surveys and detailed studies1 and plans and specifications of proposed river and harbor1 flood and storm damage reduction1 shore protection1 and aquatic ecosystem restoration projects1 and related efforts prior to construction2 for restudy of authorized projects2 and for miscellaneous investigations1 and1 when authorized by law1 surveys and detailed studies1 and plans and specifications of projects prior to construction1 #aea1jjj1jjj1 to remain available until expended3 ,provided1 ,that the ,secretary shall initiate seven new study starts during fiscal year #bjba3 ,provided further1 which such sums as are necessary to cover the ,federal share of construction costs for facilities under the ,dredged ,material ,disposal ,facilities program shall be derived from the ,harbor ,maintenance ,trust ,fund as authorized by ,public ,law #ajd-cjc2 and of which such sums as are necessary to cover one-half of the costs of construction1 replacement1 rehabilitation1 and expansion of inland waterways projects shall be derived from the ,inland ,waterways ,trust ,fund1 except as otherwise specifically provided for in law4 ,mississippi river and tributaries ,for expenses necessary for flood damage reduction projects and related efforts in the ,mississippi ,river alluvial valley below ,cape ,girardeau1 ,missouri1 as authorized by law1 #cfe1jjj1jjj1 to remain available until expended1 of which such sums as are necessary to cover the ,federal share of eligible operation and maintenance costs for inland harbors shall be derived from the ,harbor ,maintenance ,trust ,fund4 ,operation and maintenance ,for expenses necessary for the operation1 maintenance1 and care of existing river and harbor1 flood and storm damage reduction1 aquatic ecosystem restoration1 and related projects authorized by law2 providing security for infrastructure owned or operated by the ,corps1 including administrative buildings and laboratories2 maintaining harbor channels provided by a ,state1 municipality1 or other public agency that serve essential navigation needs of general commerce1 where authorized by law2 surveying and charting northern and northwestern lakes and connecting waters2 clearing and straightening channels2 and removing obstructions to navigation1 #c1hch1jjj1jjj1 to remain available until expended1 of which such sums as are necessary to cover the ,federal share of eligible operation and maintenance costs for coastal harbors and channels1 and for inland harbors shall be derived from the ,harbor ,maintenance ,trust ,fund2 of which such sums as become available from the special account for the ,corps of ,engineers established by the ,land and ,water ,conservation ,fund ,act of #aife shall be derived from that account for resource protection1 research1 interpretation1 and maintenance activities related to resource protection in the areas at which outdoor recreation is available2 and of which such sums as become available from fees collected under section #bag of ,public ,law #ajd-cjc shall be used to cover the cost of operation and maintenance of the dredged material disposal facilities for which such fees have been collected3 ,provided1 ,that #a percent of the total amount of funds provided for each of the programs1 projects1 or activities funded under this heading shall not be allocated to a field operating activity prior to the beginning of the fourth quarter of the fiscal year and shall be available for use by the ,chief of ,engineers to fund such emergency activities as the ,chief of ,engineers determines to be necessary and appropriate1 and that the ,chief of ,engineers shall allocate during the fourth quarter any remaining funds which have not been used for emergency activities proportionally in accordance with the amounts provided for the programs1 projects1 or activities4 ,regulatory program ,for expenses necessary for administration of laws pertaining to regulation of navigable waters and wetlands1 ,development ,act of #aiib4 7c7 ,the ,corps of ,engineers shall submit reports on a quarterly basis directly to the ,committees on ,appropriations of both ,houses of ,congress detailing all the funds reprogrammed between programs1 projects1 activities1 or categories of funding4 ,the first quarterly report shall be submitted not later than #fj days after the date of enactment of this ,act4 #ajb4 ,none of the funds made available in this title may be used to award or modify any contract that commits funds beyond the amounts appropriated for that program1 project1 or activity that remain unobligated1 except that such amounts may include any funds that have been made available through reprogramming pursuant to section #aja4 #ajc4 ,the ,secretary of the ,army may transfer to the ,fish and ,wildlife ,service1 and the ,fish and ,wildlife ,service may accept and expend1 up to #e1djj1jjj of funds provided in this title under the heading ,operation and ,maintenance to mitigate for fisheries lost due to ,corps of ,engineers projects4 #ajd4 ,none of the funds in this ,act shall be used for an open lake placement alternative for dredged material1 after evaluating the least costly1 environmentally acceptable manner for the disposal or management of dredged material originating from ,lake ,erie or tributaries thereto1 unless it is approved under a ,state water quality certification pursuant to section #dja