twice and referred to the ,committee on ,commerce1 ,science1 and ,transportation ,a ,,bill ,to expand enrollment in ,,tsa ,pre,check to expedite commercial travel screening and improve airport security4 #a4 ,short title ,this ,act may be cited as the ,secure ,traveler ,act4 #b4 ,definitions ,in this ,act3 7#a7 ,public agency ,the term public agency means the ,federal ,government1 a ,state government1 a unit of local government1 any combination of such government entities1 or any department1 agency1 or instrumentality of any such government entity4 7#b7 ,sponsoring agency ,the term sponsoring agency means a government agency for which a security clearance is obtained1 as determined by the ,director of the ,national ,background ,investigations ,bureau of the ,office of ,personnel ,management4 7#c7 ,public safety officer ,the term public safety officer means a person serving as a law enforcement officer1 as determined by the ,attorney ,general4 #c4 ,,tsa ,pre,check enrollment for individuals with active security clearance 7a7 ,process ,not later than #ahj days after the date of the enactment of this ,act1 the ,administrator of the ,transportation ,security ,administration1 in consultation with the ,director of the ,national ,background ,investigations ,bureau of the ,office of ,personnel ,management and other appropriate departments and agencies of the ,federal ,government1 shall establish a process to permit the verification of an active security clearance to enable enrollment in ,,tsa ,pre,check4 7b7 ,components ,in establishing the process required under subsection 7a71 the ,administrator shall ensure that-- 7#a7 eligible applicants for ,,tsa ,pre,check provide verification of active clearance through coordination with their sponsoring agency2 7#b7 active clearance is required at the time an application is submitted and at the time of its approval2 7#c7 interim security clearance is not accepted for purposes of paragraphs 7#a7 and 7#b72 and 7#d7 approved applicants are assigned a trusted traveler number4 7c7 ,eligible levels of clearance ,an individual holding any of the following security clearances shall be eligible to participate in ,,tsa ,pre,check under the process established under subsection 7a73 7#a7 ,secret4 7#b7 ,top ,secret1 including ,sensitive ,compartmented ,information4 7#c7 ,l ,clearance4 7#d7 ,q ,clearance4 7#e7 ,yankee ,white1 all categories4 7d7 ,fees ,any individual who enrolls in ,,tsa ,pre,check through the process established under subsection 7a7 shall submit any fee required to cover the costs of participation in such program4 ,notwithstanding section #ccjb of title #ca1 ,united ,states ,code1 such fee shall be retained and used by the ,transportation ,security ,administration4 7e7 ,termination2 renewal 7#a7 ,term ,if an individual remains eligible for membership in ,,tsa ,pre,check under the requirements established by the ,transportation ,security ,administration1 his or her participation in ,,tsa ,pre,check will terminate on the date that is #e years after the date on which such enrollment is approved unless it is renewed in accordance with applicable law4 7#b7 ,revocation 7,a7 ,in general ,an individual's participation in ,,tsa ,pre,check that was initiated through the process established under subsection 7a7 shall be terminated if the underlying security clearance is revoked1 as determined by the sponsoring agency4 7,b7 ,exceptions ,except as provided in subparagraph 7,a71 an individual's participation in ,,tsa ,pre,check that was initiated through the process established under subsection 7a7 may be revoked1 at the discretion of the ,administrator1 if-- 7i7 the individual is determined to pose a threat to aviation or national security2 and 7ii7 the underlying security clearance is inactivated as a result of a change of the individual's employment or the end of an individual's appointment in a particular position4 #d4 ,,tsa ,pre,check enrollment for law enforcement officers 7a7 ,process ,not later than #ahj days after the date of the enactment of this ,act1 the ,administrator of the ,transportation ,security ,administration1 in consultation with the ,attorney ,general1 shall establish a process to permit the enrollment of certain law enforcement officers in ,,tsa ,pre,check4 7b7 ,components ,in establishing the process required under subsection 7a71 the ,attorney ,general and the ,administrator shall ensure that-- 7#a7 eligible applicants for ,,tsa ,pre,check provide verification of active employment through coordination with their sponsoring agency2 7#b7 active employment in good standing is required-- 7,a7 at the time an application is submitted2 and 7,b7 at the time an application is approved2 7#c7 interim disciplinary status is not accepted for purposes of paragraphs 7#a7 and 7#b72 and 7#d7 approved applicants are assigned a trusted traveler number4 7c7 ,eligible law enforcement officers ,an individual shall be eligible to participate in ,,tsa ,pre,check under the process established under subsection 7a7 if he or she-- 7#a7 is a public safety officer for a public agency 7including a court system7 that receives ,federal financial assistance2 7#b7 is a law enforcement officer for a public agency2 or 7#c7 occupies another position1 as deemed appropriate by the ,attorney ,general and the ,administrator4 7d7 ,fees ,any individual who enrolls in ,,tsa ,pre,check through the process established under subsection 7a7 shall submit any fee required to cover the costs of participation in such program4 ,notwithstanding section #ccjb of title #ca1 ,united ,states ,code1 such fee shall be retained and used by the ,transportation ,security ,administration4 7e7 ,termination2 renewal 7#a7 ,term ,if an individual remains eligible for membership in ,,tsa ,pre,check under the requirements established by the ,transportation ,security ,administration1 his or her participation in ,,tsa ,pre,check shall terminate on the date that is #e years after the date on which such enrollment is approved unless such enrollment is renewed in accordance with applicable law4 7#b7 ,revocation ,an individual's participation in ,,tsa ,pre,check that was initiated through the process established under subsection 7a7-- 7,a7 shall be revoked if the underlying employment is terminated or suspended1 as determined by the sponsoring agency2 and 7,b7 may be revoked1 at the discretion of the ,attorney ,general and the ,administrator1 based on the termination of the underlying employment if such termination is a result of-- 7i7 a voluntary change of the individual's employment2 or 7ii7 the expiration of the term of service in a particular position to which an individual was appointed4 #e4 ,report on expanded enrollment for trusted traveler programs 7a7 ,in general ,not later than #bgj days after the date of the enactment of this ,act1 the ,commissioner of ,u4,s4 ,customs and ,border ,protection and the ,administrator of the ,transportation ,security ,administration1 in consultation with the ,attorney ,general1 the ,director of the ,national ,background ,investigations ,bureau of the ,office of ,personnel ,management1 and other appropriate departments and agencies of the ,federal ,government1 shall submit a report to ,congress on the feasibility of expanding the enrollment processes established under sections #c and #d to the ,trusted ,traveler ,programs listed in subsection 7b74 7b7 ,trusted ,traveler ,programs ,the programs listed in this subsection are-- 7#a7 ,global ,entry2 7#b7 ,,sentri2 7#c7 ,,nexus2 and 7#d7 any travel facilitation program that is similar to any of the programs listed in paragraphs 7#a7 though 7#c7 and has been designated by the ,secretary of ,homeland ,security to be included in the report required under subsection 7a74
