the ,combating ,hunger for ,older       
,americans ,during ,coronavirus ,crisis 
,act of #bjbj4  #b4 ,home delivered     
nutrition services criteria applicable  
under the ,older ,americans ,act of     
#aife during fiscal year #bjbj to       
respond to the ,,covid-#ai public health
 emergency ,for purposes of ,state      
agencies determining the delivery of    
nutrition services under subpart #b of  
part ,c of title ,,iii of the ,older    

,americans ,act of #aife 7#db ,u4,s4,c4 
#cjcj;f et seq471 during the portion of 
,,covid-#ai public health emergency     
declared under section #cai of the      
,public ,health ,service ,act 7#db      
,u4,s4,c4 #bdg;d7 that occurs in the    
period beginning on the date of the     
enactment of this ,act and ending on    
,september #ca1 #bjbj1 the ,state agency
 shall include among individuals        
receiving such delivery because they are
 homebound an individual age #fj and    
older1 or an individual with a          
disability 7of any age71 who is unable  
to obtain nutrition because the         
individual is under a quarantine1       
practicing social distancing1 or        
otherwise unable to leave home1 due to  
the emergency4  #c4 ,congregate         
nutrition services criteria applicable  
under the ,older ,americans ,act of     
#aife during fiscal year #bjbj to       
respond to the ,,covid-#ai public health
 emergency ,if a ,state demonstrates1 to
 the satisfaction of the ,assistant     

,secretary 7as defined in section #ajb  
of the ,older ,americans ,act of #aife  
7#db ,u4,s4,c4 #cjjb71 that funds       
received by the ,state and attributable 
to funds appropriated under paragraph   
7#a7 or 7#b7 of section #cjc7;b7 of the 
,older ,americans ,act of #aife 7#db    
,u4,s4,c4 #cjbc7;b771 including funds   
transferred under subparagraph 7,a7 of  
paragraph 7#d7 of such section without  
regard to the exception referring to    
subparagraph 7,b7 specified in such     
subparagraph 7,a71 for fiscal year #bjbj
 are insufficient to satisfy the need   
for services under subpart ,i or subpart
 ,,ii of part ,c of title ,,iii of the  
,older ,americans ,act of #aife 7#db    
,u4,s4,c4 #cjcj;d-#b et seq47 in fiscal 
year #bjbj during the ,,covid-#ai public
 health emergency declared under section
 #cai of the ,public ,health ,service   
,act 7#db ,u4,s4,c4 #bdg;d71 the        
,assistant ,secretary shall allow ,state
 and area agencies on aging1 without    
prior approval1 to transfer up to #ajj  

percent of the funds so received between
 subpart #a and subpart #b of such part 
,c for use the ,state or area agency on 
aging considers appropriate to meet the 
needs of the area served4  #d4 ,waiver  
,to facilitate implementation of        
subparts #a and #b of part ,c of title  
,,iii of the ,older ,americans ,act of  
#aife 7#db ,u4,s4,c4 #cjcj;e et seq47   
during any portion of the ,,covid-#ai   
public health emergency declared under  
section #cai of the ,public ,health     
,service ,act 7#db ,u4,s4,c4 #bdg;d7    
that occurs in the period beginning on  
the date of the enactment of this ,act  
and ending on ,september #ca1 #bjbj1 the
 ,assistant ,secretary for ,aging shall 
waive the requirements for emergency    
meals to comply with the requirements of
 clauses 7i7 and 7ii7 of section        
#cci7b77;,a7 of the ,older ,americans   
,act of #aife 7#db ,u4,s4,c4