of the ,federal ,water ,pollution ,control ,act 7#cc ,u4,s4,c4 #acda73 ,provided1 ,that until an open lake placement alternative for dredged material is approved under a ,state water quality certification1 the ,corps of ,engineers shall continue upland placement of such dredged material consistent with the requirements of section #aja of the ,water ,resources ,development ,act of #aihf 7#cc ,u4,s4,c4 #bbaa74 #aje4 ,none of the funds made available by this ,act may be used to carry out any water supply reallocation study under the ,wolf ,creek ,dam1 ,lake ,cumberland1 ,kentucky1 project authorized under the ,act of ,july #bd1 #aidf 7#fj ,stat4 #fcf1 ch4 #eie74 #ajf4 ,none of the funds made available by this ,act or any other ,act may be used to reorganize or to transfer the ,civil ,works functions or authority of the ,corps of ,engineers or the ,secretary of the ,army to another department or agency4 #ajg4 ,additional funding provided in this ,act shall be allocated only to projects determined to be eligible by the ,chief of ,engineers4 #ajh4 ,notwithstanding any other provision of law1 none of the funds appropriated or otherwise made available by this ,act or any prior appropriations ,acts for the ,civil ,works ,program of the ,united ,states ,army ,corps of ,engineers may be committed1 obligated1 expended1 or otherwise used to design or construct a wall1 fence1 border barriers1 or border security infrastructure along the southern border of the ,united ,states4 #aji4 ,none of the funds made available by this ,act may be used to issue a permit under section #djd of the ,federal ,water ,pollution ,control ,act to a private entity or individual for the discharge of dredged or fill material from a project located within ,water ,conservation ,areas #a1 #b;,a1 #b;,b1 #c;,a1 or #c;,b in the ,state of ,florida1 unless discharge is from a project that is generally available for the general public's or ,tribe's use and benefit and serve a public purpose1 which may include ,tribal communities4 #aaj4 7a7 ,when allocating the additional funding provided in this title under the headings ,construction and ,mississippi ,river and ,tributaries1 the ,secretary shall initiate a total of seven new construction starts during fiscal year #bjba4 7b7 ,for new construction projects1 project cost sharing agreements shall be executed as soon as practicable but no later than ,september #cj1 #bjba4 7c7 ,no allocation for a new start shall be considered final and no work allowance shall be made until the ,secretary provides to the ,committees on ,appropriations of both ,houses of ,congress an out-year funding scenario demonstrating the affordability of the selected new starts and the impacts on other projects4 7d7 ,the ,secretary shall not deviate from the new starts proposed in the work plan1 once the plan has been submitted to the ,committees on ,appropriations of both ,houses of ,congress4 ,,ii ,department of the interior ,central utah project ,central utah project completion account ,for carrying out activities authorized by the ,central ,utah ,project ,completion ,act1 #bj1jjj1jjj1 to remain available until expended1 of which #a1hjj1jjj shall be deposited into the ,utah ,reclamation ,mitigation and ,conservation ,account for use by the ,utah ,reclamation ,mitigation and ,conservation ,commission3 ,provided1 ,that of the amount provided under this heading1 #a1ejj1jjj shall be available until ,september #cj1 #bjbb1 for expenses necessary in carrying out related responsibilities of the ,secretary of the ,interior3 ,provided further1 ,that for fiscal year #bjba1 of the amount made available to the ,commission under this ,act or any other ,act1 the ,commission may use an amount not to exceed #a1ejj1jjj for administrative expenses4 ,bureau of reclamation ,the following appropriations shall be expended to execute authorized functions of the ,bureau of ,reclamation3 ,water and related resources 7including transfers of funds7 ,for management1 development1 and restoration of water and related natural resources and for related activities1 including the operation1 maintenance1 and rehabilitation of reclamation and other facilities1 participation in fulfilling related ,federal responsibilities to ,native ,americans1 and related grants to1 and cooperative and other agreements with1 ,state and local governments1 federally recognized ,indian tribes1 and others1 #a1dhg1jjj1jjj1 to remain available until expended1 of which #eh1dgf1jjj shall be available for transfer to the ,upper ,colorado ,river ,basin ,fund and #e1ehd1jjj shall be available for transfer to the ,lower ,colorado ,river ,basin ,development ,fund2 of which such amounts as may be necessary may be advanced to the ,colorado ,river ,dam ,fund3 ,provided1 ,that #be1hhb1jjj shall be available for transfer into the ,blackfeet ,water ,settlement ,implementation ,fund established by section #cgag of ,public ,law #aad-cbb3 ,provided further1 ,that such transfers may be increased or decreased within the overall appropriation under this heading3 ,provided further1 ,that of the total appropriated1 the amount for program activities that can be financed by the ,reclamation ,fund or the ,bureau of ,reclamation special fee account established by #af ,u4,s4,c4 #fhjf shall be derived from that ,fund or account3 ,provided further1 ,that funds contributed