,communications ,act of #aicd and title 
#ag1 ,united ,states ,code1 to enhance  
the ability of direct broadcast         
satellite providers to offer additional 
local broadcast services to consumers   
under limited circumstances1 and for    
other purposes4  #a4 ,short title ,this 
,act may be cited as the ,western       
,expanded ,in-,state ,television ,access
 ,act of #bjai or the ,,west ,access    
,act4  #b4 ,secondary transmissions of  
local television programming by         
satellite ,section #abb7;a77#d7 of title
 #ag1 ,united ,states ,code1 is amended 
by adding at the end the following3     
7,f7 ,certain network stations ,on      
,january #a1 #bjai1 if #af counties in a

 single ,state were in a local market   
comprised principally of counties       
located in another ,state and within the
 top #abj markets for the year #bjai    
according to ,nielsen ,media ,research1 
the statutory license provided for in   
this paragraph shall apply to the       
secondary transmission by a satellite   
carrier to subscribers in any of those  
#af counties of the primary             
transmissions of any network station    
assigned to a local market that includes
 not more than #d counties in the ,state
 in which such #af counties are located 
and all counties encompassed by such    
local market are located in the same    
time zone4  4  #c4 ,carriage of local   
television signals by satellite carriers
 ,section #cch7l7 of the ,communications
 ,act of #aicd 7#dg ,u4,s4,c4 #cch7l77  
is amended-- 7#a7 by redesignating      
paragraphs 7#c71 7#d71 and 7#e7 as      
paragraphs 7#d71 7#e71 and 7#f71        
respectively2 and  7#b7 by inserting    
after paragraph 7#b7 the following3     

7#c7 ,special consideration for requests
 involving an orphan county ,pursuant to
 a request under paragraph 7#a71 the    
,commission may modify the local market 
of a television broadcast station to add
 an orphan county1 as defined by the    
,commission1 solely on the basis of     
paragraph 7#b77;,b77iii71 if the        
,commission considers whether the       
station provides programming            
specifically related to the ,state of   
residence of the orphan county          
subscribers4  4
