violations of ethnic ,turkic ,muslims in ,xinjiang1 and calling for an end to arbitrary detention1 torture1 and harassment of these communities inside and outside ,china41 do pass with the following ,strike out all after the enacting clause and insert3 #a4 ,short title ,this ,act may be cited as the ,uighur ,intervention and ,global ,humanitarian ,unified ,response ,act of #bjai or the ,,uighur ,act of #bjai4 #b4 ,statement of purpose ,the purpose of this ,act is to direct ,united ,states resources to address human rights violations and abuses1 including gross violations of human rights1 by the ,people's ,republic of ,china's mass surveillance and internment of over #a1jjj1jjj ,uighurs and other predominantly ,turkic ,muslim ethnic minorities in ,china's ,xinjiang ,uighur ,autonomous ,region4 #c4 ,appropriate congressional committees ,in this ,act1 the term appropriate congressional committees means-- 7#a7 the ,committee on ,foreign ,affairs1 the ,committee on ,financial ,services1 and the ,committee on ,appropriations of the ,house of ,representatives2 and 7#b7 the ,committee on ,foreign ,relations1 the ,committee on ,banking1 ,housing1 and ,urban ,affairs1 and the ,committee on ,appropriations of the ,senate4 #d4 ,findings ,congress makes the following findings3 7#a7 ,the ,government of the ,people's ,republic of ,china has a long history of repressing ,turkic ,muslims1 particularly ,uighurs1 in ,china's ,xinjiang ,uighur ,autonomous ,region4 7#b7 ,in ,may #bjad1 ,chinese authorities launched their latest ,strike ,hard against ,violent ,extremism campaign1 using wide-scale1 internationally-linked threats of terrorism as a pretext to justify pervasive restrictions on and human rights violations of members of the ethnic minority communities of the ,xinjiang ,uighur ,autonomous ,region4 ,the ,august #bjaf transfer of former ,tibet ,autonomous ,region ,party ,secretary ,chen ,quanguo to become the ,xinjiang ,party ,secretary prompted an acceleration in the crackdown across the region4 ,scholars1 human rights organizations1 journalists1 and think tanks have provided ample evidence substantiating the establishment by ,chinese authorities of reeducation camps4 ,since #bjad1 ,chinese authorities have detained no less than #hjj1jjj ,uighurs1 ethnic ,kazakhs1 ,kyrgyz1 and other ethnic minorities in these camps4 7#c7 ,those detained in such facilities have described forced political indoctrination1 torture1 beatings1 and food deprivation1 as well as denial of religious1 cultural1 and linguistic freedoms1 and confirmed that they were told by guards that the only way to secure release was to demonstrate sufficient political loyalty4 ,poor conditions and lack of medical treatment at such facilities appear to have contributed to the deaths of some detainees1 including the elderly and infirm4 7#d7 ,uighurs and ethnic ,kazakhs1 who have now obtained permanent residence or citizenship in other countries1 attest to receiving threats and harassment from ,chinese officials4 ,at least five journalists for ,radio ,free ,asia's ,uighur service have publicly detailed abuses their family members in ,xinjiang have endured in response to their work exposing abusive policies across the ,xinjiang ,uighur ,autonomous ,region4 7#e7 ,in ,september #bjah1 ,united ,nations ,high ,commissioner for ,human ,rights ,michele ,bachelet noted in her first speech as ,high ,commissioner the deeply disturbing allegations of large-scale arbitrary detentions of ,uighurs and other ,muslim communities1 in so-called re-education camps across ,xinjiang4 7#f7 ,the ,government of the ,people's ,republic of ,china's actions against ,turkic ,muslims in the ,xinjiang ,uighur ,autonomous ,region1 whose population was approximately #ac million at the time of the last ,chinese census in #bjaj1 are in contravention of international human rights laws1 the ,international ,convention on the ,elimination of ,all ,forms of ,racial ,discrimination1 and the ,convention against ,torture and ,other ,cruel1 ,inhuman or ,degrading ,treatment or ,punishment1 both of which ,china has signed and ratified1 and the ,universal ,declaration of ,human ,rights and the ,international ,covenant on ,civil and ,political ,rights1 which ,china has signed4 #e4 ,sense of ,congress ,it is the sense of ,congress that-- 7#a7 the ,president should condemn abuses against ,turkic ,muslims by ,chinese authorities and call on such authorities immediately-- 7,a7 to close the reeducation camps2 7,b7 to lift all restrictions on and ensure respect for human rights2 and 7,c7 to allow those inside ,china to reestablish contact with their loved ones1 friends1 and associates outside ,china2 7#b7 the ,secretary of ,state should-- 7,a7 fully implement the provisions of the ,frank ,r4 ,wolf ,international ,religious ,freedom ,act 7,public ,law #aad-bha72 and 7,b7 should consider strategically employing sanctions and other tools under the ,international ,religious ,freedom ,act of #aiih 7#bb ,u4,s4,c4 #fdja et seq471 including measures required by reason of the designation of the ,people's ,republic of ,china as a country of particular concern for religious freedom under section #djb7;b77#a77;,a77ii7 of such ,act that directly address particularly severe violations of religious freedom2 7#c7 the ,secretary of ,state should work with ,united ,states allies and partners as well as through multilateral institutions to condemn the mass arbitrary detention of ,uighurs in ,china's ,xinjiang ,uighur ,autonomous ,region and coordinate closely with the international community on targeted sanctions and visa restrictions2 and 7#d7 the journalists of the ,uighur language service of ,radio ,free ,asia should be commended for their reporting on the human rights and political situation in the ,xinjiang ,uighur ,autonomous ,region despite efforts by the ,government of the ,people's ,republic of ,china to silence or intimidate their reporting through the detention of family members and relatives in ,china1 and the ,united ,states should expand the availability of and capacity for ,uighur language programming on ,radio ,free ,asia in the region4 #f4 ,updating statement of ,united ,states policy toward the ,people's ,republic of ,china ,section #ija7;b7 of the ,foreign ,relations ,authorization ,act1 ,fiscal ,years #aiij and #aiia 7,public ,law #aja-bdf2 #ajd ,stat4 #hd7 is amended-- 7#a7 by redesignating paragraphs 7#g71 7#h71 and 7#i7 as paragraphs 7#h71 7#i71 and 7#aj71 respectively2 and 7#b7 by inserting after paragraph 7#f7 the following3 7#g7 ,united ,states policy toward the ,people's ,republic of ,china should be explicitly linked with the situation in ,china's ,xinjiang ,uighur ,autonomous ,region1 specifically as to whether-- 7,a7 the mass internment of ethnic ,uighur and other ,turkic ,muslims in political education camps has ended2 7,b7 all political prisoners in the region are released2 7,c7 the use of high-tech mass surveillance and predictive policing to discriminate against and violate the human rights of members of specific ethnic groups is evident in other parts of ,china2 and 7,d7 the ,government of the ,people's ,republic of ,china has ended efforts aimed at cultural assimilation and particularly severe restrictions of religious practice in the region2 4 #g4 ,application of sanctions under ,global ,magnitsky ,human ,rights ,accountability ,act with respect to certain senior officials of the ,people's ,republic of ,china 7a7 ,in general ,not later than #abj days after the date of the enactment of this ,act1 the ,president shall submit to the appropriate congressional committees a list of senior officials of the ,government of the ,people's ,republic of ,china who the ,president determines are responsible for or who have knowingly engaged in serious human rights abuses against ,turkic ,muslims in the ,xinjiang ,uighur ,autonomous ,region and elsewhere in ,china4 ,such list shall include the following3 7#a7 ,senior ,chinese officials1 such as ,xinjiang ,party ,secretary ,chen ,quanguo1 who are directly responsible for the ongoing repression in the ,xinjiang ,uighur ,autonomous ,region4 7#b7 ,senior ,chinese officials responsible for mass incarceration1 political indoctrination1 or reeducation efforts targeting ,uighurs and other predominantly ,muslim ethnic minorities4 7b7 ,form ,the list required under subsection 7a7 shall be submitted in unclassified form but may contain a classified annex4 7c7 ,sanctions imposed ,on the date on which the ,president submits to the appropriate congressional