under #dc ,u4,s4,c4 #cie are available until expended for the purposes for which the funds were contributed3 ,provided further1 ,that funds advanced under the ,sacramento ,regional ,water ,bank1 the ,boise ,river ,feasibility ,study1 and the ,cle ,elum ,pool ,raise3 ,provided further1 ,that no funds may be obligated or expended for the projects specified in the preceding proviso until the ,secretary of the ,interior transmits recommendations to ,congress for projects authorized under sections #djji7;a7 and #djji7;c7 of the ,water ,infrastructure ,improvements for the ,nation ,act 7,public ,law #aad-cbb7 and the ,congress enacts a subsequent appropriations act making appropriations for energy and water development4 central valley project restoration fund ,for carrying out the programs1 projects1 plans1 habitat restoration1 improvement1 and acquisition provisions of the ,central ,valley ,project ,improvement ,act1 #ee1hge1jjj1 to be derived from such sums as may be collected in the ,central ,valley ,project ,restoration ,fund pursuant to sections #cdjg7;d71 #cdjd7;c77#c71 and #cdje7;f7 of ,public ,law #ajb-ege1 expenditure through a reprogramming of funds that-- 7#a7 creates or initiates a new program1 project1 or activity2 7#b7 eliminates a program1 project1 or activity2 7#c7 increases funds for any program1 project1 or activity for which funds have been denied or restricted by this ,act2 7#d7 restarts or resumes any program1 project1 or activity for which funds are not provided in this ,act1 unless prior approval is received from the ,committees on ,appropriations of both ,houses of ,congress2 7#e7 transfers funds in excess of the following limits-- 7,a7 #ae percent for any program1 project1 or activity for which #b1jjj1jjj or more is available at the beginning of the fiscal year2 or 7,b7 #djj1jjj for any program1 project1 or activity for which less than #b1jjj1jjj is available program1 project1 or activity4 7d7 ,the ,bureau of ,reclamation shall submit reports on a quarterly basis directly to the ,committees on ,appropriations of both ,houses of ,congress detailing all the funds reprogrammed between programs1 projects1 activities1 or categories of funding4 ,the first quarterly report shall be submitted not later than #fj days after the date of enactment of this ,act4 #bjb4 7a7 ,none of the funds appropriated or otherwise made available by this ,act may be used to determine the final point of discharge for the interceptor drain for the ,san ,luis ,unit until development by the ,secretary of the ,interior and the ,state of ,california of a plan1 which shall conform to the water quality standards of the ,state of ,california as approved by the ,administrator of the ,environmental ,protection ,agency1 to minimize any detrimental effect of the ,san ,luis drainage waters4 7b7 ,the costs of the ,kesterson ,reservoir ,cleanup ,program and the costs of the ,san ,joaquin ,valley ,drainage ,program shall be classified by the ,secretary of the ,interior as reimbursable or nonreimbursable and collected until fully repaid pursuant to the ,cleanup ,program--,alternative ,repayment ,plan and the ,,sjvdp--,alternative ,repayment ,plan described in the report entitled ,repayment ,report1 ,kesterson ,reservoir ,cleanup ,program and ,san ,joaquin ,valley ,drainage ,program1 ,february #aiie1 prepared by the ,department of the ,interior1 ,bureau of ,reclamation4 ,any future obligations of funds by the ,united ,states relating to1 or providing for1 drainage service or drainage studies for the ,san ,luis ,unit shall be fully reimbursable by ,san ,luis ,unit beneficiaries of such service or studies pursuant to ,federal reclamation services from the ,falcon and ,amistad ,dams shall be credited to this account as discretionary offsetting collections1 to remain available until expended for the sole purpose of funding the annual expenses of the hydroelectric facilities of these ,dams and associated ,western ,area ,power ,administration activities3 ,provided further1 ,that the sum herein appropriated for annual expenses shall be reduced as collections are received during the fiscal year so as to result in a final fiscal year #bjba appropriation estimated at not more than #bbh1jjj3 ,provided further1 ,that for purposes of this appropriation1 annual expenses means expenditures that are generally recovered in the same year that they are incurred3 ,provided further1 ,that for fiscal year #bjba1 the ,administrator of the ,western ,area ,power ,administration may accept up to #a1ebf1jjj in funds contributed by ,united ,states power customers of the ,falcon and ,amistad ,dams for deposit into the ,falcon and ,amistad ,operating and ,maintenance ,fund1 and such funds shall be available for the purpose for which contributed in like manner as if said sums had been specifically appropriated for such purpose3 ,provided further1 ,that any such funds shall be available without further appropriation and without fiscal year limitation for use by the ,commissioner of the ,united ,states ,section of the ,international ,boundary and ,water ,commission for the sole purpose of operating1 maintaining1 repairing1 rehabilitating1 replacing1 or upgrading the hydroelectric facilities at these ,dams in accordance with agreements reached between the ,administrator1 ,commissioner1 and the power customers4 ,federal