other source of revenue4 7iii7 ,such amount shall be reduced by the amount of any expenditures made by the ,state during calendar year #bjbj necessary to meet the non-,federal share contribution requirement of any public assistance that is provided under the ,robert ,t4 ,stafford ,disaster ,relief and ,emergency ,assistance ,act 7#db ,u4,s4,c4 #eaba et seq47 on the basis of a disaster or emergency declaration under such ,act that-- 7,i7 is declared during the period beginning on ,january #a1 #bjbj1 and ending on the date of enactment of this section2 and 7,,ii7 is not related to the ,,covid-#ai pandemic4 7#e7 ,combined minimum payment amount for relative population and relative infected population amounts 7,a7 ,in general ,the sum of the amounts determined under paragraphs 7#a7 and 7#b7 for a ,state described in subparagraph 7,c7 shall not be less than #b1jjj1jjj1jjj4 7,b7 ,pro rata adjustments ,the ,secretary shall adjust on a pro rata basis the amounts determined under paragraph 7#b7 for each ,state described in subparagraph 7,c7 to the extent necessary to comply with the requirement of subparagraph 7,a74 7,c7 ,states described ,the ,states described in this subparagraph are each of the #ej ,states1 the ,district of ,columbia1 and ,puerto ,rico4 7#f7 ,direct payments to units of local government ,not later than #ae days after a ,state receives a payment under paragraph 7#a7 of subsection 7b71 the ,state shall make the following payments from the amount reserved by the ,state under paragraph 7#b7 of that subsection with respect to such ,state payment3 7,a7 ,direct payments to counties and municipalities based on population ,from each of the amounts reserved by a ,state under paragraph 7#b7 of subsection 7b7 with respect to the payments received by the ,state under subparagraphs 7,a7 and 7,b7 of paragraph 7#a7 of that subsection1 the ,state shall pay to each unit of local government in the ,state that is a county or a municipality an amount equal to the product of-- 7i7 #ej percent of the amount so reserved2 and 7ii7 the quotient of-- 7,i7 the population of the county or municipality 7as applicable72 and 7,,ii7 the total population of-- 7aa7 in the case of a county1 all counties in the ,state2 or 7bb7 in the case of a municipality1 all municipalities in the ,state4 7,b7 ,direct payments to counties and municipalities based on lost revenue ,from the amount reserved by a ,state under paragraph 7#b7 of subsection 7b7 with respect to the payment received by the ,state under subparagraph 7,c7 of paragraph 7#a7 of that subsection1 the ,state shall pay to each unit of local government in the ,state that is a county or a municipality an amount equal to the product of-- 7i7 #ej percent of the amount so reserved2 and 7ii7 the quotient of-- 7,i7 the lost revenue amount determined for the county or municipality 7as applicable7 under subparagraph 7,c72 and 7,,ii7 the total lost revenue amounts determined under subparagraph 7,c7 for-- 7aa7 in the case of a county1 all counties in the ,state2 or 7bb7 in the case of a municipality1 all municipalities in the ,state4 7,c7 ,lost revenue amount ,for purposes of subparagraph 7,b71 with respect to a county or municipality1 the lost revenue amount shall be determined in the same manner as the lost revenue amount for a ,state is determined under paragraph 7#d74 7#g7 ,payments to tribal governments ,the amounts paid under this section to ,tribal governments from the amount reserved under subsection 7a77#b7 shall be paid not later than #cj days after the date of enactment of this section1 and shall be determined in the same manner as the amounts paid to ,tribal governments under section #fja7;c77#g7 except that1 for purposes of this section-- 7,a7 the term ,tribal government means the governing body of an ,indian ,tribe included on the most recent list published by the ,secretary pursuant to section #ajd of the ,federally ,recognized ,indian ,tribe ,list ,act of #aiid 7#be ,u4,s4,c4 #eaca72 and 7,b7 the term ,indian ,tribe has the meaning given that term in section #ajb of such ,act 7#be ,u4,s4,c4 #eacj71 except that such term shall not include an ,alaska ,native regional or village corporation established pursuant to the ,alaska ,native ,claims ,settlement ,act 7#dc ,u4,s4,c4 #afja et seq474 7#h7 ,data ,for purposes of this subsection-- 7,a7 the population of ,states1 units of local governments1 and ,indian ,tribes shall be determined based on the most recent year for which data are available from the ,bureau of the ,census2 7,b7 the determination of the populations of ,states infected with ,,covid-#ai shall be based on data from the ,centers for ,disease ,control and ,prevention2 and 7,c7 where ,indian ,tribal population cannot be readily determined by the most recent year for which data are available from the ,bureau of the ,census1 the ,department may consider tribal