7#hb ,fed4 ,reg4 #bjdbi 7,may #a1 #bjag77 have delivered economic1 cultural1 and ecological benefits to local communities and the ,united ,states2 and 7#c7 legislative actions subsequent to ,presidential declarations1 such as the ,omnibus ,public ,land ,management ,act of #bjji 7,public ,law #aaa-aa2 #abc ,stat4 #iia71 have ratified certain national monuments under review and other national monuments4 ,i ,administration of certain national monuments #aja4 ,definitions ,in this title3 7#a7 ,covered national monument ,the term covered national monument means a national monument described in section #ajc4 7#b7 ,secretary concerned ,the term ,secretary concerned means-- 7,a7 the ,secretary of the ,interior1 with respect to a covered national monument under the joint or exclusive jurisdiction of the ,national ,park ,service1 the ,bureau of ,land ,management1 or the ,united ,states ,fish and ,wildlife ,service2 7,b7 the ,secretary of ,agriculture1 with respect to a covered national monument under the joint or exclusive jurisdiction of the ,forest ,service2 and 7,c7 the ,secretary of ,commerce1 with respect to a covered national monument under the joint or exclusive jurisdiction of the ,national ,oceanic and ,atmospheric ,administration4 #ajb4 ,administration of covered national monuments 7a7 ,in general ,the ,secretary concerned shall administer each national monument described in section #ajc in accordance with-- 7#a7 the one or more applicable ,presidential proclamations specified in that section that apply to the applicable covered national monument2 7#b7 any ,act of ,congress enacted before ,december #d1 #bjag1 that provides for an adjustment to the boundary of1 or a requirement with respect to the administration of1 the applicable covered national monument2 and 7#c7 this ,act4 7b7 ,maps and legal descriptions 7#a7 ,in general ,as soon as practicable after the date of enactment of this ,act1 the ,secretary concerned shall-- 7,a7 conduct a survey of the boundaries of each covered national monument2 and 7,b7 file a map and legal description of each covered national monument with-- 7i7 the ,committee on ,energy and ,natural ,resources of the ,senate2 and 7ii7 the ,committee on ,natural ,resources of the ,house of ,representatives4 7#b7 ,force of law ,the maps and legal descriptions filed under paragraph 7#a77;,b7 shall have the same force and effect as if included in this ,act1 except that the ,secretary concerned may correct errors in the legal descriptions and maps4 7#c7 ,public availability ,the maps and legal descriptions filed under paragraph 7#a77;,b7 shall be on file and available for public inspection in the appropriate offices of the ,secretary concerned4 7c7 ,management plan ,if a management plan has not been prepared for a covered national monument as of the date of enactment of this ,act1 not later than #b years after the date of enactment of this ,act1 the ,secretary concerned shall prepare a management plan for the covered national monument1 in accordance with-- 7#a7 the one or more ,presidential proclamations specified in section #ajc that apply to the applicable covered national means the ,state of ,new ,mexico4 7#d7 ,wilderness area ,the term wilderness area means a wilderness area designated by subsection 7b77#a74 7b7 ,designation of wilderness areas 7#a7 ,in general ,in accordance with the ,wilderness ,act 7#af ,u4,s4,c4 #aaca et seq471 the following areas in the ,state are designated as wilderness and as components of the ,national ,wilderness ,preservation ,system3 7,a7 ,aden lava flow wilderness ,certain land administered by the ,bureau of ,land ,management in ,doa ,ana ,county comprising approximately #bg1fgc acres1 as generally depicted on the map entitled ,potrillo ,mountains ,complex and dated ,september #bg1 #bjah1 which shall be known as the ,aden ,lava ,flow ,wilderness4 7,b7 ,broad canyon wilderness ,certain land administered by the ,bureau of ,land ,management in ,doa ,ana ,county comprising approximately #ac1ijb acres1 as generally depicted on the map entitled ,desert ,peaks ,complex and dated ,october #a1 #bjah1 which shall be known as the ,broad ,canyon ,wilderness4 7,c7 ,cinder cone wilderness ,certain land administered by the ,bureau of ,land ,management in ,doa ,ana ,county comprising approximately #af1ice acres1 as generally depicted on the map entitled ,potrillo ,mountains ,complex and dated ,september #bg1 #bjah1 which shall be known as the ,cinder ,cone ,wilderness4 7,d7 ,east potrillo mountains wilderness ,certain land administered by the ,bureau of ,land ,management in ,doa ,ana and ,luna counties comprising approximately #ab1aee acres1 as generally depicted on the map entitled ,potrillo ,mountains ,complex and dated ,september #bg1 #bjah1 which shall be known as the ,east ,potrillo ,mountains ,wilderness4 7,e7 ,mount riley wilderness ,certain land administered by the ,bureau of ,land ,management in ,doa ,ana and ,luna counties comprising approximately #h1chb acres1 as generally depicted on the map entitled ,potrillo ,mountains ,complex and dated ,september #bg1 #bjah1 which shall be known as the ,mount ,riley ,wilderness4 7,f7 ,organ mountains wilderness ,certain land administered by the ,bureau of ,land ,management in ,doa ,ana ,county comprising approximately #ai1iaf acres1 as generally depicted on the map entitled ,organ ,mountains ,area and dated ,september #ba1 #bjaf1 which shall be known as the ,organ ,mountains ,wilderness1 the boundary of which shall be offset #djj feet from the centerline of ,dripping ,springs ,road in ,t4 #bc ,s41 ,r4 #jd ,e41 sec4 #g1 ,new ,mexico ,principal ,meridian4 7,g7 ,potrillo mountains wilderness ,certain land administered by the ,bureau of ,land ,management in ,doa ,ana and ,luna counties comprising approximately #aje1jhe acres1 as generally depicted