energy regulatory commission ,salaries and expenses ,for expenses necessary for the ,federal ,energy ,regulatory ,commission to carry out the provisions of the ,department of ,energy ,organization ,act 7#db ,u4,s4,c4 #gaja et seq471 including services as authorized by #e ,u4,s4,c4 #caji1 official reception and representation expenses not to exceed #c1jjj1 and the hire of passenger motor vehicles1 #djd1cej1jjj1 to remain available until expended3 ,provided1 ,that notwithstanding any other provision of law1 not to exceed #djd1cej1jjj of revenues from fees and annual charges1 and other services and collections in fiscal year #bjba shall be retained and used for expenses necessary in this account1 and shall remain available until expended3 ,provided further1 ,that the sum herein appropriated from the general fund shall be reduced as revenues are received during fiscal year #bjba so as to result in a final fiscal year #bjba appropriation from the general fund estimated at not more than #j4 ,general provisions--department of energy 7including transfers of funds7 #cja4 7a7 ,no appropriation1 funds1 or authority made available by this title for the ,department of ,energy shall be used to initiate or resume any program1 project1 or activity or to prepare or initiate ,requests project1 or activity has not been funded by ,congress4 7b7 7#a7 ,unless the ,secretary of ,energy notifies the ,committees on ,appropriations of both ,houses of ,congress at least #c full business days in advance1 none of the funds made available in this title may be used to-- 7,a7 make a grant allocation or discretionary grant award totaling #a1jjj1jjj or more2 7,b7 make a discretionary contract award or ,other ,transaction ,agreement totaling #a1jjj1jjj or more1 including a contract covered by the ,federal ,acquisition ,regulation2 7,c7 issue a letter of intent to make an allocation1 award1 or ,agreement in excess of the limits in subparagraph 7,a7 or 7,b72 or 7,d7 announce publicly the intention to make an allocation1 award1 or ,agreement in excess of the limits in subparagraph 7,a7 or 7,b74 7#b7 ,the ,secretary of ,energy shall submit directly to the ,committees on ,appropriations of both ,houses of ,congress within #ae days of the conclusion of each quarter a report detailing each grant allocation or discretionary grant award totaling less than #a1jjj1jjj provided during the previous quarter4 7#c7 ,the notification required by paragraph 7#a7 and the report required by paragraph 7#b7 shall include the recipient of the award1 the amount of the award1 the fiscal year for which the funds for the award were appropriated1 the account and program1 project1 or activity from which the funds are being drawn1 the title of the award1 and a brief description of the activity for which the award is made4 7c7 ,the ,department of ,energy may not1 with respect to any program1 project1 or activity that uses budget authority made available in this title under the heading ,department of ,energy--,energy ,programs1 enter into a multiyear contract1 award a multiyear grant1 or enter into a multiyear cooperative agreement unless-- 7#a7 the contract1 grant1 or cooperative agreement is funded for the full period of performance as anticipated at the time of award2 or 7#b7 the contract1 grant1 or cooperative agreement includes a clause conditioning the ,federal ,government's obligation on the availability of future year budget authority and the ,secretary notifies the ,committees on ,appropriations of both ,houses of ,congress at least #c days in advance4 7d7 ,except as provided in subsections 7e71 7f71 and 7g71 the amounts made available by this title shall be expended as authorized by law for the programs1 projects1 and activities specified in the ,bill column in the ,department of ,energy table included under the heading ,title ,,iii--,department of ,energy in the report of the ,committee on ,appropriations accompanying this ,act4 7e7 ,the amounts made available by this title may be reprogrammed for any program1 project1 or activity1 and the ,department shall notify the ,committees on ,appropriations of both ,houses of ,congress at least #cj days prior to the use of any proposed reprogramming that would cause any program1 project1 or activity funding level to increase or decrease by more than #e1jjj1jjj or #aj percent1 whichever is less1 during the time period covered by this ,act4 7f7 ,none of the funds provided in this title shall be available for obligation or expenditure through a reprogramming of funds that-- 7#a7 creates1 initiates1 or eliminates a program1 project1 or activity2 7#b7 increases funds or personnel for any program1 project1 or activity for which funds are denied or restricted by this ,act2 or 7#c7 reduces funds that are directed to be used for a specific program1 project1 or activity by this ,act4 7g7 7#a7 ,the ,secretary of ,energy may waive any requirement or restriction in this section that applies to the use of funds made available for the ,department of ,energy if compliance with such requirement or restriction would pose a substantial risk to human health1 the environment1 welfare1 or national security4 7#b7 ,the ,secretary of ,energy shall notify the ,committees on ,appropriations of both ,houses of ,congress of any waiver under paragraph 7#a7 as soon as practicable1 but not later than #c days after the date of the activity to which a requirement or restriction would otherwise have applied4 ,such notice shall include an explanation of the substantial risk under paragraph 7#a7 that permitted such waiver4 7h7 ,the unexpended balances of prior appropriations provided for activities in this ,act may be available to the same appropriation accounts for such activities established pursuant to this title4 ,available balances may be merged with funds in the applicable established accounts and thereafter may be accounted for as one fund for the same time period as originally enacted4 #cjb4 ,funds appropriated by this or any other ,act1 or made available by the transfer of funds in this ,act1 for intelligence activities are deemed to be specifically authorized by the ,congress for purposes of section #ejd of the ,national ,security ,act of #aidg 7#ej ,u4,s4,c4 #cjid7 during fiscal year #bjba until the enactment of the ,intelligence ,authorization ,act for fiscal year #bjba4 #cjc4 ,none of the funds made available in this title shall be used for the construction of facilities classified as high-hazard nuclear facilities under #aj ,,cfr ,part #hcj unless independent oversight is conducted by the ,office of ,enterprise ,assessments to ensure the project is in compliance with nuclear safety requirements4 #cjd4 ,none of the funds made available in this title may be used to approve critical decision-#b or critical decision-#c under ,department of ,energy ,order #dac4c;,b1 or any successive departmental guidance1 for construction projects where the total project cost exceeds #ajj1jjj1jjj1 until a separate independent cost estimate has been developed for the project for that critical decision4 #cje4 ,notwithstanding section #afa of the ,energy ,policy and ,conservation ,act 7#db ,u4,s4,c4 #fbda71 upon a determination by the ,president in this fiscal year that a regional supply shortage of refined petroleum product of significant scope and duration exists1 that a severe increase in the price of refined petroleum product will likely result from such shortage1 and that a draw down and sale of refined petroleum product would assist directly and significantly in reducing the adverse impact of such shortage1 the ,secretary of ,energy may draw down and sell refined petroleum product from the ,strategic ,petroleum ,reserve4 ,proceeds from a sale under this section shall be deposited into the ,,spr ,petroleum ,account established in section #afg of the ,energy ,policy and ,conservation ,act 7#db ,u4,s4,c4 #fbdg71 and such amounts shall be available for obligation1 without fiscal year limitation1 consistent with that section4 #cjf4 7a7 ,of the offsetting collections1 including unobligated balances of such collections1 in the ,department of ,energy--,power ,marketing ,administration--,colorado ,river ,basins ,power ,marketing ,fund1 ,western ,area ,power ,administration1 #ba1djj1jjj shall be transferred to the ,department of the ,interior--,bureau of ,reclamation--,upper ,colorado ,river ,basin ,fund for the ,bureau of ,reclamation to carry out environmental stewardship and endangered species recovery efforts4 7b7 ,no funds shall be transferred directly from ,department of ,energy--,power ,marketing ,administration--,colorado ,river ,basins ,power ,marketing ,fund1 ,western ,area ,power ,administration to the general fund of the ,treasury in the current fiscal year4 #cjg4 7a7 ,none of the funds made available in this ,act or any other ,act for any fiscal year may be used to take an action described in subsection 7b7 unless-- 7#a7 the ,secretary of ,energy submits a written notification to the ,committees on ,appropriations of both ,houses of ,congress regarding such action1 including-- 7,a7 a detailed justification and information about the assumptions underlying such action2 and 7,b7 with respect to an action described in paragraph 7#a7 or 7#c7 of such subsection-- 7i7 a preliminary cost range for the nuclear weapon program affected by such action2 7ii7 the estimated costs for such program during the five-year period following the notification2 and 7iii7 the source and amount of funds for such action by program1 project1 or activity level4 7#b7 a period of #ae business days elapses following the date of such notification4 7b7 ,an action described in this subsection is any of the following3 7#a7 ,approving the development of a new nuclear weapon or the modification of a nuclear weapon1 including as described in section #agi7;d77#h7 of title #aj1 ,united ,states ,code4 7#b7 ,studying whether to develop a new or modified nuclear weapon4 7#c7 ,changing the scope of a nuclear weapon program if such change modifies the cost of such program by #cjj1jjj1jjj or more4 #cjh4 ,none of the funds made available by this ,act or any other ,act making appropriations for energy and water development and related agencies for any fiscal year may be used to conduct1 or make specific preparations for1 any explosive nuclear weapons test that produces any yield4 #cji4 ,none of the funds made available by this ,act or any other ,act making appropriations for energy and water development and related agencies may be used in furtherance of working through the ,nuclear ,weapons ,council to guide1 advise1 assist1 develop1 or execute a budget for the ,national ,nuclear ,security ,administration4 ,,iv ,independent agencies ,appalachian regional commission ,for expenses necessary to carry out the programs authorized by the ,appalachian ,regional ,development ,act of #aife1 as amended1 notwithstanding #dj ,u4,s4,c4 #adgjd1 and for expenses necessary for the ,federal ,co-,chairman and the ,alternate on the ,appalachian ,regional ,commission1 for payment of the ,federal share of the administrative expenses of the ,commission1 including services as authorized by section #caji of title #e1 ,united ,states ,code1 and hire of passenger motor vehicles1 #age1jjj1jjj1 to remain available until expended4 ,defense nuclear facilities safety board ,salaries and expenses ,for expenses necessary for the ,defense ,nuclear ,facilities ,safety ,board in carrying out activities authorized by the ,atomic ,energy ,act of #aied1 as amended by ,public ,law #ajj-def1 section #adda1 #ca1jjj1jjj1 to remain available until ,september #cj1 #bjbb4 ,delta regional authority ,salaries and expenses ,for expenses necessary for the ,delta ,regional ,authority and to carry out its activities1 as authorized by the ,delta ,regional ,authority ,act of #bjjj1 notwithstanding sections #chb;,f7d71 #chb,m1 and #chb,n of said ,act1 #ae1jjj1jjj1 to remain available until expended4 ,denali commission ,for expenses necessary for the ,denali ,commission including the purchase1 construction1 and acquisition of plant and capital equipment as necessary and other expenses1 #ae1jjj1jjj1 to remain available until expended1 notwithstanding the limitations contained in section #cjf7;g7 of the ,denali ,commission ,act of #aiih3 ,provided1 ,that funds shall be available for construction projects in an amount not to exceed #hj percent of total project cost for distressed communities1 as defined by section #cjg of the ,denali ,commission ,act of #aiih 7division ,c1 title ,,iii1 ,public ,law #aje-bgg71 as amended by section #gja of appendix ,d1 title ,,vii1 ,public ,law #ajf-aac 7#aac ,stat4 #aeja;,a-#bhj71 and an amount not to exceed #ej percent for non-distressed communities3 ,provided further1 ,that notwithstanding any other provision of law regarding payment of a non-,federal share in connection with a grant-in-aid program1 amounts under this heading shall be available for the payment of such a non-,federal share for programs undertaken to carry out the purposes of the ,commission4 ,northern border regional commission ,for expenses necessary for the ,northern ,border ,regional ,commission in carrying out activities authorized by subtitle ,v of title #dj1 ,united ,states ,code1 #be1jjj1jjj1 to remain available until expended3 ,states ,code1 #bej1jjj1 to remain available until expended4 ,nuclear regulatory commission ,salaries and expenses ,for expenses necessary for the ,commission in carrying out the purposes of the ,energy ,reorganization ,act of #aigd and the ,atomic ,energy ,act of #aied1 #hdi1ijj1jjj1 including official representation expenses not to exceed #be1jjj1 to remain available until expended3 ,provided1 ,that of the amount appropriated herein1 not more than #i1ejj1jjj may be made available for salaries1 travel1 and other support costs for the ,office of the ,commission1 to remain available until ,september #cj1 #bjbb1 of which1 notwithstanding section #bja7;a77#b77;c7 of the ,energy ,reorganization ,act of #aigd 7#db ,u4,s4,c4 #ehda7;a77#b77;c771 the use and expenditure shall only be approved by a majority vote of the ,commission3 ,provided further1 ,that revenues from licensing fees1 inspection services1 and other services and collections estimated at #gbi1bic1jjj in fiscal year #bjba shall be retained and used for necessary salaries and expenses in this account1 notwithstanding #ca ,u4,s4,c4 #ccjb1 and shall remain available until expended3 ,provided further1 ,that of the amounts appropriated under this heading1 #aj1ejj1jjj shall be for university research and development in areas relevant to the ,commission's mission1 and #e1ejj1jjj shall be for a ,nuclear ,science and ,engineering ,grant ,program that will support multi-year projects that do not align with programmatic missions but are critical to maintaining the discipline of nuclear science and engineering3 version of ,chapter ,,vi of its ,internal ,commission ,procedures when responding to ,congressional requests for information1 consistent with ,department of ,justice guidance for all federal agencies4 #djb4 7a7 ,the amounts made available by this title for the ,nuclear ,regulatory ,commission may be reprogrammed for any program1 project1 or activity1 and the ,commission shall notify the ,committees on ,appropriations of both ,houses of ,congress at least #cj days prior to the use of any proposed reprogramming that would cause any program funding level to increase or decrease by more than #ejj1jjj or #aj percent1 whichever is less1 during the time period covered by this ,act4 7b7 7#a7 ,the ,nuclear ,regulatory ,commission may waive the notification requirement in subsection 7a7 if ,nuclear ,regulatory ,commission--,salaries and ,expenses shall be expended as directed in the report of the ,committee on ,appropriations accompanying this ,act4 7d7 ,none of the funds provided for the ,nuclear ,regulatory ,commission shall be available for obligation or expenditure through a reprogramming of funds that increases funds or personnel for any