,communications ,act of #aicd to provide
 for an auction of ,c-,band spectrum1   
and for other purposes4  #a4 ,short     
title ,this ,act may be cited as the    
,clearing ,broad ,airwaves for ,new     
,deployment ,act or the ,c-,,band ,act4 
#b4 ,auction of ,c-,band spectrum ,title
 ,,iii of the ,communications ,act of   
#aicd 7#dg ,u4,s4,c4 #cja et seq47 is   
amended by adding at the end the        
following3  ,v ,c-,band ,spectrum       
#cii,l4 ,auction of ,c-,band spectrum   
,not later than ,september #cj1 #bjbb1  
the ,commission shall-- 7#a7 clear and  
reallocate no less than #bjj megahertz  
and no more than #cjj megahertz of      
contiguous ,c-,band spectrum 7reserving 

#bj megahertz as guard band7--  7,a7 for
 the provision of broadband internet    
access service2 and  7,b7 in such a way 
that ensures that ,c-,band-dependent    
users--  7i7 receive equal or better    
service as before the implementation of 
this section2 and  7ii7 receive such    
service continuously throughout the     
transition process2 and  7#b7 through a 
system of competitive bidding under     
section #cji7;j71 assign licenses for   
the use of the spectrum reallocated     
under paragraph 7#a71 except for the    
spectrum reserved as guard band4        
#cii,m4 ,treatment of revenues  7a7     
,deposit in the ,treasury               
,notwithstanding section #cji7;j77#h71  
the ,commission shall deposit the total 
amount of proceeds from the auction     
conducted under section #cii,l in the   
,treasury in accordance with chapter #cc
 of title #ca1 ,united ,states ,code4   
7b7 ,rural broadband infrastructure ,of 
the total amount deposited in the       
,treasury under subsection 7a71         

#aj1jjj1jjj1jjj shall be made available 
to the ,commission for the build out and
 maintenance of rural broadband         
infrastructure in unserved rural        
communities4  #cii,n4 ,definitions ,in  
this part3 7#a7 ,c-,band-dependent user 
,the term ,c-,band-dependent user means 
a person who--  7,a7 is a licensee or   
registrant of an earth station receiving
 signals over ,c-,band spectrum2 or     
7,b7 receives or distributes programming
 or services using ,c-,band spectrum4   
7#b7 ,c-,band spectrum ,the term        
,c-,band spectrum means electromagnetic 
spectrum between the frequencies of     
#cgjj megahertz and #dbjj megahertz1    
inclusive4  7#c7 ,clear ,the term clear 
means1 with respect to ,c-,band         
spectrum1 to make such spectrum         
available for reallocation and the      
assignment of licenses through a system 
of competitive bidding 7or reservation  
as guard band7 under section #cii,l4  4
