,tribal sovereignty and economic self-sufficiency by settling water rights claims of ,indian ,tribes without lengthy and costly litigation2 7#b7 to ensure the sovereignty of the ,fort ,belknap ,indian ,community and the economy of the ,reservation will be able to depend on the development of the water and other resources of the ,reservation2 7#c7 to transfer a portion of the land within the ancestral territory of the ,fort ,belknap ,indian ,community to restore1 in part1 the historical1 cultural1 and spiritual land of the ,fort ,belknap ,indian ,community2 7#d7 to plan1 design1 and construct the facilities needed to effectively use ,reservation water rights1 consistent with the ,compact and this ,act1 and other resources that are necessary for-- 7,a7 the development of a viable ,reservation economy2 and 7,b7 the implementation of the water rights compact between the ,fort ,belknap ,indian ,community and the ,state2 7#e7 to achieve a fair1 equitable1 and final settlement of claims to water rights in the ,state for-- 7,a7 the ,fort ,belknap ,indian ,community2 and 7,b7 the ,united ,states for the benefit of the ,fort ,belknap ,indian ,community and allottees2 7#f7 to authorize1 ratify1 and confirm the ,compact1 to the extent that the ,compact is consistent with this ,act2 7#g7 to authorize and require the ,secretary-- 7,a7 to execute the ,compact2 7,b7 to make available priority funding from the ,reclamation ,water ,settlement ,fund established by section #ajeja of the ,omnibus ,public ,land ,management ,act of #bjji 7#dc ,u4,s4,c4 #djg72 and 7,c7 to take any other actions necessary to carry out the ,compact in accordance with this ,act2 7#h7 to authorize and appropriate funds1 including for certain economic development initiatives and projects on the ,reservation1 necessary for the implementation of the ,compact and this ,act in order to support a final water rights settlement for the ,fort ,belknap ,indian ,community that results in measurable benefits to the ,tribes and members2 and 7#i7 to authorize the exchange and transfer of certain ,federal and ,state land4 #c4 ,definitions ,in this ,act3 7#a7 ,allottee ,the term allottee means an individual or the ,fort ,belknap ,indian ,community who holds a beneficial real property interest in an allotment of ,indian land that is-- 7,a7 located within the ,reservation2 and 7,b7 held in trust by the ,united ,states4 7#b7 ,blackfeet ,tribe ,the term ,blackfeet ,tribe means the ,blackfeet ,tribe of the ,blackfeet ,indian ,reservation of ,montana4 7#c7 ,commissioner ,the term ,commissioner means the ,commissioner of ,reclamation4 7#d7 ,compact ,the term ,compact means-- 7,a7 the ,fort ,belknap-,montana water rights compact dated ,april #af1 #bjja1 as contained in section #he-bj-ajja of the ,montana ,code ,annotated 7#bjai72 and 7,b7 any exhibit 7including exhibit amendments71 part1 or amendment to the ,compact that is executed to make the ,compact consistent with this ,act4 7#e7 ,,cercla ,the term ,,cercla means the ,comprehensive ,environmental ,response1 ,compensation1 and ,liability ,act of #aihj 7#db ,u4,s4,c4 #ifja et seq474 7#f7 ,dodson ,the term ,dodson means the facilities of the ,milk ,river ,project1 including the ,dodson ,diversion ,dam and ,dodson ,south ,canal1 owned by the ,bureau of ,reclamation and located in the northeastern corner of1 and within the exterior boundary of1 the ,reservation4 7#g7 ,enforceability date ,the term enforceability date means the date described in section #aj7;f74 7#h7 ,fort ,belknap ,indian ,community ,the term ,fort ,belknap ,indian ,community means the ,gros ,ventre and ,assiniboine ,tribes of the ,fort ,belknap ,reservation of ,montana1 a federally recognized ,indian ,tribe included on the list published by the ,secretary pursuant to section #ajd7;a7 of the ,federally ,recognized ,indian ,tribe ,list ,act of #aiid 7#be ,u4,s4,c4 #eaca7;a774 7#i7 ,fort ,belknap ,indian ,community ,council ,the term ,fort ,belknap ,indian ,community ,council means the governing body of the ,fort ,belknap ,indian ,community4 7#aj7 ,fresno ,reservoir ,the term ,fresno ,reservoir means the dam and reservoir of the ,milk ,river ,project1 located on the ,milk ,river #ad miles west of ,havre1 ,montana1 and authorized by the ,act of ,june #af1 #aicc 7#dh ,stat4 #aie1 chapter #ij7 7commonly known as the ,national ,industrial ,recovery ,act74 7#aa7 ,indian ,tribe ,the term ,indian ,tribe has the meaning given the term ,indian tribe in section #d of the ,indian ,self-,determination and ,education ,assistance ,canal and appurtenances4 7#bd7 ,secretary ,the term ,secretary means the ,secretary of the ,interior4 7#be7 ,service contract ,the term service contract means a business or commercial agreement between a contractor and a customer covering maintenance and servicing of facilities over a specified period4 7#bf7 ,state ,the term ,state means the ,state of ,montana4 7#bg7 ,tribal water rights ,the term ,tribal water rights means the water rights of the ,fort ,belknap ,indian ,community1 as described in article ,,iii of the ,compact and this ,act1 including-- 7,a7 the allocation of water to the ,fort ,belknap ,indian ,community from ,lake ,elwell under section #g2 and 7,b7 the water rights of allottees4 7#bh7 ,trust ,fund ,the term ,trust ,fund means the ,fort ,belknap ,indian ,community ,settlement ,trust ,fund established under section #aa7;b77#a74 #d4 ,ratification of ,compact and judicial decree 7a7 ,ratification of compact 7#a7 ,in general ,as modified by this ,act1 the ,compact is authorized1 ratified1 and confirmed4 7#b7 ,amendments ,any amendment to the ,compact executed after the date of enactment of this ,act is authorized1 ratified1 and confirmed to the extent that the amendment is executed to make the ,compact consistent with this ,act4 7b7 ,execution 7#a7 ,in general ,to the extent that the ,compact does not conflict with this ,act1 the ,secretary shall execute the ,compact1 including all exhibits to1 or parts of1 the ,compact requiring the signature of the ,secretary4 7#b7 ,modifications ,nothing in this ,act precludes the ,secretary from approving any modification to an appendix or exhibit to the ,compact that is consistent with this ,act1 to the extent that the modification does not otherwise require congressional approval under section #baaf of the ,revised ,statutes 7#be ,u4,s4,c4 #agg7 or any other applicable provision of ,federal law4 7c7 ,environmental compliance 7#a7 ,in general ,in implementing the ,compact and this ,act1 the ,secretary shall comply with all applicable provisions of-- 7,a7 the ,endangered ,species ,act of #aigc 7#af ,u4,s4,c4 #aeca et seq472 7,b7 the ,national ,environmental ,policy ,act of #aifi 7#db ,u4,s4,c4 #dcba et seq472 and 7,c7 all other applicable environmental laws and regulations4 7#b7 ,effect of execution 7,a7 ,in general ,the execution of the ,compact by the ,secretary under this subsection shall not constitute a major ,federal action for purposes of the ,national ,environmental ,policy ,act of #aifi 7#db ,u4,s4,c4 #dcba et seq474 7,b7 ,compliance ,the ,secretary shall carry out all ,federal compliance activities necessary to implement the ,compact and this ,act4 #e4 ,tribal water rights 7a7 ,confirmation of ,tribal water rights 7#a7 ,in general ,the ,tribal water rights are ratified1 confirmed1 and declared to be valid4 7#b7 ,use ,any use of the ,tribal water rights shall be subject to the terms and conditions of the ,compact and this ,act4 7#c7 ,conflict ,in the event of a conflict between the ,compact and this ,act1 this ,act shall control4 7b7 ,intent of ,congress ,it is the intent of ,congress to provide to each allottee benefits that are equivalent to1 or exceed1 the benefits the allottees possess on the day before the date of enactment of this ,act1 taking into consideration-- 7#a7 the potential risks1 cost1 and time delay associated with litigation that would be resolved by the ,compact and this ,act2 7#b7 the availability of funding under this ,act and from other sources2 7#c7 the availability of water from the ,tribal water rights2 and 7#d7 the applicability of section #g of the ,act of ,february #h1 #ahhg 7#bd ,stat4 #cij1 chapter #aai2 #be ,u4,s4,c4 #cha7 and this ,act to protect the interests of allottees4 7c7 ,trust status of ,tribal water rights ,the ,tribal water rights-- 7#a7 shall be held in trust by the ,united ,states for the use and benefit of the ,fort ,belknap ,indian ,community in accordance with this ,act2 and 7#b7 shall not be subject to forfeiture or abandonment4 7d7 ,allottees 7#a7 ,applicability of the ,act of ,february #h1 #ahhg ,the provisions of section #g of the ,act of ,february #h1 #ahhg 7#bd ,stat4 #cij1 chapter #aai2 #be ,u4,s4,c4 #cha71 relating to the use of water for irrigation purposes1 shall apply to the ,tribal water rights4 7#b7 ,entitlement to water ,any entitlement to the use of water of an allottee under ,federal law shall be satisfied from the ,tribal water rights4 7#c7 ,allocations ,an allottee shall be entitled to a just and equitable allocation of water for irrigation purposes4 7#d7 ,claims 7,a7 ,exhaustion of remedies ,before asserting any claim against the ,united ,states under section #g of the ,act of ,february #h1 #ahhg 7#bd ,stat4 #cij1 chapter #aai2 #be ,u4,s4,c4 #cha71 or any other applicable law1 an allottee shall exhaust remedies available under the ,tribal water code or other applicable ,tribal law4 7,b7 ,action for relief ,after the exhaustion of all remedies available under the ,tribal water code or other applicable ,tribal law1 an allottee may seek relief under section #g of the ,act of ,february #h1 #ahhg 7#bd ,stat4 #cij1 chapter #aai2 #be ,u4,s4,c4 #cha71 or other applicable law4 7#e7 ,authority of the secretary ,the ,secretary shall have the authority to protect the rights of allottees in accordance with this section4 7e7 ,authority of the ,fort ,belknap ,indian ,community 7#a7 ,authority 7,a7 ,in general ,the ,fort ,belknap ,indian ,community shall-- 7i7 govern the use of the ,tribal water rights pursuant to ,tribal law and applicable ,federal law2 and 7ii7 have-- 7,i7 administrative1 regulatory1 and adjudicatory authority over all ,tribal water rights1 including the authority to allocate1 distribute1 use1 and temporarily transfer by service contract1 lease1 exchange1 or other agreement the ,tribal water rights for any use on the ,reservation2 and 7,,ii7 subject to the approval of the ,secretary1 the authority to voluntarily allocate1 distribute1 use1 and temporarily transfer by service contract1 lease1 exchange1 or other agreement the ,tribal water rights off the ,reservation within the ,missouri ,river ,basin4 7,b7 ,modification of ,compact ,if applicable ,state and ,federal laws are amended or expanded after the date of enactment of this ,act to authorize water users to transfer water rights interbasin1 interstate1 or internationally1 the ,compact shall be amended to recognize1 and this ,act shall recognize1 the right and authority of the ,fort ,belknap ,indian ,community to temporarily transfer ,tribal water rights of the ,fort ,belknap ,indian ,community to the same extent permissible for ,state-based and other water rights users4 7#b7 ,requirements ,a service contract1 lease1 exchange1 or other agreement referred to in subclauses 7,i7 and 7,,ii7 of paragraph 7#a77;,a77ii7-- 7,a7 shall be for a term of not more than #ajj years2 7,b7 may include provisions for renewal of the agreement for an additional term of not more than #ajj years2 and 7,c7 shall not permanently alienate any portion of the ,tribal water rights4 7#c7 ,land leases by allottees ,notwithstanding paragraph 7#a71 an allottee may lease any interest in land held by the allottee1 together with any water right determined to be appurtenant to the interest in land1 in accordance with the ,tribal water code4 7#d7 ,deferral or forbearance of tribal water use 7,a7 ,in general ,in accordance with the right of the ,fort ,belknap ,indian ,community to choose to limit the development and use of the ,tribal water rights by the ,fort ,belknap ,indian ,community and to allow the water of the ,tribal water rights to pass through the priority system to be diverted by a third party for compensation1 as negotiated by the ,fort ,belknap ,indian ,community1 the deferral or forbearance of the use of ,tribal water rights shall be permissible4 7,b7 ,limitations ,the deferral or forbearance of the use of the ,tribal water rights under subparagraph 7,a7 shall not be considered to be-- 7i7 a transfer of the ,tribal water rights off the ,reservation under paragraph 7#a77;,a77ii77,,ii72 or 7ii7 a transfer of title of the ,tribal water rights4 7f7 ,tribal water code 7#a7 ,in general ,notwithstanding article ,,iv4,a4#b4 of the ,compact1 not later than #d years after the date on which the ,fort ,belknap ,indian ,community approves the ,compact in accordance with section #aj7;f77#a71 the ,fort ,belknap ,indian ,community shall enact a ,tribal water code that-- 7,a7 is consistent with the ,compact and this ,act2 and 7,b7 provides for-- 7i7 the administration1 management1 regulation1 enforcement1 and governance1 including adjudicatory jurisdiction1 of the ,tribal water rights and all uses of the ,tribal water rights2 and 7ii7 the establishment by the ,fort ,belknap ,indian ,community of the conditions1 permit requirements1 and other requirements for the allocation1 distribution1 and use of the ,tribal water rights1 including irrigation1 livestock1 domestic1 commercial1 municipal1 industrial1 cultural1 and recreational uses4 7#b7 ,inclusions ,subject to paragraph 7#c77;,b77i71 the ,tribal water code shall-- 7,a7 provide that use of water by allottees shall be satisfied with water from the ,tribal water rights2 7,b7 provide for a process by which an allottee may request that the ,fort ,belknap ,indian ,community provide water for irrigation use in accordance with this ,act1 including the provision of water under any allottee lease under section #d of the ,act of ,june #be1 #aiaj 7#cf ,stat4 #hef1 chapter #dca2 #be ,u4,s4,c4 #djc72 7,c7 provide for a due process system that includes a process by which the ,fort ,belknap ,indian ,community can resolve disputes1 including a process for the resolution of-- 7i7 any contested administrative decision1 including any denial of a request for an allocation of water from the ,tribal water rights by-- 7,i7 an allottee for irrigation purposes on allotted land2 7,,ii7 a successor-in-interest to an allottee2 7,,iii7 any other member of the ,fort ,belknap ,indian ,community2 or 7,,iv7 an owner of fee land within the boundaries of the ,reservation2 and 7ii7 the appeal and adjudication of administrative decisions under clause 7i7 and any denied or disputed distribution of water2 and 7,d7 include a requirement that-- 7i7 any allottee asserting a claim relating to the enforcement of rights of the allottee under the ,tribal water code1 including to the quantity of water allocated to land of the allottee1 shall exhaust all remedies available to the allottee under ,tribal law before initiating an action against the ,united ,states or petitioning the ,secretary pursuant to subsection 7d77#d72 and 7ii7 any other ,tribal water user asserting a claim relating to the enforcement of rights under the ,tribal water code shall exhaust all remedies available under ,tribal law4 7#c7 ,action by ,secretary 7,a7 ,in general ,during the period beginning on the date of enactment of this ,act and ending on the date on which a ,tribal water code described in paragraphs 7#a7 and 7#b7 is enacted1 the ,secretary shall administer the ,tribal water rights1 including with respect to the rights of allottees1 in accordance with this ,act4 7,b7 ,approval ,the ,tribal water code described in paragraphs 7#a7 and 7#b7 shall not be valid unless-- 7i7 the provisions of the ,tribal water code required by paragraph 7#b7 are approved by the ,secretary2 and 7ii7 each amendment to the ,tribal water code that affects a right of an allottee is approved by the ,secretary4 7,c7 ,approval period 7i7 ,in general ,the ,secretary shall-- 7,i7 approve or disapprove the ,tribal water code or an amendment to the ,tribal water code by not later than #ahj days after the date on which the ,tribal water code or amendment to the ,tribal water code is submitted to the ,secretary2 and 7,,ii7 notify the ,fort ,belknap ,indian ,community of the decision of the ,secretary by not later than #ae days after the date on which the ,secretary makes the decision4 7ii7 ,no action ,if the ,secretary does not approve or disapprove the ,tribal water code or amendment to the ,tribal water code and notify the ,fort ,belknap ,indian ,community by the applicable deadlines described in clause 7i71 the ,tribal water code or amendment to the ,tribal water code shall be deemed to be approved4 7iii7 ,disapproval ,if the ,secretary disapproves the ,tribal water code or amendment to the ,tribal water code1 the ,secretary1 in consultation with the ,fort ,belknap ,indian ,community1 shall have #ij days to resolve the basis for the disapproval1 and if the basis for the disapproval has not been resolved by that date1 the ,tribal water code shall be deemed approved4 7iv7 ,extensions ,the deadlines described in clauses 7i77,i7 and 7iii7 may be extended by the ,secretary with the agreement of the ,fort ,belknap ,indian ,community4 7g7 ,administration 7#a7 ,no alienation ,the ,fort ,belknap ,indian ,community shall not permanently alienate any portion of the ,tribal water rights4 7#b7 ,purchases or grants of land from ,indians ,an authorization provided by this ,act for the allocation1 distribution1 leasing1 or other arrangement entered into pursuant to this ,act shall be considered to satisfy any requirement for authorization of the action by treaty or convention imposed by section #baaf of the ,revised ,statutes 7#be ,u4,s4,c4 #agg74 7#c7 ,prohibition on forfeiture ,the non-use of all or any portion of the ,tribal water rights by any water user shall not result in the forfeiture1 abandonment1 relinquishment1 or other loss by the ,fort ,belknap ,indian ,community of all or any portion of the ,tribal water rights4 7h7 ,effect ,except as otherwise expressly provided in this section1 nothing in this ,act-- 7#a7 authorizes any action by an allottee against any individual or entity1 or against the ,fort ,belknap ,indian ,community1 under ,federal1 ,state1 ,tribal1 or local law2 or 7#b7 alters or affects the status of any action brought pursuant to section #adia7;a7 of title #bh1 ,united ,states ,code4 7i7 ,pick-,sloan ,missouri ,river ,basin ,program power rates ,the ,secretary1 in cooperation with the ,secretary of ,energy1 shall make available1 at project use power pumping preferred rates established as of the date of enactment of this ,act1 ,pick-,sloan ,missouri ,river ,basin ,program pumping power to not more than #cg1dbe net acres under irrigation pursuant to projects of the ,fort subparagraph 7,b71 for purposes of a land exchange under this subsection1 the ,secretary may exchange any ,federal land within #ajj miles of the ,reservation4 7,b7 ,completion ,a land exchange under subparagraph 7,a7 shall be completed by not later than #ae years after the date of enactment of this ,act4 7#d7 ,requirements 7,a7 ,value ,the ,secretary shall negotiate with the ,state using the roughly equivalent theory of valuation of any ,federal land exchanged for ,state land4 7,b7 ,basis ,unless the ,secretary and the ,state specifically agree otherwise1 each land exchange under this subsection shall be on a whole-estate for whole-estate basis4 7#e7 ,existing rights and uses 7,a7 ,uses 7i7 ,in general ,subject to clause 7ii71 any use 7including grazing7 authorized under a valid lease1 permit1 or right-of-way on land exchanged under this subsection1 as in effect on the date of the transfer1 shall remain in effect until the date on which the lease1 permit1 or right-of-way expires4 7ii7 ,exception ,clause 7i7 shall not apply if the holder of the lease1 permit1 or right-of-way requests an earlier termination of the lease1 permit1 or right-of-way in accordance with applicable law4 7,b7 ,improvements ,any improvements constituting personal property 7as defined by ,state law7 on land exchanged under this subsection by the holder of the lease1 permit1 or right-of-way shall remain the property of the holder and shall be removed not later than #ij days after the date on which the lease1 permit1 or right-of-way expires1 unless the ,fort ,belknap ,indian ,community and the holder agree otherwise4 7,c7 ,eligibility ,notwithstanding paragraph 7#c77;,b71 if1 at any time after the date of enactment of this ,act1 the ,fort ,belknap ,indian ,community ,council enters into a lease for any other ,state parcel or secures the written consent of each lessee of any other ,state parcel to the exchange of that parcel1 the other ,state parcel shall be eligible for exchange and transfer under this subsection4 7#f7 ,quantity of ,state land to be exchanged or transferred 7,a7 ,on reservation ,the total quantity of ,state land located within the boundaries of the ,reservation that shall be exchanged and transferred under this subsection is #bj1bif4a acres4 7,b7 ,off reservation ,the total quantity of ,state land located outside of the boundaries of the ,reservation that shall be