rates for establishment of ,medicare

the ,social ,security ,act 7#db

7#a7 in paragraph 7#a7-- 7,a7 by        

striking ,beginning ,january #a1 #bjaf  
and inserting the following3  7,a7      
,general reporting requirements ,subject
 to subparagraph 7,b71 beginning

subparagraph 7,a71 as added by          
subparagraph 7,a7 of this paragraph1 by

subsection as the reporting period7     
after at a time specified by the

required during the period beginning

implemented for the private payor       
rate-based clinical laboratory fee      
schedule under the ,medicare program    
under title ,,xviii of the ,social      
,security ,act 7#db ,u4,s4,c4 #acie et  
seq474  7b7 ,scope of study ,in carrying
 out the study described in subsection  
7a71 the ,commission shall consider the 
following3  7#a7 ,how best to implement 
the least burdensome data collection    
process required under section          
#ahcd;,a7a77#a7 of such ,act 7#db       
,u4,s4,c4 #aciem-#a7;a77#a77 that       
would--  7,a7 result in a representative

 and statistically valid data sample of 
private market rates from all laboratory
 market segments1 including hospital    
outreach laboratories1 physician office 
laboratories1 and independent           
laboratories2 and  7,b7 consider the    
variability of private payor payment    
rates across market segments and        
laboratory setttings4  7#b7 ,appropriate
 statistical methods for estimating     
rates that are representative of the    
market4  7c7 ,report to ,congress ,not  
later than #ah months after the date of 
the enactment of this ,act1 the         
,commission shall submit to the         
,administrator1 the ,committee on       
,finance of the ,senate1 and the        
,committees on ,ways and ,means and     
,energy and ,commerce of the ,house of  
,representatives a report that          
includes--  7#a7 conclusions about the  
methodology described in such           
subsection2 and  7#b7 any               
recommendations the ,commission deems   
appropriate4
