following bill2 which was referred to the ,committee on ,energy and ,commerce ,a ,,bill ,to amend the ,national ,telecommunications and ,information ,administration ,organization ,act to provide for the establishment of an electromagnetic spectrum sharing prototyping program and an integrated spectrum automation enterprise strategy1 and for other purposes4 #a4 ,short title ,this ,act may be cited as the ,studying ,how to ,harness ,airwave ,resources ,efficiently ,act of #bjai or the ,,share ,act4 #b4 ,,ntia electromagnetic spectrum sharing prototyping program and automation strategy ,part ,a of the ,national ,telecommunications and ,information ,administration ,organization ,act 7#dg ,u4,s4,c4 #ija et seq47 is amended by adding at the end the following3 #ajf4 ,electromagnetic spectrum sharing prototyping program and automation strategy 7a7 ,prototyping program 7#a7 ,in general ,not later than #a year after the date of the enactment of the ,studying ,how to ,harness ,airwave ,resources ,efficiently ,act of #bjai1 the ,assistant ,secretary1 in consultation with the ,commission1 shall establish a program to facilitate the prototyping of innovative technologies and techniques that facilitate the sharing of the same covered electromagnetic spectrum by more than one ,federal entity4 7#b7 ,sharing test bed ,not later than #ae months after the date of the enactment of the ,studying ,how to ,harness ,airwave ,resources ,efficiently ,act of #bjai1 the ,assistant ,secretary1 in consultation with the ,commission1 shall1 under the program established under paragraph 7#a71 establish at least one test bed to demonstrate the potential for the dynamic sharing of the same covered electromagnetic spectrum by more than one ,federal entity4 7b7 ,development of integrated spectrum automation enterprise strategy 7#a7 ,in general ,not later than #ah months after the date of the enactment of the ,studying ,how to ,harness ,airwave ,resources ,efficiently ,act of #bjai1 the ,assistant ,secretary1 in consultation with the ,commission1 shall1 under the program established under subsection 7a77#a71 propose1 after notice and opportunity for comment1 an integrated spectrum automation enterprise strategy to address the management of covered electromagnetic spectrum in order to facilitate the sharing of such spectrum by more than one ,federal entity4 7#b7 ,matters encompassed ,in developing the strategy under paragraph 7#a71 the ,assistant ,secretary shall consider1 at a minimum1 whether to propose in the strategy-- 7,a7 changes in policy or to the law1 including legislative and regulatory changes2 and 7,b7 using-- 7i7 databases2 7ii7 artificial intelligence2 7iii7 spectrum management processes2 7iv7 public-facing application programming interfaces and online tools2 7v7 automatic frequency coordination systems1 including standard interfaces and data exchange formats and requirements2 7vi7 spectrum enforcement requirements2 7vii7 listen-before-talk2 7viii7 environmental sensing capabilities2 and 7ix7 electromagnetic spectrum compatibility analyses4 7#c7 ,updates to strategy ,not later than #b years after the strategy under paragraph 7#a7 is proposed1 and every #b years thereafter1 the ,assistant ,secretary shall update such strategy4 7c7 ,biannual report ,not later than #ah months after the date of the enactment of the ,studying ,how to ,harness ,airwave ,resources ,efficiently ,act of #bjai1 and in the last quarter of each even-numbered calendar year thereafter1 the ,assistant ,secretary1 in consultation with the ,commission1 shall submit to the ,committee on ,energy and ,commerce of the ,house of ,representatives and the ,committee on ,commerce1 ,science1 and ,transportation of the ,senate a report containing the status and results of the program established under subsection 7a71 including the status and results of the test bed established under paragraph 7#b7 of such subsection and the strategy developed under subsection 7b74 7d7 ,authorization of appropriations ,there is authorized to be appropriated to the ,assistant ,secretary to carry out this section #ej1jjj1jjj4 ,such amounts are authorized to remain available until expended4 7e7 ,definitions ,in this section3 7#a7 ,covered electromagnetic spectrum ,the term covered electromagnetic spectrum means electromagnetic spectrum allocated for exclusive or primary use by ,federal entities4 7#b7 ,federal entity ,the term ,federal entity has the meaning given such term in section #aac7l74 4 #c4 ,,fcc and ,,ntia report on expanding spectrum sharing techniques and sharing strategies 7a7 ,report ,not later than #a year after the conclusion of the first auction of ,priority ,access ,licenses in the #c4e gigahertz band1 the ,federal ,communications ,commission and the ,assistant ,secretary of ,commerce for ,communications and ,information1 in consultation with the ,director of the ,national ,institute of ,standards and ,technology1 after notice and opportunity for comment1 shall submit to the ,committee on ,energy and ,commerce of the ,house of ,representatives and the ,committee on ,commerce1 ,science1 and ,transportation of the ,senate a report that assesses and provides recommendations for expanding upon and improving spectrum sharing techniques developed for use in the #c4e gigahertz band1 or other spectrum sharing strategies1 that includes the following considerations3 7#a7 ,how to promote an ecosystem of devices employing such sharing techniques or such other sharing strategies4 7#b7 ,how to incentivize spectrum users to employ such sharing techniques or such other sharing strategies4 7#c7 ,how to ensure that any ,federal protection zones and corresponding technical rules and power levels are no more protective than necessary4 7#d7 ,the applicability of such sharing techniques or such other sharing strategies to frequencies between #cajj megahertz and #ceej megahertz1 inclusive1 and frequencies between #gabe megahertz and #hdjj megahertz1 inclusive1 to the extent any portion of such frequencies cannot be cleared in a reasonable amount of time4 7b7 ,rule of construction ,nothing in subsection 7a77#d7 may be construed to require that every spectrum sharing technique developed for use in the #c4e gigahertz band be recommended for use in other bands4