exchanged and transferred under this subsection is #g1dac acres4 7b7 ,federal land transfers 7#a7 ,in general ,in partial satisfaction of claims relating to ,indian water rights covered by this ,act1 the ,fort ,belknap ,indian ,community agrees to the transfer of land in accordance with this subsection4 7#b7 ,transfers 7,a7 ,in general ,subject to subparagraphs 7,b7 and 7,c71 on selection and request by the ,fort ,belknap ,indian ,community1 the ,secretary shall restore all ,federal land within the parcels described in paragraph 7#c7 to the ,fort ,belknap ,indian ,community by transfer to the ,united ,states1 to be held in trust for the benefit of the ,fort ,belknap ,indian ,community4 7,b7 ,valid existing rights ,any land subject to valid existing private rights1 including land subject to sections #bcah through #bceb of the ,revised ,statutes 7commonly known as the ,mining ,law of #ahgb7 7#cj ,u4,s4,c4 #ba et seq471 shall not be transferred under subparagraph 7,a74 7,c7 ,easements ,any road within a parcel described in paragraph 7#c7 that is necessary for customary access to a fee parcel by the fee owner or another private permit1 or right-of-way on land transferred under this subsection1 as in effect on the date of the transfer1 shall remain in effect until the date on which the lease1 permit1 or right-of-way expires4 7ii7 ,exception ,clause 7i7 shall not apply if the holder of the lease1 permit1 or right-of-way requests an earlier termination of the lease1 permit1 or right-of-way1 in accordance with existing law4 7,b7 ,improvements ,any improvements constituting personal property 7as defined by ,state law7 on land transferred under this subsection by the holder of the lease1 permit1 or right-of-way-- 7i7 shall remain the property of the holder2 and 7ii7 shall be removed not later than #ij days after the date on which the lease1 permit1 or right-of-way expires1 unless the ,fort ,belknap ,indian ,community and the holder agree otherwise4 7,c7 ,payments ,the ,secretary shall disburse to the ,fort ,belknap ,indian ,community any amounts that accrue to the ,united ,states under a lease1 permit1 or right-of-way on land described in paragraph 7#c7 from any sale1 bonus1 royalty1 or rental relating to that land in the same manner as amounts received from other land held by the ,secretary in trust for the ,fort ,belknap ,indian ,community4 7#e7 ,survey ,with respect to the transfer of land under this subsection-- 7,a7 unless the ,united ,states or the ,fort ,belknap ,indian ,community request an additional survey for the transferred land1 the description of land under this section shall be controlling2 7,b7 if a survey is requested1 the ,secretary and the ,fort ,belknap ,indian ,community shall jointly provide for the survey of the land1 including any mining claims2 and 7,c7 the descriptions under this section or any survey under subparagraph 7,b7 shall control the total acreage to be transferred4 7#f7 ,date of transfer 7,a7 ,land 7i7 ,in general ,subject to clause 7ii71 the transfer of land to the ,united ,states to be held in trust for the ,fort ,belknap ,indian ,community under this subsection shall take effect on the issuance of a trust deed1 which shall be issued as expeditiously as practicable after notice of the enforceability date is published in the ,federal ,register4 7ii7 ,limit ,notwithstanding clause 7i71 all transfers shall be completed by not later than #ae years after the date of enactment of this ,act4 7,b7 ,waivers ,a waiver and release of claims under subsections 7a7 and 7b7 of section #aj relating to land described in subparagraph 7,a7 shall take effect on the date on which all of the land transfers for land described in subparagraph 7,a7 are complete4 7#g7 ,total amount of ,federal land to be transferred ,the total amount of ,federal land to be transferred under this subsection is approximately #cj1hdd acres4 7c7 ,foreclosed land ,any trust land within the ,reservation that has been or is foreclosed on by the ,united ,states shall be transferred to the ,united ,states to be held in trust for the ,fort ,belknap ,indian ,community by-- 7#a7 not later than #ae years after the date of enactment of this ,act1 if the foreclosure occurs before the date of enactment of this ,act2 or 7#b7 not later than #ae years after the date of the foreclosure1 if the foreclosure occurs after the date of enactment of this ,act4 7d7 ,impacts on local governments ,the ,secretary may1 at the discretion of the ,secretary1 try to ensure that land to be exchanged under this section is selected in a manner that minimizes the financial impact of the exchange on local governments4 7e7 ,water rights 7#a7 ,acquisition ,beginning on the date of the applicable transfer of land to the ,united ,states to be held in trust for the ,fort ,belknap ,indian ,community under this section1 if any ,federal1 ,state1 or fee land transferred under this section is subject to a water right in existence on the date of the transfer1 the ,united ,states1 as trustee for the benefit of the ,fort ,belknap ,indian ,community1 shall be the successor in interest with respect to the water right1 in accordance with the terms and conditions that applied to the predecessor in interest4 7#b7 ,no reserved water rights ,no land transferred under this section shall be the basis for any claim by the ,fort ,belknap ,indian ,community to any new1 additional1 or supplemental ,federal reserved water right4 7f7 ,transfer of title ,title to all land acquired by the ,united ,states under this section shall be transferred1 subject to applicable laws1 without charge1 to the ,united ,states1 to be held in trust for the benefit of the ,fort ,belknap ,indian ,community as part of the exterior boundary of the ,reservation1 pursuant to such method of conveyance as the ,secretary determines to be necessary4 7g7 ,jurisdiction of ,grinnell ,lands 7#a7 ,in general ,notwithstanding any other provision of ,federal law1 beginning on the date on which the conditions described in paragraph 7#b7 are met1 the ,fort ,belknap ,indian ,community ,council shall have administrative1 regulatory1 and judicial jurisdiction over the ,grinnell ,lands described in subsection 7b77#c77;,c71 including jurisdiction over public recreational access1 hunting1 and fishing1 and natural resource management4 7#b7 ,conditions ,the conditions referred to in paragraph 7#a7 are the conditions that the ,fort ,belknap ,indian ,community ,council shall adopt-- 7,a7 hunting and fishing regulations that grant nontribal members equivalent rights and privileges to those that nontribal members enjoy under the hunting and fishing laws 7including regulations7 of the ,state1 as in effect on the date of enactment of this ,act1 including rights relating to permit fees and bag limits2 and 7,b7 public recreational access regulations that grant nontribal members equivalent rights of access for recreational purposes that nontribal members enjoy under ,federal law 7including regulations71 as in effect on the date of enactment of this ,act4 7#c7 ,regulations 7,a7 ,in general ,any regulations promulgated by the ,fort ,belknap ,indian ,community pursuant to the jurisdiction of the ,fort ,belknap ,indian ,community under paragraph 7#a7 shall be subject to-- 7i7 a #cj-;day notice and comment period provided by the ,secretary to the ,state2 and 7ii7 after that period1 the approval of the ,secretary1 subject to subparagraph 7,b74 7,b7 ,secretarial approval ,not later than #ahj days after the date on which the notice and comment period under subparagraph 7,a77i7 ends1 the ,secretary shall approve or disapprove the regulations4 7#d7 ,notification after ,federal or ,state amendment 7,a7 ,in general ,if an applicable ,federal or ,state hunting and fishing or recreational access law or regulation is amended after the date on which jurisdiction over that law or regulation on the ,grinnell ,lands described in subsection 7b77#c77;,c7 is transferred to the ,fort ,belknap ,indian ,community ,council under this subsection1 the head of the appropriate ,federal or ,state agency1 as applicable1 shall promptly notify the ,fort ,belknap ,indian ,community ,council of the amendment4 7,b7 ,response 7i7 ,in general ,subject to clause 7ii71 not later than #abj days after the date on which notification is provided to the ,fort ,belknap ,indian ,community ,council under subparagraph 7,a71 the ,fort ,belknap ,indian ,community ,council shall-- 7,i7 amend the regulations of the ,fort ,belknap ,indian ,community ,council to comply with the amended law or regulation2 and 7,,ii7 notify the ,secretary of the amendment4 7ii7 ,secretarial approval ,an amendment by the ,fort ,belknap ,indian ,community ,council under clause 7i7 shall be subject to the approval of the ,secretary1 who shall approve the amendment by not later than #ij days after the date on which the ,secretary receives notice of the amendment under clause 7i77,,ii74 7iii7 ,failure to respond ,if the ,fort ,belknap ,indian ,community ,council fails to comply with clause 7i71 regulatory jurisdiction shall revert to the ,united ,states under paragraph 7#a7 until the earlier of-- 7,i7 such time as the regulations of the ,fort ,belknap ,indian ,community comply with the amended ,federal or ,state law or regulation2 and 7,,ii7 the date described in paragraph 7#e74 7#e7 ,regulation by ,fort ,belknap ,indian ,community ,council ,notwithstanding any other provision of law1 beginning on the date that is #be years after the date of enactment of this ,act-- 7,a7 the ,fort ,belknap ,indian ,community ,council may regulate the ,grinnell ,lands described in subsection 7b77#c77;,c7 under1 and according to1 ,tribal law1 subject to such approval by the ,secretary as may be required for any other ,tribal law2 and 7,b7 the other provisions of this subsection shall not apply4 7h7 ,environmental analysis ,notwithstanding section #d7;c71 in preparing an environmental assessment or environmental impact statement pursuant to section #ajb7b7 of the ,national ,environmental ,policy ,act of #aifi 7#db ,u4,s4,c4 #dccb7b77 for the acquisition of ,state land parcels and the conveyance of ,federal land under this section1 the ,secretary shall only be required to study1 develop1 and describe-- 7#a7 the proposed agency action2 and 7#b7 the alternative of no action4 #g4 ,storage allocation from ,lake ,elwell 7a7 ,storage allocation of water to ,fort ,belknap ,indian ,community 7#a7 ,in general ,the ,secretary shall permanently allocate to the ,fort ,belknap ,indian ,community #bj1jjj acre-feet per year of water stored in ,lake ,elwell for use by the ,fort ,belknap ,indian ,community for any beneficial purpose on or off