committees the list described in subsection 7a71 and as appropriate thereafter1 the ,president shall impose the sanctions described in section #abfc7;b7 of the ,global ,magnitsky ,human ,rights ,accountability ,act 7subtitle ,f of title ,,xii of ,public ,law #aad-cbh2 #bb ,u4,s4,c4 #bfef note7 with respect to any foreign person that the ,president has identified on the list4 7d7 ,exception for ,united ,nations ,headquarters ,agreement2 enforcement ,subsections 7e7 and 7f7 of section #abfc of the ,global ,magnitsky ,human ,rights ,accountability ,act apply with respect to the imposition of sanctions under this section to the same extent as such subsections apply with respect to the imposition of sanctions under such section #abfc4 7e7 ,waiver for national interests ,the ,president may waive the imposition of sanctions under subsection 7c7 if the ,president-- 7#a7 determines that such a waiver is in the national interests of the ,united ,states2 and 7#b7 submits to the appropriate congressional committees notice of1 and a justification for1 the waiver4 7f7 ,regulatory authority ,the ,president shall issue such regulations1 licenses1 and orders as are necessary to carry out this section4 7g7 ,exception relating to importation of goods 7#a7 ,in general ,the authorities and requirements to impose sanctions authorized under this ,act shall not include the authority or requirement to impose sanctions on the importation of goods4 7#b7 ,good defined ,in this subsection1 the term good means any article1 natural or man-made substance1 material1 supply or manufactured product1 including inspection and test equipment1 and excluding technical data4 #h4 ,report on human rights abuses in ,china's ,xinjiang ,uighur ,autonomous ,region 7a7 ,in general ,not later than #ahj days after the date of the enactment of this ,act1 the ,secretary of ,state1 in consultation with the heads of other relevant ,federal departments and agencies and civil society organizations1 shall submit to the appropriate congressional committees and make available on the website of the ,department of ,state a report on human rights abuses in the ,xinjiang ,uighur ,autonomous ,region4 7b7 ,matters ,to be included ,the report required by subsection 7a7 shall include the following3 7#a7 ,an assessment of the number of individuals detained in political reeducation camps in the region and conditions in the camps for detainees1 including an assessment1 to the extent practicable1 of whether detainees endure torture1 efforts at forced renunciation of their faith1 or other mistreatment4 7#b7 ,an assessment of1 to the extent practicable1 the number of individuals in the region in highly-controlled forced labor camps4 7#c7 ,a description of the methods used by ,people's ,republic of ,china authorities to reeducate ,uighur detainees1 including an identification of the ,chinese agencies in charge of such reeducation4 7#d7 ,an assessment of the use and nature of forced labor in and related to the detention of ,turkic ,muslims in the ,xinjiang ,uighur ,autonomous ,region1 and a description of foreign companies and industries benefitting from such labor in the region4 7#e7 ,an assessment of the level of access to the region ,chinese authorities grant to foreign diplomats and consular agents1 independent journalists1 and representatives of nongovernmental organizations4 7#f7 ,an assessment of the repressive surveillance1 detection1 and control methods used by ,chinese authorities in the region4 7#g7 ,a description1 as appropriate1 of diplomatic efforts by ,united ,states allies and other nations to address the gross violations of universally recognized human rights in the region and to protect asylum seekers from the region4 #i4 ,restrictions on export1 reexport1 and in-country transfers of certain items that provide a critical capability to the ,government of the ,people's ,republic of ,china to suppress individual privacy1 freedom1 and other basic human rights 7a7 ,statement of policy ,it is the policy of the ,united ,states to protect the basic human rights of ,uighurs and other ethnic minorities in the ,people's ,republic of ,china4 7b7 ,list of covered items 7#a7 ,in general ,not later than #abj days after the date of the enactment of this ,act1 and as