require greater transparency for        
,federal regulatory decisions that      
impact small businesses4  #a4 ,short    
title ,this ,act may be cited as the    
,prove ,it ,act of #bjai4  #b4 ,review  
procedures related to the certification 
7a7 ,in general ,section #fje7;b7 of    
title #e1 ,united ,states ,code1 is     
amended-- 7#a7 by inserting 7#a7 before 
,sections #fjc2  7#b7 in paragraph 7#a71
 as so designated-- 7,a7 by striking the
 preceding sentence and inserting this  
subsection2 and  7,b7 by striking       
statement to the ,chief ,counsel for    
,advocacy of the ,small ,business       
,administration and inserting statement 
providing the factual basis to the      

,chief ,counsel for ,advocacy of the    
,small ,business ,administration 7in    
this subsection referred to as the      
,chief ,counsel72 and  7#c7 by adding at
 the end the following3  7#b7 7,a7 ,if  
the ,chief ,counsel disagrees with a    
certification and statement providing   
the factual basis for the certification 
published in the ,federal ,register     
under paragraph 7#a7 with respect to a  
proposed rule1 the ,chief ,counsel may1 
not later than #ad days after the date  
on which the statement and factual basis
 were published in the ,federal         
,register1 submit to the head of the    
,federal agency proposing the rule a    
letter 7in this subsection referred to  
as an advisement letter7 advising the   
head of the ,federal agency to-- 7i7    
review the certification and the        
detailed statement submitted by the     
,chief ,counsel under subparagraph 7,b72
 and  7ii7 reconsider the certification4
  7,b7 ,an advisement letter submitted  
by the ,chief ,counsel under            

subparagraph 7,a7 shall-- 7i7 include a 
detailed statement of why the ,chief    
,counsel disagreed with the             
certification or the statement providing
 the factual basis received under       
paragraph 7#a72 and  7ii7 be published  
on the website of the ,office of        
,advocacy of the ,small ,business       
,administration4  7,c7 ,not later than  
#g days after the date on which the head
 of a ,federal agency receives an       
advisement letter under subparagraph    
7,a7 with respect to a proposed rule1   
the head of the ,federal agency shall-- 
7i7 publish in the ,federal ,register   
and on the website of the ,federal      
agency an acknowledgment of receipt of  
the advisement letter2  7ii7 allow the  
public comment period for the rule to   
remain open for a period of not less    
than #cj days2 and  7iii7 if1 during the
 #cj-;day period described in clause    
7ii71 the head of the ,federal agency   
determines that the certification and   
statement providing the factual basis   

should be modified1 shorten or eliminate
 the #cj-;day period4  7,d7 7i7 ,not    
later than #cj days after the date on   
which the ,chief ,counsel submits to the
 head of a ,federal agency an advisement
 letter under subparagraph 7,a71 the    
,federal agency shall submit to the     
,chief ,counsel and publish in the      
,federal ,register and on the website of
 the ,federal agency the results of the 
review and reconsideration4  7ii7 ,if1  
after conducting the review and         
reconsideration under subparagraph 7,a71
 the head of the ,federal agency        
determines-- 7,i7 that there was not a  
sufficient factual basis to support the 
certification1 the ,federal agency shall
 perform and publish in the ,federal    
,register an initial regulatory         
flexibility analysis under section #fjc1
 with an opportunity for public comment1
 before promulgating the final rule2    
7,,ii7 that the certification was       
appropriate but the factual basis was   
inadequate to support the certification1

 the ,federal agency shall revise the   
factual basis to support the            
certification2 or  7,,iii7 that the     
certification was appropriate and the   
factual basis was adequate to support   
the certification1 the ,federal agency  
may continue with the rule making4  4   
#c4 ,judicial review ,section #faa7;a7  
of title #e1 ,united ,states ,code1 is  
amended-- 7#a7 in paragraph 7#a71 by    
striking #fje7;b7 and inserting