the ,reservation1 under a water right held by the ,united ,states and managed by the ,bureau of ,reclamation for the benefit of the ,fort ,belknap ,indian ,community1 as measured-- 7,a7 by direct diversion from the ,reservoir or at the outlet works of the ,tiber ,dam2 or 7,b7 through direct release to the ,marias ,river from the ,tiber ,dam4 7#b7 ,source of allocation 7,a7 ,in general ,for each applicable year1 the ,fort ,belknap ,indian ,community shall take the allocation under paragraph 7#a7 from the active conservation pool or the joint-use pool of the reservoir in such quantities as are sufficient to satisfy the total annual allocation4 7,b7 ,priority ,the allocation under paragraph 7#a7 to the ,fort ,belknap ,indian ,community shall take priority over any and all instream flow and recreational uses of the applicable water4 7b7 ,treatment 7#a7 ,in general ,the allocation under subsection 7a7 to the ,fort ,belknap ,indian ,community shall be considered to be a part of the ,tribal water rights4 7#b7 ,priority date ,the priority date of the allocation under subsection 7a7 to the ,fort ,belknap ,indian ,community shall be the priority date of the ,lake ,elwell water right held by the ,bureau of ,reclamation4 7#c7 ,administration 7,a7 ,in general ,the ,fort ,belknap ,indian ,community shall administer the water allocated under subsection 7a7 in accordance with-- 7i7 the ,compact2 7ii7 this ,act2 and 7iii7 ,tribal law4 7,b7 ,temporary transfer ,in accordance with subsection 7d71 the ,fort ,belknap ,indian ,community may temporarily transfer off the ,reservation1 by service contract1 lease1 exchange1 or other agreement1 the water allocated under subsection 7a71 subject to-- 7i7 the approval of the ,secretary2 and 7ii7 the requirements of the ,compact4 7,c7 ,exception ,notwithstanding subparagraph 7,a71 paragraphs 7#a7 through 7#c7 of article ,,iv4,a4#e4;b4 of the ,compact shall not apply to any annual allocation under this subsection1 except to the extent that article limits the use of the allocation to a location within the ,missouri ,river ,basin4 7c7 ,allocation agreement 7#a7 ,in general ,as a condition of receiving an allocation under this section1 the ,fort ,belknap ,indian ,community shall enter into an agreement with the ,secretary to establish the terms and conditions of the allocation1 in accordance with the ,compact and this ,act4 7#b7 ,inclusions ,the agreement under paragraph 7#a7 shall include provisions establishing that-- 7,a7 the agreement shall be without limit as to term2 7,b7 the ,fort ,belknap ,indian ,community1 and not the ,united ,states1 shall be entitled to all consideration due to the ,fort ,belknap ,indian ,community under any lease1 contract1 or agreement entered into by the ,fort ,belknap ,indian ,community pursuant to subsection 7d72 7,c7 the ,united ,states shall have no obligation to monitor1 administer1 or account for-- 7i7 any funds received by the ,fort ,belknap ,indian ,community as consideration under any lease1 contract1 or agreement entered into by the ,fort ,belknap ,indian ,community pursuant to subsection 7d72 or 7ii7 the expenditure of those funds2 7,d7 if the capacity or function of ,lake ,elwell facilities are significantly reduced1 or are anticipated to be significantly reduced1 for an extended period of time1 the ,fort ,belknap ,indian ,community shall have the same storage rights as other storage contractors with respect to the allocation under this section2 7,e7 the costs associated with the construction of the storage facilities at ,tiber ,dam allocable to the ,fort ,belknap ,indian ,community shall be nonreimbursable2 7,f7 no water service capital charge shall be due or payable for any water allocated to the ,fort ,belknap ,indian ,community under this section or the allocation agreement1 regardless of whether that water is delivered for use by the ,fort ,belknap ,indian ,community or under a lease1 contract1 or agreement entered into by the ,fort ,belknap ,indian ,community pursuant to subsection 7b77#c77;,b72 7,g7 the ,fort ,belknap ,indian ,community shall not be required to make payments to the ,united ,states for any water allocated to the ,fort ,belknap ,indian ,community under this section or the allocation agreement1 except for each acre-foot of stored water leased or transferred for industrial purposes as described in subparagraph 7,h72 7,h7 for each acre-foot of stored water leased or transferred by the ,fort ,belknap ,indian ,community for industrial purposes-- 7i7 the ,fort ,belknap ,indian ,community shall pay annually to the ,united ,states an amount necessary to cover the proportional share of the annual operation1 maintenance1 and replacement costs allocable to the quantity of water leased or transferred by the ,fort ,belknap ,indian ,community for industrial purposes2 and 7ii7 the annual payments of the ,fort ,belknap ,indian ,community shall be reviewed and adjusted1 as appropriate1 to reflect the actual operation1 maintenance1 and replacement costs for ,tiber ,dam2 and 7,i7 the ,fort ,belknap ,indian ,community has the right to divert the water that is diverted or released under subsection 7a77#a7 directly from the ,reservoir or from any point in the ,missouri ,river to the ,reservation to any point1 as determined by the ,fort ,belknap ,indian ,community4 7d7 ,agreement by ,fort ,belknap ,indian ,community ,the ,fort ,belknap ,indian ,community may use1 lease1 contract1 exchange1 or enter into any other agreement for the use of the water allocated to the ,fort ,belknap ,indian ,community under subsection 7a7 if-- 7#a7 the use of water that is the subject of such an agreement occurs within the ,missouri ,river ,basin2 and 7#b7 the agreement does not permanently alienate any water allocated to the ,fort ,belknap ,indian ,community under subsection 7a74 7e7 ,effective date ,the allocation under subsection 7a7 takes effect on the enforceability date4 7f7 ,no carryover storage ,the allocation under subsection 7a7 shall not be increased by any unused ,fort ,belknap ,indian ,community ,tribal water rights from year-to-year carryover storage4 7g7 ,water development and delivery costs 7#a7 ,obligation to provide facility for transport to reservation ,except as otherwise provided in this ,act1 the ,united ,states shall have no obligation under this ,act to provide any facility for the transport to the ,reservation or any other location of the water allocated under this section to the ,fort ,belknap ,indian ,community relating to the release of ,tribal water rights from ,lake ,elwell ,dam and ,reservoir in accordance with a request from the ,fort ,belknap ,indian ,community4 7#b7 ,development and delivery costs ,except for the use of ,federal amounts made available under section #h1 the ,united ,states is not required to pay the cost of developing or delivering to the ,reservation any water allocated under subsection 7a74 #h4 ,milk ,river ,project 7a7 ,milk ,river ,project modifications 7#a7 ,procedures 7,a7 ,in general ,the ,commissioner1 in consultation with the ,assistant ,secretary for ,indian ,affairs1 the ,fort ,belknap ,indian ,community1 the ,joint ,board1 and other affected stakeholders1 shall modify the operating procedures of the ,milk ,river ,project as the ,commissioner determines to be necessary to ensure that the ,fresno ,reservoir is operated in accordance with article ,,iii4,a4#b4 and article ,,iv4,e4 of the ,compact4 7,b7 #aidf ,fresno ,reservoir ,agreement 7i7 ,in general ,the ,commissioner shall carry out such actions as the ,commissioner determines to be necessary to provide a more equitable accounting of the #a_/g share of the ,fort ,belknap ,indian ,community to the ,fresno ,reservoir total quantity of stored water available for use during each irrigation season from the waters of the ,milk ,river that are impounded and stored in the ,fresno ,reservoir under the agreement between the ,commissioner and the ,assistant ,secretary of ,indian ,affairs relating to the ,milk ,river ,project1 numbered ,i-#a-;,ind4 #ahgbe1 and dated ,july #h1 #aidf4 7ii7 ,additional considerations ,in addition to the #a_/g share described in clause 7i71 the ,commissioner shall take into consideration and fully account for the right of the ,fort ,belknap ,indian ,community to the ,milk ,river consistent with article ,,iii4,a4#a4 of the ,compact4 7iii7 ,downstream release ,any water stored on behalf of the ,fort ,belknap ,indian ,community in the ,fresno ,reservoir that is available at the end of each irrigation season shall be released downstream1 in a manner to be determined by the ,fort ,belknap ,indian ,community1 for storage in the proposed ,fort ,belknap ,reservoir4 7iv7 ,amendments ,the ,commissioner and the ,assistant ,secretary for ,indian ,affairs may jointly amend the agreement referred to in clause 7i7 as the ,commissioner and the ,assistant ,secretary determine to be necessary to provide for an equitable accounting of the share of the ,fort ,belknap ,indian ,community described in clause 7i74 7#b7 ,facilities ,the ,secretary may make such modifications to the federally owned facilities of the ,milk ,river ,project as the ,secretary determines to be necessary to satisfy the applicable mitigation requirements of the ,compact4 7b7 ,milk ,river coordinating committee 7#a7 ,in general ,the ,secretary1 acting through the ,commissioner1 the ,director of the ,bureau of ,indian ,affairs1 the ,director of the ,united ,states ,geological ,survey1 the ,director of the ,united ,states ,fish and ,wildlife ,service1 and the ,director of the ,bureau of ,land ,management1 may participate in the ,milk ,river ,coordinating ,committee pursuant to article ,,iv4,c4 of the ,compact4 7#b7 ,inapplicability of federal advisory committee act ,the ,federal ,advisory ,committee ,act 7#e ,u4,s4,c4 ,app47 shall not apply to the ,milk ,river ,coordinating ,committee4 7#c7 ,technical support ,the ,secretary may-- 7,a7 maintain a publicly accessible database of diversions from the ,milk ,river made-- 7i7 pursuant to the ,milk ,river ,project2 7ii7 under applicable contracts2 and 7iii7 by the ,fort ,belknap ,indian ,community2 and 7,b7 provide such other technical support as the ,milk ,river ,coordinating ,committee may request1 including the maintenance of gages necessary to account for daily diversions from the ,milk ,river4 7#d7 ,coordination of storage and release ,notwithstanding article ,,iv4,c4#aa4 of the ,compact1 the ,secretary 7acting through the ,commissioner71 and in consultation with the ,milk ,river ,coordinating ,committee1 shall develop an accounting for the coordination of storage and release of water from ,federal storage facilities within the