,,ny1 while announcing his candidacy for ,president of the ,united ,states1 ,mr4 ,donald ,trump stated ,i would build a great wall1 and nobody builds walls better than me1 believe me1 and ,i'll build them very inexpensively4 ,i will build a great1 great wall on our southern border4 ,and ,i will have ,mexico pay for that wall4 ,mark my words44 7#c7 ,on ,july #ca1 #bjae in ,turnberry1 ,scotland1 layered defense44 #c4 ,prohibition on use of certain ,federal funds 7a7 ,in general 7#a7 ,federal prohibition ,notwithstanding any other provision of law1 no ,federal department or agency1 including the ,department of ,homeland ,security and the ,department of ,defense1 may obligate or expend any ,federal funds 7including any funds previously appropriated for such purpose or any fee revenue generated by the ,department of ,homeland ,security or any other ,federal department or agency7 to carry out section #ajb of the ,illegal ,immigration ,reform and ,immigrant ,responsibility ,act of #aiif 7#h ,u4,s4,c4 #aajc note7 or any other related provision of law1 or to otherwise build a border fence1 related physical barriers or infrastructure1 or wall along the southern border of the ,united ,states1 including to carry out any activities related to such construction4 7#b7 ,state prohibition ,notwithstanding any other provision of law1 a ,state that has received or receives any ,federal funding in the form of a grant from the ,department of ,homeland ,security or any other ,federal department or agency may not use such funding to carry out section #ajb of the ,illegal ,immigration ,reform and ,immigrant ,responsibility ,act of #aiif 7#h ,u4,s4,c4 #aajc note7 or any other related provision of law1 or to otherwise build a border fence1 related physical barriers or infrastructure1 or wall along the southern border of the ,united ,states1 including to carry out any activities related to such construction4 7#c7 ,foreign payment required ,the ,president is authorized to enter into a binding1 written1 and enforceable treaty1 approved by the ,senate1 with a foreign country to pay for the costs associated with carrying out section #ajb of the ,illegal ,immigration ,reform and ,immigrant ,responsibility ,act of #aiif 7#h ,u4,s4,c4 #aajc note7 or any other related provision of law1 or to otherwise build a border fence1 related physical barriers or infrastructure1 or wall along the southern border of the ,united ,states1 including to carry out any activities related to such construction4 7b7 ,audit and penalty 7#a7 ,audit ,not later than #ahj days after the end of each fiscal year1 the ,comptroller ,general of the ,united ,states shall conduct an audit of each ,federal department and agency under subsection 7a77#a7 and each ,state that has received or is receiving any ,federal funding under subsection 7a77#b7 to assess compliance with the prohibition under such subsections for each such preceding fiscal year4 7#b7 ,penalty ,if the ,comptroller ,general of the ,united ,states is unable to confirm the compliance with the prohibitions under subsection 7a7 by a ,federal department or agency or by a ,state1 as the case may be1 pursuant to an audit conducted under paragraph 7#a71 notwithstanding any other provision of law-- 7,a7 in the case of ,federal department or agency1 the ,office of ,management and ,budget may not obligate or expend more than #be percent of funds authorized to be appropriated for such ,office for the fiscal year during which such audit is conducted1 until such time as the ,comptroller ,general is able to confirm such compliance2 and 7,b7 in the case of a ,state1 the heads of appropriate ,federal departments and agencies shall take such steps as may be necessary to reduce the amount of ,federal funds that are made available to such ,state and to require such ,state to repay such amounts previously made available1 as appropriate1 until such time as the ,comptroller ,general is able to confirm such compliance4 7c7 ,sense of ,congress ,it is the sense of ,congress that the funding prohibition under this section should not interfere with the responsibility of the ,secretary of ,homeland ,security to take actions as may be required to secure the southern border of the ,united ,states4 #d4 ,oversight ,the ,inspector ,general of the ,federal department or agency responsible for carrying out the treaty referred to in section #c7;a77#c7 shall oversee the use of funds received and expended pursuant to such treaty to carry out section #ajb of the ,illegal ,immigration ,reform and ,immigrant ,responsibility ,act of #aiif 7#h ,u4,s4,c4 #aajc note7 or any other related provision of law or to otherwise build a border fence1 related physical barriers or infrastructure1 or wall along the southern border of the ,united ,states1 including to carry out any activities related to such construction4 ,such oversight shall include oversight regarding the use of high risk contractor practices1 including limited or sole source contracting1 any cost overruns1 significant delays in contract execution1 and departmental contract management and oversight of such funds4 #e4 ,budgetary impact 7a7 ,in general ,the ,director of the ,office of ,management and ,budget shall include a statement of budgetary impact1 including costs1 benefits1 and revenues1 as a result of and related to any executive order or presidential memorandum issued relating to border security during the period of fiscal year #bjai through fiscal year #bjbc4 7b7 ,contents ,any statement under subsection 7a7 shall include-- 7#a7 a narrative summary of the budgetary impact of such order or memorandum on the ,federal ,government2 7#b7 the impact on mandatory and discretionary obligations and outlays as the result of such order or memorandum1 listed by ,federal department and agency1 for each year in the #e-;fiscal-year period beginning in fiscal year #bjai2 and 7#c7 the impact on revenues of the ,federal ,government as the result of such order or memorandum over the #e-;fiscal-year period beginning in fiscal year #bjai4 #f4 ,website ,the ,director of the ,office of ,management and ,budget shall establish a publicly available website to track and display funds received from non-,federal sources1 including foreign governments1 to carry out section #ajb of the ,illegal ,immigration ,reform and ,immigrant ,responsibility ,act of #aiif 7#h ,u4,s4,c4 #aajc note7 or any other related provision of law or to otherwise build a border fence1 related physical barriers or infrastructure1 or wall along the southern border1 including to carry out any activities related to such construction4 ,such website shall be updated at least monthly to accurately reflect data on funds received by source and by date and on the obligation and expenditure of such funds4
