amend title #ac1 ,united ,states ,code1 
to make clear that each decennial       
census1 as required for the             
apportionment of ,representatives in    
,congress among the several ,states1    
shall tabulate the total number of      
persons in each ,state1 and to provide  
that no information regarding ,united   
,states citizenship or immigration      
status may be elicited in any such      
census4  #a4 ,short title ,this ,act may

 be cited as the ,every ,person ,counts 
,act4  #b4 ,census data collection  7a7 
,requirement ,section #ada7;b7 of title 
#ac1 ,united ,states ,code1 is amended  
by striking ,united ,states and         
inserting the following3 ,united        
,states1 and shall tabulate the total   
number of persons in each ,state4  7b7  
,prohibition ,section #ada7;a7 of title 
#ac1 ,united ,states ,code1 is amended  
in the second sentence by striking as   
necessary and inserting the following3  
as necessary1 except that the ,secretary
 may not include any question or        
otherwise elicit any information        
regarding ,united ,states citizenship or
 immigration status4  7c7 ,rules of     
construction ,nothing in subsection 7a7 
or 7b7 shall be construed to-- 7#a7     
permit or require the exclusion from any
 decennial census of population 7as     
defined in section #ada7;g7 of title    
#ac1 ,united ,states ,code7 of--  7,a7  
any person on the basis of age2  7,b7   
personnel in the ,armed ,forces 7and    

their dependents7 serving abroad2  7,c7 
,federal employees 7and their           
dependents7 stationed abroad2 or  7,d7  
any other persons outside of the ,united
 ,states 7in addition to persons        
described in subparagraph 7,b7 or 7,c77 
who can be traced to the ,state of their
 usual place of residence1 as determined
 by the ,secretary of ,commerce2 or     
7#b7 affect the survey conducted by the 
,secretary of ,commerce that is commonly
 referred to as the ,american ,community
 ,survey4