federally owned portion of the ,milk ,river ,project4 7c7 ,milk river project mitigation 7#a7 ,in general ,the ,state1 in consultation with the ,secretary1 the ,fort ,belknap ,indian ,community1 the ,joint ,board1 and other affected stakeholders1 shall use funds made available under subsection 7d7 and section #ab7;f7 to provide grants for projects for mitigation of the ,milk ,river ,project in accordance with-- 7,a7 article ,,vi4,b4 of the ,compact2 and 7,b7 this ,act4 7#b7 ,application ,to be eligible to receive a grant under this subsection1 the owner or operator of a project described in paragraph 7#a7 shall submit to the ,state an application at such time1 in such manner1 and containing such information as the ,state may require4 7#c7 ,delegation by ,state ,the ,state may delegate any portion of the responsibility of the ,state under this subsection to any entity organized in accordance with applicable ,federal and ,state laws4 7#d7 ,compliance with ,,nepa ,the ,secretary shall ensure that each project that receives ,federal funds under this subsection is carried out in accordance with the ,national ,environmental ,policy ,act of #aifi 7#db ,u4,s4,c4 #dcba et seq474 7d7 ,state contributions 7#a7 ,in general ,the ,secretary shall treat as a ,state contribution to mitigation of the ,milk ,river ,project-- 7,a7 the difference between-- 7i7 the #i1ejj1jjj authorized by the ,act of ,april #bh1 #bjje 7chapter #dii1 section #b7b71 #bjje ,mont4 ,laws #aigh72 and 7ii7 the #e1jjj1jjj requested from the ,state under section #aa7;i72 and 7,b7 any other funds allocated or previously expended by the ,state to carry out activities under subsection 7a74 7#b7 ,additional contributions ,the ,secretary shall request that the ,state provide1 in addition to the amounts described in paragraph 7#a7-- 7,a7 #c1ejj1jjj for purposes of mitigation and watershed improvement activities described in the ,compact2 and 7,b7 an amount equal to #d1jjj1jjj of in-kind contributions for technical1 modeling1 and other services for purposes of identifying1 supporting1 and enhancing water use and management in the ,milk ,river4 7#c7 ,treatment of contributions ,a contribution by the ,state under this subsection shall be counted towards fulfillment of the obligation of the ,state under article ,,vi4,b4 of the ,compact4 7#d7 ,expenditure of funds ,subject to applicable ,state law1 amounts provided by the ,state under this subsection may be expended at any time after the date on which funds are provided4 7#e7 ,report ,not less frequently than once each year1 the ,secretary shall request that the ,state submit to the ,fort ,belknap ,indian ,community an accounting of any funds expended by the ,state under this subsection during the preceding calendar year4 7e7 ,tribal agreement between the ,fort ,belknap ,indian ,community and the ,blackfeet ,tribe related to the ,milk ,river ,section #cgje7;e77#a7 of the ,blackfeet ,water ,rights ,settlement ,act 7,public ,law #aad-cbb2 #acj ,stat4 #ahah7 is amended by striking shall establish1 and inserting shall establish1 by not later than #a year after the date on which that #c-year period ends14 #i4 ,satisfaction of claims 7a7 ,in general ,the benefits provided under this ,act shall be in complete replacement of1 complete substitution for1 and full satisfaction of any claim of the ,fort ,belknap ,indian ,community against the ,united ,states that is waived and released by the ,fort ,belknap ,indian ,community under section #aj7;a74 7b7 ,allottees ,the benefits realized by the allottees under this ,act shall be in complete replacement of1 complete substitution for1 and full satisfaction of-- 7#a7 all claims waived and released by the ,united ,states 7acting as trustee for the allottees7 under section #aj7;a77#b72 and 7#b7 any claims of the allottees against the ,united ,states similar to the claims described in section #aj7;a77#b7 that the allottee asserted or could have asserted4 #aj4 ,waivers and releases of claims 7a7 ,in general 7#a7 ,waiver and release of claims by the ,fort ,belknap ,indian ,community and ,united ,states as trustee for the ,fort ,belknap ,indian ,community ,subject to the reservation of rights and retention of claims under subsection 7d71 as consideration for recognition of the ,tribal water rights and other benefits described in the ,compact and this ,act1 the ,fort ,belknap ,indian ,community1 acting on behalf of the ,fort ,belknap ,indian ,community and members of the ,fort ,belknap ,indian ,community 7but not any member of the ,fort ,belknap ,indian ,community as an allottee71 and the ,united ,states1 acting as trustee for the ,fort ,belknap ,indian ,community and the members of the ,fort ,belknap ,indian ,community 7but not any member of the ,fort ,belknap ,indian ,community as an allottee71 shall execute a waiver and release of all claims for water rights within the ,state that the ,fort ,belknap ,indian ,community1 or the ,united ,states acting as trustee for the ,fort ,belknap ,indian ,community1 asserted or could have asserted in any proceeding1 including a ,state stream adjudication1 on or before the enforceability date1 except to the extent that such rights are recognized in the ,compact and this ,act4 7#b7 ,waiver and release of claims by the ,united ,states as trustee for allottees ,subject to the reservation of rights and the retention of claims under subsection 7d71 as consideration for recognition of the ,tribal water rights and other benefits described in the ,compact and this ,act1 the ,united ,states1 acting as trustee for the allottees1 shall execute a waiver and release of all claims for water rights within the ,reservation that the ,united ,states1 acting as trustee for the allottees1 asserted or could have asserted in any proceeding1 including a ,state stream adjudication1 on or before the enforceability date1 except to the extent that such rights are recognized in the ,compact and this ,act4 7#c7 ,waiver and release of claims by the ,fort ,belknap ,indian ,community against the ,united ,states ,subject to the reservation of rights and retention of claims under subsection 7d71 the ,fort ,belknap ,indian ,community1 acting on behalf of the ,fort ,belknap ,indian ,community and members of the ,fort ,belknap ,indian ,community 7but not any member of the ,fort ,belknap ,indian ,community as an allottee71 shall execute a waiver and release of all claims against the ,united ,states 7including any agency or employee of the ,united ,states7 relating to-- 7,a7 water rights within the ,state that the ,united ,states1 acting as trustee for the ,fort ,belknap ,indian ,community1 asserted or could have asserted in any proceeding1 including a general stream adjudication in the ,state1 except to the extent that such rights are recognized as ,tribal water rights under this ,act2 7,b7 7i7 damage1 loss1 or injury to water1 water rights1 land1 or natural resources due to loss of water or water rights1 including damages1 losses1 or injuries to hunting1 fishing1 gathering1 or cultural rights1 if the claim first accrued on or before the enforceability date2 7ii7 interference with1 diversion of1 or taking of water1 if the claim first accrued on or before the enforceability date2 or 7iii7 failure to protect1 acquire1 replace1 or develop water1 water rights1 or water infrastructure within the ,state1 if the claim first accrued on or before the enforceability date2 7,c7 a failure to establish or provide a municipal rural or industrial water delivery system on the ,reservation2 7,d7 a failure to provide for operation and maintenance1 or deferred maintenance1 for the ,fort ,belknap ,indian ,irrigation ,project or any other irrigation system or irrigation project on the ,reservation2 7,e7 the litigation of claims relating to the water rights of the ,fort ,belknap ,indian ,community in the ,state2 7,f7 the negotiation1 execution1 or adoption of the ,compact 7including exhibits72 and 7,g7 the allocation of water of the ,milk ,river and the ,st4 ,mary ,river 7including tributaries7 between the ,united ,states and ,canada pursuant to the ,international ,boundary ,waters ,treaty of #aiji 7#cf ,stat4 #bddh74 7b7 ,effectiveness ,the waivers and releases under subsection 7a7 shall take effect on the enforceability date4 7c7 ,objections in ,montana ,water ,court ,nothing in this ,act or the ,compact prohibits the ,fort ,belknap ,indian ,community1 a member of the ,fort ,belknap ,indian ,community1 an allottee1 or the ,united ,states in any capacity from objecting to any claim to a water right filed in any general stream adjudication in the ,montana ,water ,court4 7d7 ,reservation of rights and retention of claims ,notwithstanding the waivers and releases under subsection 7a71 the ,fort ,belknap ,indian ,community1 acting on behalf of the ,fort ,belknap ,indian ,community and members of the ,fort ,belknap ,indian ,community1 and the ,united ,states1 acting as trustee for the ,fort ,belknap ,indian ,community and the allottees shall retain-- 7#a7 all claims 7including claims accruing after the enforceability date7 relating to-- 7,a7 enforcement of water rights recognized under the ,compact1 the settlement agreement1 any final court decree1 or this ,act2 and 7,b7 the land transfers required under section #f2 7#b7 all claims relating to-- 7,a7 activities affecting the quality of water1 including enforcement of any court decrees1 any claims the ,fort ,belknap ,indian ,community might have pending in any court of competent jurisdiction as of the date of enactment of this ,act1 and any claims under-- 7i7 the ,,cercla1 including damages to natural resources2 7ii7 the ,safe ,drinking ,water ,act 7#db ,u4,s4,c4 #cjj;f et seq472 7iii7 the ,federal ,water ,pollution ,control ,act 7#cc ,u4,s4,c4 #abea et seq472 and 7iv7 any regulations implementing the ,acts described in clauses 7i7 through 7iii72 7,b7 damage1 loss1 or injury to land or natural resources that are not due to loss of water or water rights 7including hunting1 fishing1 gathering1 or cultural rights72 and 7,c7 an action to prevent any person or party 7as defined in sections #bi and #cj of article ,,ii of the ,compact7 from interfering with the enjoyment of the ,tribal water rights2 7#c7 all claims arising under section #ac7;i7 relating to the enforcement of any ,federal1 ,state1 or ,tribal law 7including common law72 7#d7 all claims relating to off-,reservation hunting rights1 fishing rights1 gathering rights1 or other rights2 7#e7 all claims relating to the right to use and protect water rights acquired after the date of enactment of this ,act2 7#f7 all claims relating to the allocation of waters of the ,milk ,river and the ,milk ,river ,project between the ,fort ,belknap ,indian ,community and the ,blackfeet ,tribe1 pursuant to section #cgje7;e77#c7 of the ,blackfeet ,water ,rights ,settlement ,act 7,public ,law #aad-cbb2 #acj ,stat4 #ahah72 and 7#g7 all rights1 remedies1 privileges1 immunities1 and powers not specifically waived and released pursuant to this ,act or the ,compact4 7e7 ,effect of ,compact and ,act ,nothing in the ,compact or this ,act-- 7#a7 affects the authority of the ,fort ,belknap ,indian ,community to enforce the laws of the ,fort ,belknap ,indian ,community1 including with respect to environmental protections2 7#b7 affects the ability of the ,united ,states1 acting as a sovereign1 to take any action authorized by law 7including regulations71 including any law relating to health1 safety1 or the environment1 including-- 7,a7 the ,federal ,water ,pollution ,control ,act 7#cc ,u4,s4,c4 #abea et seq472 7,b7 the ,safe ,drinking ,water ,act 7#db ,u4,s4,c4 #cjj;f et seq472 and 7,c7 ,,cercla2 7#c7 affects the ability of the ,united ,states to act as trustee for any other ,indian ,tribe or an allottee of any other ,indian ,tribe2 7#d7 confers jurisdiction on any ,state court-- 7,a7 to interpret ,federal law relating to health1 safety1 or the environment2 7,b7 to determine the duties of the ,united ,states or any other party pursuant to a ,federal law relating to health1 safety1 or the environment2 7,c7 to conduct judicial review of a ,federal agency action2 or 7,d7 to interpret ,tribal law2 or 7#e7 waives any claim of a member of the ,fort ,belknap ,indian ,community in an individual capacity that does not derive from a right of the ,fort ,belknap ,indian ,community4 7f7 ,enforceability date ,the enforceability date shall be the date on which the ,secretary publishes in the ,federal ,register a statement of findings that-- 7#a7 the members of the ,fort ,belknap ,indian ,community have voted to approve this ,act and the ,compact by a majority of votes cast on the day of the vote1 as certified by the ,secretary and the ,fort ,belknap ,indian ,community2 7#b7 7,a7 the ,montana ,water ,court has issued a final judgment and decree approving the ,compact and that decision has become final and nonappealable2 or 7,b7 if the ,montana ,water ,court is found to lack jurisdiction1 the appropriate ,united ,states district court has approved the ,compact1 and that decision has become final and nonappealable2 7#c7 all of the amounts authorized under section #ab have been appropriated and deposited in the designated accounts2 7#d7 the ,secretary has executed the agreements with the ,fort ,belknap ,indian ,community as required under the ,compact and this ,act2 7#e7 the ,state has paid the requested amount under section #aa7;i72 and 7#f7 the waivers and releases under subsection 7a7 have been executed by the ,fort ,belknap ,indian ,community and the ,secretary4 7g7 ,tolling of claims 7#a7 ,in general ,each applicable period of limitation and time-based equitable defense relating to a claim described in this section shall be tolled for the period beginning on the date of enactment of this ,act and ending on the enforceability date4 7#b7 ,effect of subsection ,nothing in this subsection revives any claim or tolls any period of limitations or time-based equitable defense that expired before the date of enactment of this ,act4 7h7 ,voiding of waivers ,if the authority provided by this ,act terminates under section #ad-- 7#a7 the approval by the ,united ,states of the ,compact under section #d shall no longer be effective2 7#b7 any waivers and releases executed by the ,fort ,belknap ,indian ,community under this section shall be void2 7#c7 any unexpended and unobligated ,federal funds appropriated or made available to carry out the activities authorized by this ,act1 together with any interest earned on those funds1 shall be returned to the ,federal ,government1 unless otherwise agreed to by the ,fort ,belknap ,indian ,community and the ,united ,states2 and 7#d7 all statutes of limitations applicable to any claim subject to the waiver shall be tolled until ,june #cj1 #bjce4 #aa4 ,fort ,belknap ,indian ,community ,settlement ,trust ,fund 7a7 ,definition of ,plan 7#a7 ,in general ,in this section1 the term ,plan means the document entitled ,fort ,belknap ,indian ,community ,comprehensive ,water ,development ,plan1 prepared by ,natural ,resources ,consulting ,engineers1 ,inc41 and dated ,february #bjai4 7#b7 ,inclusion ,in this section1 the term ,plan includes any modification to the document referred to in paragraph 7#a7 that the ,fort ,belknap ,indian ,community determines to be necessary to account for conditions in existence at the time at which an activity is carried out pursuant to this section4 7b7 ,establishment 7#a7 ,in general ,the ,secretary shall establish in the ,treasury of the ,united ,states a trust fund1 to be known as the ,fort ,belknap ,indian ,community ,settlement ,trust ,fund1 consisting of-- 7,a7 the amounts deposited in the ,trust ,fund under subsection 7d72 and 7,b7 any interest earned on those amounts4 7#b7 ,management2 availability ,amounts in the ,trust ,fund shall-- 7,a7 be managed1 invested1 and distributed by the ,secretary2 and 7,b7 remain available until expended4 7c7 ,accounts ,the ,secretary shall establish in the ,trust ,fund the following accounts3 7#a7 ,the ,fort ,belknap ,indian ,community ,tribal ,land and ,water ,rehabilitation1 ,modernization1 and ,expansion ,account1 the principal and interest of which may be used to pay or reimburse costs incurred by the ,united ,states1 the ,state1 or the ,fort ,belknap ,indian ,community for activities described in the ,plan relating to-- 7,a7 exchanging1 transferring1 or acquiring land2 7,b7 rehabilitating or otherwise improving existing and historically irrigated land or projects2 7,c7 agricultural development2 7,d7 cultural preservation2 7,e7 water resources development2 and 7,f7 other land- and water-related projects4 7#b7 ,the ,fort ,belknap ,indian ,community ,water ,resources and ,water ,rights ,administration1 ,operation1 and ,maintenance ,account1 of which only the earned interest may be used to pay for activities described in the ,plan relating to-- 7,a7 the costs of administering the ,tribal water rights1 including through-- 7i7 the development or enactment of a ,tribal ,water ,code2 and 7ii7 the establishment and operation of a ,tribal water resources department2 and 7,b7 the annual operation and maintenance costs for ,tribal and allotted water resources projects4 7#c7 ,the ,fort ,belknap ,indian ,community ,tribal ,economic ,development ,account1 the principal and interest of which may be used by the ,fort ,belknap ,indian ,community to pay the costs of such activities described in the ,plan as the ,fort ,belknap ,indian ,community determines to be necessary to advance the economic development of the ,fort ,belknap ,indian ,community4 7#d7 ,the ,fort ,belknap ,indian ,community ,domestic ,water ,supply and ,wastewater ,systems ,account1 the principal and interest of which may be used by the ,fort ,belknap ,indian ,community to pay the costs of activities described in the ,plan relating to-- 7,a7 preparation of a feasibility study and design of a water supply and sewer treatment system for the ,fort ,belknap ,indian ,community2 7,b7 the planning1 design1 and construction of a domestic water supply system and related facilities for ,tribal communities2 7,c7 the planning1 design1 and construction of a wastewater treatment and collections system for ,tribal communities2 and 7,d7 environmental compliance in the development and construction of projects under this ,act4 7d7 ,deposits ,the ,secretary shall deposit-- 7#a7 in the ,fort ,belknap ,indian ,community ,tribal ,land and ,water ,rehabilitation1 ,modernization1 and ,expansion ,account established under subsection 7c77#a71 the amounts made available pursuant to section #ab7;b72 7#b7 in the ,fort ,belknap ,indian ,community ,water ,resources and ,water ,rights ,administration1 ,operation1 and ,maintenance ,account established under subsection 7c77#b71 the amounts made available pursuant to section #ab7;c72 7#c7 in the ,fort ,belknap ,indian ,community ,tribal ,economic ,development ,account established under subsection 7c77#c71 the amounts made available pursuant to section #ab7;d72 and 7#d7 in the ,fort ,belknap ,indian ,community ,domestic ,water ,supply and ,wastewater ,systems ,account established under subsection 7c77#d71 the amounts made available pursuant to section #ab7;e74 7e7 ,management and interest 7#a7 ,management ,on deposit of the funds into the ,accounts pursuant to subsection 7d71 the ,secretary shall manage1 invest1 and distribute all amounts in the ,trust ,fund in accordance with-- 7,a7 the ,act of ,april #a1 #ahhj 7#be ,u4,s4,c4 #afa72 7,b7 the first section of the ,act of ,june #bd1 #aich 7#be ,u4,s4,c4 #afb;a72 7,c7 the ,american ,indian ,trust ,fund ,management ,reform ,act of #aiid 7#be ,u4,s4,c4 #djja et seq472 7,d7 the obligations of ,federal corporations and ,federal ,government-sponsored entities1 the charter documents of which provide that the obligations of the entities are lawful investments for federally managed funds1 including-- 7i7 mortgages1 obligations1 and other securities of the ,federal ,home ,loan ,mortgage ,corporation described in section #cjc of the ,federal ,home ,loan ,mortgage ,corporation ,act 7#ab ,u4,s4,c4 #adeb72 7ii7 bonds1 notes1 and debentures of the ,commodity ,credit ,corporation described in section #d of the ,act of ,march #h1 #aich 7#ae ,u4,s4,c4 #gac;a-#d72 7iii7 bonds and other obligations of the ,tennessee ,valley ,authority described in section #ae;d of the ,tennessee ,valley ,authority ,act of #aicc 7#af ,u4,s4,c4 #hcan-#d72 and 7iv7 the obligations of the ,united ,states ,postal ,service described in section #bjje of title #ci1 ,united ,states ,code2 and 7,e7 this section4 7#b7 ,investment earnings ,in addition to the deposits under subsection 7d71 any investment earnings1 including interest1 credited to amounts held in the ,trust ,fund are authorized to be appropriated for use in accordance with subsection 7c74 7f7 ,availability of amounts 7#a7 ,funding ,except as provided in paragraph 7#c71 the amounts made available under this section 7including any investment earnings on those amounts7 shall be available for expenditure or withdrawal by the ,fort ,belknap ,indian ,community without fiscal year limitation beginning on the enforceability date4 7#b7 ,other funding ,in addition to funding specifically made available under this ,act1 if the ,secretary determines that1 for a given fiscal year1 a sufficient amount of funding has