on the map entitled ,potrillo ,mountains ,complex and dated ,september #bg1 #bjah1 which shall be known as the ,potrillo ,mountains ,wilderness4 7,h7 ,robledo mountains wilderness ,certain land administered by the ,bureau of ,land ,management in ,doa ,ana ,county comprising approximately #af1ggf acres1 as generally depicted on the map entitled ,desert ,peaks ,complex and dated ,october #a1 #bjah1 which shall be known as the ,robledo ,mountains ,wilderness4 7,i7 ,sierra de las uvas wilderness ,certain land administered by the ,bureau of ,land ,management in ,doa ,ana ,county comprising approximately #aa1aad acres1 as generally depicted on the map entitled ,desert ,peaks ,complex and dated ,october #a1 #bjah1 which shall be known as the ,sierra de las ,uvas ,wilderness4 7,j7 ,whitethorn wilderness ,certain land administered by the ,bureau of ,land ,management in ,doa ,ana and ,luna counties comprising approximately #i1faf acres1 as generally depicted on the map entitled ,potrillo ,mountains ,complex and dated ,september #bg1 #bjah1 which shall be known as the ,whitethorn ,wilderness4 7#b7 ,maps and legal descriptions 7,a7 ,in general ,as soon as practicable after the date of enactment of this ,act1 the ,secretary shall file maps and legal descriptions of the wilderness areas with-- 7i7 the ,committee on ,energy and ,natural ,resources of the ,senate2 and 7ii7 the ,committee on ,natural ,resources of the ,house of ,representatives4 7,b7 ,force of law ,the maps and legal descriptions filed under subparagraph 7,a7 shall have the same force and effect as if included in this ,act1 except that the ,secretary may correct errors in the maps and legal descriptions4 7,c7 ,public availability ,the maps and legal descriptions filed under subparagraph 7,a7 shall be on file and available for public inspection in the appropriate offices of the ,bureau of ,land ,management4 7#c7 ,management ,subject to valid existing rights1 the wilderness areas shall be administered by the ,secretary-- 7,a7 as components of the ,national ,landscape ,conservation ,system2 and 7,b7 in accordance with-- 7i7 this section2 and 7ii7 the ,wilderness ,act 7#af ,u4,s4,c4 #aaca et seq471 except that-- 7,i7 any reference in the ,wilderness ,act to the effective date of that ,act shall be considered to be a reference to the date of enactment of this ,act2 and 7,,ii7 any reference in the ,wilderness ,act to the ,secretary of ,agriculture shall be considered to be a reference to the ,secretary4 7#d7 ,incorporation of acquired land and interests in land ,any land or interest in land that is within the boundary of a wilderness area that is acquired by the ,united ,states shall-- 7,a7 become part of the wilderness area within the boundaries of which the land is located2 and 7,b7 be managed in accordance with-- 7i7 the ,wilderness ,act 7#af ,u4,s4,c4 #aaca et seq472 7ii7 this section2 and 7iii7 any other applicable laws4 7#e7 ,grazing ,grazing of livestock in the wilderness areas1 where established before the date of enactment of this ,act1 shall be administered in accordance with-- 7,a7 section #d7;d77#d7 of the ,wilderness ,act 7#af ,u4,s4,c4 #aacc7;d77#d772 and 7,b7 the guidelines set forth in ,appendix ,a of the ,report of the ,committee on ,interior and ,insular ,affairs to accompany ,h4,r4 #begj of the #ajast ,congress 7,h4 ,rept4 #aja-dje74 7#f7 ,military overflights ,nothing in this subsection restricts or precludes-- 7,a7 low-level overflights of military aircraft over the wilderness areas1 including military overflights that can be seen or heard within the wilderness areas2 7,b7 the designation of new units of special airspace over the wilderness areas2 or 7,c7 the use or establishment of military flight training routes over the wilderness areas4 7#g7 ,buffer zones 7,a7 ,in general ,nothing in this subsection creates a protective perimeter or buffer zone around any wilderness area4 7,b7 ,activities outside wilderness areas ,the fact that an activity or use on land outside any wilderness area can be seen or heard within the wilderness area shall not preclude the activity or use outside the boundary of the wilderness area4 7#h7 ,paragliding ,the use of paragliding within areas of the ,east ,potrillo ,mountains ,wilderness designated by paragraph 7#a77;,d7 in which the use has been established before the date of enactment of this ,act1 shall be allowed to continue in accordance with section #d7;d77#a7 of the ,wilderness ,act 7#af ,u4,s4,c4 #aacc7;d77#a771 subject to any terms and conditions that the ,secretary determines to be necessary4 7#i7 ,climatologic data collection ,subject to such terms and conditions as the ,secretary may prescribe1 nothing in this section precludes the installation and maintenance of hydrologic1 meteorologic1 or climatologic collection devices in wilderness areas if the facilities and access to the facilities are essential to flood warning1 flood control1 or water reservoir operation activities4 7#aj7 ,fish and wildlife ,nothing in this section affects the jurisdiction of the ,state with respect to fish and wildlife located on public land in the ,state1 except that the ,secretary1 after consultation with the ,new ,mexico ,department of ,game and ,fish1 may designate zones where1 and establish periods during which1 no hunting or fishing shall be permitted for reasons of public safety1 administration1 or compliance with applicable law4 7#aa7 ,withdrawals 7,a7 ,in general ,subject to valid existing rights1 the ,federal land within the wilderness areas and any land or interest in land that is acquired by the ,united ,states in the wilderness areas after the date of enactment of this ,act is withdrawn from-- 7i7 entry1 appropriation1 or disposal under the public land laws2 7ii7 location1 entry1 and patent under the mining laws2 and 7iii7 operation