appropriate thereafter1 the ,president-- 7,a7 shall identify those items that provide a critical capability to the ,government of the ,people's ,republic of ,china1 or any person acting on behalf of such ,government1 to suppress individual privacy1 freedom of movement1 and other basic human rights1 specifically through-- 7i7 surveillance1 interception1 and restriction of communications2 7ii7 monitoring of individual location or movement or restricting individual movement2 7iii7 monitoring or restricting access to and use of the internet2 7iv7 monitoring or restricting use of social media2 7v7 identification of individuals through facial recognition1 voice recognition1 or biometric indicators2 7vi7 detention of individuals who are exercising basic human rights2 and 7vii7 forced labor in manufacturing2 and 7,b7 shall1 pursuant to the ,export ,control ,reform ,act of #bjah 7#ej ,u4,s4,c4 #dhja et seq471 include items identified pursuant to subparagraph 7,a7 on the ,commerce ,control ,list in a category separate from other items1 as appropriate1 on the ,commerce ,control ,list4 7#b7 ,support and cooperation ,upon request1 the head of a ,federal agency shall provide full support and cooperation to the ,president in carrying out this subsection4 7#c7 ,consultation ,in carrying out this subsection1 the ,president shall consult with the relevant technical advisory committees of the ,department of ,commerce to ensure that the composition of items identified under paragraph 7#a77;,a7 and included on the ,commerce ,control ,list under paragraph 7#a77;,b7 does not unnecessarily restrict commerce between the ,united ,states and the ,people's ,republic of ,china1 consistent with the purposes of this section4 7c7 ,special license or other authorization 7#a7 ,in general ,beginning not later than #ahj days after the date of the enactment of this ,act1 the ,president shall1 pursuant to the ,export ,control ,reform ,act of #bjah 7#ej ,u4,s4,c4 #dhja et seq471 require a license or other authorization for the export1 reexport1 or in-country transfer to or within the ,people's ,republic of ,china of an item identified pursuant to subsection 7b77#a77;,a7 and included on the ,commerce ,control ,list pursuant to subsection 7b77#a77;,b74 7#b7 ,presumption of denial ,an application for a license or other authorization described in paragraph 7#a7 shall be subject to a presumption of denial4 7#c7 ,public notice and comment ,the ,president shall provide for notice and public comment with respect actions necessary to carry out this subsection4 7d7 ,international coordination and multilateral controls ,it shall be the policy of the ,united ,states to seek to harmonize ,united ,states export control regulations with international export control regimes with respect to the items identified pursuant to subsection 7b77#a77;,a71 including through the ,wassenaar ,arrangement and other bilateral and multilateral mechanisms involving countries that export such items4 7e7 ,termination of suspension of certain other programs and activities ,section #ijb7;b77#a7 of the ,foreign ,relations ,authorization ,act1 ,fiscal ,years #aiij and #aiia 7,public ,law #aja-bdf2 #bb ,u4,s4,c4 #baea note7 is amended-- 7#a7 in the matter preceding subparagraph 7,a71 by inserting and ,china's ,xinjiang ,uighur ,autonomous ,region after ,tibet2 7#b7 in subparagraph 7,d71 by striking and at the end2 7#c7 in subparagraph 7,e71 by striking or after the semicolon and inserting and2 and 7#d7 by adding the following new subparagraph3 7,f7 the ending of the mass internment of ethnic ,uighurs and other ,turkic ,muslims in the ,xinjiang ,uighur ,autonomous ,region1 including the intrusive system of high-tech surveillance and policing in the region2 or 4 7f7 ,definitions ,in this section3 7#a7 ,commerce ,control ,list ,the term ,commerce ,control ,list means the list set forth in ,supplement ,no4 #a to part #ggd of the ,export ,administration ,regulations under subchapter ,c of chapter ,,vii of title #ae1 ,code of ,federal ,regulations4 7#b7 ,export1 in-country transfer1 item1 and reexport ,the terms export1 in-country transfer1 item1 and reexport have the meanings given such terms in section #agdb of the ,export ,control ,reform ,act of #bjah 7#ej ,u4,s4,c4 #dhja74 ,clerk4