not been made available through annual appropriations or other sources1 the ,secretary shall expend from the ,reclamation ,water ,settlements ,fund established by section #ajeja7;a7 of the ,omnibus ,public ,land ,management ,act of #bjji 7#dc ,u4,s4,c4 #djg7;a77 such amounts as are necessary to pay the ,federal share of the costs associated with the ,trust ,fund4 7#c7 ,funding for ,tribal implementation activities ,notwithstanding paragraph 7#a71 on approval of the ,compact by the members of the ,fort ,belknap ,indian ,community pursuant to section #aj7;f77#a71 as certified by the ,secretary and the ,fort ,belknap ,indian ,community1 and subject to the availability of appropriations1 #d1hjj1jjj of the amounts in the ,fort ,belknap ,indian ,community ,water ,resources and ,water ,rights ,administration1 ,operation1 and ,maintenance ,account established under subsection 7c77#b7 shall be made available to the ,fort ,belknap ,indian ,community for-- 7,a7 the administration of the ,tribal water right2 and 7,b7 the implementation of-- 7i7 the ,compact2 and 7ii7 this ,act4 7g7 ,withdrawals 7#a7 ,american ,indian ,trust ,fund ,management ,reform ,act of #aiid 7,a7 ,in general ,the ,fort ,belknap ,indian ,community may withdraw any portion of the amounts in the ,trust ,fund on approval by the ,secretary of a ,tribal management plan in accordance with the ,american ,indian ,trust ,fund ,management ,reform ,act of #aiid 7#be ,u4,s4,c4 #djja et seq474 7,b7 ,additional requirements ,in addition to the requirements under the ,american ,indian ,trust ,fund ,management ,reform ,act of #aiid 7#be ,u4,s4,c4 #djja et seq471 the ,tribal management plan under this paragraph shall require that the ,fort ,belknap ,indian ,community shall spend all amounts withdrawn from the ,trust ,fund in accordance with-- 7i7 this ,act2 and 7ii7 the ,compact4 7,c7 ,enforcement ,the ,secretary may carry out such judicial and administrative actions as the ,secretary determines to be necessary-- 7i7 to enforce the ,tribal management plan under this paragraph2 and 7ii7 to ensure that amounts withdrawn from the ,trust ,fund by the ,fort ,belknap ,indian ,community under this paragraph are used in accordance with-- 7,i7 this ,act2 and 7,,ii7 the ,compact4 7#b7 ,expenditure plan 7,a7 ,in general ,the ,fort ,belknap ,indian ,community may submit to the ,secretary a request to withdraw funds from the ,trust ,fund pursuant to an approved expenditure plan under subparagraph 7,b74 7,b7 ,plan 7i7 ,in general ,the ,fort ,belknap ,indian ,community shall submit to the ,secretary for approval an expenditure plan for any portion of the amounts in the ,trust ,fund that the ,fort ,belknap ,indian ,community elects to withdraw pursuant to this paragraph4 7ii7 ,description ,the expenditure plan shall describe the manner in which1 and the purposes for which1 amounts in the ,trust ,fund will be used for the purposes described in-- 7,i7 this ,act2 and 7,,ii7 the ,compact4 7,c7 ,approval ,the ,secretary shall approve an expenditure plan submitted under subparagraph 7,b7 if the ,secretary determines that the plan is-- 7i7 reasonable2 and 7ii7 in accordance with-- 7,i7 this ,act2 and 7,,ii7 the ,compact4 7#c7 ,liability ,the ,secretary and the ,secretary of the ,treasury shall not be liable for any expenditure or investment of amounts withdrawn from the ,trust ,fund by the ,fort ,belknap ,indian ,community pursuant to this subsection4 7#d7 ,annual report ,for each account in the ,trust ,fund1 the ,fort ,belknap ,indian ,community shall submit to the ,secretary an annual report that describes all expenditures from the account pursuant to an expenditure plan under paragraph 7#b77;,b7 during the preceding fiscal year4 7h7 ,no per capita payments ,no principal or interest amount in any account established by this section shall be distributed to any member of the ,fort ,belknap ,indian ,community on a per capita basis4 7i7 ,peoples ,creek ,dam and ,reservoir ,to contribute to the cost of design and construction of the ,peoples ,creek ,dam and ,reservoir to support mitigation activities1 the ,secretary shall request that the ,state pay to the general fund of the ,treasury #e1jjj1jjj1 to be deposited to the credit of the ,fort ,belknap ,indian ,community ,tribal ,land and ,water ,rehabilitation1 ,modernization1 and ,expansion ,account established under subsection 7c77#a74 7j7 ,nonreimbursability of costs ,the costs to the ,secretary of carrying out this section shall be nonreimbursable4 #ab4 ,funding 7a7 ,reclamation ,water ,settlements ,fund 7#a7 ,in general ,notwithstanding any other provision of law1 on ,october #a1 #bjba1 and each ,october #a thereafter through ,october #a1 #bjcj1 out of any funds in the ,treasury not otherwise appropriated1 the ,secretary of the ,treasury shall transfer to the ,secretary for deposit in the ,reclamation ,water ,settlements ,fund established by section #ajeja7;a7 of the ,omnibus ,public ,land ,management ,act of #bjji 7#dc ,u4,s4,c4 #djg7;a77 #cj1jjj1jjj1 to remain available until expended1 for the use described in paragraph 7#b74 7#b7 ,receipt and acceptance ,the ,secretary shall be entitled to receive1 shall accept1 and shall use to carry out section #ajeja7;c77#c77;,b77iii7 of the ,omnibus ,public ,land ,management ,act of #bjji 7#dc ,u4,s4,c4 #djg7;c77#c77;,b77iii77 the funds transferred under paragraph 7#a7 specifically to pay towards the ,federal share of the remaining costs of implementing the ,indian water rights settlement agreement for the ,fort ,belknap ,indian ,community under this ,act1 without further appropriation4 7b7 ,fort ,belknap ,indian ,community ,tribal ,land and ,water1 ,rehabilitation1 ,modernization1 and ,expansion ,account 7#a7 ,mandatory appropriations ,out of any funds in the ,treasury not otherwise appropriated1 the ,secretary of the ,treasury shall deposit in the ,fort ,belknap ,indian ,community ,tribal ,land and ,water1 ,rehabilitation1 ,modernization1 and ,expansion ,account established under paragraph 7#a7 of section #aa7;c7 #acd1dgh1djj1 as adjusted to reflect changes in construction cost indices since ,may #a1 #bjaa1 that are applicable to the types of construction involved in the activities described in that paragraph4 7#b7 ,authorization of appropriations ,in addition to the amounts made available under paragraph 7#a71 there is authorized to be appropriated for deposit in the ,fort ,belknap ,indian ,community ,tribal ,land and ,water1 ,rehabilitation1 ,modernization1 and ,expansion ,account established under paragraph 7#a7 of section #aa7;c7 #aje1ffa1fjj1 as adjusted to reflect changes in construction cost indices since ,may #a1 #bjaa1 that are applicable to the types of construction involved in the activities described in that paragraph4 7c7 ,fort ,belknap ,indian ,community ,water ,resources and ,water ,rights ,administration1 ,operation1 and ,maintenance ,account 7#a7 ,mandatory appropriations ,out of any funds in the ,treasury not otherwise appropriated1 the ,secretary of the ,treasury shall deposit in the ,belknap ,indian ,community ,water ,resources and ,water ,rights ,administration1 ,operation1 and ,maintenance ,account established under paragraph 7#b7 of section #aa7;c7 #ca1bfc1jjj1 as adjusted to reflect changes in construction cost indices since ,may #a1 #bjaa1 that are applicable to the types of construction involved in the activities described in that paragraph4 7#b7 ,authorization of appropriations ,in addition to the amounts made available under paragraph 7#a71 there is authorized to be appropriated for deposit in the ,belknap ,indian ,community ,water ,resources and ,water ,rights ,administration1 ,operation1 and ,maintenance ,account established under paragraph 7#b7 of section #aa7;c7 #cj1jcg1jjj1 as adjusted to reflect changes in construction cost indices since ,may #a1 #bjaa1 that are applicable to the types of construction involved in the activities described in that paragraph4 7d7 ,fort ,belknap ,indian ,community ,tribal ,economic ,development ,account 7#a7 ,mandatory appropriations ,out of any funds in the ,treasury not otherwise appropriated1 the ,secretary of the ,treasury shall deposit in the ,fort ,belknap ,indian ,community ,tribal ,economic ,development ,account established under paragraph 7#c7 of section #aa7;c7 #ib1fad1ejj1 as adjusted to reflect changes in construction cost indices since ,may #a1 #bjaa1 that are applicable to the types of construction involved in the activities described in that paragraph4 7#b7 ,authorization of appropriations ,in addition to the amounts made available under paragraph 7#a71 there is authorized to be appropriated for deposit in the ,fort ,belknap ,indian ,community ,tribal ,economic ,development ,account established under paragraph 7#c7 of section #aa7;c7 #ge1gge1ejj1 as adjusted to reflect changes in construction cost indices since ,may #a1 #bjaa1 that are applicable to the types of construction involved in the activities described in that paragraph4 7e7 ,fort ,belknap ,indian ,community ,domestic ,water ,supply and ,wastewater ,systems ,account 7#a7 ,mandatory appropriations ,out of any funds in the ,treasury not otherwise appropriated1 the ,secretary of the ,treasury shall deposit in the ,fort ,belknap ,indian ,community ,domestic ,water ,supply and ,wastewater ,systems ,account established under paragraph 7#d7 of section #aa7;c7 #fi1jcf1hjj1 as adjusted to reflect changes in construction cost indices since ,may #a1 #bjaa1 that are applicable to the types of construction involved in the activities described in that paragraph4 7#b7 ,authorization of appropriations ,in addition to the amounts made available under paragraph 7#a71 there is authorized to be appropriated for deposit in the ,fort ,belknap ,indian ,community ,domestic ,water ,supply and ,wastewater ,systems ,account established under paragraph 7#d7 of section #aa7;c7 #ed1bdc1bjj1 as adjusted to reflect changes in construction cost indices since ,may #a1 #bjaa1 that are applicable to the types of construction involved in the activities described in that paragraph4 7f7 ,milk ,river ,project mitigation 7#a7 ,in general ,as soon as practicable after the date on which amounts are appropriated under paragraph 7#b71 the ,secretary shall make a grant to the ,state in the amount of #ba1jjj1jjj1 to be used by the ,state only to support the cost of construction involved in the mitigation activities that will be implemented for the ,milk ,river ,project1 including by making grants under section #h7;c77#a74 7#b7 ,authorization of appropriations ,there is authorized to be appropriated to the ,secretary to carry out this subsection #ba1jjj1jjj for fiscal year #bjba1 as adjusted