of the mineral leasing1 mineral materials1 and geothermal leasing laws4 7,b7 ,parcel b ,the approximately #f1dih acres of land generally depicted as ,parcel ,b on the map entitled ,organ ,mountains ,area and dated ,september #ba1 #bjaf1 is withdrawn in accordance with subparagraph 7,a71 except that the land is not withdrawn for purposes of the issuance of oil and gas pipeline or road rights-of-way4 7,c7 ,parcel c ,the approximately #a1big acres of land generally depicted as ,parcel ,c on the map entitled ,organ ,mountains ,area and dated ,september #ba1 #bjaf1 is withdrawn in accordance with subparagraph 7,a71 except that the land is not withdrawn from disposal under the ,act of ,june #ad1 #aibf 7commonly known as the ,recreation and ,public ,purposes ,act7 7#dc ,u4,s4,c4 #hfi et seq474 7,d7 ,parcel d 7i7 ,in general ,the ,secretary of the ,army shall allow for the conduct of certain recreational activities on the approximately #b1jce acres of land generally depicted as ,parcel ,d on the map entitled ,organ ,mountains ,area and dated ,september #ba1 #bjaf 7referred to in this subparagraph as the parcel71 which is a portion of the public land withdrawn and reserved for military purposes by ,public ,land ,order #hcc dated ,may #ba1 #aieb 7#ag ,fed4 ,reg4 #dhbb74 7ii7 ,outdoor recreation plan 7,i7 ,in general ,the ,secretary of the ,army shall develop a plan for public outdoor recreation on the parcel that is consistent with the primary military mission of the parcel4 7,,ii7 ,requirement ,in developing the plan under subclause 7,i71 the ,secretary of the ,army shall ensure1 to the maximum extent practicable1 that outdoor recreation activities may be conducted on the parcel1 including hunting1 hiking1 wildlife viewing1 and camping4 7iii7 ,closures ,the ,secretary of the ,army may close the parcel or any portion of the parcel to the public as the ,secretary of the ,army determines to be necessary to protect-- 7,i7 public safety2 or 7,,ii7 the safety of the military members training on the parcel4 7iv7 ,transfer of administrative jurisdiction2 withdrawal 7,i7 ,in general ,on a determination by the ,secretary of the ,army that military training capabilities1 personnel safety1 and installation security would not be hindered as a result of the transfer to the ,secretary of administrative jurisdiction over the parcel1 the ,secretary of the ,army shall transfer to the ,secretary administrative jurisdiction over the parcel4 7,,ii7 ,withdrawal ,on transfer of the parcel under subclause 7,i71 the parcel shall be-- 7aa7 under the jurisdiction of the ,director of the ,bureau of ,land ,management2 and 7bb7 withdrawn from-- 7,,aa7 entry1 appropriation1 or disposal under the public land laws2 7,,bb7 location1 entry1 and patent under the mining laws2 and 7,,cc7 operation of the mineral leasing1 mineral materials1 and geothermal leasing laws4 7,,iii7 ,reservation ,on transfer under subclause 7,i71 the parcel shall be reserved for management of the resources of1 and military training conducted on1 the parcel in accordance with a memorandum of understanding entered into under clause 7v74 7v7 ,memorandum of understanding relating to military training 7,i7 ,in general ,if1 after the transfer of the parcel under clause 7iv77,i71 the ,secretary of the ,army requests that the ,secretary enter into a memorandum of understanding1 the ,secretary shall enter into a memorandum of understanding with the ,secretary of the ,army providing for the conduct of military training on the parcel4 7,,ii7 ,requirements ,the memorandum of understanding entered into under subclause 7,i7 shall-- 7aa7 address the location1 frequency1 and type of training activities to be conducted on the parcel2 7bb7 provide to the ,secretary of the ,army access to the parcel for the conduct of military training2 7cc7 authorize the ,secretary or the ,secretary of the ,army to close the parcel or a portion of the parcel to the public as the ,secretary or the ,secretary of the ,army determines to be necessary to protect-- 7,,aa7 public safety2 or 7,,bb7 the safety of the military members training2 and 7dd7 to the maximum extent practicable1 provide for the protection of natural1 historic1 and cultural resources in the area of the parcel4 7vi7 ,military overflights ,nothing in this subparagraph restricts or precludes-- 7,i7 low-level overflights of military aircraft over the parcel1 including military overflights that can be seen or heard within the parcel2 7,,ii7 the designation of new units of special airspace over the parcel2 or 7,,iii7 the use or establishment of military flight training routes over the parcel4 7#ab7 ,robledo mountains 7,a7 ,in general ,the ,secretary shall manage the ,federal land described in subparagraph 7,b7 in a manner that preserves the character of the land for the future inclusion of the land in the ,national ,wilderness ,preservation ,system4 7,b7 ,land description ,the land referred to in subparagraph 7,a7 is certain land administered by the ,bureau of ,land ,management1 comprising approximately #ajj acres as generally depicted as ,lookout ,peak ,communication ,site on the map entitled ,desert ,peaks ,complex and dated ,october #a1 #bjah4 7,c7 ,uses ,the ,secretary shall permit only such uses on the land described in subparagraph 7,b7 as were permitted on the date of enactment of this ,act4 7#ac7 ,release of wilderness study areas ,congress finds that1 for purposes of section #fjc7;c7 of the ,federal ,land ,policy and ,management ,act of #aigf 7#dc ,u4,s4,c4 #aghb7;c771 the public land in ,doa ,ana ,county administered by the ,bureau of ,land ,management not designated as wilderness by paragraph 7#a7 or described in paragraph 7#ab7-- 7,a7 has been adequately studied for wilderness designation2 7,b7 is no longer subject to section #fjc7;c7 of the ,federal ,land ,policy and ,management ,act of #aigf 7#dc ,u4,s4,c4 #aghb7;c772 and 7,c7 shall be managed in accordance with-- 7i7 the ,federal ,land ,policy and ,management ,act of #aigf 7#dc ,u4,s4,c4 #agja et seq472 7ii7 this section2 and 7iii7 any other applicable laws4 7#ad7 ,private land ,in accordance with section #e of the ,wilderness ,act 7#af ,u4,s4,c4 #aacd71 the ,secretary shall ensure adequate access to non-,federal land located within the boundary of a wilderness area4 7c7 ,border security 7#a7 ,in general ,nothing in this section-- 7,a7 prevents the ,secretary of ,homeland ,security from undertaking law enforcement and border security activities1 in accordance with section #d7;c7 of the ,wilderness ,act 7#af ,u4,s4,c4 #aacc7;c771 within the wilderness areas1 including the ability to use motorized access within a wilderness area while in pursuit of a suspect2 7,b7 affects the #bjjf ,memorandum of ,understanding among the ,department of ,homeland ,security1 the ,department of the ,interior1 and the ,department of ,agriculture regarding cooperative national security and counterterrorism efforts on ,federal land along the borders of the ,united ,states2 or 7,c7 prevents the ,secretary of ,homeland ,security from conducting any low-level overflights over the wilderness areas that may be necessary for law enforcement and border security purposes4 7#b7 ,withdrawal and administration of certain area 7,a7 ,withdrawal ,the area identified as ,parcel ,a on the map entitled ,potrillo ,mountains ,complex and dated ,september #bg1 #bjah1 is withdrawn in accordance with subsection 7b77#aa77;,a74 7,b7 ,administration ,except as provided in subparagraphs 7,c7 and 7,d71 the ,secretary shall administer the area described in subparagraph 7,a7 in a manner that1 to the maximum extent practicable1 protects the wilderness character of the area4 7,c7 ,use of motor vehicles ,the use of motor vehicles1 motorized equipment1 and mechanical transport shall be prohibited in the area described in subparagraph 7,a7 except as necessary for-- 7i7 the administration of the area 7including the conduct of law enforcement and border security activities in the area72 or 7ii7 grazing uses by authorized permittees4 7,d7 ,effect of subsection ,nothing in this paragraph precludes the ,secretary from allowing within the area described in subparagraph 7,a7 the installation and maintenance of communication or surveillance infrastructure necessary for law enforcement or border security activities4 7#c7 ,restricted ,route ,the route excluded from the ,potrillo ,mountains ,wilderness identified as ,restricted--,administrative ,access on the map entitled ,potrillo ,mountains ,complex and dated ,september #bg1 #bjah1 shall be-- 7,a7 closed to public access2 but 7,b7 available for administrative and law enforcement uses1 including border security activities4 7d7 ,organ ,mountains-,desert ,peaks ,national ,monument 7#a7 ,management plan ,in preparing and implementing the management plan for the ,monument1 the ,secretary shall include a watershed health assessment to identify opportunities for watershed restoration4 7#b7 ,incorporation of acquired state trust land and interests in state trust land 7,a7 ,in general ,any land or interest in land that is within the ,state trust land described in subparagraph 7,b7 that is acquired by the ,united ,states shall-- 7i7 become part of the ,monument2 and 7ii7 be managed in accordance with-- 7,i7 ,presidential ,proclamation #iaca1 as issued on ,may #ba1 #bjad 7#ed ,u4,s4,c4 #cbjcja note72 7,,ii7 this section2 and 7,,iii7 any other applicable laws4 7,b7 ,description of state trust land ,the ,state trust land referred to in subparagraph 7,a7 is the ,state trust land in ,t4 #bb ,s41 ,r4 #ja ,w41 ,new ,mexico ,principal ,meridian and ,t4 #bb ,s41 ,r4 #jb ,w41 ,new ,mexico ,principal ,meridian4 7#c7 ,land exchanges 7,a7 ,in general ,subject to subparagraphs 7,c7 through 7,f71 the ,secretary shall attempt to enter into an agreement to initiate an exchange under section #bbja4a of title #dc1 ,code of ,federal ,regulations 7or successor regulations71 with the ,commissioner of ,public ,lands of ,new ,mexico1 by the date that is #ah months after the date of enactment of this ,act1 to provide for a conveyance to the ,state of all right1 title1 and interest of the ,united ,states in and to ,bureau of ,land ,management land in the ,state identified under subparagraph 7,b7 in exchange for the conveyance by the ,state to the ,secretary of all right1 title1 and interest of the ,state in and to parcels of ,state trust land within the boundary of the ,monument identified under that subparagraph or described in paragraph 7#b77;,b74 7,b7 ,identification of land for exchange ,the ,secretary and the ,commissioner of ,public ,lands of ,new ,mexico shall jointly identify the ,bureau of ,land ,management land and ,state trust land eligible for exchange under this paragraph1 the exact acreage and legal description of which shall be determined by surveys approved by the ,secretary and the ,new ,mexico ,state ,land ,office4 7,c7 ,applicable law ,a land exchange under subparagraph 7,a7 shall be carried out in accordance with section #bjf of the ,federal ,land ,policy and ,management ,act of #aigf 7#dc ,u4,s4,c4 #agaf74 7,d7 ,conditions ,a land exchange under subparagraph 7,a7 shall be subject to-- 7i7 valid existing rights2 and 7ii7 such terms as the ,secretary and the ,state shall establish4 7,e7 ,valuation1 appraisals1 and equalization 7i7 ,in general ,the value of the ,bureau of ,land ,management land and the ,state trust land to be conveyed in a land exchange under this paragraph-- 7,i7 shall be equal1 as determined by appraisals conducted in accordance with clause 7ii72 or 7,,ii7 if not equal1 shall be equalized in accordance with clause 7iii74 7ii7 ,appraisals 