program1 project1 or activity for which funds are denied or restricted by this ,act4 7e7 ,the ,commission shall provide a monthly report to the ,committees on ,appropriations of both ,houses of ,congress1 which includes the following for each program1 project1 or activity1 including any prior year appropriations-- 7#a7 total budget authority2 7#b7 total unobligated balances2 and 7#c7 total unliquidated obligations4 ,v ,general provisions 7including transfer of funds7 #eja4 ,none of the funds appropriated by this ,act may be used in any way1 directly or indirectly1 to influence congressional action on any legislation or appropriation matters pending before ,congress1 other than to communicate to ,members of ,congress as described in #ah ,u4,s4,c4 #aiac4 #ejb4 7a7 ,none of the funds made available in title ,,iii of this ,act may be transferred to any department1 agency1 or instrumentality of the ,united ,states ,government1 except pursuant to a transfer made by or transfer authority provided in this ,act or any other appropriations ,act for any fiscal year1 transfer authority referenced in the report of the ,committee on ,appropriations accompanying this ,act1 or any authority whereby a department1 agency1 or instrumentality of the ,united ,states ,government may provide goods or services to another department1 agency1 or instrumentality4 7b7 ,none of the funds made available for any department1 agency1 or instrumentality of the ,united ,states ,government may be transferred to accounts funded in title ,,iii of this ,act1 except pursuant to a transfer made by or transfer authority provided in this ,act or any other appropriations ,act for any fiscal year1 transfer authority referenced in the report of the ,committee on ,appropriations accompanying this ,act1 or any authority whereby a department1 agency1 or instrumentality of the ,united ,states ,government may provide goods or services to another department1 agency1 or instrumentality4 7c7 ,the head of any relevant department or agency funded in this ,act utilizing any transfer authority shall submit to the ,committees on ,appropriations of both ,houses of ,congress a semiannual report detailing the transfer authorities1 except for any authority whereby a department1 agency1 or instrumentality of the ,united ,states ,government may provide goods or services to another department1 agency1 or instrumentality1 used in the previous #f months and in the year-to-date4 ,this report shall include the amounts transferred and the purposes for which they were transferred1 and shall not replace or modify existing notification requirements for each authority4 #ejc4 ,none of the funds made available by this ,act may be used in contravention of ,executive ,order ,no4 #abhih of ,february #aa1 #aiid 7,federal ,actions to ,address ,environmental ,justice in ,minority ,populations and ,low-,income ,populations74 #ejd4 7a7 ,none of the funds made available in this ,act may be used to maintain or establish a computer network unless such network blocks the viewing1 downloading1 and exchanging of pornography4 7b7 ,nothing in subsection 7a7 shall limit the use of funds necessary for any ,federal1 ,state1 tribal1 or local law enforcement agency or any other entity carrying out criminal investigations1 prosecution1 or adjudication activities4 ,,vi ,additional ,infrastructure ,investments ,department of the ,army ,corps of ,engineers--,civil ,investigations ,for an additional amount for ,investigations1 #aaj1jjj1jjj1 to remain available until expended1 for necessary expenses related to the completion1 or initiation and completion1 of studies which are currently authorized or which are authorized after the date of enactment of this ,act3 ,provided1 ,that the ,secretary may initiate additional new project starts with funds provided in this paragraph1 without regard to other limitations in this ,act3 ,provided further1 ,that such amount is designated by the ,congress as being for an emergency requirement pursuant to section #bea7;b77#b77;,a77i7 of the ,balanced ,budget and ,emergency ,deficit ,control ,act of #aihe4 ,construction ,for an additional amount for ,construction1 #aj1jjj1jjj1jjj1 to remain available until expended1 of which not less than #ejj1jjj1jjj shall be for water-related environmental infrastructure assistance and #c1jjj1jjj1jjj shall be for inland waterways projects3 ,provided1 ,that section #ajb of ,public ,law #aji-ajc 7#cc ,u4,s4,c4 #bbba7 shall not apply to funds provided in this paragraph3 ,provided further1 ,that notwithstanding any other provision of law1 section #ajb of the ,water ,resources ,development ,act of #aihf 7,public ,law #ii-ffb2 #cc ,u4,s4,c4 #bbab7 shall not apply to funds provided in this paragraph3 ,provided further1 ,that the ,secretary may initiate additional new construction starts with funds provided in this paragraph without regard to section #aaj of this ,act3 ,provided further1 ,that the limitation concerning total project costs in section #ijb of the ,water ,resources ,development ,act of #aihf 7,public ,law #ii-ffb2 #cc ,u4,s4,c4 #bbhj71 as amended1 shall not apply to any project receiving funds provided in this paragraph3 ,provided further1 ,that funds appropriated in this paragraph may be used by the ,secretary of the ,army1 acting through the ,chief of ,engineers1 to undertake work