,,bill  ,to provide an incentive for    
firearm owners to sell their firearms   
safely and responsibly4  #a4 ,short     
title ,this ,act may be cited as the    
,keeping ,guns ,from ,criminals ,act4   
#b4 ,prohibition on sale or other       
disposition of a firearm to a prohibited
 person made into a strict liability    
crime with affirmative defenses  7a7 ,in
 general ,section #ibb7;d7 of title #ah1
 ,united ,states ,code1 is amended--    
7#a7 in the first sentence-- 7,a7 in the
 matter preceding paragraph 7#a71 by    
striking any person knowing or having   
reasonable cause to believe that such   
person and inserting another person who2
  7,b7 in each of paragraphs 7#e7 and   
7#g71 by striking who12 and  7,c7 in    
paragraph 7#f71 by striking who2 and    

7#b7 by adding at the end the following3
 ,it shall be an affirmative defense to 
a prosecution under this subsection that
 the defendant can prove by a           
preponderance of the evidence that1 at  
the time of the sale or other           
disposition of the firearm1 the         
,national ,instant ,criminal ,background
 ,check ,system established under       
section #ajc of the ,brady ,handgun     
,violence ,prevention ,act had indicated
 to any person that a sale or other     
disposition of a firearm to the         
recipient would not be unlawful1 or the 
recipient possessed a valid permit1     
issued to the recipient by the ,state in
 which the sale or other disposition    
occurred1 which authorizes the carrying 
of a concealed weapon1 unless the       
defendant knew or had reasonable cause  
to believe that this subsection         
prohibited the sale or disposition of a 
firearm or ammunition to the recipient  
or that subsection 7g7 prohibited the   
recipient from receiving a firearm or   

ammunition which has been shipped or    
transported in interstate or foreign    
commerce44  7b7 ,conforming amendments  
,section #ibd7;a77#b7 of such title is  
amended-- 7#a7 by striking 7d712 and    
7#b7 by inserting 1 or violates         
subsection 7d71 before of section #ibb4 
#c4 ,effective date ,the amendments made
 by this ,act shall apply to conduct    
engaged in after the #ij-;day period    
that begins with the date of the        
enactment of this ,act4