7,i7 ,in general ,the ,bureau of ,land ,management land and ,state trust land to be exchanged under this paragraph shall be appraised by an independent1 qualified appraiser that is agreed to by the ,secretary and the ,state4 7,,ii7 ,requirements ,an appraisal under subclause 7,i7 shall be conducted in accordance with-- 7aa7 the ,uniform ,appraisal ,standards for ,federal ,land ,acquisitions2 and 7bb7 the ,uniform ,standards of ,professional ,appraisal ,practice4 7iii7 ,equalization 7,i7 ,in general ,if the value of the ,bureau of ,land ,management land and the ,state trust land to be conveyed in a land exchange under this paragraph is not equal1 the value may be equalized by-- 7aa7 making a cash equalization payment to the ,secretary or to the ,state1 as appropriate1 in accordance with section #bjf7;b7 of the ,federal ,land ,policy and ,management ,act of #aigf 7#dc ,u4,s4,c4 #agaf7;b772 or 7bb7 reducing the acreage of the ,bureau of ,land ,management land or ,state trust land to be exchanged1 as appropriate4 7,,ii7 ,cash equalization payments ,any cash equalization payments received by the ,secretary under subclause 7,i77aa7 shall be-- 7aa7 deposited in the ,federal ,land ,disposal ,account established by section #bjf7;a7 of the ,federal ,land ,transaction ,facilitation ,act 7#dc ,u4,s4,c4 #bcje7;a772 and 7bb7 used in accordance with that ,act4 7,f7 ,limitation ,no exchange of land shall be conducted under this paragraph unless mutually agreed to by the ,secretary and the ,state4 #cjb4 ,cerro del ,yuta and ,ro ,san ,antonio ,wilderness ,areas 7a7 ,definitions ,in this section3 7#a7 ,map ,the term map means the map entitled ,ro ,grande del ,norte ,national ,monument ,proposed ,wilderness ,areas and dated ,july #bh1 #bjae4 7#b7 ,secretary ,the term ,secretary means the ,secretary of the ,interior4 7#c7 ,wilderness area ,the term wilderness area means a wilderness area designated by subsection 7b77#a74 7b7 ,designation of ,cerro del ,yuta and ,ro ,san ,antonio ,wilderness ,areas 7#a7 ,in general ,in accordance with the ,wilderness ,act 7#af ,u4,s4,c4 #aaca et seq471 the following areas in the ,ro ,grande del ,norte ,national ,monument are designated as wilderness and as components of the ,national ,wilderness ,preservation ,system3 7,a7 ,cerro del yuta wilderness ,certain land administered by the ,bureau of ,land ,management in ,taos ,county1 ,new ,mexico1 comprising approximately #ac1dbj acres as generally depicted on the map1 which shall be known as the ,cerro del ,yuta ,wilderness4 7,b7 ,ro san antonio wilderness ,certain land administered by the ,bureau of ,land ,management in ,ro ,arriba ,county1 ,new ,mexico1 comprising approximately #h1abj acres1 as generally depicted on the map1 which shall be known as the ,ro ,san ,antonio ,wilderness4 7#b7 ,management of wilderness areas ,subject to valid existing rights1 the wilderness areas shall be administered in accordance with the ,wilderness ,act 7#af ,u4,s4,c4 #aaca et seq47 and this section1 except that with respect to the wilderness areas designated by this section-- 7,a7 any reference to the effective date of the ,wilderness ,act shall be considered to be a reference to the date of enactment of this ,act2 and 7,b7 any reference in the ,wilderness ,act to the ,secretary of ,agriculture shall be considered to be a reference to the ,secretary4 7#c7 ,incorporation of acquired land and interests in land ,any land or interest in land within the boundary of the wilderness areas that is acquired by the ,united ,states shall-- 7,a7 become part of the wilderness area in which the land is located2 and 7,b7 be managed in accordance with-- 7i7 the ,wilderness ,act 7#af ,u4,s4,c4 #aaca et seq472 7ii7 this section2 and 7iii7 any other applicable laws4 7#d7 ,grazing ,grazing of livestock in the wilderness areas1 where established before the date of enactment of this ,act1 shall be administered in accordance with-- 7,a7 section #d7;d77#d7 of the ,wilderness ,act 7#af ,u4,s4,c4 #aacc7;d77#d772 and 7,b7 the guidelines set forth in appendix ,a of the ,report of the ,committee on ,interior and ,insular ,affairs to accompany ,h4,r4 #begj of the #ajast ,congress 7,h4 ,rept4 #aja-dje74 7#e7 ,buffer zones 7,a7 ,in general ,nothing in this section creates a protective perimeter or buffer zone around the wilderness areas4 7,b7 ,activities outside wilderness areas ,the fact that an activity or use on land outside a wilderness area can be seen or heard within the wilderness area shall not preclude the activity or use outside the boundary of the wilderness area4 7#f7 ,release of wilderness study areas ,congress finds that1 for purposes of section #fjc7;c7 of the ,federal ,land ,policy and ,management ,act of #aigf 7#dc ,u4,s4,c4 #aghb7;c771 the public land within the ,san ,antonio ,wilderness ,study ,area not designated as wilderness by this subsection-- 7,a7 has been adequately studied for wilderness designation2 7,b7 is no longer subject to section #fjc7;c7 of the ,federal ,land ,policy and ,management ,act of #aigf 7#dc ,u4,s4,c4 #aghb7;c772 and 7,c7 shall be managed in accordance with title ,i4 7#g7 ,maps and legal descriptions 7,a7 ,in general ,as soon as practicable after the date of enactment of this ,act1 the ,secretary shall file the map and legal descriptions of the wilderness areas with-- 7i7 the ,committee on ,energy and ,natural ,resources of the ,senate2 and 7ii7 the ,committee on ,natural ,resources of the ,house of ,representatives4 7,b7 ,force of law ,the map and legal descriptions filed under subparagraph 7,a7 shall have the same force and effect as if included in this ,act1 except that the ,secretary may correct errors in the legal description and map4 7,c7 ,public availability ,the map and legal descriptions filed under subparagraph 7,a7 shall be on file and available for public