population data from the ,department of ,interior or ,department of ,housing and ,urban ,development4 7d7 ,use of funds 7#a7 ,in general ,amounts paid or distributed under this subsection shall be used-- 7,a7 to cover only those costs of the ,state1 unit of local government1 or ,tribal government that-- 7i7 are necessary expenditures incurred due to the public health emergency with respect to the ,coronavirus ,disease #bjai 7,,covid-#ai7 7including expenditures necessary to meet the non-,federal share contribution requirement of any public assistance that is provided under the ,robert ,t4 ,stafford ,disaster ,relief and ,emergency ,assistance ,act 7#db ,u4,s4,c4 #eaba et seq47 on the basis of a disaster or emergency declaration under such ,act that is declared in calendar year #bjbj2 7ii7 were not accounted for in the budget most recently approved as of ,march #bg1 #bjbj1 for the ,state or local government2 and 7iii7 were incurred during the period that begins on ,march #a1 #bjbj1 and ends on ,december #ca1 #bjbb2 or 7,b7 for expenditures in calendar year #bjbj1 #bjba1 or #bjbb that the ,state1 ,tribal government1 or unit of local government would otherwise be unable to make because of decreased or delayed revenues4 7#b7 ,limitation ,no ,state may use funds made available under this section for deposit into any ,state pension fund4 7e7 ,fair and equitable budgeting requirement ,as a condition for receiving amounts paid under this subsection1 each ,state1 to the extent allowable by ,state law1 shall agree-- 7#a7 to base any cut to funding to units of local government under the ,state budget on emergency need1 and shall ensure that such cuts are balanced to ensure all units of local government are treated fairly2 7#b7 to primarily use economic conditions1 budgetary shortfall1 and revenue loss for each respective county and municipality1 as compared to #bjai levels1 to determine whether any such cut is balanced and appropriate2 and 7#c7 that the ,state legislative body shall have the authority to disapprove such a cut if it violates a condition of paragraph 7#a7 or 7#b74 7f7 ,application of other provisions 7#a7 ,definitions 7,a7 ,in general ,except as otherwise provided in this paragraph and subsection 7c77#g71 the terms used in this section have the meanings given those terms in subsection 7g7 of section #fja4 7,b7 ,county ,the term county means a county1 parish1 or other equivalent county division 7as defined by the ,bureau of the ,census74 7,c7 ,unit of local government ,in this section1 the term unit of local government means a county1 municipality1 town1 township1 village1 parish1 borough1 or other unit of general government below the ,state level4 7#b7 ,oversight ,the amounts paid under this section-- 7,a7 shall be subject to the oversight requirements of subsection 7f7 of section #fja in the same manner as such requirements apply to the amounts paid under that section1 and the recoupment authority under paragraph 7#b7 of that subsection shall apply to oversight of compliance with the use of funds requirements of subsection 7d7 of this section and the fair and equitable budgeting requirements of subsection 7e7 of this section2 and 7,b7 shall be distributed in accordance with all applicable ,federal laws4 7#c7 ,,ig funding authority ,notwithstanding section #fja7;f77#c71 the ,inspector ,general of the ,department of the ,treasury may use the amounts appropriated under that section to carry out oversight and recoupment activities under this section in addition to the oversight and recoupment activities carried out under section #fja7;f74 4 7b7 ,conforming amendments ,section #fja7;d7 of title ,,vi of the ,social ,security ,act1 as added by section #ejja7;a7 of the ,coronavirus ,aid1 ,relief1 and ,economic ,security ,act 7,public ,law #aaf-acf71 is amended-- 7#a7 by redesignating paragraphs 7#a7 through 7#c7 as subparagraphs 7,a7 through 7,c71 respectively1 and adjusting the margins accordingly2 7#b7 in subparagraph 7,a7 7as so redesignated71 by inserting 7including expenditures necessary to meet the non-,federal share contribution requirement of any public assistance that is provided under the ,robert ,t4 ,stafford ,disaster ,relief and ,emergency ,assistance ,act 7#db ,u4,s4,c4 #eaba et seq47 on the basis of a disaster or emergency declaration under such ,act that is declared in calendar year #bjbj7 before the semicolon2 7#c7 in subparagraph 7,c7 7as so redesignated71 by striking the period at the end and inserting 2 and2 7#d7 by striking under this section to cover only and inserting 8under this section-- 7#a7 to cover only-- 2 and 7#e7 by adding at the end the following new paragraph3 7#b7 for expenditures in calendar year #bjbj1 #bjba1 or #bjbb that the ,state1 ,tribal government1 or unit of local government would otherwise be unable to make because of decreased or delayed revenues4 4