authorized to be carried out in accordance with section #ad of the ,flood ,control ,act of #aidf 7#cc ,u4,s4,c4 #gjar71 section #bje of the ,flood ,control ,act of #aidh 7#cc ,u4,s4,c4 #gjas71 section #bjf of the ,water ,resources ,development ,act of #aiif 7,public ,law #ajd-cjc2 #cc ,u4,s4,c4 #bccj71 or section #aace of the ,water ,resources ,development ,act of #aihf 7,public ,law #ii-ffb2 #cc ,u4,s4,c4 #bcji;a71 notwithstanding the program cost limitations set forth in those sections3 ,provided further1 ,that such amount is designated by the ,congress as being for an emergency requirement pursuant to section #bea7;b77#b77;,a77i7 of the ,balanced ,budget and ,emergency ,deficit ,control ,act of #aihe4 ,mississippi ,river and ,tributaries ,for an additional amount for ,mississippi ,river and ,tributaries1 #hge1jjj1jjj1 to remain available until expended1 of which #aej1jjj1jjj shall be used for necessary expenses to address emergency situations at ,corps of ,engineers ,federal projects caused by natural disasters3 ,provided1 ,that the ,secretary may initiate additional new study starts and additional new construction starts with funds provided under this paragraph without regard to other limitations in this ,act3 ,provided further1 ,that the limitation concerning total project costs in section #ijb of the ,water ,resources ,development ,act of #aihf 7,public ,law #ii-ffb2 #cc ,assistance ,program1 the ,,hud ,lead ,hazard ,control and ,healthy ,homes ,program1 and the ,department of ,veterans ,affairs4 #fjc4 ,the ,secretary of ,energy shall1 within funds made available in this title1 distribute funds to ,,wap grantees via the formula in part ,a of title ,,iv of the ,energy ,conservation and ,production ,act 7,public ,law #id-che2 #db ,u4,s4,c4 #fhfa et seq471 for the purpose of innovative activities that will increase the number of dwelling units that become weatherization-ready through critical repairs1 promote the deployment of renewable energy systems and emerging technologies1 include community-based weatherization concepts1 and improve indoor environments through healthy homes measures4 ,grantees may also use such funds for innovative outreach and education1 quality control of work performed1 data collection1 measurement1 verification1 program monitoring1 oversight1 evaluation1 reporting1 training1 and planning related to such work4 ,such funding is not subject to the savings-to-investment ratio requirements in #aj ,,cfr #ddj4ba4 #fjd4 7a7 ,section #dae7;c77#a7 of the ,energy ,conservation and ,production ,act 7,public ,law #id-che2 #db ,u4,s4,c4 #fhfe7;c77#a77 is amended by striking #f1ejj and inserting #aj1jjj4 7b7 ,section #dae7;a77#a7 of the ,energy ,conservation and ,production ,act 7,public ,law #id-che2 #db ,u4,s4,c4 ,u4,s4,c4 #fhfe7;c77#b77 is amended to read as follows3 7#b7 ,dwelling units weatherized 7including dwelling units partially weatherized7 under this part1 or under other ,federal programs 7in this paragraph referred to as #8previous weatherization'71 may not receive further financial assistance for weatherization under this part until the date that is #ae years after the date such previous weatherization was completed4 ,this paragraph does not preclude dwelling units that have received previous weatherization from receiving assistance and services 7including the provision of information and education to assist with energy management and evaluation of the effectiveness of installed weatherization materials7 other than weatherization under this part or under other ,federal programs1 or from receiving non-,federal assistance for weatherization44 #fje4 7a7 ,no later than #f months after the date of enactment of this ,act1 the ,secretary of ,energy1 in coordination with the ,secretary of ,commerce1 shall-- 7#a7 determine any geographic area within the contiguous ,united ,states that lacks a ,federal power marketing agency2 7#b7 develop a plan or criteria for the geographic areas identified in paragraph 7#a7 regarding investment in renewable energy and associated infrastructure within an area identified in paragraph 7#a72 and 7#c7 identify any ,federal agency within an area in paragraph 7#a7 that has1 or could develop1 the ability to facilitate the investment in paragraph 7#b74 7b7 ,the ,secretary of ,energy1 in coordination with the ,secretary of ,commerce1 shall provide the determinations made under subsection 7a7 to the ,committee on ,appropriations and the ,committee on ,energy and ,commerce of the ,house of ,representatives4 7c7 ,based upon the determinations made pursuant to subsection 7a71 the ,secretary of ,energy1 in coordination with the ,secretary of ,commerce1 shall recommend to the ,committee on ,energy and ,commerce of the ,house of ,representatives the establishment of any new ,federal lending authority1 including authorization of additional lending authority for existing ,federal agencies1 not to exceed #c1ejj1jjj1jjj per geographic area identified in subsection 7a77#a74 7d7 ,there is hereby appropriated #be1jjj1jjj to carry out this section4 7e7 ,the amounts provided by this section are designated by the ,congress as being for an ,requirements relating to non-,federal cost-share grants and cooperative agreements for the ,denali ,commission are waived for grants awarded in fiscal year #bjbj and in subsequent years in response