inspection in the appropriate offices of the ,bureau of ,land ,management4 7#h7 ,national landscape conservation system ,the wilderness areas shall be administered as components of the ,national ,landscape ,conservation ,system4 7#i7 ,fish and wildlife ,nothing in this section affects the jurisdiction of the ,state of ,new ,mexico with respect to fish and wildlife located on public land in the ,state4 7#aj7 ,withdrawals ,subject to valid existing rights1 any ,federal land within the wilderness areas designated by paragraph 7#a71 including any land or interest in land that is acquired by the ,united ,states after the date of enactment of this ,act1 is withdrawn from-- 7,a7 entry1 appropriation1 or disposal under the public land laws2 7,b7 location1 entry1 and patent under the mining laws2 and 7,c7 operation of the mineral leasing1 mineral materials1 and geothermal leasing laws4 7#aa7 ,treaty rights ,nothing in this section enlarges1 diminishes1 or otherwise modifies any treaty rights4 ,,iv ,designation of wilderness areas in ,clark ,county1 ,nevada #dja4 ,findings ,congress finds that-- 7#a7 public land administered by the ,bureau of ,land ,management in the ,county contains unique and spectacular natural1 cultural1 and historical resources1 including-- 7,a7 priceless habitat for numerous species of plants and wildlife2 7,b7 thousands of acres of land that remain in a natural state2 and 7,c7 numerous sites containing significant cultural and historical artifacts2 and 7#b7 continued preservation of the public land would benefit the ,county and all of the ,united ,states by-- 7,a7 ensuring the conservation of ecologically diverse habitat2 7,b7 protecting prehistoric cultural resources2 7,c7 conserving primitive recreational resources2 and 7,d7 protecting air and water quality4 #djb4 ,definitions ,in this title3 7#a7 ,county ,the term ,county means ,clark ,county1 ,nevada4 7#b7 ,map ,the term ,map means the map entitled ,gold ,butte ,national ,conservation ,area and dated ,may #bc1 #bjac4 7#c7 ,public land ,the term public land has the meaning given the term public lands in section #ajc of the ,federal ,land ,policy and ,management ,act of #aigf 7#dc ,u4,s4,c4 #agjb74 7#d7 ,secretary ,the term ,secretary means the ,secretary of the ,interior4 7#e7 ,state ,the term ,state means the ,state of ,nevada4 7#f7 ,wilderness area ,the term wilderness area means a wilderness area designated by section #djc7;a74 #djc4 ,additions to ,national ,wilderness ,preservation ,system 7a7 ,additions ,in furtherance of the ,wilderness ,act 7#af ,u4,s4,c4 #aaca et seq471 the following public land administered by the ,bureau of ,land ,management in the ,county is designated as wilderness and as components of the ,national ,wilderness ,preservation ,system3 7#a7 ,virgin peak wilderness ,certain public land managed by the ,bureau of ,land ,management1 comprising approximately #ah1bif acres1 as generally depicted on the ,map1 which shall be known as the ,virgin ,peak ,wilderness4 7#b7 ,black ridge wilderness ,certain public land managed by the ,bureau of ,land ,management1 comprising approximately #ah1aib acres1 as generally depicted on the ,map1 which shall be known as the ,black ,ridge ,wilderness4 7#c7 ,bitter ridge north wilderness ,certain public land managed by the ,bureau of ,land ,management comprising approximately #ae1aad acres1 as generally depicted on the ,map1 which shall be known as the ,bitter ,ridge ,north ,wilderness4 7#d7 ,bitter ridge south wilderness ,certain public land managed by the ,bureau of ,land ,management1 comprising approximately #ab1fdf acres1 as generally depicted on the ,map1 which shall be known as the ,bitter ,ridge ,wilderness4 7#e7 ,billy goat peak wilderness ,certain public land managed by the ,bureau of ,land ,management1 comprising approximately #cj1dfj acres1 as generally depicted on the ,map1 which shall be known as the ,billy ,goat ,peak ,wilderness4 7#f7 ,million hills wilderness ,certain public land managed by the ,bureau of ,land ,management1 comprising approximately #bd1hah acres1 as generally depicted on the ,map1 which shall be known as the ,million ,hills ,wilderness4 7#g7 ,lime canyon wilderness additions ,certain public land managed by the ,bureau of ,land ,management1 comprising approximately #aj1jfi acres1 as generally depicted on the ,map1 which is incorporated in1 and shall be managed as part of1 the ,lime ,canyon ,wilderness designated by section #bjb7;a77#i7 of the ,clark ,county ,conservation of ,public ,land and ,natural ,resources ,act of #bjjb 7#af ,u4,s4,c4 #aacb note2 ,public ,law #ajg-bhb74 7b7 ,national landscape conservation system ,the wilderness areas shall be administered as components of the ,national ,landscape ,conservation ,system4 7c7 ,road offset ,the boundary of any portion of a wilderness area that is bordered by a road shall be at least #ajj feet away from the centerline of the road so as not to interfere with public access4 7d7 ,map and legal description 7#a7 ,in general ,as soon as practicable after the date of enactment of this ,act1 the ,secretary shall file a map and legal description of each wilderness area with the ,committee on ,natural ,resources of the ,house of ,representatives and the ,committee on ,energy and ,natural ,resources of the ,senate4 7#b7 ,effect ,each map and legal description under paragraph 7#a7 shall have the same force and effect as if included in this title1 except that the ,secretary may correct clerical and typographical errors in the map or legal description4 7#c7 ,availability ,each map and legal description under paragraph 7#a7 shall be on file and available for public inspection in the appropriate offices of the ,bureau of ,land ,management4 #djd4 ,administration 7a7 ,management ,subject to valid existing rights1 the wilderness areas shall be