,committee on ,transportation and ,infrastructure ,a ,,bill ,to amend title #di1 ,united ,states ,code1 to establish a pilot program for intermodal transportation infrastructure grants1 and for other purposes4 #a4 ,short title ,this ,act may be cited as the #bast ,century ,aerospace ,infrastructure ,act of #bjbj4 #b4 ,intermodal transportation infrastructure improvement pilot program 7a7 ,in general ,section #dgaae of title #di1 ,united ,states ,code1 is amended by adding at the end the following3 7l7 ,intermodal transportation infrastructure improvement pilot program 7#a7 ,in general ,the ,secretary shall establish a pilot program to issue transportation infrastructure grants to operators of launch sites for the construction1 repair1 or maintenance of infrastructure and facilities at such sites4 7#b7 ,pilot program application required ,in order to participate in the pilot program established under paragraph 7#a71 an operator shall submit an application to the ,secretary in such form1 at such time1 and containing such information as prescribed by the ,secretary4 7#c7 ,pilot program qualifications ,the ,secretary may only accept an operator into the pilot program established under paragraph 7#a7 and issue a grant under this subsection to such operator if the operator-- 7,a7 has submitted a complete and timely application under paragraph 7#b72 7,b7 certifies to the ,secretary that the grant will be used for an eligible purpose under paragraph 7#d72 and 7,c7 agrees to maintain such records relating to the grant as the ,secretary may require and to make such records available to the ,secretary or the ,comptroller ,general of the ,united ,states upon request4 7#d7 ,permitted use of pilot program grants ,an operator may use a grant provided under this subsection for the construction1 repair1 or improvement of infrastructure and facilities that-- 7,a7 are located at1 or adjacent to1 a launch site2 and 7,b7 directly enable or support transportation safety or covered transportation activities4 7#e7 ,authority to enter into agreements ,the ,secretary may enter into agreements to provide grants under this subsection4 7#f7 ,pilot program grants 7,a7 ,grant formula ,at the beginning of each fiscal year after fiscal year #bjbj1 the ,secretary shall issue a grant to any operator in the pilot program established under paragraph 7#a7 an amount equal to the sum of-- 7i7 #bej1jjj for each licensed launch operation conducted from the applicable launch site or at any adjacent ,federal launch range in the previous fiscal year2 and 7ii7 #ajj1jjj for each permitted launch operation conducted from the applicable launch site or at any adjacent ,federal launch range in the previous fiscal year4 7,b7 ,maximum grant ,except as provided in paragraph 7#g77;,d71 a grant issued to an operator under this subsection shall not exceed #b1ejj1jjj for a fiscal year4 7,c7 ,adjacency 7i7 ,in general ,in issuing a grant to an operator under subparagraph 7,a71 the ,secretary shall determine whether a launch site is adjacent to a ,federal launch site4 7ii7 ,limitation ,only #a operator may receive an amount under subparagraph 7,a7 for each licensed or permitted launch operation described in such subparagraph4 7iii7 ,multiple launch sites operated by #a operator ,if an operator holds a license to operate more than #a launch site that is adjacent to a ,federal launch range1 the ,secretary shall consider such launch sites as #a launch site for purposes of subparagraph 7,a74 7#g7 ,supplemental grants in support of ,state1 local1 or private matching ,the ,secretary may issue a supplemental grant from the funds authorized to carry out this subsection to an operator1 subject to the following conditions3 7,a7 ,dollar-for-dollar matching ,if a qualified entity provides an operator an amount equal to or greater than the amount of a grant provided in a fiscal year under paragraph 7#f7 7for the explicit purpose of matching such grant71 the ,secretary may issue a supplemental grant to the operator that is equal to #be percent of such grant in the following fiscal year4 7,b7 ,additional non-,federal matching ,if a qualified entity provides an operator an amount equal to or greater than two times the amount of a grant provided in a fiscal year to the operator under paragraph 7#f7 7for the explicit purpose of matching such grant71 the ,secretary may issue a supplemental grant to the operator that is equal to #ej percent of such grant in the following fiscal year4 7,c7 ,supplemental grant limitations ,the following limitations shall apply to supplemental grants issued to an operator pursuant to this paragraph3 7i7 ,match timing ,the ,secretary may issue a supplemental grant under subparagraph 7,a7 or 7,b7 only if an amount provided by a qualified entity is provided to the operator in the same fiscal year as the grant issued under paragraph 7#f74 7ii7 ,non-duplication of matching grants ,if the ,secretary issues a supplemental grant to the operator of a launch site under subparagraph 7,b71 the ,secretary may not issue a supplemental grant under subparagraph 7,a7 to the same operator in the same fiscal year4 7,d7 ,non-application of grant ceiling ,the limitation on a grant amount under paragraph 7#f77;,b7 shall not apply to supplemental grants issued under this paragraph4 7#h7 ,program administration 7,a7 ,award timing ,amounts designated to carry out this section that are not obligated for grants under paragraphs 7#f7 or 7#g7 by ,july #a of the fiscal year in which the amounts were made available shall be made available for projects in accordance with subsection 7j74 7,b7 ,grant assurance applicability ,except as provided in subparagraph 7,c71 a grant issued under this subsection shall not be subject to the conditions of sections #dgajf or #dgajg1 including any regulations prescribed thereunder1 or any other conditions associated with grants made under this subchapter pursuant to the ,secretary's authority under chapters #dga or #dge4 7,c7 ,combination with other ,federal funds ,if an operator combines amounts received under this subsection with ,federal funds from any other source 7including funds received under chapter #dga and #dge71 the applicable statutory or regulatory requirements associated with such funds shall apply to the total project being funded and to the funds provided under this subsection4 7#i7 ,funding 7,a7 ,pilot program grant funds ,the grants issued under this subsection shall be issued from funds made available under subsection 7j77#d74 7,b7 ,maximum annual limit on pilot program 7i7 ,in general ,the total amount of all grants issued under this subsection shall not exceed #bj1jjj1jjj in any fiscal year4 7ii7 ,grant reduction ,in carrying out clause 7i71 the ,secretary-- 7,i7 may proportionally reduce the amount of1 or decline to issue1 a supplemental grant under paragraph 7#g72 and 7,,ii7 if the reduction under subclause 7,i7 is insufficient1 shall proportionally reduce grants issued under paragraph 7#f74 7#aj7 ,definitions ,in this subsection1 the following definitions apply3 7,a7 ,covered transportation activity ,the term covered transportation activity means the movement of people or property to1 from1 or within a launch site to any other location and the necessary or incidental activities associated with such movement1 including through use of-- 7i7 a vehicle2 7ii7 a vessel2 7iii7 an aircraft 7as defined in section #djajb72 7iv7 a railroad 7as defined in section #bjajb72 7v7 a pipeline facility 7as defined in section #fjaja72 or 7vi7 a launch vehicle4 7,b7 ,launch2 launch site2 launch vehicle ,the terms launch1 launch site1 and launch vehicle have the meanings given those terms in section #ejijb of title #ea4 7,c7 ,operator ,the term operator means a person licensed by the ,secretary to operate a launch site4 7,d7 ,qualified entity ,the term qualified entity means a ,state1 local1 or tribal government or private sector entity1 or any combination thereof4 7#aa7 ,pilot program sunset ,this subsection shall cease to be effective on ,october #a1 #bjbc4 4 7b7 ,conforming amendment ,section #dgaae7;j77#d7 of title #di1 ,united ,states ,code1 is amended by inserting and subsection 7l7 after this subsection4
