read twice and referred to the ,committee on ,energy and ,natural ,resources ,a ,,bill ,to enable projects that will aid in the development and delivery of related instruction associated with apprenticeship and preapprenticeship programs that are focused on serving the skilled technical workforce at the ,national ,laboratories and certain facilities of the ,national ,nuclear ,security ,administration1 and for other purposes4 #a4 ,short title ,this ,act may be cited as the ,department of ,energy ,national ,labs ,jobs ,,access ,act4 #b4 ,national ,laboratory ,jobs ,access ,program 7a7 ,in general ,not later than #ahj days after the date of enactment of this ,act1 the ,secretary shall establish a program known as the ,department of ,energy ,national ,lab ,jobs ,,access ,program1 under which the ,secretary shall award1 on a competitive basis1 #e-year grants to eligible entities described in subsection 7c7 for the ,federal share of the costs of technical1 skills-based preapprenticeship and apprenticeship programs that provide employer-driven or recognized postsecondary credentials during the grant period4 7b7 ,requirements ,a program funded by a grant awarded under this section shall develop and deliver customized and competency-based training that-- 7#a7 leads to recognized postsecondary credentials for secondary school and postsecondary students2 7#b7 is focused on skills and qualifications needed to meet the immediate and on-going needs of traditional and emerging technician positions 7including machinists and cyber security technicians7 at the ,national ,laboratories and covered facilities of the ,national ,nuclear ,security ,administration2 7#c7 creates an apprenticeship or preapprenticeship partnership with a ,national ,laboratory or covered facility of the ,national ,nuclear ,security ,administration2 and 7#d7 creates an apprenticeship or preapprenticeship program with the ,secretary of ,labor or a ,state department of labor4 7c7 ,eligible entities ,an entity that is eligible to receive a grant under this section shall be a workforce intermediary or an eligible sponsor of a preapprenticeship or an apprenticeship program that-- 7#a7 demonstrates experience in implementing and providing career planning and career pathways towards technical1 skills-based apprenticeship or preapprenticeship training programs2 7#b7 7,a7 has a relationship with a ,national ,laboratory or covered facility of the ,national ,nuclear ,security ,administration2 7,b7 has knowledge of technician workforce needs of such laboratory or facility and the associated security requirements of such laboratory or facility2 and 7,c7 is eligible to enter into an agreement with such laboratory or facility that would be paid for in part or entirely from grant funds received under this section2 7#c7 demonstrates the ability to recruit and support individuals who plan to work in relevant technician positions upon the successful completion of such programs2 7#d7 provides students who complete such programs with a recognized postsecondary credential1 such as a journeyman craft license or an industry-recognized certification2 7#e7 uses a customized training curriculum that is specifically aligned with employers1 utilizing workplace learning advisors and on-the-job training to the greatest extent possible2 and 7#f7 demonstrates successful outcomes connecting graduates of such programs to careers relevant to such programs4 7d7 ,applications ,an eligible entity seeking a grant under this section shall submit to the ,secretary an application at such time1 in such manner1 and containing such information as the ,secretary may require4 7e7 ,priority ,in selecting eligible entities to receive grants under this section1 the ,secretary shall prioritize an eligible entity that-- 7#a7 is a member of an industry or sector partnership2 7#b7 provides the training described in subsection 7b7-- 7,a7 at an institution of higher education 7such as a community college7 that includes basic science1 technology1 and mathematics education in the curriculum2 7,b7 through an apprenticeship program that was registered with the ,department of ,labor or a ,state before the date on which the eligible entity applies for the grant under subsection 7d72 or 7,c7 with respect to a preapprenticeship program1 at a local educational agency1 a secondary school1 an area career and technical education school1 or an appropriate community facility2 7#c7 works with the ,secretary of ,defense or veterans organizations to transition members of the ,armed ,forces and veterans to apprenticeship or preapprenticeship programs in a relevant sector2 7#d7 plans to use the grant to carry out the training described in subsection 7b7 with an entity that receives ,state funding or is operated by a ,state agency2 and 7#e7 plans to use the grant to carry out the training described in subsection 7b7 for-- 7,a7 young adults ages #ag to #bi1 inclusive2 or 7,b7 individuals with barriers to employment4 7f7 ,additional consideration ,in making grants under this section1 the ,secretary shall consider regional diversity4 7g7 ,limitation on applications ,an eligible entity may not submit1 either individually or as part of a joint application1 more than #a application for a grant under this section during any #a fiscal year4 7h7 ,limitations on amount of grant ,the amount of a grant provided under this section for any #bd-month period of the #e-year grant period shall not exceed #ejj1jjj4 7i7 ,non-,federal share ,the non-,federal share of the cost of a customized training program carried out using a grant under this section shall be not less than #be percent of the total cost of the program4 7j7 ,technical assistance ,the ,secretary may provide technical assistance to eligible entities described in subsection 7c7 to leverage the existing job training and education programs of the ,department of ,labor and other relevant programs at appropriate ,federal agencies4 7k7 ,report 7#a7 ,in general ,not less than once every #b years1 the ,secretary of ,labor shall submit to ,congress1 and make publicly available on the website of the ,department of ,labor1 a report on the program established under this section1 including-- 7,a7 a description of-- 7i7 any entity that receives a grant under this section2 7ii7 any activity carried out using the grants under this section2 and 7iii7 best practices used to leverage the investment of the ,federal ,government under this section2 and 7,b7 an assessment of the results achieved by the program established under