administered by the ,secretary in accordance with the ,wilderness ,act 7#af ,u4,s4,c4 #aaca et seq471 except that-- 7#a7 any reference in that ,act to the effective date of that ,act shall be considered to be a reference to the date of enactment of this ,act2 and 7#b7 any reference in that ,act to the ,secretary of ,agriculture shall be considered to be a reference to the ,secretary4 7b7 ,incorporation of acquired land and interests ,any land or interest in land within the boundaries of a wilderness area that is acquired by the ,united ,states after the date of enactment of this ,act shall be added to1 and administered as part of1 the wilderness area within which the acquired land or interest is located4 7c7 ,water rights 7#a7 ,findings ,congress finds that-- 7,a7 the land designated as a wilderness area-- 7i7 is within the ,mojave ,desert2 7ii7 is arid in nature2 and 7iii7 includes ephemeral streams2 7,b7 the hydrology of the land designated as a wilderness area is locally characterized by complex flow patterns and alluvial fans with impermanent channels2 7,c7 the subsurface hydrogeology of the region within which the land designated as a wilderness area is located is characterized by ground water subject to local and regional flow gradients and artesian aquifers2 7,d7 the land designated as a wilderness area is generally not suitable for use or development of new water resource facilities2 7,e7 there are no actual or proposed water resource facilities and no opportunities for diversion1 storage1 or other uses of water occurring outside the land designated as a wilderness area that would adversely affect the wilderness or other values of the land2 and 7,f7 because of the unique nature and hydrology of the desert land designated as a wilderness area and the existence of the ,clark ,county ,multi-,species ,habitat ,conservation ,plan1 it is possible to provide for proper management and protection of the wilderness1 perennial springs1 and other values of the land in ways different than the methods used in other laws4 7#b7 ,statutory construction 7,a7 ,no reservation ,nothing in this title constitutes an express or implied reservation by the ,united ,states of any water or water rights with respect to the land designated as a wilderness area4 7,b7 ,state rights ,nothing in this title affects any water rights in the ,state existing on the date of enactment of this ,act1 including any water rights held by the ,united ,states4 7,c7 ,no precedent ,nothing in this subsection establishes a precedent with regard to any future wilderness designations4 7,d7 ,no effect on compacts ,nothing in this title limits1 alters1 modifies1 or amends any of the interstate compacts or equitable apportionment decrees that apportion water among and between the ,state and other ,states4 7,e7 ,clark county multi-species habitat conservation plan ,nothing in this title limits1 alters1 modifies1 or amends the ,clark ,county ,multi-,species ,habitat ,conservation ,plan with respect to the land designated as a wilderness area1 including specific management actions for the conservation of perennial springs4 7#c7 ,nevada water law ,the ,secretary shall follow the procedural and substantive requirements of ,state law in order to obtain and hold any water rights not in existence on the date of enactment of this ,act with respect to the land designated as a wilderness area4 7#d7 ,new projects 7,a7 ,definition 7i7 ,in general ,in this paragraph1 the term water resource facility means irrigation and pumping facilities1 reservoirs1 water conservation works1 aqueducts1 canals1 ditches1 pipelines1 wells1 hydropower projects1 and transmission and other ancillary facilities1 and other water diversion1 storage1 and carriage structures4 7ii7 ,exclusion ,in this paragraph1 the term water resource facility does not include wildlife guzzlers4 7,b7 ,no licenses or permits ,except as otherwise provided in this title1 on and after the date of enactment of this ,act1 neither the ,president nor any other officer1 employee1 or agent of the ,united ,states shall fund1 assist1 authorize1 or issue a license or permit for the development of any new water resource facility within the land designated as a wilderness area4 7d7 ,withdrawal ,subject to valid existing rights1 any ,federal land within the wilderness areas1 including any land or interest in land that is acquired by the ,united ,states within the ,gold ,butte ,national ,monument after the date of enactment of this ,act1 is withdrawn from-- 7#a7 entry1 appropriation1 or disposal under the public land laws2 7#b7 location1 entry1 and patent under the mining laws2 and 7#c7 operation of the mineral leasing1 mineral materials1 and geothermal leasing laws4 #dje4 ,adjacent management 7a7 ,no buffer zones ,congress does not intend for the designation of land as wilderness areas to lead to the creation of protective perimeters or buffer zones around the wilderness areas4 7b7 ,nonwilderness activities ,the fact that nonwilderness activities or uses can be seen or heard from areas within a wilderness area shall not preclude the conduct of those activities or uses outside the boundary of the wilderness area4 #djf4 ,military1 law enforcement1 and emergency overflights ,nothing in this title restricts or precludes-- 7#a7 low-level overflights of military1 law enforcement1 or emergency medical services aircraft over the area designated as wilderness by this title1 including military1 law enforcement1 or emergency medical services overflights that can be seen or heard within the wilderness area2 7#b7 flight testing and evaluation2 or 7#c7 the designation or creation of new units of special use airspace1 or the establishment of military1 law enforcement1 or emergency medical services flight training routes1 over the wilderness area4 #djg4 ,release