to reflect changes in construction cost indices since ,may #a1 #bjaa1 that are applicable to the types of construction involved in the mitigation activities that will be implemented for the ,milk ,river ,project4 7g7 ,federal contribution to the ,milk ,river project mitigation 7#a7 ,state trust account ,the ,secretary shall establish a trust account for the ,state1 consisting of such amounts as are made available by the ,secretary to carry out the mitigation and watershed improvement activities described in the ,compact4 7#b7 ,transfer ,not later than #fj days after the date on which an amount is appropriated under paragraph 7#d7 for a fiscal year1 the ,secretary shall transfer the amount1 at no charge to the ,state1 to the ,state trust account established under paragraph 7#a74 7#c7 ,allocations 7,a7 ,interest ,the ,state may expend the interest accruing on amounts in the ,state trust account under paragraph 7#a7 as the ,state determines to be appropriate to fulfill the purposes of the ,compact4 7,b7 ,principal ,the ,state shall not expend the principal amount in the ,state trust account until-- 7i7 the ,fort ,belknap ,indian ,community has developed1 or is in the process of developing1 the ,tribal water rights in accordance with the ,compact and this ,act2 and 7ii7 the ,state1 in consultation with the ,secretary1 determines that a proposed expenditure of the principal amount is necessary to satisfy mitigation or watershed improvement obligations under the ,compact4 7#d7 ,authorization of appropriations ,there is authorized to be appropriated to the ,secretary to carry out this subsection #e1jjj1jjj for each of fiscal years #bjba through #bjbc4 7h7 ,nonreimbursability of costs ,all amounts incurred by the ,secretary under this section shall be nonreimbursable4 #ac4 ,miscellaneous provisions 7a7 ,waiver of sovereign immunity by the ,united ,states ,except as provided in subsections 7a7 through 7c7 of section #bjh of the ,department of ,justice ,appropriation ,act1 #aiec 7#dc ,u4,s4,c4 #fff71 nothing in this ,act waives the sovereign immunity of the ,united ,states4 7b7 ,other tribes not adversely affected ,nothing in this ,act quantifies or diminishes any land or water right1 or any claim or entitlement to land or water1 of an ,indian ,tribe1 band1 or community other than the ,fort ,belknap ,indian ,community4 7c7 ,elimination of debts or liens against allotments of the ,fort ,belknap ,indian ,community members ,the ,secretary shall cancel and eliminate all debts or liens against the allotments of land held by the ,fort ,belknap ,indian ,community and the members of the ,fort ,belknap ,indian ,community due to construction assessments1 annual operation and maintenance charges1 and any other charge that may have been levied relating to an irrigation project of the ,secretary for the ,fort ,belknap ,indian ,community4 7d7 ,effect on current law ,nothing in this ,act affects any provision of law 7including regulations7 in effect on the day before the date of enactment of this ,act with respect to pre-enforcement review of any ,federal environmental enforcement action4 7e7 ,effect on reclamation laws ,the activities carried out by the ,commissioner under this ,act shall not establish a precedent or impact the authority provided under any other provision of the reclamation laws1 including-- 7#a7 the ,reclamation ,rural ,water ,supply ,act of #bjjf 7#dc ,u4,s4,c4 #bdja et seq472 and 7#b7 the ,omnibus ,public ,land ,management ,act of #bjji 7,public ,law #aaa-aa2 #abc ,stat4 #iia74 7f7 ,additional funding ,nothing in this ,act prohibits the ,fort ,belknap ,indian ,community from seeking-- 7#a7 additional funds for ,tribal programs or purposes2 or 7#b7 funding from the ,united ,states or the ,state based on the status of the ,fort ,belknap ,indian ,community as an ,indian ,tribe4 7g7 ,rights under ,state law ,except as provided in section #a of article ,,iii of the ,compact 7relating to the closing of certain water basins in the ,state to new appropriations in accordance with the laws of the ,state71 nothing in this ,act or the ,compact precludes the acquisition or exercise of a right arising under ,state law 7as defined in section #f of article ,,ii of the ,compact7 to the use of water by the ,fort ,belknap ,indian ,community1 or a member or allottee of the ,fort ,belknap ,indian ,community1 outside the ,reservation by-- 7#a7 purchase of the right2 or 7#b7 submitting to the ,state an application in accordance with ,state law4 7h7 ,water storage and importation ,nothing in this ,act or the ,compact prevents the ,fort ,belknap ,indian ,community from participating in any project to import water to1 or improve storage in1 the ,milk ,river4 7i7 ,environmental protection 7#a7 ,definition of little rockies mountains ,in this subsection1 the term ,little ,rockies ,mountains means the mountains that-- 7,a7 form the southern boundary of the ,reservation2 and 7,b7 are sacred and culturally significant to the ,fort ,belknap ,indian ,community4 7#b7 ,protection ,nothing in the ,compact or this ,act limits-- 7,a7 the authority of the ,united ,states1 the ,state1 or the ,fort ,belknap ,indian ,community to enforce any ,federal1 ,state1 or ,tribal law 7including common law7 relating to the protection of the environment2 or 7,b7 any claim of the ,fort ,belknap ,indian ,community1 a member of the ,fort ,belknap ,indian ,community1 or an allottee1 or of the ,united ,states1 acting on behalf of the ,fort ,belknap ,indian ,community1 a member of the ,fort ,belknap ,indian ,community1 or an allottee1 for-- 7i7 damage to water quality caused by mining activities in the ,little ,rockies ,mountains2 or 7ii7 depletion in surface flows or groundwater on the southern end of the ,reservation4 7j7 ,water transport obligation 7#a7 ,in general ,the ,secretary1 acting through the ,director of the ,bureau of ,indian ,affairs and the ,commissioner1 shall provide assistance with-- 7,a7 the planning1 design1 and construction of-- 7i7 the ,fort ,belknap water supply infrastructure2 7ii7 the ,fort ,belknap ,indian ,irrigation ,rehabilitation ,project2 and 7iii7 the restoration of historic irrigation projects within the boundaries of the ,reservation2 and 7,b7 any environmental compliance activities necessary in the development and construction of a project under this ,act4 7#b7 ,authorization of studies 7,a7 ,in general ,the ,secretary1 acting through the ,director of the ,bureau of ,indian ,affairs and the ,commissioner1 in consultation with the ,fort ,belknap ,indian ,community and the ,state1 shall carry out #a or more studies-- 7i7 to determine the feasibility 7and1 if feasible1 the design7 of a water supply and wastewater treatment system for the ,fort ,belknap ,indian ,community2 and 7ii7 if a project to be developed and constructed under this ,act is associated with1 affected by1 or located within the same river basin as a ,federal reclamation project in existence on the date of enactment of this ,act-- 7,i7 to determine the environmental impact of the project2 and 7,,ii7 to ensure environmental compliance in the development and construction of the project4 7,b7 ,cooperative agreement with the state and the fort belknap indian community ,the ,secretary may enter into #a or more cooperative agreements with the ,state and the ,fort ,belknap ,indian ,community to carry out a study described in subparagraph 7,a7 if the ,secretary determines that a cooperative agreement would be cost-effective and efficient4 7k7 ,title to constructed works ,the ,federal ,government shall continue to hold title to any designated works constructed for the ,fort ,belknap ,indian ,community pursuant to this ,act until such time as all of the following conditions have been met3 7#a7 ,construction is completed4 7#b7 ,the designated constructed works are in operation and functioning according to standards of the relevant ,federal agency responsible for the works4 7#c7 ,the ,secretary has implemented a process for the management and transfer of the designated constructed works that includes-- 7,a7 organizational development2 7,b7 completion of irrigation system infrastructure1 rehabilitation1 and improvement2 and 7,c7 agricultural development 7such as extension services71 including-- 7i7 completion of a training program for employees designated by the ,fort ,belknap ,indian ,community2 and 7ii7 a determination by the ,fort ,belknap ,indian ,community and the relevant ,federal agency that the employees that completed the training program under clause 7i7 are competent to assume partial or all operational and maintenance responsibilities for the constructed works to be transferred4 7#d7 ,the ,fort ,belknap ,indian ,community ,council has agreed to the transfer of the title for the designated constructed works to the ,fort ,belknap ,indian ,community with the assumption of all responsibilities for that designated constructed works4 7#e7 ,after the transfer of title to the ,fort ,belknap ,indian ,community1 the ,united ,states shall have no further responsibilities for the operation and maintenance of the designated constructed works4 7l7 ,conflict of provisions ,if any provision of this ,act conflicts with a provision of the ,compact1 this ,act shall prevail4 #ad4 ,termination on failure to meet enforceability date 7a7 ,in general ,if the ,secretary has not published a statement of findings under section #aj7;f7 by the applicable date described in subsection 7b7-- 7#a7 the authority provided by this ,act shall terminate effective on-- 7,a7 ,january #a1 #bjcj2 or 7,b7 a later date agreed to by the ,fort ,belknap ,indian ,community and the ,secretary2 7#b7 any action taken by the ,secretary and any contract or agreement entered into pursuant to this ,act that can be reversed shall be void2 and 7#c7 any waivers and releases executed under section #aj7;a7 shall be void4 7b7 ,date described ,the date referred to in subsection 7a7 is1 as applicable-- 7#a7 ,december #ca1 #bjbi2 or 7#b7 an alternative later date agreed to by the ,fort ,belknap ,indian ,community and the ,secretary after reasonable notice to the ,state4 #ae4 ,antideficiency ,the ,united ,states shall not be liable for any failure to carry out any obligation or activity authorized by this ,act1 including any obligation or activity under the ,compact1 if-- 7#a7 adequate appropriations are not provided by ,congress expressly to carry out the purposes of this ,act2 or 7#b7 there are not enough funds available in the ,reclamation ,water ,settlements ,fund established by section #ajeja7;a7 of the ,omnibus ,public ,land ,management ,act of #bjji 7#dc ,u4,s4,c4 #djg7;a77 to carry out the purposes of this ,act4