this section1 including the rate of employment for participants after completing a job training and education program carried out using a grant under this section4 7#b7 ,provision of information ,the ,secretary of ,energy shall provide such information as necessary to the ,secretary of ,labor for purposes of the report under paragraph 7#a74 7l7 ,definitions ,in this section3 7#a7 ,,esea terms ,the terms local educational agency and secondary school have the meanings given the terms in section #haja of the ,elementary and ,secondary ,education ,act of #aife 7#bj ,u4,s4,c4 #ghja74 7#b7 ,,wioa terms ,the terms career planning1 community-based organization1 customized training1 economic development agency1 individual with a barrier to employment1 industry or sector partnership1 on-the-job training1 recognized postsecondary credential1 and workplace learning advisor have the meanings given such terms in section #c of the ,workforce ,innovation and ,opportunity ,act 7#bi ,u4,s4,c4 #cajb74 7#c7 ,apprenticeship ,the term apprenticeship means an apprenticeship registered under the ,act of ,august #af1 #aicg 7commonly known as the ,national ,apprenticeship ,act2 #ej ,stat4 #ffd1 chapter #ffc2 #bi ,u4,s4,c4 #ej et seq474 7#d7 ,area career and technical education school ,the term area career and technical education school has the meaning given the term in section #c of the ,carl ,d4 ,perkins ,career and ,technical ,education ,act of #bjjf 7#bj ,u4,s4,c4 #bcjb74 7#e7 ,community college ,the term community college has the meaning given the term junior or community college in section #cab7;f7 of the ,higher ,education ,act of #aife 7#bj ,u4,s4,c4 #ajeh7;f774 7#f7 ,covered facility of the ,national ,nuclear ,security ,administration ,the term covered facility of the ,national ,nuclear ,security ,administration means a national security laboratory or a nuclear weapons production facility as such terms are defined in section #djjb of the ,atomic ,energy ,defense ,act 7#ej ,u4,s4,c4 #beja74 7#g7 ,eligible ,sponsor ,the term eligible sponsor means a public organization or an organization described in section #eja7;c7 of the ,internal ,revenue ,code of #aihf and exempt from tax under section #eja7;a7 of that ,code1 that-- 7,a7 with respect to an apprenticeship program1 administers such program through a partnership that may include-- 7i7 a business2 7ii7 an employer or industry association2 7iii7 a labor-management organization2 7iv7 a local workforce development board or ,state workforce development board2 7v7 a #b- or #d-year institution of higher education that offers an educational program leading to an associate's or bachelor's degree in conjunction with a certificate of completion of apprenticeship2 7vi7 the ,armed ,forces 7including the ,national ,guard and ,reserves72 7vii7 a community-based organization2 or 7viii7 an economic development agency2 and 7,b7 with respect to a preapprenticeship program1 is a local educational agency1 a secondary school1 an area career and technical education school1 a ,state workforce development board1 a local workforce development board1 or a community-based organization1 that administers such program with any required coordination and necessary approvals from the ,secretary of ,labor or a ,state department of labor4 7#h7 ,institution of higher education ,the term institution of higher education has the meaning given the term in section #aja of the ,higher ,education ,act of #aife 7#bj ,u4,s4,c4 #ajja74 7#i7 ,local workforce development board ,the term local workforce development board has the meaning given the term local board in section #c of the ,workforce ,innovation and ,opportunity ,act 7#bi ,u4,s4,c4 #cajb74 7#aj7 ,national ,laboratory ,the term ,national ,laboratory has the meaning given the term in section #b of the ,energy ,policy ,act of #bjje 7#db ,u4,s4,c4 #aehja74 7#aa7 ,preapprenticeship ,the term preapprenticeship1 used with respect to a program1 means an initiative or set of strategies that-- 7,a7 is designed to prepare participants to enter and succeed in an apprenticeship program2 7,b7 is carried out by an eligible sponsor that has a documented partnership with one or more sponsors of apprenticeship programs2 and 7,c7 includes each of the following3 7i7 ,training 7including a curriculum for the training7 aligned with industry standards related to apprenticeships and reviewed and approved annually by sponsors of the apprenticeships within the documented partnership that will prepare participants by teaching the skills and competencies needed to enter one or more apprenticeship programs4 7ii7 ,hands-on training and theoretical education for participants that-- 7,i7 includes proper observation of supervision and safety protocols2 and 7,,ii7 does not displace a paid employee4 7iii7 ,a formal agreement with a sponsor of an apprenticeship program that would enable participants who successfully complete the preapprenticeship program-- 7,i7 to enter directly into the apprenticeship program if a place in the program is available and if the participant meets the qualifications of the apprenticeship program2 and 7,,ii7 to earn credits towards the apprenticeship program4 7#ab7 ,related instruction ,the term related instruction means an organized and systematic form of instruction designed to provide an apprentice with the knowledge of the theoretical and technical subjects related to the occupation of the apprentice or the instruction needed to prepare an individual to enter and succeed in an apprenticeship program4 7#ac7 ,secretary ,the term ,secretary means the ,secretary of ,energy1 in consultation with the ,secretary of ,labor1 except as otherwise specified in this ,act4 7#ad7 ,state workforce development board ,the term ,state workforce development board has the meaning given the term ,state board in section #c of the ,workforce ,innovation and ,opportunity ,act 7#bi ,u4,s4,c4 #cajb74 7#ae7 ,workforce intermediary ,the term workforce intermediary-- 7,a7 means an organization that proactively addresses workforce needs using a dual customer approach1 which considers the needs of both employees and employers2 and 7,b7 may include a faith-based and community organization1 an employer organization1 a community college1 a temporary staffing agency1 a ,state workforce development board1 a local workforce development board1 or a labor organization4 7m7 ,authorization of appropriations ,there is authorized to be appropriated to carry out this section #e1jjj1jjj for each of the fiscal years #bjbj through #bjbd4