of wilderness study areas 7a7 ,finding ,congress finds that1 for the purposes of section #fjc of the ,federal ,land ,policy and ,management ,act of #aigf 7#dc ,u4,s4,c4 #aghb71 the ,bureau of ,land ,management land in any portion of the wilderness study areas located within the ,gold ,butte ,national ,monument not designated as a wilderness area has been adequately studied for wilderness designation4 7b7 ,release ,any ,bureau of ,land ,management land described in subsection 7a7 that is not designated as a wilderness area-- 7#a7 is no longer subject to section #fjc7;c7 of the ,federal ,land ,policy and ,management ,act of #aigf 7#dc ,u4,s4,c4 #aghb7;c772 7#b7 shall be managed in accordance with-- 7,a7 the land management plans adopted under section #bjb of that ,act 7#dc ,u4,s4,c4 #agab72 and 7,b7 cooperative conservation agreements in existence on the date of enactment of this ,act2 and 7#c7 shall be subject to-- 7,a7 the ,endangered ,species ,act of #aigc 7#af ,u4,s4,c4 #aeca et seq472 and 7,b7 title ,i4 #djh4 ,native ,american cultural and religious uses ,nothing in this title diminishes-- 7#a7 the rights of any ,indian ,tribe2 or 7#b7 ,tribal rights regarding access to ,federal land for ,tribal activities1 including spiritual1 cultural1 and traditional food-gathering activities4 #dji4 ,wildlife management 7a7 ,in general ,in accordance with section #d7;d77#g7 of the ,wilderness ,act 7#af ,u4,s4,c4 #aacc7;d77#g771 nothing in this title affects or diminishes the jurisdiction of the ,state with respect to fish and wildlife management1 including the regulation of hunting1 fishing1 and trapping1 in the wilderness areas4 7b7 ,management activities 7#a7 ,in general ,in furtherance of the purposes and principles of the ,wilderness ,act 7#af ,u4,s4,c4 #aaca et seq471 management activities to maintain or restore fish and wildlife populations and the habitats to support the populations may be carried out within the wilderness areas1 if the activities-- 7,a7 are consistent with relevant wilderness management plans2 and 7,b7 are carried out in accordance with appropriate policies1 such as those set forth in ,appendix ,b of ,house ,report #aja-dje4 7#b7 ,use of motorized vehicles ,the management activities under paragraph 7#a7 may include the occasional and temporary use of motorized vehicles1 if the use1 as determined by the ,secretary1 would-- 7,a7 promote healthy1 viable1 and more naturally distributed wildlife populations that would enhance wilderness values2 and 7,b7 accomplish the purposes described in subparagraph 7,a7 with the minimum impact necessary to reasonably accomplish the task4 7c7 ,existing activities ,consistent with section #d7;d77#a7 of the ,wilderness ,act 7#af ,u4,s4,c4 #aacc7;d77#a77 and in accordance with appropriate policies such as those set forth in ,appendix ,b of ,house ,report #aja-dje1 the ,state may continue to use aircraft 7including helicopters7 to survey1 capture1 transplant1 monitor1 and provide water for wildlife populations1 including bighorn sheep1 and feral stock1 horses1 and burros4 7d7 ,wildlife water development projects ,subject to subsection 7f71 the ,secretary shall authorize structures and facilities1 including existing structures and facilities1 for wildlife water development projects1 including guzzlers1 in the wilderness areas if-- 7#a7 the structures and facilities will1 as determined by the ,secretary1 enhance wilderness values by promoting healthy1 viable and more naturally distributed wildlife populations2 and 7#b7 the visual impacts of the structures and facilities on the wilderness areas can reasonably be minimized4 7e7 ,hunting1 fishing1 and trapping 7#a7 ,in general ,the ,secretary may designate1 by regulation1 areas in which1 and establish periods during which1 for reasons of public safety1 administration1 or compliance with applicable laws1 no hunting1 fishing1 or trapping will be permitted in the wilderness areas4 7#b7 ,consultation ,except in emergencies1 the ,secretary shall consult with the appropriate ,state agency before promulgating regulations under paragraph 7#a74 7f7 ,cooperative agreement ,the ,state1 including a designee of the ,state1 may conduct wildlife management activities in the wilderness areas-- 7#a7 in accordance with the terms and conditions specified in the cooperative agreement between the ,secretary and the ,state entitled ,memorandum of ,understanding between the ,bureau of ,land ,management and the ,nevada ,department of ,wildlife ,supplement ,no4 #i and signed ,november and ,december #bjjc1 including any amendments to the cooperative agreement agreed to by the ,secretary and the ,state2 and 7#b7 subject to all applicable laws 7including regulations74 #daj4 ,wildfire1 insect1 and disease management 7a7 ,in general ,in accordance with section #d7;d77#a7 of the ,wilderness ,act 7#af ,u4,s4,c4 #aacc7;d77#a771 the ,secretary may take such measures in each wilderness area as the ,secretary determines to be necessary for the control of fire1 insects1 and diseases 7including1 as the ,secretary determines to be appropriate1 the coordination of the activities with a ,state or local agency74 7b7 ,effect ,nothing in this title precludes a ,federal1 ,state1 or local agency from conducting wildfire management operations 7including operations using aircraft or mechanized equipment7 in accordance with section #d7;d77#a7 of the ,wilderness ,act 7#af ,u4,s4,c4 #aacc7;d77#a774 #daa4 ,climatological data collection ,subject to such terms and conditions as the ,secretary may require1 nothing in this title precludes the installation and maintenance of hydrologic1 meteorologic1 or climatological collection devices in the wilderness areas if the facilities and access to the facilities are essential to flood warning1 flood control1 and water reservoir operation activities4
